C9Steve iuc knam Jr. Project Engineer SB:jd Att. �� G ��7 ' AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES WATER PRESSURE ZONE III- SERVICE CAPACITY STUDY THIS AGREEMENT is made and entered into this /S -4day of 1976, by and between the City of Newport Beach, a municipal corporation, hereinafter referred to as CITY; and the firm of James M. Montgomery, Consulting Engineers Incorporated, hereinafter referred to as ENGINEER. WITNESSETH WHEREAS, CITY desires a study of water pressure Zone III connections to the Metropolitan Water District's (hereinafter referred to as MWD) Feeder Distribution System to determine if modifications to existing connections or new connections are required to meet future water service demands; and WHEREAS, ENGINEER has submitted a proposal to CITY to perform engineering services in connection with the study; and WHEREAS, CITY desires to accept said proposal; NOT THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by ENGINEER ENGINEER hereby agrees to perform the following services: 1. Review water demand requirements for Pressure Zones III through VIII. In order to facilitite the review and comparison of the alternatives, a computer model of the "backbone" water delivery system for Zone III would be prepared. 2. Prepare preliminary piping and valving sketches for new or modified MWD connection alternati:ves. 3. Prepare preliminary cost estimates of the required facilities for each alternative. 4. Obtain preliminary construction schedules from - 1 - 0 Pi MWD for those alternatives that would require that they provide new or modified facilities. 5. Make recommendations concerning the selection of an alternative for construction. 6. Prepare a letter type report to include the results of the study. 7. The alternatives to be studied are as follows: (a) Enlargement of connection CM -11 and possible main extension to the San Joaquin Reservoir outlet. (b) New connection to Orange County Feeder at Bison Avenue. (c) New connection to outlet of the San Joaquin Reser- voir. (d) Modification of connection CM -9 at Jamboree Road and Bristol Street. (e) New connection to Orange County Feeder at exten- sion of Eastbluff Drive at the time the proposed relocation of the Orange County Feeder is accom- plished due to proposed freeway construction. (f) New connection at the MWD- Corona del Mar Reservoir along New MacArthur Boulevard. (g) Enlargement of the Zone III Pump Station at Big Canyon Reservoir. III. Duties of CITY CITY agrees to supply ENGINEER with the following infor- mation and materials: A. Water System Atlas Maps of Zones III through VIII existing systems. B. Proposed water system backbone system in CITY's downcoast sphere of influence. C. Land Use data for existing and potential service areas. D. Any other additional information available which the parties hereto agree may be beneficial to the study. IV. Ownership of Study Documents Original drawings, reports, notes, maps and other docu- ments shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. - 2 - 0 V. ENGINEER in Cha DuWayne R. Lidke, RCE No. 13888, shall be the Engineer in charge of the INVESTIGATION. VI. Right of Termination CITY reserves the right to terminate this agreement at any time by giving ENGINEER three (3) days prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to any of ENGINEER's business offices. In the event of termination due to fault of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER. If this agreement is terminated for any reason other than fault of ENGINEER, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termina- tion, on the basis of the fee schedule contained herein. VII. Completion of Study The study in preliminary form shall be completed within 90 calendar days following authorization by CITY to proceed with the work. Two (2) copies of the preliminary study shall be provided to CITY. Ten (10) copies of the final report shall be submitted to CITY within fifteen (15) days of ENGINEER's receipt of CITY's comments on the preliminary report. VIII. Fee Schedule and Payment In consideration of the performance of the above described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Eleven Thousand Dollars ($11,000.00), except as otherwise provided herein. A. Hourly rates for office and field personnel shall be as follows: - 3 - F, IX P 9 0 Senior Company Officer $60.00 /hour Principal Engineer $48.00 /hour Supervising Engineer $36.00 /hour Senior Engineer $30.00 /hour Engineer $25.00 /hour Associate Engineer $21.00 /hour Senior Designer $26.00 /hour Designer $20.00 /hour Drafters $15.00 /hour Clerical $11.00 /hour Computer $50.00 /meter hour The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (90 %) of the maximum fee; 2. Balance of the total amount earned to be paid upon completion of the work specified in Section II (Services to be Performed by ENGINEER). 3. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said report and related documents as well as computer costs, filing fees, checking fees, vehicle mileage, and other related costs authorized by the Public Works Director and advanced by ENGINEER. Additional Work Should ENGINEER complete any additional work not outlined in the agreement, but authorized by CITY, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section X (Fee Schedule and Payment) above. Study Scope Revisions The scope of the study may be changed and the maximum fee revised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed Eleven Hundred Dollars ($1100.00). If the revisions to the scope of the study would result in an increase in the maxi- mum fee exceeding Eleven Hundred Dollars ($1100.00), an amendment providing for such revisions shall be processed and executed by the parties hereto. - 4 - XI. Hold Harmless ENGINEER shall assume the defense of and indemnify and save harmless, the CITY, and its officers and employees, from all claims, loss, damage, injuries, or liability; directly or indirectly arising from any errors, omissions, or negligence in the ENGINEER's performance of this Agreement or from the professional services herein provided. MONTGOMERY, CONSULTING ENGINEERS, INC., FOR PREPARATION OF A SERVICE CAPACITY STUDY OF WATER PRESSURE ZONE III WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain engineering services agreement between the City of Newport Beach and James M. Montgomery, Consulting Engineers, Inc., in connection with the preparation of a Service Capacity Study of Water Pressure Zone III; and WHEREAS, the City Council has reviewed the terms and conditions of said agreement and finds them to be satisfactory and that it would be in the best interest of the City to authorize the Mayor and City Clerk to execute said agreement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
