considered before taking action.
Presently G.K. Boston Company is contracted to maintain and
clean the lower Newport Harbor and upper bay log boom for a
total of 32 hours per week. At this time we are spending over
40 hours per week not only on maintenance, but on Public Relations
and various functions surrounding the well being of our City.
Since 1975, when my company and the City began its association,
we have become very skilled on the techniques and equipment
needed to do our job. Should a disaster occur, we can give the
City of Newport Beach the best services available.
�ue to 'i7nicipal Code 17.32,040, I have been unable to clean
around individual docks and other areas in the harbor which
are in need of cleanup. If the scope of my work remains unchanged,
I will require no increase in funds. Should the scope of work
increase, I would be happy to work out a new proposal.
As an example of my own experience of a Municipality attempting
to maintain their harbor, I would like to tell you of Huntington
Beach's experience with this. Prior to the contract between

G.M. Boston Company and The City of Huntington Beach, the City
was attempting to maintain their harbor with City equipment
and personnel. The most prevalent problem they encountered
during this period of time was that of the number of complaints
from citizens in their area. Because it was a "City maintained"
function, the public felt that they were not receiving adequate
maintenance and cleanup for their tax dollar. The City employees
lacked the ability in areas of Public Relations and community
involvement, and after many problems with the community and
their own employees, Huntington Beach decided that it would be
more beneficial for them to hire an outside contractor to
take care of their harbor. G.M. Boston Company has been under
a contract with the City of Huntington Beach for over three
years, with mutual satisfaction on both ends.
In closing, I would like to thank you for your time in considering
this matter of utmost importance. I would like an opportunity
to meet with all of you in the near future so that I can go into
further detail on certain items, and answer any questions that
you might Pave.

HARBOR DEBRIS COLLECTION
AMENDED
THIS AGREEMENT, made and entered into this /Z-day o ,
1982, by and between THE CITY OF NEWPORT BEACH, a Municipal Corporation,
hereinafter referred to as "CITY" and G. M. BOSTON & ASSOCIATES,
hereinafter referred to as "CONTRACTOR ", is an amendment to that certain
agreement entered into between the parties hereto on September 21, 1977
and amended as to term and compensation on October 1, 1979 and December
11, 1980.
RECITALS
A. CITY has determined that the waters of Newport Harbor are pub-
lic navigable waterways heavily used by boaters, beach users, tourists
and sightseers, and that one of the impacts from this use is floating
litter and debris.
B. CITY has determined that the Harbor would benefit by having
this litter and debris collected and removed and that a private con-
tractor can most economically perform this collection and removal.
AGREEMENT
NOW, THEREFORE, it is hereby agreed by and between the parties here-
to as follows;
In consideration of the sum of NINETEEN THOUSAND FORTY EIGHT DOLLARS
($19,048.00) per year, to be paid to CONTRACTOR by CITY in twelve (12)
equal payments of ONE THOUSAND FIVE HUNDRED EIGHTY SEVEN AND THIRTY
THREE CENTS ($1,587.33), the first such payment to be due and payable on
the 15th day of the month next succeeding the month during which
CONTRACTOR commences the work described herein, and such subsequent
payment to be payable on the 15th day of the month following the month
during which the latest payment was made. CONTRACTOR agrees to provide
all necessary labor, materials, transportation and equipment required to
collect and remove litter and debris, as described in this agreement,
for a period of three (3) years, commencing on the 14 day of cOpr��
1982. Said work shall consist of the following items and shall be on
the following terms and conditions provided for herein.
As additional compensation, CONTRACTOR shall be paid TWO THOUSAND
FOUR HUNDRED DOLLARS ($2,400.00) in twelve (12) monthly installments of
TWO HUNDRED DOLLARS ($200.00) per month for the additional work outlined
in paragraph (6) under SCOPE OF WORK.
SCOPE OF WORK
1. Area of Responsibility
(a) Lower Newport Bay, including the West Newport
Channels, Promontory Bay, Grand Canal, The Thrine, the navig-
able portion of the bay and those portions adjacent to the
shoreline that are under City jurisdiction.
(b) The Upper Bay debris log boom.. Areas encumbered by
commercial and leased areas and private pier, slips and
beaches are excluded.
(2) Specifications for Work
(a) General
1. Contractor will collect and remove litter and debris
from the Bay in the areas described above on a daily
basis Monday through Friday, exception legal holidays,
for a minimum of 32 hours per week.
2. Contractor will collect floating litter and debris
including but not limited to cans, bottle, paper, plastics,
timbers, poles, trees, scrappings, landings, dead birds
and animals, kelp and other marine growth, yard trimmings,
construction debris and enteramorphogous growth.
3. Minimum equipment required is a registered boat equipped
with skimmers and nets and containers sufficient to
transport litter and debris to a disposal site.
4. Contractor will dispose of all litter and debris off site
in an approved disposal area. Larger poles or trees will
be cut to a size acceptable at the disposal area.
5. Contractor is required to maintain an office provided with
telephone service during normal working hours within thirty
(30) minutes driving time from the location at which his
work vessel is moored. Contractor is further required to
provide City with an emergency number for contact outside
normal working hours.
6. In addition to a minimum of thirty -two (32) hours per
week, the contractor shall inspect the Upper Bay debris
log boom weekly and remove what debris has accumulated
there.
EXTRA WORK
(1) When hazards to navigation occur due to debris resulting from
storm conditions, seasonal excessive marine growth or other intermittent conditions,
contractor may be required to perform extra work as directed by the Marine Director.
(2) Contractor will be reimbursed for extra work at his actual cost
for labor plus twenty (20) percent. There will be no additional reimbursement for
extra use of equipment. The actual cost will be based upon hourly figure submitted
as a part of the contractor's proposal.
INSPECTION
Contractor will report to the Marine Director on alternate Fridays
approximate quantities of litter and debris collected and those areas where unusual
concentration of litter and debris have collected subsequent to the prior reporting
date. Contractor will also submit to the Marine Director a report of hours worked
subsequent to the prior reporting date.
CONTROL OF WORK
The City of Newport Beach Marine Director shall decide all questions
which may arise as to the quality of acceptability of materials furnished and
work performed; all questions which may arise as to the interpretation of the
specifications; all questions as to the acceptable fulfillment of the contract on
the part of CONTRACTOR; and all questions as to compensation. His decision shall
be final and he shall have authority to enforce and make effective such decisions
and orders which CONTRACTOR fails to carry out promptly and deduct the cost thereof
from the payments made to CONTRACTOR.
ICIUMMUS
(1) CONTRACTOR shall deposit with the CITY a certificate of Workmen's
Compensation Insurance policy, which shall be in accordance with the laws of the
State of California.
(2) CONTRACTOR shall deposit with the CITY a certificate of Insurance
on forms provided by the City which shall evidence the fact that CONTRACTOR has in
full force and effect a comprehensive Bodily Injury and Property Damage insurance
policy in amounts and coverages of not less than that which is set forth in said
City form.
(3) The policy shall name the City of Newport Beach as an additional
insured. In addition, the policy shall provide that it cannot be cancelled without
at least thirty (30) days notice to CITY.
CONTRACT EXTENSION OR TERMINATION
(,1) The duration of the Agreement may be extended so long as the
parties hereto mutually agree in writing with respect to each such extension at
least thirty (30) calendar days prior to the date on which the contract or an
extension thereof would otherwise have terminated.
(2) This Agreement may be terminated for any reason by thirty (30)
days prior written notice of intent to terminate, which notice may be given by
either party to the other party to such agreement.

AMENDMENT TO
HARBOR DEBRIS COLLECTION AGREEMENT
THIS AGREEMENT, entered into this //2��day
of 1980, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred to
as "City," and G. M. BOSTON & ASSOCIATES, hereinafter referred to
as "Contractor," is made with reference to the following facts:
1. On September 21, 1977, City and Contractor entered into
a Harbor Debris Collection Agreement; and
2. On October 1, 1979, the City Council of the City of
Newport Beach approved an extension of said Agreement for one
year commencing September 21, 1979, and increased the amount of
annual compensation for work performed by Contractor eight
percent (8 %), to $15,742.08; and
3. Both parties desire to amend said Agreement to extend
the term thereof for an additional one (1) year period, to
September 21, 1981; and

4. Both parties desire to further amend said Agreement to
increase the annual compensation for work performed by ten
percent (108), to $17,316.20.
NOW, THEREFORE, in consideration of the foregoing, the
parties hereto agree as follows:
A. Page one of the Harbor Debris Collection Agreement dated
September 21, 1977, is amended in part to read as follows:
"Agreement. In consideration of the sum of
Seventeen Thousand Three Hundred Sixteen
Dollars and Twenty Cents ($17,316.20) to be
paid to Contractor by City in twelve (12)
equal payments of One Thousand Four Hundred
Forty -Three Dollars and One Cent ($1,443.01),
the first such payment to be due and payable
on the fifteenth (15th) day of the month next
succeeding the month during which Contractor
commences the work prescribed herein and such
subsequent payment to be payable on the fif-
teenth (15th) day of the month following the
month during which the latest payment was

made. Contractor agrees to provide all neces-
sary labor, materials, transportation and
equipment required to collect and remove lit-
ter and debris as described in this Agreement
for a period of one (1) year commencing on
September 21, 1980. Said work shall consist

B. All other terms and conditions not inconsistent herewith
shall remain in full force and effect.

a. Adopt Resolution # M;L- authorizing the City Council to extend
Contract #1936 with G. M. Boston & Associates for a twelve (12)
month period.
b. Approve an amendment to the above contract to allow .a ten per-
cent (10 %) increase in compensation to the contractor.
Discussion:
On September 21, 1977, the City Council awarded Contract #1936 to G. M. Boston
& Associates for the removal of floating debris from the waters of Newport Harbor.
This Contract provides that the "Agreement may be extended for successive one -year
periods so long as the parties hereto mutually agree in writing."
The Contract last year totaled $15,742, with funding shared equally between the
City and the County of Orange, under a cooperative agreement previously approved
by the City Council. This agreement provides for participation by the County up
to $10,000, with "annual renewal subject to the approval of the County's Director
of the Environmental Management Agency." The City received that approval on Octo-
ber 1, 1980 (letter attached).
The contractor, G. M. Boston & Associates, has submitted a request (letter attached)
for a twelve (12) month extension with a ten percent (10 %) increase, due to rising
overhead costs. The new contract total would be $17,316.20. Under the terms of
the above mentioned City /County Agreement, $8,658.10 would be paid by the County
and a like amount by the City.
The contractor has performed to the satisfaction of the Marine Department and the
overall project is being well received by the public.

Recommendation
If desired, approve the extension of Contract #1936 for a twelve month
period beginning September 21, 1979 with an (8) eight percent inflation-
ary increase.
Discussion
On September 21, 1977, the City Council awarded Contract #1936 to Gregg
Boston and Associates for the removal of floating debris from the waters
of Newport Harbor.
This Contract provides that the "Agreement may be extended for successive
one year periods so long as the parties hereto mutually agree in writing."
The amount of the contract was $14,576 with the funding shared equally
between the City and the County of Orange under a cooperative agreement
approved by City Council. This cooperative agreement provides for
participation by the County of up to $10,000 with "annual renewal subject
to the approval of County's Director EMA ". A request has been submitted
to the County for the renewal of their share of the funding for this
contract. The Council.approved the expenditure of $15,000 (half City
and half County) in their 1979 -80 budget.
The contractor has performed to the satisfaction of the Marine Department
for the past year, and the overall project is being well received by the
public.
The contractor has submitted a request (copy attached) for a (12) twelve
month extension with an (8) eight percent increase due to rising gasoline
and operational costs. The new contract total would be $15,742.
The Marine Department will submit a mid -year budget adjustment request to

AGREEMENT
This agreement is made and entered into.,thi&W-day ofil 14.77,
by and between the City of Newport Beach, a municipal corporation, hereinafter
referred to as "City" and G.M. Boston & Assoc. hereinafter referred to as
"Contractor ".
RECITALS
(i) City has determined that the waters of Newport Harbor are public
navigable waterways heavily used by boaters, beach users, tourists, and sightseers
and that one of the impacts from this use is floating litter and debris.
(.ii) City has determined that the Harbor would benefit by having this
litter and debris collected and removed and that a private contractor can most
economically perform this collection and removal.
AGREEMENT
THEREFORE, it is hereby agreed by and between the parties hereto
as follows:
In consideration of the sum of Fourteen Thousand Five Hundred Seventy-
six dollars to be paid to CONTRACTOR by CITY in twelve (12) equal payments of
One thousand two hundred fourteen and sixty -six cents the first such payment
to be due and payable on the fifteenth (15th) day of the month next succeeding the
month during which CONTRACTOR commences the work prescribed herein and.such subsequent
payment to be payable on the fifteenth (15) day of the month following the month
during which the latest payment was made. CONTRACTOR agrees to provide all necessary
labor, materials, transportation and equipment required to collect and remove litter
and debris as described in this agreement for a period of one (1) year commencing on

shoreline that are under City jurisdiction. Areas encumbered by commercial and
]eased areas and private pier, slips and beaches are excluded.
Specifications for Work

(a) General

from the Bay in the areas described above on a daily basis
Monday through Friday, exception legal, holidays, for a
minimum of 32 hours per week.
2. Contractor will collect floating litter and debris including
but not limited to cans, bottles,.,paper, plastics, timbers,
poles, trees, scrappings, landings; dead animals and birds,
kelp and other marine growth, yard trimmings, construction
debris and entomophagous growth.
3. Minimum equipment required is a registered boat equipped
with skimmers and nets and containers sufficient to.
transport litter and debris to a disposal site.
4." Contractor will dispose of all litter and debris off site
in an approved disposal: area. Larger poles or trees will
be cut to a size acceptable at the disposal area.
5. Contractor i.s required to <Maintain an office provided with
telephone service during normal working hours within thirty
(30) minutes driving time from the location at which his work
vessel is moored. Contractor is further required to provide
City with an emergency number for contact outside normal
working hours.
EXTRA WORK
(1) When hazards to navigation occur due to debris resulting from
storm conditions, seasonal excessive marine growth.or other.intermittent conditions,
contractor may be required to perform extra work as directed by the Marine Director.
(2) Contractor will be reimbursed for extra.work at his actual cost
for labor plus twenty (20) percent. There will be no additional reimbursement for
extra use of equipment. The actual cost will be based upon hourly figure submitted
as a part of the contractor's proposal.

City may accompany contractor at its option for the purpose of inspect-
ing the execution of the work to be performed.
REPORTING OF WORK COMPLETED
Contractor will report to the Marine Director on alternate Fridays
approximate quantities of litter and debris collected and those areas where unusual

CONTROL OF WORK
The City of Newport.Beach Marine Director shall decide all _questions
which may arise as to the quality of acc pi} #'Cy of materials furnished and
work performed; all questions which may as, to the interpretation of the
specifications; all questions as to the acceptable fulfillment of the contract on
the part of CONTRACTOR; and all questions as to compensation. _His decision shall I
be final and he shall have authority to enforce and make effective ^such decisions
and orders which CONTRACTOR fails to carry out promptly and deduct the cost.thereof
from the payments made to CONTRACTOR.
INSURANCE
(1) CONTRACTOR shall deposit with the CITY a certificate of Workmen's
Compensation Insurance policy, which shall be in accordance with the laws of the
State of California.
(2) CONTRACTOR shall deposit with the CITY a certificate of insurance
on forms provided by the City which shall evidence the fact that CONTRACTOR has in
full force and effect a comprehensive Bodily Injury and Property Damage insurance
policy in amounts and coverages of not less than that which is set forth in said
City form.
(3) The policy shall name the Ctty of Newport Beach as an additional
insured. In addition, the policy shall provide that it cannot be cancelled without
at least thirty (30) days notice to CITY.
CONTRACT EXTENSION OR TERMINATION
(1) The duration of this Agreement may be extended for successive
one year periods so long as the parties hereto mutually agree in writing with
respect to each such extension at least thirty (30) calendar days prior to the
date on which the contract or an extension thereof would otherwise have terminated.
(2) This Agreement may be terminated for any reason by thirty (30)
days prior written notice of intent to terminate, which notice may be given by
either party to the other party to such agreement.

WHEREAS, pursuant to the notice inviting bids for
work in connection with the harbor debris clean -up program,
in accordance with the plans and specifications heretofore
adopted, bids were received on the 2Sth day of August, 1977,
and publicly opened and declared; and
WHEREAS, it appears that the lowest responsible
bidder therefor is G. M. BOSTON & ASSOCIATES;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the bid of G. M. Boson &
Associates for the work in the amount of $14,576.00 be accepted,
and that the contract for the described work be awarded to
said bidder;
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized and directed to execute a contract in
accordance with the specifications, bid and this award on

Recommendation
If desired, approve the extension °r a twelve month period
beginning September 21, 1978.
Discussion
On September 21, 1977, the City Council awarded Contract #1936 to Gregg Boston
and Associates for the removal of floating debris from t e waters of Newport
Harbor.
This contract provides that the "Agreement may be extended for successive one
year periods so long as the parties hereto mutually agree in writing."
The amount of the contract was $14,576 with the funding shared equally between
the City and the County of Orange under a cooperative agreement approved by
City Council. This cooperative agreement provides for participation by the
County of up to $10,000 with "annual renewal subject to the approval of County's
Director, EMA. ". A request has been submitted to the County for renewal of
their share of the funding for this contract.
The Council approved the expenditure of $15,000 (half City and half County) in
their 1978 -79 budget.
The contractor has performed to the satisfaction of the Marine Department for
the past year and the overall project has been well received by the public.
The contractor has submitted a request for a twelve (12) month extension at
the same contract price.

Discussion
On June 27, 1977 the Council:
a) Adopted a resolution authorizing joint funding with the County of Orange
for this contract;
b) Approved the bid documents; and,
c) Authorized the advertising for bids to be opened on July 25.
Because of•the delays in approval and execution of the agreement by the County,,
the opening of bids was postponed until August 26, 1977.
One bid was received and opened in the Marine Department office at 2:00 p.m.
on August 26, 1977.
