DISCUSSION:
Stage 8 project funds for the local share
o modify a portion of the existing beach
Since 1963, the City of Newport Beach has participated in a coopera-
tive beach erosion control project covering the area from Surfside to Newport
Beach. The project has been constructed in a number of stages, with the major
work consisting of the construction of groins and placement of beach fill in
West Newport, and the placement of several increments of beach fill at
Surfside /Sunset Beach. Construction of the Stage 8 beach fill at Surfside
was recently completed. The City's share of Stage 8 (1.79 %, or $139,800) was
budgeted in F.Y. 1983 -84. (The table appended to the attached letter indi-
cates the participants in the cooperative project, and their percentage share
of the costs.)
A letter dated July 24, 1984 (copy attached) has been received from
the Orange County Environmental Management Agency asking the local.partici-
pants in.the project to approve the use of funds left over from the Stage 8
contract to perform a study of a structure to be constructed at or near the
Naval Weapons Station jetty at the upcoast end of the project. It is felt
that the construction of such a structure could save participants in the on-
going cooperative project $8 - $11 million over a 50 -year projected life by
extending the period between renourishment stages.
Sufficient funds remain unexpended from the Stage 8 construction
to fund the requested study without additional appropriations should the
participants approve. The Public Works Department feels the concept is worth
investigating, and the potential cost savings are significant. Approval is
recommended.

SUBJECT: Sunset /Surfside - Newport Beach Federal Beach Erosion Control
Project
Dear Mr. Wynn:
In conjunction with subject project, State of California, Resources Agency,
Department of Boating and Waterways is in process of proposing U.S. Army Corps
of Engineers, Los Angeles District perform a feasibility study to determine
"Federal Interest" in modifying the project to reduce costs of renourishment.
Specifically, the Department of Boating and Waterways is requesting local
agency approval that remaining funds from construction of Stage 8 of the
project be used to fund the established 338 local matching share for the
study. The original funding agreements from which the work is proposed to be
funded did not envision the study, accordingly, it is requested that as a
local agency you advise me as regards approving the use of leftover Stage 8
funds for funding the State Department of Boating and Waterways proposed Corps
of Engineers study. EMA will recommend use of its Harbors, Beaches and Parks
District's proportionate share of leftover Stage 8 funds be approved by its
Board of Supervisors.
To assist you in making your determination, the following background
information is furnished:
1. Investigations by the Department of Boating and Waterways indicate that
accelerated erosion adjacent to and downcoast of Naval Weapons Station
jetties (,apparently caused by reflected wave energies off of jetties)
causes need for frequent beach replenishment in order to maintain
necessary beach widths Sunset /Surfside area and causes unnecessary beach
width buildup downcoast.
2. Preliminary Department of Boating and Waterways calculations indicate that
construction of minimal structure (i.e., submerged breakwater, groin,

etc.) vicinity Sunset /Surfside could save project participants
$8 -$11 million over the 50 -year life of a structure by extending the
period between renourishment stages. Incidental benefit that could also
accrue include (a) conservation of a scarce sand resource and (b) a
reduction in planning and design administration costs and costs required
in obtaining Federal and State Funding.
3. Federal Interest Study will be conducted by Corps of Engineers by con-
structing a scale model at its Waterway Experimental Station, Vicksburg,
Mississippi. Based on a seminar to discuss the scope and methodology
attended by local participants technical staff, it is believed the
condition can be accurately modeled and an effective project designed.
4. Estimated cost to perform Federal Interest Study is $100,000 and would
require approximately one year to complete. Although final accounting of
Stage 8 construction costs has not been performed, Stage 8 leftover funds
in the amount of approximately $1,000,000 to cover the cost of the study
are available.
5. Estimated construction costs of a proposed structure are difficult to
ascertain at this time. However, Department of Boating and Waterways
believes construction costs would range from $500,000 - $800,000. Actual
decision to proceed with construction would be made at completion of
proposed study.
6. To assist agencies in making decision, attached exhibit has been prepared
showing pro rata estimated costs of study and preliminary cost estimates
based on project's funding allocation formula.

THIS AGREEMENT is made and entered into the Leday of 67_,

County of Orange, Harbors, Beaches and Parks
District, a political subdivision of the State
of California, hereinafter called "DISTRICT ",
City of Newport Beach, a municipal
corporation, hereinafter called "CITY"
WHEREAS, Congress has, by the enactment of Public Law 874, 87th Congress,
adopted and authorized a beach erosion control project, to be accomplished in
stages, which extends from Anaheim Bay Harbor to the west jetty of Newport Beach
Harbor in Orange County, and
WHEREAS, the implementation of said Federal beach erosion control project
is of direct benefit to the beaches owned and operated by "CITY" and "DISTRICT" in
providing a source of beach sand for replenishment of natural erosion of said
beaches, and
WHEREAS, the United States Army Corps of Engineers is prepared to under-
take Stage 8 of said project at an estimated cost of $7,995,000, to be financed on
the following basis:
Federal Government 67 percent
State of California 16.5 percent
Local Agency shoreline owners consisting 16.5 percent
of cities, DISTRICT, private and state
division of beaches and parks
and
WHEREAS, the 5 year sand monitoring program of Stage 7 for the entire
80,000 linear footage of shoreline of the Federal beach erosion project is still in
progress, and

WHEREAS, the "DISTRICT" is prepared to pay the local agency contribution
of $599,700 as a share for all local shoreline owners for Stage 8 construction
except that portion to be contributed by the State Department of Parks and
Recreation, and
WHEREAS, the shoreline owners' share of the cost for Stage 8 construction,
based upon a formula of 80,000 linear feet of beach frontage within the Federal
project area is as follows:
Private beach owners: Surfside Colony Storm Water Protection District

Public beach owners: Orange County Harbors, Beaches and Parks District

NOW, THEREFORE, the parties hereto do mutually agree as follows:
I
"CITY" agrees that remaining funding from Stages 4B and 5 for said project
shall be applied to the design cost of Stage 8 of the project which shall cover the
entire 80,000 lineal footage of shoreline of the Federal project area including
"CITY'S" Newport Pier area, and that the final accounting of Stages 4B, 5 and 7
funding shall be incorporated into the accounting for Stage 8 described in Clause VI
herein.

"CITY" agrees to pay "DISTRICT" within 60 days after billing by

"DISTRICT ", "CITY's" portion of the cost of Stage 8 of the aforesaid beach erosion
control project, said portion being the amount of $139,800.
III
"DISTRICT" agrees to coordinate said project with "CITY" and other local
shoreline owners, State of California, and the United States Army Corps of Engineer;
to the mutual benefit of all parties concerned.
IV
"DISTRICT" shall, within 30 days of the execution of this agreement and
similar agreements by all of the aforementioned local shoreline owners and receipt
of billing from the State of California, pay the local shoreline owners' portion of
the Stage 8 Federal beach erosion control project in the amount of $599,700 to the
United States Army Corps of Engineers to facilitate implementation of said Stage 8
project.
V
"DISTRICT" shall, and "CITY" may, assign inspector to project to inspect
and determine the acceptability of the work to be performed by the United States
Army Corps of Engineers as part of Stage 8 project, and it is agreed that the
decision of "DISTRICT's" inspector shall be final in relation to the acceptability
of said Corps of Engineers work.
VI
"DISTRICT" will obtain from the State of California Department of
Navigation and Ocean Development, the agency coordinating the Stage 8 project with
the United States Army Corps of Engineers, an accounting of all expenditures of all
funds received for Stage 8 of the aforementioned project and shall pursue refund of
any funds which are in excess of ultimate project cost on a proportionate basis to
"DISTRICT" and shall, in turn, refund to "CITY" its prorated share of any refunds
received within 30 days after receipt thereof by "DISTRICT" in a ratio equal to that
stated in the recitals of Page 2 of this agreement.

"CITY" agrees, in recognition of "DISTRICT'S" financial assistance under
the terms of this agreement, to allow residents of "DISTRICT" to utilize public
beaches of "CITY" on an equal basis with "CITY" residents and without discrimination
as to race, religion, sex, political persuasion or area of residency.
VIII
To the extent permitted by law, "CITY" shall indemnify and save harmless
"DISTRICT ", its officers, agents and employees from and against all claims, demands,
loss or liability of any kind or nature which "CITY" its officers, agents, or
employees may sustain or incur or which may be imposed upon them or any of them for
injury to or death of persons, or damage to property as a result of the negligence
or wrongful act or omission by "DISTRICT ", its officers, agents, employees or
invitees in carrying out the terms of this agreement or exercising the rights herein
granted.

Gentlemen:
Transmitted for action by the Board of Supervisors are copies of the
Stage 8 Beach Erosion Control Project Cooperative Agreement. This
agreement was approved by the Newport Beach City Council on April 11.
1983.
The City wishes to express its dissatisfaction with the language of the
indemnification section contained in the agreement. Because of the
importance of proceeding expeditiously however, the agreement has been
approved as originally written. It would be appreciated if EMA could
request the County Counsel's office to work with our City Attorney.
Robert Burnham, to develop mutually satisfactory language for the indem-
nification section to be used in future cooperative agreements.

Approve an agreement between the City and the Orange County Harbors,
Beaches and Parks District providing for City participation in
Stage 8 of the Cooperative Federal Beach Erosion Control Project;
and authorize the Mayor and the City Clerk to execute the agreement.
DISCUSSION:
By letter dated March 11, 1983 (copy attached), the County of Orange
has requested that the City enter into an agreement providing for City parti-
cipation in Stage 8 of the Cooperative Federal Beach Erosion Control Project.
This is the project under which, in earlier stages, beach fill was placed and
the groin field constructed in West Newport. The currently proposed Stage 8
work consists of placing approximately 1,500,000 cubic yards of dredged sand
on the beach in Surfside /Sunset Beach.
The estimated total cost for the Stage 8 work is $7,995,000; with
the Federal Government bearing 67% of the cost, the State of California bear-
ing 16'x% of the cost, and local agency shoreline owners bearing 16-12% of the
cost. The cost to the City of Newport Beach is $139,800. Payment of the
City's share would be due in Fiscal Year 1983 -84, and funds have been included
in the proposed Capital Projects budget.
Attached for reference and background information is a copy of an
earlier.report dated August 22, 1977 on the beach erosion control project.
This report contains information regarding the history, nature, and funding
of the project. As indicated, earlier stages of the project have been of
great direct benefit to the City. In addition, the fill material placed on
the upcoast beaches tends to migrate downcoast over time, and eventually to
provide further nourishment of the beaches in West Newport.
The most recent work on the project was Stage 7, completed in 1979
at a total cost of $3,840,000 and a City share of $102,960. This work con-
sisted of placing approximately 1,300,000 cubic yards of dredged sand on the
beach in Surfside /Sunset Beach. In addition, a long -term sediment monitoring
program was established in Stage 7. The monitoring program has not yet been
com leted.

SUBJECT: FEDERAL BEACH EROSION CONTROL PROJECT
Attached is a letter dated July 20, 1977, from the Environmental
Management Agency regarding a proposed federal beach erosion control_ project
scheduled for construction in the fall of 1978. This construction project
will be the next stage in the continuing program for the control of beach ero-
sion extending from Anaheim Bay Harbor southeast to Newport Harbor. Because
of the.funding complexities of the different stages, a summary has been in-
cluded for Council information.
The proposed project will place about 1,500,000 cubic yards of
acceptable beach material southeast of Anaheim Bay jetty to form a feeder beach
about 6,000 feet long and 250 feet wide. The present estimated project cost is
$4,000,000. The Department of the Army is presently investigating alternate
dredge sites in determining if the high cost per cubic yard of beach sand can
be reduced.
The complete beach erosion control project is described in House
Document No. 602, 87th Congress,and was specifically adopted and authorized by
Public Law 874, 87th Congress. The law authorizes the federal government to
assist states and political subdivisions thereof in the construction of works
for improvement and protection against erosion by waves and currents of their
shores, and other purposes.
The following is a summary of the previous beach erosion projects:
Stage 1 of the project, completed in June 1964, comprised the place-
ment of 4,000,000 cubic yards of sand, dredged from the U.S. Naval Weapons
Station Harbor, to provide a feeder beach 500 feet wide and 2 miles long in the
Surfside- Sunset Beach area. Total cost was $2,159,000. Newport Beach's share
was $38,600.
Stage 2 was accomplished under two contracts. The first contract,
which was completed in February 1968, included the placement of 494,000 cubic
yards of sand on the beach between 32nd and 50th Streets at Newport Beach and
the construction of an experimental 258 -foot steel sheet -pile groin at 40th
Street.
The second contract, completed in November 1968, provided an addi-
tional 240,000 cubic yards of sand in the upcoast area and the construction of
a 190 -foot steel sheet -pile groin at 44th Street and a 60 -foot steel sheet -pile
groin at 48th Street. Total cost $700,000. Newport Beach's share was $12,500.

Stage 3 provided for the construction of four rock groins and the place-
ment of 750,000 cubic yards of sand on the Newport Beach area. The groin work,
completed in November 1969, comprised: rebuilding the steel sheet -pile groin
at 48th Street to a length of 340 feet; and constructing rock groins at 36th, 52nd,
and 56th Streets with lengths of 490, 340, and 570 feet respectively. Sand fill
was obtained from the Santa Ana River Channel as part of a flood control channel
restoration project. This work was completed in January 1970. Total cost $600,000.
Newport Beach's share was $10,761.
Stage 4A, which was similar to Stage 1, provided for the additional
placement oir2,300,000 cubic yards of sand on the Surfside- Sunset Beach area to
maintain a 500 - foot -wide by a 6,000- foot -long feeder beach. Again, the source
of material was from the U.S. Naval Weapons Station Harbor. The work was com-
pleted in May 1971. Total cost $1,074,000. Newport Beach's share was $19,260.
Stage 48 and Sta e 5 provided for rehabilitation of the two steel test
groins at 40th and 44t Streets with permanent rock construction. This stage
also includes a rock groin at 32nd and 28th Streets and the placement of 100,000
cubic yards of imported fill on the beach in the vicinity of 32nd Street and
40th Street. The sand would bB obtained from the`mouth of the Santa Ana River
and the beach immediately downcoast of the river. Total cost $1,526,000.
Newport Beach's share was $27,371.

Project financing is 67% federal funds and 33% local (State, County,
City and private) funds in accordance with the existing Federal -State agreement.
It is assumed that the State Department of Water Resources and Department of Parks
and Recreation will contribute to the new project on the same basis as in the
previous phase of the program. If so, and using previous local funding cost dis-
tributions, the County, cities, and private interest costs would be approximately
$330,000. The proportionate shares would be about $20,300 for Surfside Colony
Ltd., $77,400 for the City of Newport Beach, $38,700 for the City of Huntington
Beach and $193,600 for the County. The County plans to budget the total local
costs of $330,000 and then get reimbursed from the other local funding sources.

funding on the different projects.

10 WHEREAS, Congress has, by the enactment of Public Law 874, 87th Congress,
adopted and authorized a beach erosion control project, to be accomplished in stages,

12 which extends from Anaheim Bay Harbor to the west jetty of Newport Beach Harbor in

WHEREAS, the implementation of said Federal beach erosion control project

15 is of direct benefit to the beaches owned and operated by "CITY" and ", DISTRICT" in

16 providing a source of beach sand for replenishment of natural erosion of said
beaches, and

18� WHEREAS, Stage 4B and 5 of the federal project has not been accepted
by "CITY" due to concern that the area in the vicinity of the Newport Beach Fier
19
may be experiencing sand erosion as an impact of the federal project, and
20
WHEREAS, the United States Army Corps of Engineers is prepared to under -

23�take Stage 7 of said project at an estimated cost of $3,840,000, to be financed

WHEREAS, said Stage 7 of the Federal project will include a sand moni-
Loring program of approximately 5 years in duration for the entire 80,000 lineal
footage of shoreline of the erosion project including the area of the Newport
Beach Pier which is of primary concern to "CITY ", and
WHEREAS, the "DISTRICT" is prepared to pay the local agency contribution
of $316,800 as a share for all local shoreline owners for Stage 7 construction except
that portion to be contributed by the State Department of Parks and Recreation, and
WHEREAS, the shoreline owners' share of the cost for Stage 7 construction,
based upon a formula of 80,000 linear feet of beach frontage within the Federal
project area is as follows:

NOW, THEREFORE, the parties hereto do mutually agree as follows:
I
"CITY" accepts Stages 4B and 5 of the Federal beach erosion project and
agrees that remaining funding for said project shall be applied to the 5 year sand

monitoring program of Stage 7 of the project which shall cover the entire 80,000
lineal footage of shoreline of the Federal project area, including "CITY'S"
Newport Fier area, and that the final accounting of Stage 4B and 5 funding shall
be incorporated into the accounting for Stage 7 described in Clause VI herein.
II
"CITY" agrees to pay " DIS'TRICT" within 60 days after billing by "DIS-
TRICT", "CITY'S" portion of the cost of Stage 7 of the aforesaid beach erosion
control project, said portion being the amount of•$101,960.
III
"DISTRICT" agrees to coordinate said project with "CITY" and other local
shoreline owners, State of California, and the United States Army Corps of Engineers
to the mutual benefit of all parties concerned.
IV
"DISTRICT" shall, within 30 days of the execution of this agreement and
similar agreements by all of the aforementioned local shoreline owners and receipt
of billing from the State of California, pay the local shoreline owners' portion
of the Stage 7 Federal beach erosion control project in the amount of $316,8UO
to the United States Army Corps of Engineers to facilitate implementation of said
Stage 7 project.
V
"DISTRICT" shall, and "CITY" may, assign inspector to project to inspect
and determine the acceptability of the work to be performed by the United States
Army Corps of Engineers as part of Stage 7 project, and it is agreed that the
decision of "DIS1'RICT's" inspector shall be final in relation to the acceptability
of said Corps of Engineers work.
VI
"DISTRICT" will obtain from the State of California Department of Navigation
and Ocean Development, the agency coordinating the Stage 7 project with the United
States Army Corps of Engineers, an accounting of all expenditures of all funds

received for Stage 7 of the aforementioned project and shall pursue refund of
any funds which are in excess of ultimate project cost on a proportionate basis
to "DISTRICT" and shall, in turn, refund to "CITY" its prorated share of any refunds
received within 30 days after receipt thereof by "DISTRICT" in a ratio equal to
that stated in the recitals of page 2 of this agreement.
VII
"CITY" agrees, in recognition of "DISTRICT's" financial assistance
under the terms of this agreement, to allow residents of "DISTRICT" to utilize
public beaches of "CITY" on an equal basis with "CITY" residents and without
discrimination as to race, religion, sex, political persuasion or area of residency.
VIII
To the extent permitted by law, "CITY" shall indemnify and save harmless
"DISTRICT ", its officers, agents and employees from and against all claims, demands,
loss or liability of any kind or nature which "CITY ", its officers, agents, or
employees may sustain or incur or which may be imposed upon them or any of them
for injury to or death of persons, or damage to property as a result of the
negligence or wrongful act or omission by "DISTRICT ", its officers, agents,
employees or invitees in carrying out the terms of this agreement or exercising
the rights herein granted.

CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE
CITY OF NEWPORT BEACH AND THE COUNTY OF ORANGE,
HARBORS, BEACHES AND PARKS DISTRICT, FOR THE
CONTRIBUTION OF COSTS IN CONNECTION WITH STAGE
7 OF THE FEDERAL BEACH EROSION CONTROL PROJECT
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the County of Orange, Harbors,
Beaches and Parks District, for the contribution of costs in
connection with Stage 7 of the Federal Beach Erosion Control
Project; and
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and
equitable,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement for the contribution
of costs above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the same on
behalf of the City of Newport Beach.
