(Public Works) this date. eg • 0 AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES REPORT ON STRUCTURAL CONDITION OF BALBOA ISLAND BRIDGE THIS AGREEMENT is made and entered into this ! i -t�, day of 1977, by and between the City of Newport Beach, a municipal corporation, hereinafter referred to as "CITY ", and the firm of Boyle Engineering Corporation, hereinafter referred to as "ENGINEER ". WITNESSETH: WHEREAS, CITY intends to conduct a study of the structural condition of the Balboa Island Bridge and to have its findings compiled into a document hereinafter referred to as "REPORT "; and WHEREAS, ENGINEER has submitted a proposal to CITY to perform engineering services in connection with the preparation of said REPORT; and WHEREAS, CITY desires to accept said proposal; NOW THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by ENGINEER ENGINEER agrees to perform the following services. 1. Perform a visual inspection of pilings,substructure, super- structure, and deck, supplemented by diver inspection. 2. Analysis of settlement problems. 3. A check of the live load and dead load capacities of the bridge. 4. Perform an earthquake evaluation using "Caltrans" design criteria. 5. Analyze and compile recommendations and findings of the soils report being prepared by Converse, Davis, Dixon Associates, Consulting Engineers and Geologists, and the concrete testing report being prepared by H. V. Lawmaster and Company Inc., Testing and Inspection Engineers; and incorporate in the report. 6. Recommendations for repair of the bridge. - 1 - follows: 0 III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following: 1. Soils Report, and Concrete Testing Report. 2. Personnel assistance to ENGINEER during visual inspection of bridge for boat operation and note taking. 3. Current horizontal and vertical control data on bridge structure. 4. Construction drawings of the bridge. 5. Any additional information available which the parties hereto agree may be beneficial to the preparation of the Report. IV. Ownership of Report Documents Original drawings, reports, notes, maps and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. V. Engineer in Charge James W. Bradford, RCE No. 11106, SE No. 1020, shall be the Engineer in charge of REPORT preparation. VI. Completion of REPORT Two (2) copies of a draft REPORT shall be completed and sub- mitted to CITY by November 1, 1977. Five (5) copies of the final REPORT shall be submitted to CITY within 30 calendar days following ENGINEER's receipt of CITY's comment on the draft REPORT. VII. Fee Schedule and Payment In consideration of the performance of the above described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Twelve Thousand Five Hundred Dollars ($12,500.00), except as otherwise pro- vided herein. A. Hourly rates for office and field personnel shall be as - 2 - VIII 0 0 Consulting Engineer $50.00 /hr Principal Engineer $45.25/hr Senior Engineer $39.00 /hr Associate Engineer $33.25/hr Assistant Engineer $28.50/hr Senior Draftsman $25.00 /hr Draftsman $22.50/hr Clerical $11.50 /hr B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (90 %) of the maximum fee; 2. Balance of the total amount earned to be paid upon completion of work specified in Section II (Services to be Performed by ENGINEER), or by January 1, 1978, whichever occurs first; 3. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said REPORT and related documents, as well as computer costs, plus ten percent (10 %) and other related costs authorized by the Public Works Director and advanced by ENGINEER. Right of Termination CITY reserves the right to terminate this agreement at any time by giving ENGINEER seven (7) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER's business office at 1501 Quail Street, Newport Beach, California 92663. In the event of termination due to errors, omissions or negligence of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER for that portion of the work affected by such errors, omissions or negligence of the ENGINEER. If this agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. IX. Amendment The scope of services to be furnished by ENGINEER may be changed - 3 - E 0 and the maximum fee amended upon prior written approval of the Public Works Director, except that any increase in the maximum fee exceeding Twelve Hundred and Fifty Dollars ($1250.00) shall be approved by City Council. X. Assignment This agreement or any portion thereof shall not be assigned without the written consent of the CITY. XI. Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, omissions or negligence in the ENGINEER's performance of the engineering work and services required by this agreement except for that portion of the work prepared and provided by the CITY and defined in Section III. LAWMASTER TESTING ENGINEERS IN CONNECTION WITH A REPORT ON STRUCTURAL CONDITION OF BALBOA ISLAND BRIDGE WHEREAS, there has been presented to the City Council of the City of Newport Beach certain professional engineering services agreements between the City of Newport Beach and Boyle Engineering Corporation; Converse, Davis, Dixon Associates; and H. V. Lawmaster Testing Engineers for the preparation of a Report on Structural Condition of the Balboa Island Bridge; and WHEREAS, the City Council has reviewed the terms and conditions of said agreements and finds them to be satisfactory and that it would be in the best interest of the City to authorize the Mayor and City Clerk to execute said aforementioned agreements; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said agreements above described are hereby approved, and the Mayor and City Clerk are authorized and directed to execute the same on behalf of the City of Newport Beach.
