1. Approve revised Map Checking Agreement with County of
Orange.
2. Authorize the Mayor and the City Clerk to execute the
Agreement.
The Public Works Department has proposed to revise the existing
Subdivision Map Checking Agreement with the County of Orange. This revision
will allow the County of Orange to check all mapping and technical data with-
in the subdivision boundaries. At present, the County checks only the mapping
and technical data for the subdivision boundaries.
This revision will help eliminate overlap in plan checking the
subdivision map data, and provide a more streamlined system for performing
the work.
This revision will have no impact on the City's revenues as the
developer is still required to pay the City filing fees for map processing.
The County of Orange charges the developer for plan check on an hourly basis.
It is recommended that the City Council approve the recommended
actions.

This Agreement dated this ! "day of 19 ,, between the
County of Orange, California, hereinafter "County" and the City of Newport Beach,
California, hereinafter "City."
that:
W I T N E S S E T H:
WHEREAS, Section 66442 of the Government Code (Subdivision Map Act) provides
"66442. (a) If a subdivision for which a final map is required lies within
an unincorporated area, a certificate by the county surveyor and, if such subdi-
vision lies within a city, a certificate by the city engineer is required. The
appropriate official shall state that:
(1) He has examined the map.
(2) The subdivision as shown is substantially the same as it appeared on
the tentative map, and any approved alterations thereof.
(3) All provisions of this chapter and of any local ordinances applicable
at the time of approval of the tentative map have been complied with.
(4) He is satisfied that the map is technically correct.
(b) The county surveyor or the city engineer, as the case may
be, or other public official or employee qualified and authorized to perform the
functions of either, shall complete and file with his legislative body his certi-
ficate as required by this section within 20 days from the time the final map is
submitted to him by the subdivider for approval "; and

WHEREAS, Section 66450 of said code provides that:
"66450 ". If a subdivision for which a parcel map is required .lies within

unincorporated territory, the parcel map shall be submitted to the county surveyor
for his examination prior to filing, and if such subdivision lies within a city,

Within 20 days after receiving the parcel map, such officer or officers
shall examine it for the survey information shown thereon, and if satisfied that it is
technically correct, the following certification shall be placed on the map.

"66431. Upon mutual agreement of their respective legislative
bodies, the county surveyor may perform any or all of the duties assigned to
the city engineer, including required certifications. 1Tnenever such duties
have been divided between the county surveyor and city engineer, each officer
shall certify to the duties performed by him."

County Surveyor.

IT IS FURTHER MUTUALLY AGREED that County, as its sole compensation for the work
performed under this Agreement, shall collect from subdividers whose Subdivisions are
located in City, the same deposit fees and hourly rates in the same manner as charged
to subdividers for examining and checking maps located in the unincorporated territory
of Orange County.
For the purpose of effectuating collection of fees provided for herein,
it is agreed that the County Surveyor shall have all power of the City Engi-
neer or other city officer responsible for the collection of such fees and
that City shall supply full cooperation therein.
TT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED:
1. That neither County nor any officer or empinyee thereof shall be responsihle
for any damage or liability occurring by reason of anything done or omitted
to he done by City under or in connection with any work, authority or juris-
diction delegated to City under this Agreement. Tt is also understood and
agreed that, pursuant to Government Code Section 895.4, City shall fully
indemnify, defend and hold County harmless from any liability imposed for

injury (as defined by Government Code Section 810.8), occurring by reason of
anything done or omitted to be done by City under or in connection with any
work, authority or jurisdiction delegated to City under this agreement.
2. That neither City nor any officer or employee thereof shall be responsible
for any damage or liability occurring by reason of anything done or omitted
to be done by County under or in connection with any work, authority or
jurisdiction not delegated to City under this agreement. It is also under-
stood and agreed that, pursuant to Government Code Section 895.4, County
shall fully indemnify, defend and hold City harmless from any liability
imposed for injury (as defined in Government Code Section 810.8), occurring
by reason of anything done or omitted to be done by County under or in con-
nection with any work, authority or jurisdiction not delegated to City under
this agreement.
EFFECTIVE DATE AND TERMINATION
This agreement shall become effective on the date hereinabove written and shall
continue in full force and effect through June 30 , 19 83 . Unless
terminated as hereinafter provided, this agreement shall be automatically renewed
from year to year for successive one -year periods thereafter.
This contract may be terminated at the end of any year period by either the
City or County, by giving written notice of intent to so terminate, not later than
120 days prior to the end of such annual period.

IN RE: AGREEMENT SURVEY SERVICES CITY OF NEWPORT BEACH
On motion of Supervisor Wieder, duly seconded and unanimously
carried, the Clerk of the Board, on behalf of the Board of Supervisors,
is authorized to execute the Agreement, dated July 13, 1982, between
the County of Orange and the City of Newport Beach for map checking
survey services.

Attached are 6 copies of a proposed agreement between the City
and the County of Orange. The standard agreement has been reviewed by our
department and appears to be satisfactory for use.
The following actions are requested:
1. City Attorney
a. Approve the agreement as to form.
b. Prepare an appropriate resolution authorizing the
Mayor and City Clerk to execute the agreement. The
resolution is desired for City Council consideration
at the meeting on May 10, 1976.
2. City Clerk
a. Present the agreement to the City Council for approval.
b. Have 6 copies of the agreement executed by the Mayor
and yourself.
c. Return the 6 executed copies of the agreement to
this department.
We will be responsible for transmitting the copies to the Board
of Supervisors for execution and approval. Upon approval by the Board of
Supervisors, two copies of the agreement will be returned to this office.
One copy of the agreement will be for your files.
We will prepare the Council memo on the matter.

CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE COUNTY OF
ORANGE IN CONNECTION WITH MAP CHECKING SERVICES
FOR SUBDIVISION FINAL MAPS AND PARCEL MAPS
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the County of Orange in connection
with map checking services for subdivision final maps and
parcel maps; and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to
authorize the Mayor and City Clerk to execute said agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.

SUBJECT: AGREEMENT FOR MAP CHECKING SERVICES FOR SUBDIVISION FINAL MAPS
AND PARCEL MAPS
RECOMMENDATIONS:
Adopt a resolution authorizing the Mayor and the City Clerk
to execute the subject agreement with the County of Orange.
DISCUSSION:
Current and past practice in Orange County provides for checking
by the County Surveyor of the boundaries of all City final subdivision and
parcel maps for legality and mathematical accuracy. However, at present
there is no written agreement between the Board of Supervisors and the
City Council for these services, and the County Surveyor does not collect
any fees for performing them.
The County Surveyor has notified the Public Works Department that
we must have a written agreement in order to continue their map checking
services. The County Surveyor's office subsequently prepared a standard
agreement covering these services. The standard agreement has been reviewed
and appears satisfactory for use.
The agreement provides for the following:
a. The County Surveyor and the City to continue their current
practice for checking final and parcel maps - the County
checks the exterior and the City checks the interior.
b. The County to collect fees from the subdivider for map
checking.
c. Fee collection procedures will be consistent with those
currently used for map checking services in the unincor-
porated area of the County.
In the event that the City does not enter into this agreement, the
County will cease checking City maps on May 14, 1976.
