Application
This application requests approval of an off - site parking agreement
in conjunction with the establishment of the Voyagers Yacht Club.
In accordance with Section 20.30.035(D) of the Newport Beach Municipal
Code, the Planning Commission shall not recommend and the City Council
shall not approve off - street parking on a separate lot from the build-
ing site or sites unless:
(a) Such lot is so located as to be useful in connection
with the proposed use or uses on the building site
or sites.
(b) Parking on such lot will not create undue traffic
hazards in the surrounding area.
(c) Such lot and the building site are i.n the same owner-
ship, or the owners of the building sites have a
common ownership in such lot, and the owner or owners
are entitled to the immediate possession and use
thereof (ownership of the off -site lot must be owner-
ship in fee or a leasehold interest of a duration
adequate to serve all proposed uses on the building
site or sites).
(d) The owner or owners and the City, upon the approval
of the City Council, execute a written instrument
or instruments, approved as to form and content by
the City Attorney, providing for the maintenance of
the required off - street parking on such lot for the
duration of the proposed use or uses on the building
site or sites. Should a change in use or additional
use be proposed, the off - street parking regulations
applicable at the time shall apply. Such instruments
shall be recorded in the office of the County Recorder
and copies thereof filed with the Department of Com-
munity Development.
Suggested Action
If desired, adopt Resolution No. authorizing the execution
of an off -site parking agreement between the City of Newport Beach
and the Voyagers Yacht Club., Newport Beach.

Planning Commission Recommendation
At its meeting of February 17, 1977, the Planning Commission voted
(5 Ayes, 1 Abstain, 1 Absent) to make the following findings and to
approve Use Permit No. 1821 of the Voyagers Yacht Club, subject to
the following conditions:
A. FINDINGS:
1. That the proposed development is consistent with the
General Plan, and is compatible with the surrounding
land uses in "Cannery Village."
2. Adequate off - street parking spaces can be provided
for the proposed development.
3. The required off - street .parking spaces on a separate
lot from the building site is justifiable for the
following reasons:
a) The applicant has a long term .(five year) agreement
for the use of the off -site parking lot.
b) Said off -site parking lot is .located directly east
of the building site.
c) Both parcels are under the same ownership.
d) Parking on the subject lot will not create undue
traffic hazards in the surrounding area.
4. The proposed development will have no significant
environmental impact.
5. The Police Department has indicated that they do not
contemplate any problems.
6. The approval of Use Permit No. 1821 will not, under
the circumstances of this case be detrimental to the
health, safety, peace, morals, comfort and general
welfare of persons residing and working in the
neighborhood or be detrimental or injurious to
property and improvements in the neighborhood or
the general welfare of the City.
B. CONDITIONS:
1. That development shall be in substantial conformance
with the approved plot plan and floor plan, except
as noted in the conditions below.
2. That an off -site parking agreement shall be approved
by the City Council guaranteeing that a minimum of
twenty -three parking spaces will be provided for
members of the Voyagers Yacht Club on Parcel 1 of
Record of Survey 76/45 (Resubdivision No. 165) and
on the northerly portion of Lot 10, Subdivision of
Block 227, Section "A Newport Beach, recorded in
Book 7153, Page 993, of the Official Records of
Orange County, for the duration of the yacht club
use on the property in question.
3. That all mechanical equipment and trash areas shall
be screened from public streets, The Rhine, or
adjoining properties.
4. That a revised parking layout of the subject off -site
parking lot shall be submitted to and approved by the
City Traffic Engineer. Said plan shall consist of

approximately twenty -seven off - street parking
spaces. The spaces shall be marked with approved
traffic markers or painted white lines not less
than four inches wide.
5.
That the
two driveway approaches shown on the
plot plan
be reconstructed and widened to minimum
width of
twenty -four feet at locations to be
approved
by the City Traffic Engineer.
6.
That the
existing driveway approach on Newport
Boulevard
in the middle of Parcel 1 be closed up.
7.
That the
existing parking meter in the driveway
approach
in the northwest corner of Parcel 1 be
relocated
as directed by the City Traffic Engineer.
8.
That the
interior parking be revised to accommodate
the new driveway
approaches and be reviewed by the
City Traffic Engineer.
9.
That the
work in the Newport Boulevard right -of-
way be done
under an encroachment permit obtained
from the
.Public Works Department.
10.
That this
approval shall be for a period of five
years, and
any extension-shall be subject to the
approval
of the Modifications Committee.
Background
The applicant proposes to relocate the existing Voyagers Yacht Club
facilities from the third floor of the Lido Building at 3355 Via Lido
tothe property in question. The proposed move to a site on the water
is being requested so as to facilitate youth sailing and water safety
programs as well as promoting adult sailing activities within the club.
The applicant will utilize the rear 2,100 sq:ft.t of the former Newport
Produce Market building for its clubhouse activities. The area will
consist of a club room with bar area, an office, a board room and two
restrooms. An open deck is proposed between the structure and the
boat storage area adjacent to The Rhine. Portions of the existing
boat storage area and existing hoist on the property in question will
also be utilized in conjunction with the proposed development.
The Municipal Code does not specify an off - street parking standard for
yacht clubs. In the past, the staff has recommended and the Planning
Commission has required one parking space for each three seats in the
dining and drinking areas, and one parking space for each 250 sq.ft.
of office space. However, the staff is of the opinion that the parking
requirements should be revised in this particular case, since the
proposed development is on a much smaller scale than other recently
approved yacht clubs (i.e., Bahia Corinthian and Shark Island Yacht
Clubs), and no large eating or office areas are proposed.
Information provided by the applicant indicates that the club members
utilize approximately twenty -three vehicles per function. The twenty -
three parking spaces are proposed to be located on off -site locations
directly east of the club facilities and on the northerly side of
28th Street, between the northerly and southerly bound.lanes of Newport
Boulevard. There will be thirty -seven (37) spaces located in the lot
immediately adjacent to the Yacht Club and.an additional thirty -three
(33) spaces in the lot on 28th Street.
Attached for the City Council's information and review is a copy of the
Planning Commission staff report and an excerpt from the minutes of
the Planning Commission meeting of February 17, 1977.

Application
This application is a request to establish a yacht club facility
adjacent to Cannery Village in the C -O -Z District. In accordance
with Section 20.30.020 (b) of the Newport Beach Municipal Code,
yacht clubs may be permitted in any commercial district, subject
to the securing of a use permit in each case. Use Permit procedures
are outlined in Chapter 20.80 of the Municipal Code.
This application also requests approval of an offsite parking agree-
ment for the required parking spaces for the subject yacht club. In
accordance with Section 20.30.040 C. of the Newport Beach Municipal
Code, the Planning Commission shall not recommend and the City
Council shall not approve off - street parking on a separate lot from

Environmental Signiffcance
This project has been reviewed, and it has been determined that is
will not have any significant environmental impact.
Conformance with General Plan
The Land Use Element of the General Plan designates the site for
"Recreational and Marine Commercial" and "General Industrial" uses.
The proposed development falls within the permitted uses. The area is
also designated for a Specific Area Plan.
Subject Property and Surrounding Land Use
The subject property consists of a vacant, renovated building (formerly
occupied by the Newport Produce Market), a marine service store, and
boat storage area. To the north, across 28th Street, are two fish
markets, a restaurant, and an industrial storage area in Cannery
Village; to the east, is the 28th Street Marina on The Rhine; to
the south, is an office building, a boat storage area and related
offstreet parking lot. (The subject parking lot is utilized by all
of the uses on Parcels 1 and 2 indicated on the attached plot plan,
since both lots are owned by the same property owner); and to the
west, across Newport Boulevard (northbound) is a motel, and retail
and office uses.
Background
At its meeting of April 1, 1976, the Planning Commission approved
Use Permit No. 1779 that permitted the establishment of the Voyagers
Yacht Club facility at 2814 Lafayette Avenue in Cannery Village. The
Commission also recommended the approval of an offsite parking agree-
ment for the required parking spaces. The City Council approved the
subject offsite parking agreement at its meeting of April 12, 1976.
However, the approved yacht club site was never used by the applicant
because of leasing problems with the property owner.
Analysis
The applicant proposes to relocate the existing Voyagers Yacht Club
facilities from the third floor of the Lido Building at 3355 Via Lido
to the property in question. The proposed move to a site on the water
is being requested so as to facilitate youth sailing and water safety
programs as well as promoting adult sailing activities within the club.
The applicant will utilize the rear 2,100 sq. ft. ± of the former
Newport Produce Market building for its clubhouse activities. The
area will consist of a club room with bar area, an office, a board room
and two restrooms. An open deck is proposed between the structure and
the boat storage area adjacent to The Rhine. Portions of the existing
boat storage area and existing hoist on the property in question will
also be utilized in conjunction with the proposed development.
Offstreet Parki
The Municipal Code does not specify an offstreet parking standard for
yacht clubs. In the past, the staff has recommended and the Planning
Commission has required one parking space for each 3 seats in the
dining and drinking areas and one parking space for each 250 sq. ft.
of office space. However, the staff is of the opinion that the parking
requirements should be revised in this particular case, since the
proposed development is on a much smaller scale than other recently
approved yacht clubs (i.e. Bahia Corinthian and Shark Island Yacht
Clubs), and no large eating or office areas are proposed.
The attached information from the applicant indicates that the club
members utilize approximately 23 vehicles per function. The 23
parking spaces are proposed to be located in an offsite location
directly east of the club facilities.

T0: Planning Commission - 3.
As indicated on the attached plot plan,31 offstreet parking spaces
are provided immediately adjacent to the yacht club site. In addi-
tion, the property owner is now in the process of relocating a chain
link fence so as to enlarge the existing parking lot. Approximately
37 parking spaces will be provided on the expanded lot, which will
be adequate for both the proposed and existing uses on the site.
Sixteen (16) parking spaces are required for the retail and office
uses, including the vacant retail space proposed in the front portion
of the former Newport Produce Market building. However, all of the
proposed 27 parking spaces will be available during the evening hours
when most of the yacht club activities occur and the adjoining uses
are closed. There are only two Saturdays a year when the clubhouse is
used at the same time that the retail uses are open for business.
There will still be an adequate number of parking spaces for the joint
use of the subject parking lot, since only 9 parking spaces are
required for the retail space. Most of the office uses will be
closed on weekends.
The property owner has also indicated that the members of the Voyagers
Yacht Club may use the 33 space parking lot located on the northerly
side of 28th Street between the northerly and southerly lanes of
Newport Boulevard (see attached vicinity map). The property owner
has owned this parcel for over fifteen years, and the site has been
utilized as a parking lot for the 28th Street Marina and adjoining
boat slips for the past ten years. Only 15 of the 33 parking spaces
are required for the 20 boat slips adjoining the subject property,
based upon the Ordinance requirement of 0.75 parking spaces for each
boat slip.
Specific Findings and Recommendation
Section 20.80.060 of the Newport Beach Municipal Code provides that
in order to grant any use permit, the Planning Commission shall find
that the establishment, maintenance or operation of the use or
building applied for will not, under the circumstances of the particular
case, be detrimental to the health, safety, peace, morals, comfort
and general welfare of persons residing or working in the neighborhood
of such proposed use or be detrimental or injurious to property and
improvements in the neighborhood or the general welfare of the City.
Staff recommends approval of Use Permit No. 1821 and suggests that
the Planning Commission make the following findings in conjunction
with the applicant's request:
1. The proposed development is consistent with the General
Plan, and is compatible with the surrounding land uses
in "Cannery Village."
2. Adequate offstreet parking spaces can be provided for the
proposed development.

We are submitting the following information as part
of our Use Permit application.
Voyagers Yacht Club.is looking foward to obtaining the
proposed water front property so that we may increase our
youth sailing activities and get more people with dinghys
on the water as well as providing on -the -water boating safety
instructions to all members.
Voyagers Yacht Club, unlike most Yacht clubs in the
in.the Newport area, can be considered a limited function
Yacht club for the following reasons:
1. Club functions are limited to one or two nights
per month from 1730 to 2300hrs.
2. All board meetings are conducted from 1930 to 2300hrs.
on the first Thursday of each month.
3..,All services and labor are provided by Club members
on a voluntary basis
4. The Club facilities are not in use during the week-
day hours.
5. There are only two Saturdays a year when the Club
is used during the hours of 0800 to 1300.
6. The Club does not have kitchen facilities for the
preparation of full course meals.
In conclusion, we are a sailing oriented Yacht Club
whose primary interest is sailing and water safety. Our social
functions are limited to one or two evenings a month and
two Saturday mornings a year.

Dear Commodore Woods:
The following parking agreement is being submitted to you as per
the requirements of the City of Newport Beach:
I, Mike Singer, acting as agent for Mary J. Singer (lessor), do
hereby agree to unconditionally provide Voyagers Yacht Club
(lessee) with thirty -seven (37) joint -use parking spaces for the
length of the lease, with provisions therein to extend this agree-
ment with any additional renewals of said lease.

CITY CLERK TO EXECUTE AN OFF -SITE PARKING �-
AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH / v�
AND VOYAGERS YACHT CLUB
WHEREAS, there has been presented to the City Council
of the City of Newport Beach an off -site parking agreement
between the City of Newport.Beach and Voyagers Yacht Club;
and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to
authorize the Mayor and City Clerk to execute said agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
