Subject: OCSD Capacity Charge / SB 13 - ADU's
Good Morning,
As many of you know, legislation was recently passed regarding Accessory Dwelling Units
(ADU’s) that goes into effect on January 1, 2020. SB13, among other things, provides that
agencies cannot charge “impact fees” on ADU’s of less than 750 square feet. However, the term
“impact fees” is defined in such a way that the term does not include connection fees or
capacity charges. Therefore, there is no change for how OCSD Capacity Charges are currently
calculated for ADU’s.
