AGREEMENT

THIS AGREEMENT, made and entered into by and between
the CITY OF NEWPORT BEACH, a chartered municipal corporation,
hereinafter referred to as "CITY ", and ASSESSMENT AND TREATMENT
SERVICES CENTER (ATSC) OF COASTAL ORANGE COUNTY, a duly
organized and existing nonprofit corporation, hereinafter
referred to as "ATSC "; and
WHEREAS, CITY is desirous of establishing programs as
alternatives to formal juvenile court processes for youthful
offenders, using private and non -city or county property resources;
and
WHEREAS, ATSC is a duly organized and existing nonprofit
corporation, having as its goal the diagnosing and correction
of juvenile behavior problems;
NOW, THEREFORE, in consideration of the terms, covenants,
conditions and promises to be kept, performed and observed by
the parties hereto, it is agreed as follows:

ATSC agrees to provide and conduct a community assessment
and treatment services center located at 1640 Southeast Bristol,
Santa Ana, California, for the period of January 1, 1977, through
December 31, 1977.
II
The services to be provided by ATSC to youth shall be consistent
with the goals and objectives specified in its charter, and shall
include, but not be limited to:

a. To provide psychological evaluation services and
counseling service to behaviorally disturbed
juveniles and the families of such juveniles
who have come in contact with law enforcement
agencies, as an alternative to juvenile court
proceedings.
b. To utilize probation officers, clinical psychologists
with correctional experience, technicians, and
counselors to maintain and operate clinical
facilities necessary to help such behaviorally
disturbed juveniles.
III
CITY agrees to pay ATSC Ninety Dollars ($90.00) per
juvenile offender referred by CITY to ATSC.
IV
This agreement is subject to termination by either party
with or without cause upon thirty (30) days prior written notice
of such intention to terminate.
V
Unless sooner terminated, this Agreement will expire at
midnight December 31, 1977.
VI
At no time shall employees of ATSC be considered employees
Of CITY. ATSC shall be solely responsible for providing to its
employees, all legally required employee benefits, and CITY
shall not be called upon to assume any liabilities for the
direct payment of any salaries, wages, or other compensation to
any ATSC personnel performing services hereunder or any liability
other than provided for in this Agreement.

IN WITNESS WHEREOF, CITY has caused this Agreement to be
executed by the Mayor of the Newport Beach City Council and
attested by the Clerk of said City, and ATSC has caused this
Agreement to be executed by the Chairman of its Board of
Directors to be effective as of January 1, 1977.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND ASSESSMENT AND
TREATMENT SERVICES CENTER (ATSC) OF COASTAL
ORANGE COUNTY
WHEREAS, there has been presented to the City
Council of the City of Newport Beach a certain agreement
between the City of Newport Beach and Assessment and Treatment
Services Center (ATSC) of Coastal Orange County in connection
with services to be provided for juvenile offenders; and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to authorize
the Mayor and City Clerk to execute said agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
