O P I N I O N
Balboa Island Ferry, (VCC -2) , a California corporation,
operates common carrier ferry service for the transportation of
persons and motor vehicles across Balboa Bay between Balboa and
Balboa Island in the City of Newport.
By this application, Balboa Island Ferry seeks to adjust
its fares for an additional annual revenue of $95,648. This would
represent a fare increase of approximately 26 %. The present and
proposed fares are summarized below:
(1) Only increase proposed in this application.
(2) Auto commute fare reduced from 254 to 204. This
will permit the fare for an automobile and driver
to remain at 354 as it is under the present fares.

The present fares were originally established by
Decision No. 86107 in Application No. 56404 dated July 15, 1976.
Applicant alleges that his present fares do not yield
sufficient revenue to allow it to conduct its vessel operations
at a profit. For the rate year ending June 30, 1980 applicant
alleges that there will be an operating loss of $25,387 at
present fares.
Applicant further alleges that additional revenue is
required because of increased cost in phases of operation, including
fuel, insurance, labor and maintenance.
While the fare increase authorized herein is an exception
to the President's Guidelines for wage and price increases, the
proposed fares are reasonable and necessary to ensure the continued
viability of this transportation service.
Notice of filing of this application appeared in the
Commission's Daily Calendar on May 1, 1979. No protests have
been received.
After consideration the Commission finds that:
1. The requested fare would result in an additional annual
revenue of $95,648.
2. The proposed fare increase is justified.
3. A public hearing is unnecessary.
O R D E R
IT IS ORDERED that:
1. Balboa Island Ferry is authorized to establish the
increased fares proposed in Application 58829.
2. Tariff publications required to be made by Balboa Island
Ferry as a result of this order shall be filed not earlier than the
effective date of this order and may be made effective not earlier
than the fifth day after the effective date of this order on not
less than five days' notice to the Commission and to the public.

3. The authority herein granted shall expire unless exercised
within ninety days after the effective date of this order.
4. In addition to the required posting and filing of tariffs,
Balboa Island Ferry shall give notice to the public by posting in
its vessels and terminals a printed explanation of the new fares.
Such notice shall be posted not less than five days before the effective
date of the fare change and shall remain posted for a period of not
less than thirty days.
Since applicant is operating at a loss, the effective date
of this order is the date hereof.

A survey of city traffic on the Balboa Island Ferry was conducted in mid -
March, 1976. Based on this survey, annual city traffic was estimated and
a corresponding monthly charge calculated. This charge was established in
an agreement between Balboa Island Ferry Inc. and the City of Newport Beach
dated April 28, 1976.
On July 21, 1976 the Public Utilities Commission approved a fare increase
applicable to automobiles and trucks carried by the ferry. The regulations
of the Public Utilities Commission require that the same fares be applicable
to all users of the ferry. Virtually all city traffic on the ferry consists
of automobiles and light trucks. Accordingly, the increased monthly charge
has been calculated a shwon below:

The new rate structure raises fare to 40F for automobile and driver, with

35C fare is considered applicable to city traffic.

SUBJECT: Adjustment of Balboa Island Ferry
Flat Rate Charge for City Usage
On May 10, 1976, the City Council adopted Resolution No. 8764
authorizing an increase to $200.00 of the flat rate fee paid
by the City to the Balboa Island Ferry for use of the Ferry
by City employees on City business.
After that date, the California Public Utilities Commission
approved a fare increase applicable to automobiles and
trucks, raising the base rate from 30 to 40 cents plus 10
cents for each additional passenger. Historic data indicates
that the average for City vehicles is 2.0 persons per car.
Based upon surveys, City vehicles use the Ferry approximately
500 trips per month.

Under the new fare schedule, the Balboa Island Ferry is making
available to the City a rate of 35 cents per automobile and
10 cents per passenger, pusruant to a discount ticket book
price, and the new fare would be 45 cents per trip times 500
for $225.00 per month.

WHEREAS, there has existed for several years an
agreement providing for the payment by the City of a flat rate
to the Balboa Island Ferry for the use of the Balboa Island
Ferry by City employees while on City business; and
WHEREAS, on May 10, 1976, the City Council adopted
Resolution No. 8764 setting said flat rate at $200.00 per
month; and
WHEREAS, the Public Utilities Commission approved
a fair increase on July 21, 1976 resulting in a net increase
of five cents per trip for vehicles used by City employees
on City business; and
WHEREAS, it is fair and equitable to increase the
monthly flat rate fee to comply with the rate set by the
California Public Utilities Commission; and
WHEREAS, it is found and determined that the proposed
agreement is fair and equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the agreement between the City
and the Balboa Island Ferry providing for a flat rate fee of
Two Hundred and Twenty -Five Dollars ($225.00) per month for
use by City employees on City business be and is hereby approved
BE IT FURTHER RESOLVED that the City Manager is
hereby authorized and directed to execute the letter agreement
with the Balboa Island Ferry authorizing said payment to the
Balboa Island Ferry from the City of Newport Beach.
BE IT FURTHER RESOLVED that Resolution No. 8764 is
hereby rescinded.

Balboa Island Ferry - Flat
Rate Charge for City Usage
In April, 1969, the City entered into an Agreement with the
Balboa Island Ferry establishing a flat rate fee to be paid
by the City for use of the ferry by City employees on City
business.
Prior to that time, the City and the Balboa Island Ferry had
used an accounting system which apparently became time
consuming, cumbersome and costly to both parties. Based upon
a study of the Balboa Island Ferry, a flat rate fee of
$50.00 per month was established. Since that time, the fee
has been increased.
Pursuant to a more recent study by the Balboa Island Ferry,
it appears that the current usage of the ferry by City employees
in either City vehicles or their own vehicles on City business
has amounted to enough trips to average out to be $200.00 per
month in ferry fees, based upon the charges levied by the
Balboa Island Ferry pursuant to the Tariff Schedule approved
by the Public Utilities Commission.

As a result of the documented experience of recent ferry
travel by City employees, during two spot checks, the
flat rate which would be paid by the City for the service
amounts to $2,400.00 a year, which is payable monthly at
$200.00 per month. City employees will be required to use
standard personalized city identification cards which
identify them as being employees of the City. It is under-
stood, that use of employee identification cards for
ferry travel will be restricted to City owned vehicles with
the exception of personal vehicles used on work days during
regular business hours for City business.
The ferry operators are welcome to conduct periodic spot
checks to determine if ferry usage has changed significantly.
The fee schedule will be subject to change as may be
mutually agreed to by both the City and the Balboa Island
Ferry. A request for change in fee schedule shall be
processed in writing at least two weeks in advance of the
effective date of any new schedule deemed appropriate by the

SUBJECT: USE OF THE BALBOA ISLAND FERRY
The Manager of the Balboa Island Ferry has indicated that
use by City employees has increased fivefold in the last few years.
The City payment to the Ferry Company has remained constant since
1969.
In an effort to determine the best arrangement for both
the Ferry Company and the City, starting immediately, the following
practice will be implemented. --
1. Only automobiles or trucks having an "E" license
plate will be permitted to use the Ferry at no
direct charge to the operator.
2. Undercover agents of the Police Department who will
be operating vehicles not having an "E" license plate
will be required either to show a badge or proper
identification, or will be required to pay the fare
and obtain reimbursement from the Department.
3. Employees who are on City business, but forced to
use their private automobiles, will be required to
pay the fare, but will be reimbursed by the City with
evidence that they were on City business.
It is requested that you make this policy available to all
of your employees. The Ferry Company will adhere to the above policy
beginning immediately. rr

SUBJECT: TRAFFIC CONGESTION IN THE BALBOA BUSINESS DISTRICT
At the June 26, 1973, Traffic Affairs Committee meeting
representatives from the Palm and Balboa business district met with TAC
to discuss implementing an experimental plan to reduce traffic congestion
at the entrance to the automobile ferry on Palm Street. After reviewing
the alternatives, it was agreed to install the following modifications to
the traffic plan in that area on an experimental basis:
1. Eliminate all left turn movements for vehicles eastbound
on Balboa Boulevard at Palm Street;
2. Revise the existing overhead signs on Balboa Boulevard at
Palm Street to direct ferry traffic to turn right on Palm Street instead
of left;
3. Provide directional signs for patrons desiring to use the
ferry along the following route:
a. South on Palm Street to the Balboa parking lot frontage
road,
b. East on the frontage road to Main Street,
c. North on Main Street to Balboa Boulevard,
d. West on Balboa Boulevard to Palm Street,
e. North on Palm Street.
4. Create a ferry stacking lane on the north side of Balboa
Boulevard from Palm Street to the alley east of Palm and remove parking
along that section;
5. Place an informational sign at the end of the ferry holding
lane indicating how long a wait for the ferry is to be expected;
6. Maintain two westbound traffic lanes on Balboa Boulevard, and
7. Request the Police Department keep westbound vehicular traffic
moving on Balboa Boulevard rather than having vehicles waiting past the end
of the ferry stacking lane.

After a reasonable testing period, if this plan is not
successful, the Traffic Affairs Committee will again review this situation
in order to alleviate traffic congestion in the Balboa business district.
