AMENDMENT TO AGREEMENT
This Amendment to Agreement is made and entered
into this 2- V�-day of S�=Pr , 1976, by and between the
CITY OF NEWPORT BEACH, a chartered municipal corporation,
hereinafter referred to as "City" and the firm of KAMMEYER &
LYNCH, LANDSCAPE ARCHITECTS, hereinafter referred to as
"Architect ".
W I T N E S S E T H:
WHEREAS, City and Architect have entered into an
Agreement for Design Services dated October 15, 1975 to
provide certain landscaping consulting services in connection
with the proposed West Newport Park; and
WHEREAS, City and Architect wish to amend that Agree-
ment to change the services to be performed by Architect as
well as the fee and payment schedule.
NOW, THEREFORE, in consideration of these premises,
the parties hereto agree to amend the Agreement for Design
Services dated October 15, 1975 to provide as follows:
I. Services to be Performed by Architect.
A. Final Design, Preparation of Plans, Specifica-
tions and Estimate Phase.
1. Revise the existing construction drawings
from 59th Street eastward to the park boundary; the
revised drawings will allow for complete construction
of the area, in accordance with the master plan and
within the City's budget limitations.
2. The specific design items include:
(a) 4 tennis courts with lighting stubs
but no lighting.

(b) 2 parking lots (approximately 50 stalls).
(c) 4 three wall handball courts with
lighting stubs but no lighting.
(d)** 1 children's play area.

(f) Alignment of bicycle trail for total
length of park per master plan but construction of
only as much as budget permits because of material
change from AC to concrete.
(g) Landscape and irrigate park area.
(h) Planned drainage pipe to extend to
River Avenue curb inlet.
3. Revise, as necessary, the previously prepared
construction documents, bid documents and construction
cost estimate.
II. Fee Schedule and Payment
In consideration of the performance of the
above described services, the City hereby agrees to pay Architect
an amount based upon the hourly rate schedule set forth below.
In no event shall said amount be greater than Four Thousand
Five Hundred Dollars ($4,500.00), except as otherwise provided
herein.
A. Payments will be made within the period
or at the completion of final design preparation.
IT IS FURTHER AGREED that all of the terms,
conditions, and provisions as set forth in that Agreement
between the parties dated October 15, 1975, which are not revised
inconsistent with or otherwise modified by this Amendment shall

remain in full force and effect and shall be binding on the
parties hereto.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement on the day and year first above written.
