RESOLUTION OF THE BOARD OF SUPERVISORS OF

ORANGE COUNTY, CALIFORNIA

On motion of Supervisor Riley, duly seconded and carried, the

following Resolution was adopted:

WHEREAS, the Purchasing Agent has established a Cooperative
9
Purchasing Program whereby the County, various districts governed by thi!
10
Board, cities and other districts within the County can achieve certain
11
cost'savings; and
12
WHEREAS, the County has invited the participation of cities and
13
districts within the County in said program; and
14
WHEREAS, the City of Newport Beach has requested to participate

in said program; and

WHEREAS, the City of Newport Beach and the County each in the

conduct of its separate affairs has the power and authority to purchase
18
materials, supplies, equipment, and repair and maintenance services; and
19
WHEREAS, it is permissible under Section 51301 et seq. of the
20
Government Code of the State of California to contract with the County
21
to perform certain functions for the City of Newport Beach;
22
NOW, THEREFORE, BE IT RESOLVED that the Purchasing Agent is hereb!
23
authorized and directed to act as the Purchasing Agent for the City of
24
Newport Beach on the terms set forth in Resolution No. 8931 of the City
25
of Newport Beach.

BE IT FURTHER RESOLVED that this Resolution and said Resolution

No. 8931 of the City of Newport Beach shall constitute an Agreement

Enclosed are two certified copies of Resolution No. 8931 authorising
purchases of certain items to be made for the City of Newport Beach
by the Purchasing Agent of the County of Orange. This resolution
was adopted by the City Council on November 8, 1976.
The approval of the terms of this resolution by the Orange County
Board of Supervisors shall constitute a contract between the City
and the County for a term of five years. Please notify the City
of the Board of Supervisors' approval of said resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING PURCHASES
OF CERTAIN ITEMS TO BE MADE FOR THE CITY BY
THE PURCHASING AGENT OF THE COUNTY OF ORANGE
WHEREAS, it is permissible under Sections 51301,
et sue., of the Government Code of the State of California
to contract with the County to perform certain functions for
the City; and
WHEREAS, it appears that it is possible to acquire
certain items consistent with the City's centralized purchas-
ing system at a substantially lower cost by having them
purchased by the County; and
WHEREAS, it is, therefore, the desire of the City
Council to contract with the County for the County Purchasing
Agent to purchase certain items for the City under the follow-
ing conditions;
NOW, THEREFORE, BE IT RESOLVED that the City of

BE IT FURTHER RESOLVED that the City hereby agrees
to pay the expenses and costs incurred by the County in per-
forming the services for the City within fifteen (15) days
after being billed for the same, provided such expenses and
costs incurred in any month are billed to the City prior to
the end of the following month.

BE IT FURTHER RESOLVED that, upon the approval of
the terms of this resolution by the Orange County Board of
Supervisors, it shall constitute a contract between the City
and the County, which said contract shall have a term of five
(5) years from the date of approval ans shall be subject to
termination by either party upon giving written notice to the
other party one year prior to the date of termination.
