Application
This application requests approval of an off -site parking agreement
for a portion of the required parking spaces for the Le Rendezvous
Restaurant. In accordance with Section 20.30.035 D. of the Newport
Beach Municipal Code, the Planning Commission shall not recommend
and the City Council shall not approve off - street parking on a
separate lot from the building site or sites unless:
(a)
Such lot is so located as to be useful in
connection with
the proposed use or uses on the building
site or sites.
(b)
Parking on such lot will not create undue
traffic hazards
in the surrounding area.
(c)
Such lot and the building site are in the
same ownership,
or the owners of the building sites have
a common owner-
ship in such lot, and the owner or owners
are entitled to
the immediate possession and use thereof
(ownership of
the off -site lot must be ownership in fee
or a leasehold
interest of a duration adequate to serve
all proposed
uses on the building site or sites).
(d) The owner or owners and the City, upon the approval of
the City Council, execute a written instrument or instru-
ments, approved as to form and content by the City Attorney,
providing for the maintenance of the required off - street
parking on such lot for the duration of the proposed use
or uses on the building site or sites. Should a change
in use or additional use be proposed, the off - street
parking regulations applicable at the time shall apply.
Such instruments shall be recorded in the office of the
County Recorder and copies thereof filed with the Depart-
ment of Community Development.
Suggested Action
If desired, adopt Resolution No. authorizing the execution
of an off -site parking agreement with Alvin Teuteberg, Taverinn Inc.,
Newport Beach.

Planninq Commission Recommendation
At its meeting of October 7, 1976, the Planning Commission voted
unanimously to recommend the approval of this off -site parking
arrangement to the City Council with the findings and subject to
the conditions as follows:
A. FINDINGS:
1. The off -site parking lot is approximately 250 ft.
from the restaurant site and is so located to be
useful to the restaurant facility.
The off -site parking spaces will not create undue
traffic hazards in the surrounding area.
3. The lease agreement for the off -site parking spaces
on a year -to -year basis appears to be the only park-
ing available for the restaurant use at this time and
should provide a practical interim solution to the
existing parking problem.
4. The Police Department has indicated that they do
not contemplate any problems with the off -site
parking lot.
CONDITIONS:
1. That the operation of the restaurant shall be limited
to the hours of 5:30 P.M. through 2:00 A.M., Monday
through Saturday, and all day on Sundays, provided
the applicant can obtain an amended lease agreement.
These hours may be adjusted by the Planning Commission
provided satisfactory parking can be provided in
another location.
2. That an off -site parking agreement shall be approved
by the City Council, guaranteeing that a minimum of
twenty -five parking spaces shall be provided at the
rear of The Beachcomber Shops, located at 2633 West
Coast Highway, during all hours of operation of the
restaurant facility.
3. That a valet service shall be provided on the
restaurant site during all hours of operation.
4. That a diagram shall be provided at the entrance of
the restaurant complex showing the location of the
off -site parking spaces for the benefit of the customers.
5. That sixteen parking spaces shall be maintained on
the restaurant site in accordance with the approved
parking layout. Said parking spaces shall be
marked with approved traffic markers or painted
white lines not less than four inches wide. Wheel
stops shall be provided adjacent to the westerly
side property line so as to keep parked automobiles
from damaging the existing fence between the subject
property and the adjoining Ancient Mariner Restaurant
site.
6. That the parking arrangement be subject to review by
the Modifications Committee one year after approval
of the off -site parking agreement by the City Council

Application
This application requests approval of an offsite parking agreement
for a portion of the required parking spaces for the Le Rendezvous
Restaurant. In accordance with Section 20.30.035 D. of the Newport

Environmental Significance
This project has been reviewed, and it has been determined that it is
categorically exempt under Class 1 (i.e. Existing Facilities) from
the requirements of the California Environmental Qualities Act.

Conformance with General Plan
The Land Use Element of the General Plan designates the site for
"Recreational and Marine Commercial" uses. The existing restaurant
development falls within the permitted uses.
Subject Property and Surrounding Land-Use_
The Le Rendezvous Restaurant is located on the property in question.
To the north, across West Coast Highway, is the Mariners Mile Square
commercial complex; to the east, is the Newport Marine electronics
facility and a residential use; to the south, is Newport Bay; and to
the west, is the Ancient Mariner Restaurant and then the Beachcomber
Shops and related offstreet parking spaces. The offsite parking
spaces required for the LeRendezvous Restaurant are proposed to be
located on the Beachcomber site.
Background
The subject restaurant was built in 1968 without a use permit and at
a time when the parking requirement was based upon one space for
each three seats (occupant load). In addition to the serving of
food and on -sale alcoholic beverages, the restaurant use at various
times has included live entertainment and dancing. However, dancing
has not been provided for over a period of six months and the current
owner of the business does not have a Cafe Dance Permit. Therefore, any
change in the operational characteristics of the establishment from
those which currently exist, such as a new request for dancing, would
require a use permit and would allow the Commission and staff to
evaluate the parking requirements based upon the current standards
which are based on net public area.
When the restaurant was originally established, it had an occupant
load of 65 persons and a parking requirement of 22 spaces. Twelve
spaces were originally provided on site and the balance were provided
behind the Beachcomber Shops, approximately 250 feet westerly, through
an off -site parking agreement approved by the Planning Commission and
the City Council. The agreement was subsequently declared to be null
and void when the use of the spaces was no longer available.
Since that time the restaurant has changed ownership twice and the
name of the business has been changed at least three times. Under
the various ownerships, this business has had alterations made to
the interior of the structure which has increased the interior
occupant load to 80 persons. In addition, the outdoor deck on the
bayward side of the building has been protected by a glass wind screen
which provides an additional area for outdoor dining with an occupant
load of 34 persons. Therefore, the restaurant currently has a
total occupant load of 114 persons which would require parking for
38 automobiles.
In addition to the restaurant parking requirement noted above, the boat
slips bayward of the building were altered in 1973 from a four fingered
slip cluster to one "U" shaped slip. The current parking requirement
for this slip is 3 spaces based on 3/4 of a parking space per leased
slip space. Therefore, the total parking requirement for all uses
on the premises is 41 spaces.
The last off -site parking agreement for the restaurant was approved
by the City Council on March 12, 1973. At that time the restaurant
was known as the Monterey Still and the operator of the business
was Giles Svehlek dba Taverinn, Inc. Under the terms of the agreement,
30 parking spaces were provided behind the United'California Bank on
the north side of Coast Highway approximately 500 feet from the
restaurant site. Restrictions placed on the restaurant in conjunction
with the approval of the off -site parking arrangement requried:
1. That the operation of the restaurant Monday through Friday
shall be limited to the hours between 4:00 P.M. and 2:00 A.M.

2. That the hours of operation may be adjusted by the Director
of Community Development upon submittal of satisfactory
evidence as required by Section 20.30.035D. of the Municipal
Code.
3. That a valet service shall be provided during all hours of
operation.
4. That satisfactory restraints shall be provided to keep
automobiles on the property as determined by the Community
Development Department.
5. That a diagram shall be provided at the entrance of the
restaurant showing the location of the off -site parking
for the benefit of the customers.
6. That a satisfactory off -site parking agreement shall be
executed.
The spaces noted above were available for the use of the restaurant
until January 11, 1975, when a fire on Mariners Mile destroyed the
United California Bank and the adjoining buildings. In May of this
year the Department of Community Development became aware of the fact
that the lease arrangement between the restaurant and the bank had
been terminated and that the off -site parking spaces formerly desig-
nated for the evening use of the restaurant were no longer available.
At the same time the Department took steps to close the restaurant
during the noon hour after it had been open for lunch in violation
of the off -site parking agreement. The City has filed a legal action
against the restaurant with the District Attorney and prosecution of
that action is pending on the outcome of the applicant's request for
a new off -site parking agreement.
Analysis
Parking. As indicated on the attached site plans, the applicant is
proposing to utilize a total of 41 parking spaces, a portion of which
are on -site, with the balance being off -site as noted below.
On -site Parking. The applicant proposes to restripe the restaurant
parking lot so as to provide 16 on -site parking spaces where only
10 parking spaces now exist. The Traffic Engineer has no objections
to the proposed parking layout indicated on the attached plot plan,
subject to the condition that valet service shall be provided during
all hours of operation of the restaurant facility.
Off -site Parking. Twenty five (25) offsite parking spaces are pro-
posed to be located at the rear of the Beachcomber Shops, approxi-
mately 250 feet westerly of the restaurant site. The subject spaces
are only available for the restaurant use after 5:30 P.M., Monday
through Saturday, after the Beachcomber clothing store and coffee
shop are closed for business. Sufficient offsite parking spaces
are also available during the day on Sunday when the Beachcomber
retail shop is closed and the coffee shop is open. The attached
lease agreement dated August 3, 1976 indicates that the owner has
authorized the applicant to use 25 of the existing 41 parking spaces
after 5:30 P.M., seven days a week. However, the staff would have
no objections if the lease agreement was amended to permit the
restaurant to use the offsite lot a'.l day on Sunday.
The hours of operation of the Le Rendezvous Restaurant are consistent
with the availability of the offsite parking lot. The applicant has
indicated that the restaurant complex will be open from 5:30 P.M.
to 2:00 A.M., Monday through Saturday, and 10:00 A.M. to 3:00 A.M.
on Sunday. The applicant is also aware that the restaurant use can-
not be open for luncheon trade during the week, unless additional
offsite parking spaces are secured at another location during daytime
hours.
Staff is of the opinion that the proposed offsite parking lot is so
located to be useful, and will not create undue traffic hazards in

the surrounding area. The total number of 41 parking spaces (i.e. 16
on -site and 25 off -site spaces) also meets the 38 spaces required for
the restaurant facility with an occupant load of 114 persons, in
addition to the 3 parking spaces required for the 4 leased boat slips
bayward of the restaurant site.
Staff is only concerned, however, in that the length of the attached
agreement does not meet the criteria of the City's offsite parking
standards. The Municipal Code provides that an offsite parking lot
must be ownership in fee or a leasehold interest of a duration
adequate to serve the proposed use on the building site. This
criteria has more recently been interpreted to require an agreement
of at least 5 years. In this case however, the property owner of
the proposed offsite lot, as many owners on Mariners Mile, was
unwilling to commit the property for more than one year at a time
pending the adoption of the Mariners Mile Specific Area Plan and
a decision by the City as what future requirements on development
will be. Staff does not therefore object to the agreement on an
annual basis in that it appears to be the only available parking
for the restaurant use in the area and should provide a practical
interim solution to a parking problem that has existed for many
years. If the lease agreement is not extended.in the future, the
applicant will have to obtain other parking spaces on another offsite
lot to be approved by the Planning Commission and the City Council,
or the restaurant will have to close.
ecific Findings and Recommendation
Staff recommends the approval of an offsite parking agreement for a
portion of the required parking spaces of the Le Rendezvous Restaurant
and suggests that the Planning Commission make the following findings
in conjunction with the applicant's request.

1. The offsite parking lot is approximately 250 feet from the
restaurant site and is so located to be useful to the rest-
aurant facility.
2. The offsite parking spaces will not create undue traffic
hazards in the surrounding area.
3. The lease agreement for the offsite parking spaces on a
year to year basis appears to be the only parking avail-
able for the restaurant use at this time and should provide
a practical interim solution to the existing parking
problem.
4. The Police Department has indicated that they do not contem-
place any problems with the offsite parking lot.

3. That a valet service shall be provided on the
restaurant site during all hours of operation.
4. That a diagram shall be provided at the
entrance of the restaurant complex showing
the location of the offsite parking spaces
for the benefit of the customers.
5. That 16 parking spaces shall be maintained on
the restaurant site in accordance with the
approved parking layout. Said parking spaces
shall be marked with approved traffic markers
or painted white lines not less than 4 inches
wide. Wheel stops shall be provided adjacent
to the westerly side property line so as to
keep parked automobiles from damaging the
existing fence between the subject property
and the adjoining Ancient Mariner Restaurant
site.
6. That the parking arrangement be subject to
review by the Modifications Committee one year
after approval of the offsite parking agree-
ment by the City Council.

AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND ALVIN TEUTEBERG IN CONNECTION WITH A
RESTAURANT FACILITY AT 2601 WEST COAST
HIGHWAY
WHEREAS, there has been presented to the City

Council of the City of Newport Beach a certain off -site parking
agreement between the City of Newport Beach and Alvin Teuteberg
in connection with a restaurant facility at 2601 West Coast
Highway; and
WHEREAS, the City Council has reviewed the terms and
conditions of said off -site parking agreement and finds them
to be satisfactory and that it would be in the best interest
of the City to authorize the Mayor and City Clerk to execute
said off -site parking agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said off -site parking agreement
above described is approved, and the Mayor and City Clerk are
hereby authorized and directed to execute the same on behalf of
the City of Newport Beach.
