I suppose I have no one to blame but myself since I chose to hire this maintenance couple. I probably should have checked more carefully instead of relying on a resume which usually contains only one's good qualities. It appears that this couple is very manipulative. For the most part the 23 years I have spent with the City have been a rewarding experience and I wish the City much success in securing a manager who has considerable experience and possesses the skill and temperament required to properly manage a mobile home park. Delino Deputy City Manager 3300 Newport Blvd. Newport Beach, California Dear Mr. Delino: 0 In response to your letter requesting a written reply to the allegations made by Mrs. Peake, I wish to offer the following: Regarding Paragraph #2, I was not aware that the gas was off until Sunday night as I explained to you. And if Mr Kellar was here fourteen years as he clained, he should have known that the gas was on the same meter as the Naudical Museum. I was not aware of the problem until I noticed the tent over the building since we had no reason to use gas on Sunday. We had sufficient hot water and didInt realize there was a problem. Sunday, however, I did go to Space 1 -E (Mrs. Stetson) and ask her if they had gas. Please understand, no one advised me that the gas would we off S This story is total fabrication. How would this man, who ever he was, know that our gas came from the museum? This entire papagraph is totally untrue Regarding paragraph #3: Mrs. Peake did call me regarding the flood in the laundry room. I went right down and found someone had put some very large rugs in the washer and it caused the machine to go off balance and broke a water pipe. I started to sweep out the laundry room when Mrs Peake stood in the doorway (with her hands on her hips) and proceeded to really read me the riot act. The only one simgle thing I said to her was, 'Mrs. Peake, why don't you mind your own bukiness' . . and nothing more. I swear, I NEVER said I go to hell t or any thing like it. I wish I could get some of the people here in Marinapark (who mind their own business) to talk to you. I am cerain it would give you an entire different prospective. As you know, Mrs. Peaks son Steven, moved Mr Kellar. A few days later, her son brought me a back door key and a mail box key. He stood at our door and chatted brief9y and stated that he thought the trailer was left in terrible condition. 'hiring the conversation, he stated that he wished his mother would adnd:her own business. On a previous occassion Steve came to me for a key to do some work in someone's mobile home and made the same statement. Someone came to me in the last few days and stated that Mrs. Peake is having 'some problems, and is taking her anger out on me. If nay further explanation is needed, please let me know. Considering the City Manager's August 18th letter to you, the allegations about foul and abusive language are particularly disturbing. Our former Assistant Manager, Mr. Kellar, called us over the week- end and asked my husband to check his gas line because he had no gas to cook with or heat water. My husband went down to check for him and there was no gas coming into the trailer, he advised him to call the emergency gas company number. The representative came out and told Mr. Kellar they had turned the gas off because of the tent- ing for termites at the museum on Balboa Blvd.. The man said they had advised Mr. Reinhart that the gas would be off. Today I came home from the post office and saw water pouring down the drive and coming out of the laundry room. I ran in my unit to get the key, one of the washers had broken and water was pouring out the bottom, I opened the lid which stopped the machine, which stopped the flooding. I then called the office and Mr. Reinhart came down, he asked if this was my wash and I told him no, I have my own laundry equipment. I then asked him "by the way do you have gas in your house ? ", he replied "no ", I asked why he had not told Mr. Kellar the gas was going to be off for the weekend and he said "nobody asked ". I told him it was only common decency or courtesy to have told Mr. Kellar, being 82 years of age, with no hot water or gas to cook with. Mr. Reinhart replied "You people have reamed me out so badly, I don't give a damn about any of you and you ought to keep your nose out of other peoples' business ". I replied he was a mean spirited man and asked if all of the tenants had had their gas turned off would he have done the same to us. He told me to "go to hell and mind my own business ". I really don't feel that I should have to take this kind of treatment from anyone. This man is an "animal ", he does not know how to be courteous, he could have thanked me for calling him to tell him of the flood, but he does not have the mentality to be nice to anyone. Balboa Blvd. Newport Beach, CA 92663 E CITY OF NEWPORT BEACH Office of City Manager (714) 644 -3000 August 18, 1992 Subject: Notice of Breach of Contract Dear Mr. Reinhart: Your performance as Manager of Marinapark during the past twenty -two years has generally been very good, and City staff has appreciated your loyalty and your dedication. Park residents for the most part have also appreciated your efforts. However, the one area of your performance which has been subject to criticism over the years is your demeanor in dealing with people. For this reason the following clause was specifically placed in your contract: "...CONTRACTORS, ... shall, at all times, perform their duties in a professional and courteous manner to reflect positively, and in the best interest of, the City." Recently, the City received a letter dated July 27, 1992 from the Marinapark Homeowners Association that listed certain "grievances" regarding your behavior and demeanor. Quotes from that letter include: "the peace and tranquility in the Marinapark have been seriously disrupted by Mr. Reinhart's attitude and performance. He has frightened ... wives, children and guests by his rude, callous and surly behavior.... Yells at drivers ... harassed tenants and guests ... created an atmosphere of fear and anxiety... interferes with rights of tenants to sell their trailers ... harasses real estate agents ... does not perform his work with courtesy and respect ... his performance does not reflect well upon the City." The letter was accompanied by letters from twelve residents of the Park, two of which were complimentary and ten of which were critical of your performance. City Hall • 3300 Newport Boulevard • P.O. In the future, if the City receives similar statements of evidence from Park residents or others that your demeanor in performing your duties as Park Manager is less than professional and courteous, then the City will, under the terms of your contract, declare a material breach and terminate the contract after giving thirty (30) days notice. To avoid such termination, you are directed to be tactful, friendly and courteous in dealing with all persons who reside, visit or even wander into the Park. Please keep in mind that despite the difficulty in enforcing Park rules and regulations, you are an ambassador of the City and your demeanor reflects on the entire City. The Homeowners Association has received notice, but not a copy, of this letter. The Deputy City Manager and I will meet with you to discuss this letter and our expectations. The total is subject to an annual CPI adjustment. The Reinharts desire all the increase this year, therefore beginning July 1, 1991, issue checks in the amount of $1805 and $450. Thank you. The preliminary 1990 -91 budget eliminates the regular position for the Manager of Marina Park and replaces it with a contract employee. The attached contract provides for both the manager and the maintenance person who will now be an employee of the manager. The contract maintains the existing duties of the manager, provides for a five (5) year term, provides $1700 per month plus use of a trailer to the manager, provides $450 per month plus use of a trailer to the maintenance person, and provides annual CPI increases. DELINO KJD:mb • • PROFESSIONAL SERVICES CONTRACT (Marinapark Management) This Agreement, dated the 1st day of July 1990, between the CITY OF NEWPORT BEACH, a municipal corporation and charter city ('CITY') and NORBERT AND MABEL REINHART ( "CONTRACTORS ") is made with reference to the following: A. CITY owns Marinapark, a mobile home community consisting of approximately fifty -eight spaces and situated between Balboa Boulevard and Newport Bay on the north and south and 16th Street and 19th Street on the east and west. B. CONTRACTORS have experience managing mobile home parks, are currently residents of Marinapark, and are familiar with CITY's needs in terms of management services. C CITY wishes to retain the services of CONTRACTORS to manage Marinapark. In light of the foregoing, the Parties agree as follows: ARTICLE I Term of Contract This Agreement shall become effective on the date first above written and will continue in effect until terminated as provided in Article VII. ARTICLE II Management Services A. CONTRACTORS shall provide basic management services for Marinapark. Specific services to be provided include: 1. Maintain the Marinapark Service Office from 8 a.m. to 5 p.m. seven days a week. 2. Provide twenty -four hour on -call assistance for Marinapark tenants in the event of an emergency. 3. Direct and supervise the work of maintenance and repair personnel retained by the CITY. [-I i 4. Perform minor repairs to Marinapark facilities as necessary, and arrange for repairs and maintenance as necessary. 5. Perform minor gardening services as necessary. 6. Issue parking passes and register guests. 7. Enforce Marinapark rules and regulations and post notices subject to compliance with the provisions of the Mobile Home Residency Law. B. CONTRACTORS shall determine the method, details and means of performing the services described above, provided, however, CONTRACTORS, and their agents and employees, shall, at all times, perform their duties in a professional and courteous manner to reflect positively, and in the best interest of, the City. C CONTRACTOR may, at his own expense, employ such assistants as he, in his sole discretion, deems necessary to perform services required by this Agreement. CITY shall not have the right to control, direct or supervise CONTRACTORS' assistants or employees in the performance of these services. However, City may, without any obligation to do so and at the request of CONTRACTOR, provide payroll administrative services to CONTRACTOR regarding such employment. ARTICLE III Compensation A. Monthly Payments CITY shall pay CONTRACTORS two thousand one hundred fifty dollars ($2,150.00) per month in consideration of the services to be performed pursuant to this Agreement, which amount shall be increased on each anniversary of this Agreement proportionate to any increase in the Consumer Price Index (U.S. All Urban) during the year previous to the anniversary. B. Non - Monetary Compensation 1. CONTRACTORS shall, during the term of this Agreement and to facilitate the performance of services required, have the right to occupy a CITY -owned mobile home within Marinapark and to receive all utilities, except phone service, without 2 charge. CONTRACTORS shall vacate the CITY -owned mobile home within five days of the expiration, or termination, of this Agreement and the mobile home shall be in good condition and repair. 2. CONTRACTORS shall, during the term of this Agreement and to facilitate employment of assistants, have the right to occupy a second CITY -owned mobile home within Marinapark, with all utilities, except phone service, paid by the CITY. CONTRACTORS shall not rent or lease this mobile home, nor receive consideration of any type or kind for the right to occupy the mobile home. CONTRACTORS shall take all steps necessary to ensure this mobile home is vacated within five (5) days of the expiration, or termination, or this Agreement and the mobile home shall, at such time, be delivered in good condition and repair. ARTICLE IV Obligations of Contractor A. Minimum Amount of Service CONTRACTORS agree to devote a minimum of one hundred (100) hours per month to performance of the services required by this Agreement. CONTRACTORS may represent, perform services for, and be employed by, such additional clients, persons, or companies as CONTRACTORS, in their sole discretion, deem appropriate. B. Indemnification CONTRACTORS shall defend, indemnify and hold harmless the CITY, as well as its officers, employees and representatives, with respect to any damage, loss, injury, cost, expense, or liability arising out of, or in any way related, to the performance of services pursuant to this Agreement, unless due to the sole negligence, fraud or willful misconduct of CITY, or its officers, employees or agents. 3 ARTICLE V Obligations of City 0 A. Cooperation CITY agrees to comply with all reasonable requests of CONTRACTORS necessary to the performance of their duties pursuant to this Agreement. B. Place of Work CITY agrees to furnish space within Marinapark, including the Marinapark office, for use by CONTRACTORS while performing services pursuant to this Agreement. C Indemnification CITY shall defend, indemnify and hold harmless CONTRACTORS, as well as their officers, employees and representatives, with respect to any damage, loss, injury, cost, expense, or liability arising out of, or in any way related, to the CITY's ownership of Marinapark unless due to the sole negligence, fraud or willful misconduct of CONTRACTORS, or their officers, employees or agents. ARTICLE VI Assignment Neither CITY nor CONTRACTORS shall have the right to assign this Agreement without the prior written consent of the other which shall not be unreasonably withheld. ARTICLE VII Termination A. Term The term of this Contract shall be for five (5) years from the date first above written unless terminated earlier as provided below. B. CONTRACTORS may terminate this Agreement, at any time, by giving thirty (30) days written notice of their intention to do SO. C Termination For Cause In the event of a material failure to perform in accordance with any article of this Contract, the non - breaching Party shall have the right to terminate this Agreement by giving the other thirty (30) days written notice of its intention to terminate. D. Termination Upon Death This Agreement shall terminate upon the death or disability of CONTRACTORS. ARTICLE VIII General Provisions A. Entire Agreement This Agreement supersedes any and all agreements, oral or written, between the Parties with respect to provision of services by CONTRACTORS and contains all of the covenants and agreements between the Parties with respect to the services to be provided and the compensation to be paid. Each Party to this Agreement acknowledges that no representations, inducements, promises, agreements, orally or otherwise, have been made by the other, or anyone acting in their behalf, which are not contained in this Agreement. Any modification of this Agreement will be effective only if it is in writing and signed by the Party to be charged. 5 C Partial Invalidity If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions will nevertheless continue in full force without being impaired or invalidated in any way. The undersigned agrees to cover the office duties two (2) days each week, all City holidays, additional days for Manager's accumulated overtime plus two (2) weeks or more vacation time. 2. Water entire grounds two (2) or more times per week as needed, re- pair sprinklers, and assist in repairing broken water lines. 3. Clean laundry and rest rooms and replace supplies as needed. 4. Minor painting and repairing as needed. 5. Put up and take down flags each day. (Weekends may be omitted) 6. Replace light bulbs as needed. Lights to be checked on a weekly basis. 7. Assist in keeping Marinapark in a generally neat, clean and attractive condition. Keep areas around trash containers reasonably clean. Keep office clean and neat. 8. Prepare soil for replanting when necessary. 9. The use of alcohol is prohibited during working hours. All work to be supervised by Marinapark Manager. The undersigned agrees to work forty (40) hours per week and as compensa- tion shall receive two hundred dollars ($200) every two weeks and shall occupy a City -owned mobile home including utilities valued at $800.00 per month and shall be unfurnished. IT IS UNDERSTOOD THAT in the event the undersigned resigns or is terminated, they (he) shall vacate the City -owned mobile home within five (5) days without recourse and said mobile home shall be left in neat and clean condition. IT IS UNDERSTOOD THAT THIS IS A CONTRACT AGREEMENT AND THE U':JERSIGNED IS NOT ENTITLED TO THE REGULAR CITY BENEFITS. Date EMPLOYMENT AGREEMENT (Marinapark Manager) 0 THIS AGREEMENT is made and entered into this day 1975 by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "City" and NORBERT REINHART, hereinafter referred to as "Reinhart" W I T N E S S E T H WHEREAS, Marinapark is owned and operated as a trailer park by the City of Newport Beach; and WHEREAS, the services of a manager are required to super- vise the management and maintenance of the facility as well as the collection of rents at Marinapark; and WHEREAS, City has determined that Reinhart is well qualified to perform such services; and WHEREAS, City desires to retain Reinhart as the Marinapark manager; NOW, THEREFORE, IN CONSIDERATION OF these premises, it is mutually agreed by and between the parties as follows: 1) City hereby retains and employs Reinhart to act as Marinapark manager; 2) Reinhart agrees to supervise the management and main- tenance of Marinapark in an efficient manner, collecting rents, keeping accurate records, supervising maintenance gardeners, making or suggesting improvements where possible with the best interests of the City in mind, and reporting periodically to the City Manager; 3) Reinhart agrees to make necessary repairs or call specialized help in an emergency on a 24 -hour basis; 4) City agrees to compensate Reinhart at Seven Hundred Dollars ($700.00) per month for a 40 -hour work week, plus Reinhart will be allowed to reside in the City -owned trailer located at Marinapark, free of rent; 5) Reinhart shall be permitted to take a two -week vacation and during his absence Marinapark shall be adequately covered by an attendant; attendant shall also cover for Reinhart two days each week, keeping the regular office hours; regular office hours shall be from 8:00 A.M. to 5:00 P.M. and shall be covered by Reinhart or his wife on all but two days each week. 6) Reinhart and his wife shall be covered by health insurance on the same basis as other City employees, and Reinhart agrees to have the amount of the premium deducted from his salary. 7) Both parties to this Agreement reserve the right to terminate this Agreement upon thirty (30) days prior written notice. 8) This Agreement shall become effective on the /� 64 day of , 1975. BE IT FURTHER RESOLVED that the compensation for the Marinapark Manager be and is hereby altered, effective July 1, 1980 to $9,198.00 per year. V'+d .' ... 6 0 RESOLUTION NO. 8 0 12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN EMPLOY- MENT AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND MABEL REINHART IN CONNECTION WITH MARINAPARK WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain employment agreement between the City of Newport Beach and Mabel Reinhart to employ her as Marinapark Manager; and WHEREAS, the City Council has reviewed the terms and conditions of said agreement and finds them to be satisfactory and that it would be in the best interest of the City to authorize the Mayor and City Clerk to execute said agreement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach. ATTEST: City Clerk DDO:yz 6/17/76 EMPLOYMENT AGREEMENT (Marinapark Manager) THIS AGREEMENT is made and entered into this a 44 day of 1976, by and between the CITY OF NEWPOR BEACH, a Municipal Corporation, hereinafter referred to as "City" and MABEL REINHART, hereinafter referred to as "Reinhart ". W I T N E S S E T H: WHEREAS, Marinapark is owned and operated as a trailer park by the City of Newport Beach; and WHEREAS, the services of a manager are required to supervise the management and maintenance of the facility as well as the collection of rents at Marinapark; and WHEREAS, City has determined that Reinhart is well qualified to perform such services; and WHEREAS, City desires to retain Reinhart as the Marinapark manager; NOW, THEREFORE, IN CONSIDERATION of these premises, it is mutally agreed by and between the parties as follows: 1. City hereby retains and employs Reinhart to act i 44b Marinapark manager; 2. Reinhart agrees to supervise the management and maintenance of Marinapark in an efficient manner, collecting rents, keeping accurate records, supervising maintenance gardeners, making or suggesting improvements where possible with the best interests of the City in mind, and reporting periodically to the City Manager; 3. City agrees to compensate Reinhart at Five Hundred Dollars ($500.00) per month for a 40 -hour work week, plus Reinhart will be allowed to reside in the City -owned trailer located at Marinapark, free of rent; 0 0 4. Reinhart shall be entitled to take a two week vacation annually. 5. The regular office hours shall be from 8:00 A.M. to 5:00 P.M., seven days per week. Two days each week Reinhart will be allowed time off and the office will be run by a full time on duty attendant on said days 6. Reinhart and her husband shall be covered by health insurance on the same basis as other City employees, and Reinhart agrees to have the amount of the premium deducted from her salary. 7. Both parties to this Agreement reserve the right to terminate this Agreement upon thirty (30) days prior written notice. 8. This Agreement shall become effective on the 1st day of July, 1976.
