(Public Works) for transmittal to Engineers. eg 1 F AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES CONCRETE AND STEEL TESTING REPORT ON BALBOA ISLAND BRIDGE THIS AGREEMENT is made and entered into this 4z day of {� , 1477, by and between the City of Newport Beach, a municipal corporation, hereinafter referred to as "CITY" and the firm of H. V. Lawmaster and Company Incorporated, Testing and Inspection Engineers, hereinafter referred to as "ENGINEER ". WITNESSETH WHEREAS, CITY is contracting with the firm of Boyle Engineering Corporation, hereinafter referred to as " BOYLE" for the preparation of a "Report on the Structural Condition of Balboa Island Bridge ", hereinafter referred to as "BRIDGE REPORT "; and WHEREAS, CITY intends to have a Concrete and Steel Testing Report, hereinafter referred to as "TESTING REPORT ", prepared to provide input to BOYLE during preparation of the BRIDGE REPORT: and WHEREAS, ENGINEER has submitted a proposal to CITY to perform engineer- ing services in connection with the preparation of said TESTING REPORT; and WHEREAS, CITY desires to accept said proposal; NOW THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by ENGINEER ENGINEER agrees to perform the following services: 1. Secure six (6) four inch diameter cores, two (2) from deck, two (2) from girder, one (1) from pile cap, and one (1) from pile. 2. Perform compression tests on all six (6) cores. 3. Perform analysis to determine the proportion of cement and aggregate in four (4) samples of the concrete (deck, girder, pile cap, and pile). - 1 - 0 0 4. Secure - four (4) samples (testable) of reinforcing steel. Steel will be machined from square bar ends to round bar ends to allow standard testing. 5. Lap weld two (2) pieces of reinforcing steel for testing. 6. Perform two (2) tensile tests (one on "as received" steel and one (1) on lap welded steel) to provide yield point, ultimate strength, and elongation. 7. Perform one (1) bend test on an "as received" sample of reinforcing steel. 8. Present the results of the above tests in a letter type report. 9. Coordinate preparation of the TESTING REPORT with BOYLE's preparation of the BRIDGE REPORT. III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following; 1. Staging and scaffolding for use by the coring crew to reach sample areas. 2. Water transportation to sample areas. 3. Traffic control, cleanup of sample locations, and patching of deck surface. 4. Any additional information available which the parties hereto agree may be beneficial to the preparation of the TESTING REPORT. IV. Ownership of TESTING REPORT Documents Original drawings, reports, notes, maps and other documents shall become the property of the CITY and may be reproduced and used as deemed necessary by the Public Works Director. V. Principal in Charge H. V. Lawmaster shall be the Principal in charge of TESTING REPORT preparation. VI. Completion of Report Two (2) copies of a draft TESTING REPORT shall be submitted to CITY by September 15, 1977. Five (5) copies of the final TESTING REPORT shall be submitted to CITY for incorporation into BOYLE's BRIDGE REPORT by October 15, 1977. VII. Fee Schedule and Payment In consideration of the performance of the above described - 2 - i engineering services, CITY hereby agrees to pay ENGINEER a lump sum amount which in no event shall be greater than Two Thousand Dollars ($2000,00), except as otherwise provided herein. The contract amount shall be paid to ENGINEER upon acceptance by CITY of the final TESTING REPORT. VIII, Right of Termthation CITY reserves the right to terminate this agreement at any time by giving ENGINEER three (3) days prior written notice; notice shall be deemed served upon deposit in the United States mail, postage prepaid, addressed to any of ENGINEER's business offices. In the event of termination due to fault of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER. If this agreement is terminated for any reason other than fault of ENGINEER, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. IX. Amendment The scope of services to be furnished by ENGINEER may be changed and the maximum fee amended upon prior written approval of the Public Works Director, except that any increase in the maximum fee exceeding Five Hundred Dollars ($500.00) shall be approved by the City Manager. X. Assignment This agreement or any portion thereof shall not be assigned without the written consent of the CITY. XI. Hold Harmless ENGINEER shall assume the defense of and indemnify and save harmless the CITY, and its officers and employees, from all claims, loss, damage, injury, and liability, directly arising from any errors, om:i:ssions, or negligence in ENGINEER's per- formance of this agreement or from the engineering work and services herein provided. - 3 - CIT P" EWPORT BE By: Mayor CITY H. 0 M. 4k4 Ply 0 RESOLUTION NO. 9 j 6 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE PROFESSIONAL ENGINEERING SERVICES AGREEMENTS WITH BOYLE ENGINEERING CORPORATION, CONVERSE, DAVIS DIXON ASSOCIATES AND ji. {T T. nt"T� $�i" MTWCr -u T�'S'IN CONNECTION WITH A REPORT ON RAL CONDITION OF BALBOA ISLAND BRIDGE WHEREAS, there has been presented to the City Council of the City of Newport Beach certain professional engineering services agreements between the City of Newport Beach and Boyle Engineering Corporation; Converse, Davis, Dixon Associates; and H. V. Lawmaster Testing Engineers for the.preparation of a Report on Structural Condition of the Balboa Island Bridge; and WHEREAS, the City Council has reviewed the terms and conditions of said agreements and finds them to be satisfactory and that it would be in the best interest of the City to authorize the Mayor and City Clerk to execute said aforementioned agreements; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said agreements above described are hereby approved, and the Mayor and City Clerk are authorized and directed to execute the same on behalf of the City of Newport Beach.
