SUBJECT: SAN JOAQUIN HILLS ROAD AND JAMBOREE ROAD FREE RIGHT -TURN
LANE (C -1991)
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk
to execute an agreement for engineering services with
Williamson and Schmid for the design of the subject project.
DISCUSSION:
On December 12, 1977, the Council certified the Environmental
Impact Report -- Negative Declaration for the subject project.
A proposal has been requested and received from the firm of
Williamson and Schmid to provide the engineering services necessary
for the design and preparation of plans and specifications to construct
the free right -turn lane. Compensation will be based on standard hourly
rates, with the maximum fee not to exceed $14,700 (rate schedule is
attached). Funds in the amount of $13,000 have been provided in the
currently budgeted Gas Tax project for "Prepare Plans for Construction
of Right -turn Lane at San Joaquin Hills Road and Jamboree Road." A
budget amendment for the remaining $1,700 will be prepared for Council
consideration at a later date should the additional funds be required.
It is anticipated that the project will be included in the
1979 -80 Arterial Highway Financing Program (AHFP), with funding of
50% County AHFP and 50 °% City Gas Tax funds.
A project can be advertised for bids in July 1979, with
construction by September 1979.
Attached is a sketch showing the project limits and typical
section.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE
CITY OF NEWPORT BEACH AND WILLIAMSON AND
SCHMID FOR ENGINEERING SERVICES IN CONNECTION
WITH THE DESIGN OF THE SAN JOAQUIN HILLS ROAD
AND JAMBOREE ROAD FREE RIGHT -TURN LANE PROJECT,
CONTRACT NO. 1991
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Williamson and Schmid for engineering
services in connection with the design of the San Joaquin Hills
Road and Jamboree Road free right -turn lane project; and
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and
equitable,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement for engineering
services above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the same on
behalf of the City of Newport Beach.

RECOMMENDATION:
Adopt a resolution requesting the County of Orange to increase
the Fiscal Year 1979 -80 Arterial Highway Financing Program
allocation for the construction of San Joaquin Hills Road and
Jamboree Road free right -turn lane (C- 1991).
DISCUSSION:
On December 11, 1978, the City Council requested the County of
Orange to include the subject project in the 1979 -80 Arterial Highway
Financing Program, and provide $82,750 as the County's share of the
project.
Construction of the project was completed in September 1980,
and final accounting indicates that the County's portion of the project
cost is $101,022.95.
AHFP guidelines require that the City Council must adopt a
resolution requesting the additional funding if project cost exceeds
the original allocations by more than 15 %.

WHEREAS, on December 11, 1978, the City Council adopted
Resolution No. 9478 requesting the County to provide $82,750.00
for construction of the San Joaquin Hills Road and Jamboree Road
free right -turn- lane in its 1979 -80 Arterial Highway Financing
Program (AHFP), Project No. 1007; and
WHEREAS, based on the final project accounting, the
County's share of costs needs to be increased further to
$101,022.95; and
WHEREAS, the County has requested that the City adopt a
resolution requesting the increased allocation for AHFP Project
No. 1007,
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach hereby requests that the County of
Orange increase the AHFP allocation for Project No. 1007 to
$101,022.95.

AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
FOR
SAN JOAQUIN HILLS ROAD
AND
JAMBOREE ROAD
FREE RIGHT TURN LANE
THIS AGREEMENT is made and entered into this z�) day of
October, 1978, by and between the CITY OF NEWPORT BEACH, a municipal
corporation, hereinafter referred to as "CITY ", and the firm of WILLIAMSON
AND SCHMID, hereinafter referred to as "ENGINEER"
W I T N E S S E T H
WHEREAS, CITY's Circulation Element - Master Plan of Streets and
Highways has designated San Joaquin Hills Road and Jamboree Road as major
roads; and
WHEREAS, the City desires to construct a right -turn lane from
westbound San Joaquin Hills Road to northbound Jamboree Road, as shown on
Exhibit "A" attached hereto and by this reference made a part hereof, under
a project to be cooperatively financed with County of Orange Arterial Highway
Financing Program (AHFP), hereinafter referred to as "PROJECT "; and
WHEREAS, ENGINEER has submitted a proposal to CITY (dated August 25,
1978) to perform engineering services in connection with the design of
PROJECT; and
WHEREAS, CITY desires to accept said proposal;
NOW, THEREFORE, in consideration of the foregoing, the parties
hereto agree as follows:
1. General
A. CITY engages ENGINEER to perform the services hereinafter
described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon the terms
hereinafter set forth.
II. Services to be performed by ENGINEER
ENGINEER hereby agrees to perform the following services:
A. Gather and review existing record maps, improvement
plans, and other documentation affecting the project.
B. Perform any additional field survey work necessary to
check and reestablish the existing street right -of -way
boundaries in which the project is to be constructed.

Perform any additional field survey work to obtain complete
topography of the project area. Work to include establishing
lines for horizontal and vertical control beneficial to
future construction staking. The horizontal control estab-
lished will be shown on one of the sheets included within the
set of final design improvement plans.
Prepare final design for the project on standard City of
Newport Beach improvement plan sheets having a plan view scale
of 1" = 20'.
E. Prepare the necessary special provisions and bid proposals,
using the CITY's Standard Plans and Special Provisions as
well as the "STANDARD SPECIFICATIONS FOR PUBLIC WORKS
CONSTRUCTION," 1976 Edition, on Xerox masters suitable for
use by the CITY in calling for competitive bids.
F. Prepare a final ENGINEER's estimate based on the quantities
used in the bid proposal.
G. Provide professional consultation for interpretation of
plans and specifications and advice during construction of
the PROJECT.
H. Review existing hydrology and hydraulic studies affecting
the project area and prepare final design for storm drain
improvements to be constructed as part of this project.
I. Complete an investigation of underground utilities affect-
ing the PROJECT.
III. Duties of CITY
CITY hereby agrees to supply ENGINEER with the following informa-
tion and materials:
A. Title, plan, and plan and profile sheets as needed for the
PROJECT.
B. Materials investigations,required pavement sections, and
soils information necessary to design retaining walls.
C. General geometric requirements for the street improvements.
D. Available records pertaining to existing street improve-
ments and City -owned utilities.
IV. Time of Completion
Final design, including all plans and other documents for the

PROJECT shall be submitted to the Public Works Director of the
CITY for final review by December 15, 1978.
V. Ownership of PROJECT Documents
Original drawings, reports, notes, maps, and other documents
shall become the property of the CITY and may be reproduced
and utilized as deemed necessary by the Public Works Director.
VI. Engineer in Charge
Gail P. Pickart, RCE No. 19832, shall be the Engineer in
charge of PROJECT design.
VII. Right of Termination
CITY reserves the right to terminate this agreement at any time
by giving ENGINEER seven (7) days' prior written notice; notice
shall be deemed served upon deposit in the United States Mail,
postage prepaid, addressed to the ENGINEER's business office
at 17782 Skypark Boulevard, Irvine, California 92714. In the
event of termination due to errors, omissions, or negligence
of ENGINEER, CITY shall be relieved of any obligation to
compensate ENGINEER for that portion of the work affected by
such errors, omissions, or negligence of the ENGINEER. If
this agreement is terminated for any other reason, CITY agrees
to compensate ENGINEER for the actual services performed up to
the effective date of the notice of termination, on the basis
of the fee schedule contained herein.
VIII. Fee Schedule and Payment
In consideration of the performance of the above - described
engineering services, CITY hereby agrees to pay ENGINEER an
amount based upon the hourly rate schedule set forth below.
In no event shall said amount be greater than Fourteen
Thousand Seven Hundred Dollars ($14,700.00) except as otherwise
provided herein.
A. Hourly rates for office and field personnel shall be as
follows:

These hourly rates will be subject to an increase
August 1, 1979.
B. The contract amount shall be paid to ENGINEER as follows:
1. Monthly partial payments shall be based on the amount
earned each month, as determined by the fee schedule.
The sum of the monthly partial payments shall not
exceed ninety -five percent (95 %) of the maximum fee;
2. Balance of the total amount earned to be paid upon
completion of work specified in Section II (Services
to be Performed by ENGINEER), or by January 1, 1980,
whichever occurs first;
3. In addition, CITY agrees to reimburse ENGINEER for the
actual cost of reproduction of copies of said plans
and related documents, as well as cost of aerial
photography, materials' cost related to survey work,
and other related costs authorized in advance by the
Public Works Director and advanced by ENGINEER.
IX. Additional Work
Should ENGINEER complete any additional work not outlined in
this agreement, but authorized by CITY, the extra work shall
be performed on an hourly basis in accordance with the hourly
rate standard fee schedule set forth in Section VIII (Fee
Schedule and Payment) above.
X. PROJECT Scope Revisions
The scope of the PROJECT may be changed and the maximum fee
revised upon prior written approval of the Public Works

Director if the increase in the maximum fee does not exceed
One Thousand Four Hundred and Seventy Dollars ($1,470.00).
If the revisions to the scope of the PROJECT would result in
an increase in the maximum fee exceeding One Thousand Four
Hundred and Seventy Dollars ($1,470.00), an amendment provid-
ing for such revisions shall be processed and executed by the
parties hereto.
XI. Hold Harmless
ENGINEER shall indemnify and save harmless CITY and its
officers and employees from any damage or liability arising
from any errors, omissions, or negligence in the ENGINEER's
performance of the engineering work and services required by
this agreement except for that portion of the work prepared
and provided by the CITY and defined in Section III D.
IN WITNESS WHEREOF, the parties hereto have executed this agreement
on the date first above written.
