all necessary equipment sad hardware to tie that
three osistihg wells into one vent and attach s
vacuum pump of, sufficient slim to dispel the gas
at approxlmatoly 15% above its natural floc rate.
2. To proper* plans and ostimates and administer Say
Service bents or Contracts awerded to aecom-
plish the work.
3. To submit reeeipted bills daouauaating the actual
cost of asoomplishing the work to State within
30 days after completion.
4. To iaclud* State in its liability iasureenoe policy
in the amount of #5,000,000.00 in eegmmeation with
the censtrustion and eperaties of the abavo-
dos*ribed facilities and Say damages to surrounding
properties.
5. To accept the full responsibility for the operation

hardware► during and after installation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND .
CITY CLERK TO EXECUTE A COOPERATIVE AGREEMENT
BETWEEN THE CITY OF NEWPORT BEACH AND THE
STATE OF CALIFORNIA,.DEPARTMENT OF TRANSPORTA-
TION,FOR SHARING THE GEOLOGIC TESTING AND
INVESTIGATION IN CONNECTION WITH THE NOXIOUS GAS
SEEPAGE CONTROL PROBLEM IN WEST NEWPORT
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a Cooperative Agreement between
the City of Newport Beach and the State of California, Depart-
ment of Transportation, for sharing the geologic testing and
investigation in connection with the noxious gas seepage
control problem in West Newport;. and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to
authorize the Mayor and City Clerk to execute said agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council .
of the City of Newport. Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to.execute.the same on behalf of the City of.
Newport Beach.
