AGREEMENT PROVIDING FOR PEDESTRIAN CONNECTION
ACROSS MESA DRIVE EASTERLY OF IRVINE AVENUE
(Newport Beach Golf Course)
THIS AGREEMENT, made and entered into this �'�,
day of , 1976, by and between the CITY OF NEWPORT
BEACH,ipal corporation, hereinafter referred to
as "City" and NEWPORT BEACH GOLF COURSE, a partnership,
hereinafter referred to as "Company ",.
W I T N E S S E T Hs
WHEREAS, Company proposes to construct a public golf
course on leased land adjacent to Irvine Avenue and Mesa
Drive in the City of Newport Beach; and
WHEREAS, said golf course is intersected by Mesa.. Drive
and, as a condition to permit the golf course construction,
Company is required by City to provide a pedestrian connection
to the golf course on each side of Mesa Drive; and
WHEREAS, Company proposes to construct a pedestrian
barrier along the curb on each side of Mesa Drive which will
direct patrons of the golf course desiring to cross Mesa
Drive to the existing cross walk at the intersection of Mesa
Drive with Irvine Avenue; and
WHEREAS, City desires to evaluate the effectiveness of
said pedestrian barrier for an extended period of time.
NOW, THEREFORE, inconsideration of their. mutual
promises, the parties hereto agree as follows:
1. Company shall be allowed by City to initiate
operation of the golf course using the Mesa Drive pedestrian
barrier described above.
2. City will observe and evaluate the effectiveness
of said barrier.
3. Company agrees to design, redesign, modify and /or
construct a method of pedestrian crossing acceptable to and
approved by the City in a reasonable time after notification•
by the City that, in City's sole opinion, said barrier is
effective in controlling pedestrians
4. Company agrees to provide a bond in favor of City
the ount of Ten Thousand Dollars ($10,000.00).for a

io of fivr years to guarantee performance of this agreement.
5. It is mutually agreed that.the terms of this .
/,- greement sh 1 remain in full force and effect for a period

6. It is further agreed that the terms of this
agreement may be mutually amended in writing by the parties
hereto,, and that the bonding company guaranteeing performance
of this agreement specifically agrees to waive notice of
any amendment hereto.
IN WITNESS WHEREOF,.the parties hereto have caused
this agreement.to be made and executed on the day and year
first above written.

8 �T A RESOLUTION OF THE CITY COUNCIL OF THE CITY
Y QF NEWPORT BEACH APPROVING AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE NEWPORT BEACH
GOLF COURSE, AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAID AGREEMENT PROVIDING FOR
A PEDESTRIAN CONNECTION ACROSS MESA DRIVE
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the Newport Beach Golf Course,
providing for a pedestrian connection across Mesa Drive easterly
of Irvine Avenue; and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and findsthem to be satisfactory
and that it would be in the best interest of the City to
authorize the Mayor and City Clerk to execute said agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
