This Agreement is made and entered into this
day of E al�r.em 1976, by and between the CITY OF NEWPORT
BEACH, a Municipal Corporation, hereinafter referred to as
"City" and TEMPLE BAT YAHM, a Corporation, hereinafter referred
to as "Owner".
W I T N E S S E T H:
RECITALS:
A. Temple Bat Yahm has received approval of Use Permit
No. 1785 by the Planning Commission of the City of Newport
Beach permitting the establishment of a synagogue facility in a
relocatable building at 1001 Camelback Street on the south-
easterly corner of Camelback Street and Jamboree Road in "North
Ford", which property is more particularly described as:
Parcel 1 of the Parcel Map filed on September 1, 1972 in Book
45, Page 39 of Parcel Maps in the Office of the County Recorder
of Orange County, California, iiereinafter referred to as "Parcel A".
B. The operation by Owner of said synagogue requires not
less than thirty-five (35) off-street automobile parking spaces
located off-site of Parcel A.
C. Owner has leased from the Irvine Company certain
property located east of Parcel A.
D. On March 18, 1976, the Planning Commission of the City
of Newport Beach approved Use Permit No. 1785 to permit the ,
establishment of a synagogue in a relocatable building on Parcel A
and recommended approval of an Off -Site Parking Agreement between
the Owner and the City on the property leased by the Owner.from��
the Irvine Company. On June 28 1976, the Ci r�IcoVu�;�il

of the City of Newport Beach approved the Off -Site Parking
Agreement between the owner and the City of Newport Beach
to permit the Owner to use the property leased from the Irvine
Company to provide off-street automobile parking as required by
the Newport Beach Municipal Code.
NOW, THEREFORE, in consideration of the approval by
the City of Owner's intended use of the property designated
hereinabove as Parcel A, it is agreed by the City and the Owner
as follows:
1. For so long as the Owner uses Parcel A as the site
for a synagogue facility in a relocatable building, the Owner
or successor in interest will provide not fewer than thirty-five
(35) off-street automobile parking spaces on the property located
immediately to the east thereof leased by Owner from the Irvine
Company.
2. In the event the use of the Off -Street Automobile
Parking spaces as described in Paragraph 1 should be terminated
for any reason, Owner will immediately thereafter obtain additional
off-street parking spaces satisfactory to and to be approved by
the City, or if substitute parking facilities are not obtained,
Owner shall reduce the occupancy load of the synagogue in their
relocatable building to such a level to be consistent with the
off-street automobile parking then available to owner on Parcel A,
measured by the City of Newport Beach parking standards then in
effect.
3. This Agreement shall run with the property owned
by Owner and described hereinabove as Parcel A and shall bind
the heirs, successors, devisees and assigns of the parties hereto,
and shall be recorded in the Office of the County Recorder of
the County of Orange, State of California.

WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to authorize
the Mayor and City Clerk to execute said agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.

This application requests approval of an off -site parking agreement
in conjunction with the establishment of the Temple Bat Yahm Synagogue.
In accordance with Section 20.30.035(D) of the Newport Beach Municipal
Code, the Planning Commission shall not recommend and the City
Council shall not approve off - street parking on a separate lot from
the building site or sites unless:
(a) Such lot is so located as to be useful in connection
with the proposed use or uses on the building site
or sites.
(b) Parking on such lot will not create undue traffic
hazards in the surrounding area.
(c) Such lot and the building site are in the same owner-
ship, or the owners of the building sites have a
common ownership in such lot, and the owner or owners
are entitled to the immediate possession and use
thereof (ownership of the off -site lot must be owner-
ship in fee or a leasehold interest of a duration
adequate to serve all proposed uses on the building
site or sites).
(d) The owner or owners and the City, upon the approval
of the City Council, execute a written instrument
or instruments, approved as to form and content by
the City Attorney, providing for the maintenance of
the required off - street parking on such lot for the
duration of the proposed use or uses on the building
site or sites. Should a change in use or additional
use be proposed, the off - street parking regulations
applicable at the time shall apply. Such instruments
shall be recorded in the office of the County Recorder
and copies thereof filed with the Department of Com-
munity Development.
Suggested Action
If desired, adopt Resolution No. authorizing the execu-
tion of an off -site parking agreement between the City of Newport
Beach and Temple Bat Yahm, Corona del Mar.

Planning Commission Recommendation
At its meeting of March 18, 1976, the Planning Commission voted
(5 Ayes, 2 Absent) to make the following findings and to approve
Use Permit No. 1785 of Temple Bat Yahm, subject to the following
conditions:
A. FINDINGS:
1.
The proposed
development does not conflict with
the General
Plan and is compatible with the
surrounding
land uses.
2.
The project,
as conditioned below, will not have
any significant
environmental impact.
3.
The proposed
relocatable building is acceptable
for the synagogue
use on a temporary basis.
4.
That adequate
parking can be provided on site
or off site
immediately adjacent to the synagogue.
5.
The approval
of Use Permit No. 1785, as conditioned,
will not, under
the circumstances of this case, be
detrimental
to the health, safety, peace, morals,
comfort and
general welfare of persons residing
and working
in the neighborhood or be detrimental
or injurious
to property and improvements in the
neighborhood
or the general welfare of the City.
B. CONDITIONS:
1. That this approval shall be for a period of two
years, and any extension shall be subject to the
approval of the Modifications Committee.
2. That development shall be in substantial conform-
ance with the approved plot plan and elevations,
except as noted in Condition No. 3.
3. That a minimum of one parking space /five occupants
in the public assembly area shall be provided on
site or off site on the vacant property directly
east of the synagogue site. Vehicular and pedes-
trian access and design of the parking layout shall
be approved by the Traffic Engineer. Said parking
area shall be paved with asphalt, plant mix, or
other street surfacing material of a permanent
nature. The parking spaces shall be marked with
approved traffic markers or painted white lines
not less than four inches wide. An off -site
parking agreement shall be approved by the City
Council if the required parking spaces are located
on the adjacent vacant property.
4. All signs shall be approved by the Director of
Community Development.
5. That landscape and irrigation plans shall be sub-
mitted to and approved by the Director of Parks,
Beaches and Recreation. All landscaped areas shall
be continuously maintained.
6. All exterior illumination shall be subject to
review and approval of the Director of Community
Development.

Background
The applicant proposes to purchase the former one story Great West-
ern Savings and Loan Association relocatable building in Newport
Center, and relocate the structure on the property in question for
a temporary synagogue use. The building will be utilized for
religious services for approximately two and one -half years until
a permanent facility is constructed on the site. The services
will be held on Friday nights between the hours of 8:00 P.M. and
10:30 P.M. with an occasional Saturday morning service between
10:00 A.M. and 12:00 Noon. The two attached letters from the
applicant describe the operation of the proposed development.
The occupant load of the main sanctuary is approximately two hundred
persons as determined by the Building Division. Forty (40) parking
spaces are therefore required for the proposed development, based
upon one parking space for each five seats in the public assembly
area.
The applicant's proposal does not include any on -site parking for
this temporary use. In lieu thereof, the applicant proposes to
provide the required parking off site on The Irvine Company's
Community Cablevision and Property Services Complex. This site
is immediately adjacent to that portion of the Temple's property
which will be improved with the temporary synagogue. The Irvine
Company has agreed to permit the applicant to use a minimum of
forty parking spaces during the evening and on weekends until
permanent facilities are constructed (see attached letter from The
Irvine Company).
Attached for the City Council's information and review is an excerpt
from the minutes of the Planning Commission meeting of March 18, 1976
and a copy of the Planning Commission staff report dated March 11,
1976 which contains a complete description and analysis of the ap-
plicant's proposal, as well as the changes which were made at the
time of the public hearing.
A site plan illustrating the applicant's proposal will be on display
at the time of the City Council's meeting.

Commissioner Seely stepped down from the dais and
refrained from deliberation on this item because
of a possible conflict of interest in that he has
performed services for the applicant's architect.
Assistant Community Development Director Hewicker
advised of a communication received from the Polic
Department reiterating some of their concerns whit
were also contained in the staff report relative
to parking because of the distance between the
temple and the offsite parking area. Mr. Hewicker
also advised that subsequent to the distribution
of the staff report, the applicant had revised the
plan to alleviate the concerns expressed by the
City relative to parking. Copies of the revised
plans were distributed to the Commission for revie
.
Public hearing was opened in connection with this
matter.
Bernie Rome, President of the Congregation,
appeared before the Commission on behalf of the
applicant to answer questions relative to the
request.
There being no others desiring to appear and be
heard, the public hearing was closed.
Assistant Community Development Director Hewicker
advised that Condition No. 7 could be deleted
since a resubdivision would not be required under
the revised plan.

Application
This application requests approval for a synagogue within a relocatable
building in Area 2 of the "North Ford" Planned Community. In accord-
ance with Chapter 20.51 of the Newport Beach Municipal Code, churches
shall be permitted in a P -C District, subject to the securing of a
use permit in each case. The placement of a relocatable building
on the site also requires the securing of a use permit in accordance
with Section 15.21.030 of the Municipal Code. Use Permit procedures
are outlined in Chapter 20.80 of the Municipal Code.
This application, as proposed, will require approval of an offsite
parking agreement for the required parking spaces. In accordance with
the Newport Beach Municipal Code, the Planning Commission shall not
recommend and the City Council shall not approve off - street parking
on a separate lot from the building site or sites unless:
(a) Such lot is so located as to be useful in connection with
the proposed use or uses on the building site or sites.
(b) Parking on such lot will not create undue traffic hazards
in the surrounding area.

The Land Use Element of the General Plan designates the site for
"Administrative, Professional and Financial Commercial" and "General
Industrial" uses. The General Plan does not designate specific sites
for church or synagogue use but staff feels that the proposed use is
similar to the existing Mariners Church and to other quasi - public
uses in the Planned Community, such as the Post Office and the Edison
substation, and that it will not be adversely affected by any of the
other uses permitted in the area.
Subject Property and Surrounding Land Use
The subject property is presently vacant. To the north, across
Camelback Street, is vacant property,.to the east, is vacant property
and The Irvine Company's Community Cablevision and Property Services
complex with its related outdoor storage area; to the south, is vacant
property; and to the west, across Jamboree Road, are single family
dwellings in Eastbluff.
Analysis
The applicant proposes to purchase the former one story Great Western
Savings and Loan Association relocatable building in Newport Center,
and relocate the structure on the property in question for a temporary
synagogue use. The building will be utilized for religious services
for approximately 21-2 years until a permanent facility is constructed
on the site. The services will be held on Friday nights between the
hours of 8:00 P.M. and 10:30 P.M. with an occassional Saturday morning
service between 10:00 A.M. and 12:00 Noon. The two attached letters
from the applicant describe the operation of the proposed development.
Offstreet Parking
The occupant load of the main sanctuary is approximately 172 persons
as determined by the Building Division. Thirty five (35) parking
spaces are therefore required for the proposed development, based
upon one parking space for each five seats in the public assembly
area.
As indicated on the attached plan, the applicant's proposal does not
include any on -site parking for the temporary use. In lieu thereof, the
proposal is to provide the required parking off -site on The Irvine
Company's Community Cablevision and Property Services complex. This
site would be approximately 500 feet easterly of the synagogue where
The Irvine Company has agreed to permit the applicant to use a minimum
of 40 parking spaces during the evening and on weekends until permanent
facilities are constructed (see attached letter from The Irvine Company).
The Traffic Engineer has indicated that the proposed off -site parking
location is not adequate to serve the needs of the applicant because
of distance and because of the lack of sidewalks on Camelback Street.
It should be noted that Camelback Street is improved with curbs,
gutters and street lights between the sites but the lack of sidewalks
will force the congregation to walk in the street unless a sidewalk
is installed or a temporary pedestrian linkage is provided between
the two sites.
The Police Department has also indicated that the matter of parking
should be reviewed critically in conjunction with the proposed
development. The Police Department has already experienced traffic

problems on Bison Avenue with the Mariners Church complex. The
Department indicates that there is considerable traffic congestion at
the corner of Bison Avenue and Jamboree Road on Sundays as occupants
of automobiles are dropped off in front of the church before and
after worship services. Many automobiles also park along Bison
Avenue since it is more convenient to park in the street than in the
existing church parking lot.
The Police Department feels that the same kind of traffic congestion may
occur on the corner of Camelback Street and Jamboree Road when the
congregation of the Temple Bat Yam park their automobiles on Camelback
Street rather than the inconvenient offsite parking lot.
Staff has no objections to the proposed utilization of the 2,000 sq.ft.
relocatable building for a synagogue facility on a temporary basis,
but in light of the concerns noted above, we feel that the required
35 parking spaces should be located on -site or off -site on the vacant
land directly east of the subject property.
Specific Findings and Recommendation
Section 20:80.060 of the Newport Beach Municipal Code provides that
in order to grant any use permit, the Planning Commission shall
find that the establishment, maintenance or operation of the use or
building applied for will not, under the circumstances of the particular
case, be detrimental to the health, safety, peace, morals, comfort
and general welfare of persons residing or working in the neighborhood
of such proposed use or be detrimental or injurious to property and
improvements in the neighborhood or the general welfare of the City.
Staff recommends approval of Use Permit No. 1785 and suggests that
the Planning Commission make the following findings in conjunction
with the applicant's request:
1. The proposed development does not conflict with the General
Plan and is compatible with the surrounding land uses.
2. The project, as conditioned below, will not have any significant
environmental impact.
3. The proposed relocatable building is acceptable for the
synagogue use on a temporary basis.
4. That adequate parking can be provided on -site or off -site
immediately adjacent to the synagogue.
5. The approval of Use Permit No. 1785, as conditioned, will not,
under the circumstances of this case be detrimental to the
health, safety, peace, morals, comfort and general welfare
of persons residing and working in the neighborhood or be
detrimental or injurious to property and improvements in the
neighborhood or the general welfare of the City.
Approval of Use Permit No. 1785 is therefore recommended, subject to
the following conditions:
1. That this approval shall be for a period of two years, and
any extension shall be subject to the approval of the Modi-
fications Committee.
2. That development shall be in substantial conformance with the
approved plot plan and elevations, except as noted in Condi-
tion No. 3.
3. That a minimum of one parking space /5 occupants in the public
assembly area shall be provided on site or off -site on the vacant
propertydirectly east of the synagogue site. Vehicular and
pedestrian access and design of the parking layout shall be
approved by the Traffic Engineer. Said parking area shall
be paved with asphalt, plant mix, or other street surfacing
material of a permanent nature. The parking spaces shall be

marked with approved traffic markers or painted white lines
not less than 4 inches wide. An offsite parking agreement
shall be approved by the City Council if the required
parking spaces are located on the adjacent vacant property.
4. All signs shall be approved by the Director of Community
Development.
5. That landscape and irrigation plans shall be submitted to
and approved by the Director of Parks, Beaches and Recreation.
All landscaped areas shall be continuously maintained.
6. All exterior illumination shall be subject to review and
approval of the Director of Community Development.
7. That a resubdivision be approved and a parcel map be
filed.
If the Planning Commission feels that the proposal as presented by
the applicant is adequate and will not create any problems given the
temporary nature of the permit, the following changes should be made
to the findings and conditions:
A. Findings
4 a. That adequate off - street parking is being provided for the
proposed development off -site on The Irvine Company's
Property Services /Community Cablevision facility.
b. That the proposal to provide off - street parking at the loca-
tion noted above is justifiable for the following reasons:
1. The applicant has an agreement for the use of the off -
site lot during the evening hours and on weekends.
2. The subject parking lot is so located as to be useful
for the proposed use.
3. Parking on the subject lot will not create any undue
traffic hazards in the surrounding area given the
temporary nature of the use.
B. Conditions
3 a. That a minimum of one parking space /5 occupants in the public
assembly area shall be provided.
b. That a pedestrian access way be provided between the
synagogue and the off -site parking lot. Said access way
shall be a minimum of 5 feet in width and shall be paved
with asphalt, plant mix, concrete or other surfacing material
of a permanent nature. Said access way shall be constructed
within the Camelback parkway or within an appropriate
easement connecting the two sites.
c. That an off -site parking agreement shall be approved by
the City Council.

Gentlemen:
Temple Bat Yahm is a congregation which was formed approximately 21 years
ago to serve the Jewish community in the greater Newport Beach area.
The congregation membership has grown to slightly over 100 families since its
inception and we are, therefore, actively pursuing the acquisition of a permanent
facility. We have not been successful in locating an existing permanent facility
in Newport Beach to meet the needs of the congregation; therefore, we have been
negotiating with the Irvine Company to acquire land for our future temple site.
A parcel of land on the corner of Camelback and Jamboree has been selected and
we anticipate entering into escrow during the month of February, 1976. Rolly
Pulaski &Associates have been engaged as our architect to review the site require-
ments and develop the preliminary plans. He has also been requested to act as
our agent to develop the documents required for obtaining a use permit so we can
use a temporary facility on the property until a permanent building is designed
and constructed. We are presently negotiating to purchase the former Great
Western Savings and Loan Association temporary building which is located in
Newport Center and anticipate moving this to the future temple site. The temporary
building would be used primarily as an office during the day for our Rabbi and
religious services on Friday night.
We have discussed the parking needs for Friday nights with our adjacent neighbors
and since they only use their parking facility during the day and we basically only
need parking facilities for Friday night, they have agreed to allow us to share
their parking lot to accommodate this temporary facility.
We appreciate receiving approval for the above noted plan so we may provide
adequate service to the local Jewish community as soon as possible.

Yahm, we submit the following additional information.
1. The primary purpose of the building would be for holding
services on Friday night between the approximate hours
of 8:00 and 10:30 p.m. On occasions a special Saturday
morning service would be held between 10:00 a. m, and
12:00 noon. Our Rabbi would also use this building as an
office during the day on an approximate 1 /2 time basis.
2. It is the intent and plan of the congregation to build a
permanent building on the site in approximately 2 1 /2 years.
Plans for the permanent building and development of the
site will be submitted to the Planning Commission for
approval.

Re: Conditional Use Permit Application - Temple Bat Yahm
Southeast Corner of Jamboree and Camel Back
This letter will serve to inform you that the Temple Bat Yahm congregation
has entered into an escrow agreement with The Irvine Company to purchase
the subject property. One of the provisions of the said agreement allows
the Temple Bat Yahm to construct and occupy a temporary facility subject
to compliance with all applicable governmental regulations and subject
to architectural /design approvals by The Irvine Company,
The Temple Bat Yahm, by virtue of the escrow agreement, does have the
authority and, in fact, the responsibility to obtain a Conditional Use
Permit prior to use of the property.
We have further agreed in principle to allow the Temple Bat Yahm use of off -
street parking at our adjacent Property Services /Community Cablevision
facility to accommodate the contemplated temporary facility on an interim
basis. We intend to make available for the Temple Bat Yahm's use - not less
than 40 parking spaces - for evening and week -end use when they are not
needed to meet the code requirements during the course of the normal business
day for the employees of Property Services /Community Cablevision.
This letter shall not be considered as The Irvine Company's final approval of
plans submitted by the Temple Bat Yahm to obtain necessary permit approvals.
We reserve the right to impose further restrictions and business terms
consistent with jurisdictional approvals.
It is our intention to work closely with the City and Temple Bat Yahm on this
matter to insure a mutually satisfactory development. Please advise if we may
be of further assistance in this regard.
