This agreement was authorized by the City Council on November 10, 1975 by the adoption of Resolution No. 8635. swk enc. 0 0 AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES ALIGNMENT AND INTERSECTION STUDY FOR COAST HIGHWAY - BALBOA BOULEVARD - SUPERIOR AVENUE - 15TH STREET (2�-/773z THIS AGREEMENT, made and entered into this Ly Lgday of 44 V—L 1975, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY", and the firm of WILLIAMSON AND SCHMID, CIVIL ENGINEERS, herein- after referred to as "ENGINEER" W I T N E S S E T H WHEREAS, CITY'S Circulation Element - Master Plan of Streets and Highways has not designated the precise alignments of Coast Highway, Balboa Boulevard, Superior Avenue and 15th Street in the area between Newport Boulevard and the easterly side of Newport Shores; and WHEREAS, ENGINEER has submitted a proposal to CITY to perform the engineering services necessary to establish a pre- cise alignment for Coast Highway between the easterly side of Newport Shores and Newport Boulevard, to establish a precise 4 alignment for the extension of 15th Street from Monrovia to the Coast Highway, and to establish a new alignment for Superior Avenue, and possibly Balboa Boulevard, as they inter- sect with Coast Highway, and the study will also produce recom- mended right of way widths and intersection geometrics com- patible with existing traffic projections and shall hereinafter be referred to as "STUDY "; and WHEREAS, CITY desires to accept said proposal, NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: 1. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. -1- II. Services to be Performed by ENGINEER i ENGINEER hereby agrees to perform the following services: A. Prepare a 100 -scale topographic map with a 2 foot contour interval together with a 100- scale aerial photograph which will cover the area included within the STUDY. B. Prepare four or five alternate alignments for the aforementioned streets. C. Prepare detailed analysis of two of the alter- nates mentioned in Item B. above, as directed by the CITY. D. Consult with Herman Kimmel & Associates and evaluate intersection geometrics and spacing, considering existing traffic projections and bicycle movements. E. Consult with land owners involved, to consider i . their future planning as it would affect the alignments. F. Prepare exhibits for presentation of recommended alignment. G. Prepare rough estimates of cost for construction of two alignments outlined in Item C above. H. Prepare overlay showing affected property lines and City limit lines. III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following information and materials: A. Existing plans, mapping and studies affecting the STUDY. B. Current traffic studies and counts. C. Estimates of future traffic volumes. D. Standard plan sheets as necessary for STUDY. -2- IV. Time of Completion ENGINEER agrees to complete all of the services specified herein within one hundred eighty (180) days after execution of this agreement. V. Ownership of Project Documents i Original drawings, reports, notes, maps and other documents shall become the property of the City and may be reproduced and utilized as deemed necessary by the Public Works i Director. VI. Engineer in Charge Bob W. Williamson, RCE No. 10180, shall be the engineer in charge of STUDY. VII. Right of Termination CITY reserves the right to terminate this agreement at any time by giving ENGINEER three (3) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to any of ENGINEER'S business offices. In the event of termination due to fault of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER. If this agreement is terminated for any reason other than fault of ENGINEER, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VIII. Fee Schedule and Payment In consideration of the performance of the above- described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Seventeen Thousand Nine Hundred Dollars ($17,900), except as otherwise provided herein. A. Hourly rates for office and field personnel shall be as follows: -3- 1 i • • B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (90 %) of the maximum fee; 2. Balance of the total amount earned to be paid upon completion of work specified in Section II (Services to be Performed by ENGINEER), or by November 1, 1976, whichever occurs first; 3. In addition CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents, and other related costs authorized in advance by the Public Works Director and advanced by ENGINEER. IX. STUDY Scope Revisions The scope of the STUDY may be changed and the maximum fee revised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed One Thousand Five Hundred Dollars ($1,500). If revisions to the scope of the STUDY would result in an increase in the maximum fee exceeding One Thousand Five Hundred Dollars ($1,500), an amendment providing for such revisions shall be processed and executed by the parties hereto. ATTEST: M CITY OF NEWPORT BEACH F : SY �- Mayor WILLIAMSON AND SCHMID, CIVIL ENGINEERS '� by By *ney -5- HRC:dt 11/5/75 0 9 RESOLUTION NO. 8 6 3 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREE- MENT BETWEEN THE CITY OF NEWPORT BEACH AND WILLIAMSON AND SCHMID FOR ENGINEER- ING SERVICES IN CONNECTION WITH AN ALIGNMENT AND INTERSECTION STUDY OF BALBOA BOULEVARD, COAST HIGHWAY, 15TH STREET AND SUPERIOR AVENUE WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain agreement between the City of Newport Beach and Williamson and Schmid, for engineering services in connection with an alignment and intersection study of Balboa Boulevard, Coast Highway, 15th Street and Superior Avenue; and WHEREAS, the City Council has considered the terms and conditions of said agreement and found them to be fair and equitable, and in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
