H -2(b) Adopt a resolution authorizing the Mayor and the City Clerk to execute an agreement for engineering services with Robert Bein, William Frost and Associates for design of the project. DISCUSSION: On December 11, 1978, the City Council certified the environmental document (categorical exemption) and adopted a resolution requesting that the project be included in the 1979 -80 Orange County Arterial Highway Financing Program (AHFP). The estimated cost of the project is $175,000. A proposal has been requested and received from Robert Bein, William Frost and Associates for design and preparation of plans and specifi- cations for the project. Compensation will be based on standard hourly rates, with the maximum fee not to exceed $21,250 (rate schedule attached). Funds have been provided 50% from the County AHFP and 50% from the currently bud- geted gas tax project, "Improve South Side of Coast Highway, 57th Street to Balboa Boulevard." Also included in the proposal were engineering services to design and prepare plans and specifications for the improvement of approximately 400 feet of curb, gutter, sidewalk and A.C. shoulder pavement along the south side of West Coast Highway just westerly of Newport Boulevard. Construction of these improvements would complete the improvements to the south side of Coast Highway from the Santa Ana River through Corona del Mar. Funds for the design of this work (which is not included in the AHFP project) are available in the currently budgeted gas tax account to "Prepare environmental impact reports and preliminary plans for street construction projects." Funding for the total agreement is as follows: County AHFP $10,625.00 City Gas Tax 13,375.00 Total $24,000.00 Advertising for bids is scheduled in January 1980, with construction to be completed by June 1980. Attached is a sketch showing the AHFP project limits and typical section. Benjamin B. WEST COAST HIGHWAY SOUTHERLY SIDE STREET IMPROVEMENTS FROM 57TH STREET TO BALBOA BOULEVARD �UIy THIS AGREEMENT is made and entered into this day of 1979, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY," and the firm of ROBERT BEIN, WILLIAM FROST AND ASSOCIATES, hereinafter referred to as "ENGINEER." W I T N E S S E T H WHEREAS, CITY's Circulation Element -- Master Plan of Streets and Highways has designated West Coast Highway as a major road; and WHEREAS, the CITY desires to construct street improvements to the southerly side of West Coast Highway, as shown on Exhibit "A" attached hereto and by this reference made a part hereof, under a project to be cooperatively financed with County of Orange Arterial Highway Financing Program (AHFP), hereinafter referred to as "PROJECT "; and WHEREAS, ENGINEER has submitted a proposal to CITY (dated June 4, 1979) to perform engineering services in connection with the design of PROJECT; and WHEREAS, CITY desires to accept said proposal; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be performed by ENGINEER ENGINEER hereby agrees to perform the following services: A. Gather and review existing record maps, improvement plans, utility plans, and other documentation affecting the project. B. Perform field topographic location and elevation surveys necessary for completion of PROJECT design. 0 0 C. Plot cross sections and profiles from field notes. D. Prepare final design for the PROJECT on standard City of Newport Beach improvement plan and profile sheets. E. Prepare the necessary special provisions and bid proposals, using the CITY's Standard Plans and Special Provisions as well as the "STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION," 1979 Edition, on Xerox masters suitable for use by the CITY in calling for competitive bids. F. Prepare a final ENGINEER's estimate based on the quanti- ties used in the bid proposal. G. Provide professional consultation for interpretation of plans and specifications and advice during construction of the PROJECT. H. Review existing hydrology and hydraulic studies, perform necessary hydrology and hydraulic studies, and prepare final design for storm drain improvements to be constructed as part of this PROJECT. I. Complete an investigation of underground utilities affect- ing the PROJECT. J. Provide surveying service to establish and monument the center line of West Coast Highway from the existing monu- mentation at 57th Street to Balboa Boulevard. Scope of work to include establishment of temporary markers at each control point and, following installation of well monuments by the CITY's contractor, set permanent marker disks within the well. K. Preparation of construction plans, special provisions and cost estimates for approximately 400 linear feet of street improvements along the south side of West Coast Highway just west of Newport Boulevard. Drawings to be included in the PROJECT plans and special provisions. III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following informa- tion and materials: A. Title, plan, and plan and profile sheets as needed for the PROJECT. - 2 - 0 0 B. Materials investigations and required pavement sections. C. General geometric requirements for the street improvements. D. Available records pertaining to existing street improve- ments and City -owned utilities. IV. Time of Completion Final design, including all plans and other documents for the PROJECT shall be submitted to the Public Works Director of the CITY for final review by September 14, 1979. V. Ownershio of PROJECT Documents Original drawings, reports, notes, maps, and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. VI. Engineer in Charge Orville Meyers, RCE No. 11902, shall be the engineer in charge of PROJECT design. VII. Right of Termination CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER's business office at 1401 Quail Street, P.O. Box 2590, Newport Beach, California 92663. In the event of termination due to errors, omissions, or negligence of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER for that portion of the work affected by such errors, omissions, or negligence of the ENGINEER. If this Agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VIII. Fee Schedule and Payment In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Twenty -four Thou- sand Dollars ($24,000.00) except as otherwise provided herein. - 3 - IX 0 0 A. Hourly rates for office and field personnel shall be as follows: Rates Overtime* Professional Consultation 60.00 /hr. Registered Engineer 40.00 /hr. 60.00 /hr. Engineering (Design Calc's & Supervision) 32.00 /hr. 48.00 /hr. Drafting 22.00 /hr. 33.00 /hr. Technician 15.00 /hr. 22.50/hr. Field Survey Crew (3 -man) 90.00 /hr. 135.00 /hr. Consultation in connection with litigation and appearance before courts and /or commissions. 100.00 /hr. *Charged only if authorized by CITY. These hourly rates will be subject to a 10% increase August 1, 1979. B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety -five percent (95%) of the maximum fee; 2. Balance of the total amount earned to be paid upon completion of work specified in Section II (Services to be Performed by ENGINEER), or by January 1, 1981, whichever occurs first; 3. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents, as well as cost of aerial photo- graphy, materials' cost related to survey work, and other related costs authorized in advance by the Public Works Director and advanced by ENGINEER. Additional Work Should ENGINEER complete any additional work not outlined in this Agreement, but authorized by CITY, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section VIII (Fee Schedule and Payment) above. - 4 - 0 0 X. PROJECT Scope Revisions The scope of the PROJECT may be changed and the maximum fee revised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed Two Thousand Four Hundred Dollars ($2,400.00). If the increase in the maximum fee would exceed $2,400, an amendment providing for such revisions shall be processed and executed by the parties hereto. XI. Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, omissions, or negligence in the ENGINEER's performance of the engineering work and services required by this Agreement. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE CITY OF NEWPORT BEACH AND ROBERT BEIN, WILLIAM FROST AND ASSOCIATES IN CONNECTION WITH WEST COAST HIGHWAY IMPROVEMENTS, 57TH STREET TO BALBOA BOULEVARD (C -2062) WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain Agreement for Engineering Services between the City of Newport Beach and Robert Bein, William Frost and Associates in connection with West Coast Highway improvements, 57th Street to Balboa Boulevard; and WHEREAS, the City Council has reviewed the terms and conditions of said agreement and finds them to be satisfactory and that it would be in the best interest of the City to execute said agreement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
