THIS AGREEMENT is made and entered into this ILA_

Ana, a chartered municipal corporation, hereinafter referred to
as "Santa Ana" and the City of Newport Beach , hereinafter
referred to as " Newport Beach if
W I T N E S S E T H
WHEREAS, Santa Ana and Newport Beach have previous-
ly agreed in principle to participate with other cities within
Orange County and with various County of Orange Agencies to esta-
blish an Orange County Burglary Prevention Index; and
WHEREAS, in order to provide essentially timely, expe-
ditious, and continually available support to the Orange County
Burglary Prevention Index members and interface with other law
enforcement agencies in the area of burglary information collec-
tion, analysis and distribution, a coordinator's office will be
established and will be located within the Santa Ana Police De-
partment building; and
WHEREAS, this Agreement will become operative only if
and when the United States Department of Justice Law Enforcement
Assistance Administration provides funds in the sum of One Hun-
dred Seventy Nine Thousand Dollars ($179,000.00) and a State
grant of Nine Thousand Nine Hundred and Forty Four Dollars
($9,944.00) of matching funds for the second year of operation
for said program; and
WHEREAS, this project has been approved for such funding
by the California Counsel on Criminal Justice under C.C.C.J. No.
A- 1425 -2 -75.

NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL TERMS,
CONDITIONS AND PREMISES EXPRESSED ABOVE AND HEREINAFTER SET
FORTH THE PARTIES HERETO AGREE AS FOLLOWS:

The Director of Finance for the City of Santa Ana,
as financial officer, shall immediately establish a special
Orange County Burglarly Prevention Budget Account No. I desig-
nated for the Orange County Burglarly Prevention Index contain-
ing deposits from participating cities and agencies in the
system.
Upon award and receipt of said grant, One Hundred
Seventy Nine Thousand Dollars ($179,000.00) of a federal grant
and Nine Thousand Nine Hundred Forty Four Dollars ($9,944.00)
of a state grant, Budget Account No. II shall be established.
All monies shall be disbursed in a manner consistent
with the grant conditions. The Director of Finance for the
City of Santa Ana shall also provide and maintain a separate
accountability for said fund during the life of the project.

The Santa Ana Chief of Police, as Project Director,
shall order and provide project direction and make appropriate
payments on behalf of for services provided on aforesaid grant
that are required in establishing the coordinator's office.

III
Newport Beach agrees to deposit with Financial
Four Hundred Forty Seven Dollars and Fifty Cents
within ninety (90) days after
execution of this Agreement as its share of the Orange County
Burglarly Prevention Index. Said monies shall be used by the
Coordinator's Office in order to fulfill the major project
objectives, which include, but are not limited to the following:

(a) Expand the data processing capabilities
of the system as they pertain to burglarly prevention
and the apprehension function of law enforcement
by providing on -line data input and retrieval to all
regional police agencies.
(b) Integrate, on a regional basis, related
burglarly information; i.e., phone reports, field
contacts, officers daily logs, etc., in order to
provide correlation between major data sources as
they pertain to the crime of burglarly.
(c) Provide tactical planning information
in the form of statistics and reports for distribution
of police patrol units for the most effective burglarly
prevention and apprehension.
IV
Each participating city and agency, with the exception
of Santa Ana, will contribute a pro rata share of the Nine
Thousand Four Hundred Forty Four Dollar ($9,944.00) fund to
be provided by the participants. The shares may be readjusted
as the number of participants varies. Said funds shall be
returned within thirty (30) days in the event that the grant
is terminated for any reason.
V
Newport Beach agrees to fulfill all duties as
specified in said application incorporated by reference herein.
VI
The Project Director and Financial Officer shall re-
ceive and disburse project funds through the above two special
accounts in accordance with all legal requirements for the
accounting of funds under the Omnibus Crime Control and Safe

Streets Act of 1968 and any amendments thereof.
VII
The Project Director shall direct the Financial Officer
to reimburse Newport Beach
for any portion of its contri-
bution remaining unexpended at the completion of the project.
VIII
This Agreement shall terminate either twelve (12)
months after the grant is approved by the Office of Criminal
Justice Planning or any extensions to the project by the Office
of Criminal Justice Planning have been expired or when all
funds are expended by Santa Ana.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE CITY OF
SANTA ANA IN CONNECTION WITH THEIR CONTINUED
PARTICIPATION IN THE ORANGE COUNTY BURGLARY
INDEX
WHEREAS, there has been presented to the City Council
of the City of Newport Beach an agreement between the City
of Newport Beach and the City of Santa Ana in connection
with the City of Newport Beach's continued participation in
the Orange County Burglary Index; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
