Address lee E. 17 St. Coat& mesa, G Amount of Contract $11,000 Ao-t� Lttlm A.-C City Clerk fi Li A_G_R_E_E M_E N T_ 0 FOR CONSTRUCTION OF KITCHEN FACILITY SENIOR CITIZENS CENTER THIS AGREEMENT is made and entered into this " a day of 73iiuorV 1978, by and between the CITY OF NEWPORT BEACH, `a chartered municipal corporation, hereinafter referred to as "CITY ", and the firm of JAMES RAY CONSTRUCTION, INC., hereinafter referred to as "CONTRACTOR ". W I T N E S S E T H: WHEREAS, City wishes to construct a kitchen facility in the Senior Citizens Center located at Fifth and Marguerite in Corona del Mar; and WHEREAS, Contractor has submitted a proposal to construct said kitchen facility; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. GENERAL. A. City agrees to perform the services hereinafter described for the compensation herein stated. B. Architect agrees to perform said services upon the terms herein set forth. II. DUTIES OF THE CITY. City hereby agrees to supply the Contractor with the following information and materials: A. An approved set of working drawings and specifications. B. Dishwasher, refrigerator, hood oven and range when needed by Contractor. 0 • C. All permits associated with the construction. D. Periodic inspections during construction. III. SERVICES TO BE PERFORMED BY CONTRACTOR. Contractor hereby agrees to perform the following services: A. Construct a kitchen facility in accordance with the approved set of plans, subject to any alterations approved by the City. B. Meet with the City staff to resolve technical matters presenting potential difficulties in accomplishing construction. C. Provide a 30 gallon hot water heater and sink as called for. D. Prepare, document and present to City all payroll slips, wage rates and other reports required by HUD. IV. FEE SCHEDULE AND PAYMENT. Upon completion of the above services, City agrees to pay Contractor Eleven Thousand Dollars ($11,000.00) in one lump sum. V. PROJECT SCOPE REVISIONS. The scope of the project may be changed and the fee revised with prior approval of the Parks, Beaches & Recreation Director as long as the fee is not increased by more than One Thousand Dollars ($1,000.00). VI. HOLD HARMLESS. Contractor shall indemnify and save harmless City and its officers and employees from any damage or liability arising from any errors, omissions or negligence in Contractor's performance of this Agreement, or -2- 0 in the work and services herein provided.
