Minney, Newport Beach OWNER: Minney Family Enterprises, Inc., Newport Beach Application This application requests approval of an off -site parking agreement for a portion of the required parking spaces for the proposed Josh Slocum's Restaurant. In accordance with Section 20.30.035 D. of the Newport Beach Municipal Code, the Planning Commission shall not recommend and the City Council shall not approve off - street parking on a separate lot from the building site or sites unless: (a) Such lot is so located as to be useful in connection with the proposed use or uses on the building site or sites. (b) Parking on such lot will not create undue traffic hazards in the surrounding area. (c) Such lot and the building site are in the same ownership, or the owners of the building sites have a common ownership in such lot, and the owner or owners are entitled to the immediate possession and use thereof (ownership of the off - site lot must be ownership in fee or a leasehold interest of a duration adequate to serve all proposed uses on the building site or sites). (d) The owner or owners and the City, upon the approval of the City Council, execute a written instrument or instruments, approved as to form and content by the City Attorney, providing for the maintenance of the required off - street parking on such lot for the duration of the proposed use or uses on the building site or sites. Should a change in use or additional use be proposed, the off - street parking regulations applicable at the time shall apply. Such instruments shall be recorded in the office of the County Recorder and copies thereof filed with the Department of Community Development. , t . TO: City Council - 2. Suggested Action If desired, adopt Resolution No. authorizing the execution of an off -site parking agreement with Joseph A. Minney, Newport Beach. Planning Commission Recommendation At its meeting of August 4, 1977, the Planning Commission voted (6 Ayes, 1 Absent) to recommend the approval of the requested off -site parking arrangement with the findings and subject to the conditions of ap- proval as follows: A. FINDINGS: 1. The off -site parking lot is approximately 350 ft. from the restaurant site and is so located to be useful to the restaurant facility. 2. The off -site parking spaces will not create undue traffic hazards in the surrounding area. 3. A minimum five year lease agreement for the off -site parking spaces will be approved by the property owner after a one year trial period if no problems occur. The existing off -site parking agreement is on an annual basis only. 4. The Police Department has indicated that they do not contemplate any problems with the off -site parking lot. B. CONDITIONS: 1. That the operation of the restaurant shall be limited to the hours of 4:30 P.M. through 2:00 A.M., Monday through Friday,and from 8:00 A.M. through 2:00 A.M. on Saturday and Sunday, provided the applicant can obtain an amended lease agreement. These hours may be adjusted by the Planning Commission provided satis- factory parking can be provided in another location. 2. That an off -site parking agreement shall be approved by the City Council, guaranteeing that a minimum of twenty -six parking spaces shall be provided at the rear of Mariners' Mile Square on Parcel 2 of Parcel Map 73 -23 during all hours of operation of the restaurant facility. 3. That a valet service shall be provided on the restaurant site during all hours of operation. 4. That a diagram shall be provided at the entrance of the restaurant complex showing the location of the off -site parking spaces for the benefit of the customers. 5. That sixteen parking spaces shall be maintained on the restaurant site in accordance with the approved parking layout. Said parking spaces shall be marked with approved traffic markers or painted white lines not less than four inches wide. Wheel stops shall be provided adjacent to the westerly side property line so as to keep parked automobiles from damaging the existing fence between the subject property and the adjoining Ancient Mariner Restaurant site. 6. That the parking arrangement be subject to review by the Modifications Committee one year after approval of the off -site parking agreement by the City Council. TO: City Council - 3. Environmental Significance This project has been reviewed, and it has been determined that it is categorically exempt under Class 1 (i.e. Existing Facilities) and Class 11 (Accessory Structures), from the requirements of the California Environmental Qualities Act. Conformance with General Plan The Land Use Element of the General Plan designates the site for "Recreational and Marine Commercial" uses. The existing restaurant development falls within the permitted uses. Subject Property and Surrounding Land Use The former Le Rendezvous Restaurant is located on the property in question. The restaurant is now closed for renovation and will open for business in approximately two months. No additional "net public area" is proposed. The proposed use will be named Josh Slocum's Restaurant. To the north across West Coast Highway, is the Mariners Mile Square commercial complex and related offstreet parking spaces. The offsite parking spaces required for Josh Slocum's Restaurant are proposed to be located on the Mariners Mile Square property. To the east, is the Newport Marine electronics facility and a residential use; to the south, is Newport Bay; and to the west, is the Ancient Mariner Restaurant and then the Beachcomber Shops. Background The subject restaurant was build in 1968 without a use permit and at a time when the parking requirement was based upon one space for each three seats (occupant load). In addition to the serving of food and on -sale alcoholic beverages, the restaurant use at various times has included live entertainment and dancing. However, dancing has not been provided for over a period of one year and the former owner of the business did not have a Cafe Dance Permit. Therefore, any change in the operational characteristics of the establishment from those which existed under the previous use, such as a new request for dancing, would require a use permit and would allow the Commission and staff to evaluate the parking requirements based upon the current standards which are based on net public area. When the restaurant was originally established, it had an occupant load of 65 persons and a parking requirement of 22 spaces. Twelve spaces were originally provided on site and the balance were provided behind the Beachcomber Shops, approximately 250 feet westerly, through an off -site parking agreement approved by the Planning Commission and the City Council. The agreement was subsequently declared to be null and void when the use of the spaces was no longer available. Since that time the restaurant has changed ownership twice and the name of the business has been changed at least four times. Under the various ownerships, this business has had alterations made to the interior of the structure which has increased the interior occupant load to 80 persons. In addition, the outdoor deck on the bayward side of the building has been protected by a glass wind screen which provides an additional area for outdoor dining with an occupant load of 34 persons. Therefore, the restaurant currently has a total occupant load of 114 persons which would require parking for 38 automobiles. In addition to the restaurant parking requirement noted above, the boat slips bayward of the building were altered in 1973 from a four fingered slip cluster to one "U" shaped slip. The current parking requirement for this slip is 3 spaces based on 3/4 of a parking space per leased slip space. Therefore, the total parking requirement for all uses on the premises is 41 spaces. An off -site parking agreement for the restaurant was approved by the City Council on March 12, 1973. At that time the restaurant was known as the Monterey Still and the operator of the business was Item No. 5 0 0 TO: Planning Commission - 3. Giles Svehlek dba Taverinn, Inc. Under the terms of the agreement, 30 parking spaces were provided behind the United California Bank on the north side of Coast Highway approximately 500 feet from the restaurant site. Restrictions placed on the restaurant in conjunc- tion with the approval of the off -site parking arrangement required: That the operation of the restaurant Monday through Friday shall be limited to the hours between 4:00 P.M. and 2:00 A.M. 2. That the hours of operation may be adjusted by the Director of Community Development upon submittal of satisfactory evidence as required by Section 20.30.035 D. of the Municipal Code. 3. That a valet service shall be provided during all hours of operation. 4. That satisfactory restraints shall be provided to keep automobiles on the property as determined by the Community Development Department. 5. That a diagram shall be provided at the entrance of the restaurant showing the location of the off -site parking for the benefit of the customers. 6. That a satisfactory off -site parking agreement shall be executed. The spaces noted above were available for the use of the restaurant until January 11, 1975, when a fire on Mariners Mile destroyed the United California Bank and the adjoining buildings. In May, 1976, the Department of Community Development became aware of the fact that the lease arrangement between the restaurant and the bank has been terminated and that the off -site parking spaces formerly designated for the evening use of the restaurant were no longer available. At the same time the Department took steps to close the restaurant during the noon hour after it had been open for lunch in violation of the off -site parking agreement. At its meeting of October 7, 1976, the Planning Commission recommended the approval of a new offsite parking agreement for a portion of the required offstreet parking spaces in conjunction with the subject restaurant facility. The City Council approved the offsite parking agreement on October 26, 1976. The approved agreement provided for 25 of the required 41 parking spaces to be located at the rear of the Beachcomber Shops, approximately 250 feet westerly of the restaurant site. The required conditions of approval for that offsite parking agreement were as follows: 1. That the operation of the restaurant shall be limited to the hours of 5:30 P.M. thru 2:00 A.M., Monday through Saturday, and all day on Sundays provided the applicant can obtain an amended lease agreement. These hours may be adjusted by the Planning Commission provided satisfactory parking can be provided in another location. 2. That an offsite parking agreement shall be approved by the City Council, guaranteeing that a minimum of 25 parking spaces shall be provided at the rear of The Beachcomer Shops located at 2633 West Coast Highway during all hours of operation of the restaurant facility. 3. That a valet service shall be provided on the restaurant site during all hours of operation. 4. That a diagram shall be provided at the entrance of the restaurant complex showing the location of the offsite parking spaces for the benefit of the customers. Item No. 5 T0: Planning Commission - 4. 5. That 16 parking spaces shall be maintained on the restaurant site in accordance with the approved parking layout. Said parking spaces shall be marked with approved traffic markers or painted white lines not less than 4 inches wide. Wheel stops shall be provided adjacent to the westerly side pro- perty line so as to keep parked automobiles from damaging the existing fence between the subject property and the adjoining Ancient Mariner Restaurant site. 6. That the parking arrangement be subject to review by the Modifications Committee one year after approval of the offsite parking agreement by the City Council. Analysis The applicant is now requesting the approval of an offsite parking agreement for a portion of the required restaurant parking spaces in another location. Twenty -six (26) offsite parking spaces are now proposed to be located to the rear of the Mariners Mile Square commer- cial complex, approximately 350 feet to the north of the restaurant site. (Sixteen on -site parking spaces are proposed, resulting in a total of 42 parking spaces for the restaurant use). The attached lease agreement dated July 7, 1977, indicates that the owner has authorized the applicant to use 26 parking spaces after 4:30 P.M., Monday through Saturday and all day on Sunday. However, the spaces will only be available for the restaurant use after 5:00 P.M., Monday through Friday and on weekends when the office uses on the second floor of the Mariners Mile Square complex are closed for business. (Several of the commercial shops on the first floor of Mariners Mile Square are open after 5:00 P.M., but adequate parking spaces will still exist in the parking lot for the restaurant uses.) Staff has no strong objections to employees of Josh Slocum's Restaurant being able to park their automobiles in the subject offsite parking lot prior to 5:00 P.M., Monday through Friday. However, it is suggested that the restaurant facility not be permitted to open for business until 5:00 P.M. during the week unless satisfactory parking can be provided in another location. The staff would have no objections to the restaurant's all day use of the spaces on Saturday as well as the requested Sunday operation so long as the lease agreement is amended to permit this use. Staff is of the opinion that the proposed offsite parking lot is so located to be useful, and will not create undue traffic hazards in the surrounding area, provided that a valet service is used during all hours of operation. It should be pointed out, however, that the length of the attached agreement does not meet the criteria of the City's offsite parking standards. The Municipal Code provides that an off- site parking lot must be ownership in fee or a leasehold interest of a duration adequate to serve the proposed use on the building site. This criteria has more recently been interpreted to require an agreement of at least 5 years. In this case, however, the property owner of the proposed offsite lot will lease the subject parking spaces for a one year trial period. A five year lease will be approved after one year if no problems occur. Staff does not have any strong objections to the one year agreement in this particular case, since it appears that vehicular accessibility and maneuverability to the proposed offsite parking lot is better than now exists to the rear of the Beachcomber Shops. Furthermore, the existing lease agreement is on a year to year basis with no provisions for extensions beyond a one year period of time. Specific Findings and Recommendation Staff recommends the approval of an offsite parking agreement for a portion of the required parking spaces of the Josh Slocum's Restaurant facility and suggests that the Planning Commission make the following findings in conjunction with the applicant's request: Item No. 5 0 TO: Planning Commission - 5. Coast Highway, Portion of Lot H. Tract 919, located on the southerly side of West Coast Highway, across from Tustin Ave., on Mariner's Mile. Gentlemen: At this time we have an off site parking agreement for 25 spaces located at the rear of the Beachcomber Shops approximately 200 ft. from the westerly side of our restaurant. We find that it would be more convenient to ourselves and to our restaurant customers to park across the street behind the Mariner's Square buildings. We have entered into a lease agreement with Mr. Vin Jorgensen and Mr. Ron McCune to lease 26 spaces from them. This agreement is the same as our agreement with the Beachcomber Restaurant which calls for a year to year lease for 25 spaces, however Mr. Jorgensen has stated that after a trial period of one year, that he would give us a five year lease. The traffic pattern and ease with which our customers could come into our restaurant would be greatly enhanced by this new agreement. It is our intention to use these parking spaces Monday through Saturday from 4:30 P. M. to 2:00 A. M., and on Sunday from 8:00 A. M. to 2 :00 A. M. We have spent considerable time and effort to alleviate the parking problems which are inborn at the Monterey Mansion Restaurant, and respectfully submit this parking change for your approval. For you information after ten years of putting up with numerous tenants, poor management and problems too numerous to mention, it is our intention to personally operate, own, and mantain a restaurant which will be known as Josh Slocum's and which will compliment and enhance the marine theme of Mariner's Mile. Gentlemen: I have entered into a lease agreement with Minney Family Enterprises, Inc. The lease calls for the use of 26 of my parking spaces located behind my building known as Mariner's Square. At this time we have an off site parking agreement for 25 spaces located at the rear of the Beachcombe s approximately 200 ft. 8sa from the westerly side of odr-1 urant. a find that it would be more convenient to ourselves and to our restaurant customers to park across the street behind the Mariner's Square buildings. We have entered into a lease agreement with Mr. Vin Jorgensen and Mr. Ron McCune to lease 26 spaces from them. This agreement is the same as our agreement with the Beachcomber Restaurant which calls for a year to year lease for 25 spaces, however Mr. Jorgensen has stated that after a trial period of one year, that he would give us a five year lease. The traffic pattern and ease with which our customers could come into our restaurant would be greatly enhanced by this new agreement.
