AGREEMENT BETWEEN THE
CITY OF SANTA ANA AND
THE CITY OF NEWPORT BEACH
FOR THE BURGLARY PREVENTION INDEX
THIS AGREEMENT, made and entered into this 1Si day of

Municipal Corporation of the State of California, hereinafter re-
ferred to as "SANTA ANA ", and the City of Newport Beach, a Municipal
Corporation of the State of California, hereinafter referred to as
"NEWPORT BEACH ",
RECITALS
W I T N E S S E T H
1. SANTA ANA, pursuant to resolution No. 76 -24 of its
City Council, adopted on February 2, 1976, submitted an application
for a Federal Discretionary Grant Award Project under Section 301
(b) of the Omnibus Crime Control and Safe Streets Act of 1968,
Public Law 90 -351, as amended by Public Law 91 -644, to be funded in
part from monies made available pursuant to the Crime Control Act
of 1973, Public Law 9383, administered by the Office of Criminal
Justice Planning for the California Council on Criminal Justice, to
continue a certain project designated as the Orange County Burglary
Prevention Index.
2. The parties hereto have previously cooperated with
other cities and agencies within the County of Orange to establish
a Burglary Prevention Index and have participated in the afore-
mentioned Project by prior contractual arrangements.
3. A Burglary Prevention Index office has been estab-
lished and will be located within the SANTA ANA Police Department
facilities to provide for timely, expeditious and continuous
support to the Orange County Burglary Prevention Index members and
interface with other law enforcement agencies in the area of
burglary information collection, analysis, and distribution.
WHEREFORE, in consideration of the respective and mutual
covenants and promises hereinafter contained and made, the parties
hereto agree as follows:

I. This contract will become operative if and when the
United States Department of Justice, Law Enforcement Assistance
Administration, agrees to provide third -year funding to said
Project.
II. The Director of Finance for SANTA ANA, as Financial
Officer, shall, upon award of the grant resulting from said ap-
plication, simultaneously establish a special trust fund designated
for Orange County Burglary Prevention Index. Said trust fund shall
consist of funds derived from said federal funding and state buy -
in, together with local hard cash matching funds in the amount of
nine thousand seven hundred and sixteen dollars ($9,716), and shall
be disbursed in a manner consistent with the grant conditions. The
Director of Finance shall provide the required accountability for
the project.
III. The SANTA ANA Chief of Police, as Project Director,
shall order and provide direction and make payment on behalf of
NEWPORT BEACH for services provided on the aforesaid grant and that
are required in establishing the Burglary Prevention Index office.

V. NEWPORT BEACH agrees to fulfill all duties as
specified in the aforementioned application for grant award, which
document and amendments thereto are hereby incorporated by
reference as part of this contract.
VI. The Project Director and Financial Officer shall
receive and disburse project funds through the above trust account
in accordance with all legal requirements for the accounting of
funds under the Omnibus Crime Control and Safe Streets Act of 1968
and any amendments thereto.

VII. SANTA ANA shall cause the Financial Officer to
reimburse NEWPORT BEACH for any portion of its pro -rata
contribution remaining unexpended at the completion of ._the Project.
VIII. This Agreement shall terminate either twelve (12)
months after the grant is approved by the Office of Criminal
Justice Planning or when any extensions to the Project by the
Office of Criminal Justice Planning have expired or when all funds
are expended by SANTA ANA.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the date and year first above written.

SECT; Burglary Prevention Index Agreement
Sorry to keep bugging you over this but can't,seem to get it together!
I'm attaching a copy of the unexecuted agreement along with the enabling
resolution and my memo to our file showing copies were sent to your
office for transmittal to and execution by the City of Santa Ana. They
were to return a fully executed copy for our files. This particular
agreement is apparently a continuation of Contract Ito. 1782 with the
City of Santa Ana that was executed on January 16, 1975 by Resolution
No. 8681.
I show no City Council action in regard to Contract No. 1890 (the
Dec. 15, 1976 agreement) before or after the date of December 16, 1976.
Please do what you can to secure an executed copy of the agreement as
a cony must go to our Finance Director.

RESOLUTION NO. 8956
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWHRT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE CITY OF
SANTA ANA FOR CONTINUED PARTICIPATION IN THE
ORANGE COUNTY BURGLARY PREVENTION INDEX
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the City of Santa Ana for continued
participation in the Orange County Burglary Prevention Index;
and
WHEREAS, the City Council has reviewed the terms and
conditions.of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to
authorize the Mayor and City Clerk to execute said contract;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
