At the request of your City Attorney, Mr. Dennis O'Neil,
we are pleased to submit a proposal for legal services in con-
nection with the authorization, issuance and sale of general
obligation bonds in the approximate amount of $7,000,000 for
the acquisition and development of park lands for the City of
Newport Beach.
The legal services to be rendered by us will consist of
general advice to the staff and Council, drafting of all resolu-
tions, notices and other documents required for the authorization,
issuance and sale of the bonds, examination of the transcript of
the proceedings and the issuance of our legal approving opinion
to the purchasers of the bonds.
For said legal services our fee is based on the amount of
bonds authorized and sold. The following schedule applies:

over $5,000,000
Fee
$2 per thousand
$2,000, plus $1 per
thousand on excess
over $1,000,000
$6,000, plus $.50 per

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE A LETTER AGREEMENT WITH
RUTAN & TUCKER TO ACT AS SPECIAL COUNSEL FOR
THE OPEN SPACE BOND ELECTION
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a Letter Agreement between the
City of Newport Beach and Rutan & Tucker in connection with
the legal services to be rendered in conjunction with the
authorization, issuance and sale of general obligation bonds
in the approximate amount of $7,000,000.for the acquisition
and development of open space and park lands for the City of
Newport Beach; and
WHEREAS, the City Council has reviewed the terms and
conditions of said Letter Agreement and finds them to be
satisfactory and that it would be in the best interest of the
City to authorize the Mayor and City Clerk to execute said
agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said Letter Agreement above
described is approved, and the Mayor and City Clerk are hereby
authorized and directed to execute the same on behalf of the
City of Newport Beach.
