CALIF. 92653 • E AGREEMENT BETWEEN THE CITY OF SANTA ANA AND THE CITY OF NEWPORT BEACH FOR THE NARCOTICS TASK FORCE LfB 6�— THIS AGREEMENT, made and entered into thisday of P77 , 1976, by and between the City of Santa Ana, a Municipal Corporation of the State of California, hereinafter referred to as "SANTA ANA," and the CITY OF NEWPORT BEACH, a Municipal Corporation of the State of California, hereinafter referred to as "NEWPORT BEACH." RECITALS W I T N E S S E T H 1. SANTA ANA, pursuant to Resolution No. 73 -38, dated April 16, 1973, submitted an application for a Federal Discretionary Grant Award Project under Section 301(b) of the Omnibus Crime Control and Safe Streets Act of 1968, Public Law 90 -351, as amended by Public Law 91 -644, to be funded in part from monies made available pursuant to the Crime Control Act of 1973, Public Law 93 -83, administered by the Office of Criminal Justice Planning for the California Council on Criminal Justice, to undertake a certain project designated as the Orange County Narcotic Index. 2. The parties hereto have previously cooperated with other cities and agencies within, the County of Orange to form a Narcotics Task Force and have participated in the aforementioned Project by prior contractual arrangements. 3. A Narcotic Index Office has been established and will be located within the SANTA ANA Police Department facilities to provide for timely, expeditious and continuous support to the Task Force members and interface with other law enforcement agencies in Narcotic oriented intelligence collection, analysis and distribution. WHEREFORE, in consideration of the respective and mutual covenant and promises hereinafter contained and made, the parties hereto agree as follows: I. This Contract will become operative if and when the United States Department of Justice, Law Enforcement Assistance Administration, agrees to provide fourth -year funding to said Project. H. The Director of Finance for SANTA ANA, as Financial Officer, shall upon wvard of the grant resulting from said application simultaneously establish a special trust fund designated for Orange County Narcotics Index. Said trust fund shall consist of funds derived from said federal funding and hard cash matching funds in the amount of ten thousand three hundred and twenty -four dollars ($10,324) and shall be disbursed in a manner consistent with the grant conditions. The Director of Finance shall provide the required accountability for the project. III. The Santa Ana Chief of Police, as Project Director, shall order and provide direction and make payment on behalf of NEWPORT BEACH for services provided on the aforesaid grant and that are required in establishing the Narcotic Index Office. IV. NEWPORT BEACH agrees to deposit with SANTA ANA four hundred thirteen dollars ($413) within ninety (90) days, to be NEWPORT BEACH'S pro-rata share of the Narcotics Task Force Hard Cash Matching Funds. The foregoing funds shall be immediately returned to NEWPORT BEACH if said grant funding is not awarded. V. NEWPORT BEACH agrees to fulfill all duties as specified in the aforementioned application for grant award, which document and amendments thereto are hereby incorporated by reference as part of this Contract. VI. The Project Director and Financial Officer shall receive and disburse project funds through the above trust account in accordance with all legal requirements for the accounting of funds under the Omnibus Crime Control and Safe Streets Act of 1968 and any amendments thereto. VII. Santa Ana shall cause the Financial Officer to reimburse NEWPORT BEACH for any portion of its contribution remaining unexpended at the completion of the Project. The original agreement was sent to your office for transmittal to the City of Santa Ana for execution on September 16. Would you please check to see if you have received an executed copy from Santa Ana and if so, transmit to the Clerk's office for our official files. S L P i 3 1976 RESOLUTION NO. 8 88 9 By the CITY COUN-IL CITY OF Nr4WW *EW6ftION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF NEWPORT BEACH AND THE CITY OF SANTA ANA, AGREEING TO CONTINUE TO PARTICIPATE IN THE LEAA FEDERAL GRANT TO THE ORANGE COUNTY NARCOTIC TASK FORCE WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain contract between the City of Newport Beach and the City of Santa Ana, wherein the City of Santa Ana is named as the sponsoring city to receive and disburse certain federal grant funds offered to the Orange County Narcotic Task Force by the Law Enforcement Assistance Administration (LEAA); and WHEREAS, in order to receive said federal grant monies, the cities of Orange County, all of whom are members of the Narcotic Task Force, must agree to contribute certain matching funds based on population; and WHEREAS, the City of Newport Beach's population per- centage share would be the sum of Four Hundred Thirteen Dollars ($413.00); and WHEREAS, the City Council believes that it would be in the best interest of the citizens of the City of Newport Beach to agree to share in the matching funds in order to receive said federal grant which will aid in the investigation, appre- hension and conviction of major narcotics violators; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby agrees to contribute Four Hundred Thirteen Dollars ($413.00) as its share of the matching funds to the LEAA grant to the Orange County Narcotic Task Force. BE IT FURTHER RESOLVED that the Mayor and City Clerk 0 0 are hereby authorized and directed to execute the contract between the City of Newport Beach and the City of Santa Ana to continue to participate in the LEAA Federal Grant to the Orange County Narcotic Task Force.
