Science Applications, Inc. (SAI) and Datacom Systems Corpora-
tion are pleased to announce that SAI's Parking Citation
Management Division is being merged into the Datacom Corporation.
Datacom is the largest company providing parking citation
processing and collection services in the country. Since
1975, Datacom has processed over five million citations and
has collected over $25 million for its municipal customers:
Major clients include most of the cities in Santa -Clara
County, California, the city of New York and Washington, D.C.
Both SAI and Datacom believe that Dati:com's experience in
the field of parking citation processing and collection will
result in significantly- enhanced services for all parking
citation management clients. One of the unique services
that Datacom provides is the ability -- through its relationships
with more than 40 Department of Motor Vehicles -- to identify,
pursue and collect from out -of -state violators. In addition,_
Datacom provides lockbox and revenue collection services for
many of its customers.
No changes are anticipated in either the services provided
or contractual terms as a result of this action. Mr. Wally

CONTRACT AGREEMENT
On this Ztk- day of 1980, the City of
Newport Beach, a Municipal corporation, and Science Applications,
Inc., a corporation organized and existing under and by virtue
of the laws of the State of California, hereinafter referred to
as "SAI," mutually agree:
WHEREAS, on July 24, 1980, the City of Newport Beach
and SAI entered into a parking citation management contract; and
WHEREAS, both parties desire to amend said contract to
reduce the compensation therein payable by City of Newport Beach
to SAI from $1.74 per citation processed to $1.42 per citation
processed and further amends said Agreement to provide that SAI
may terminate the Agreement upon sixty days written notice.
NOW, THEREFORE, the City of Newport Beach and SAI do
mutually agree as follows:
1. Paragraph 20 of said Agreement, dated July 24,
1980, is hereby amended to read as follows:
"20. Compensation
$1.42 per citation processed from September 23,
1980 to the expiration of the contract term,
subject to the condition that contract cost
increases, based upon materials, postage, other
overhead items may be items for negotiations
during the term of the contract."
2. Paragraph 19 of said Agreement, is hereby amended to
provide that SAI may terminate said Agreement on sixty days
notice as well as the City of Newport Beach.
3. All other terms and conditions not inconsistent
herewith shall remain in full force and effect.
This Agreement is made and executed the day and year
first above written.

SUBJECT: AMENDMENT OF THE PARKING CITATION MANAGEMENT
CONTRACT WITH SCIENCE APPLICATIONS, INC.
Background
On September 8, 1980, the City Council reviewed the subject of
parking citation management with specific emphasis upon contract
cost.
The existing contract with Science Applications, Inc. (SAI) provides
for a payment by the City of $1.74 per citation processed. (Attachment
1). Several other firms had offered to perform this function for
significantly less than $1.74, hence the staff had presented these
alternatives to the Council for consideration.
During the course of the meeting on the 8th, SAI indicated that
as the result of implementing certain operating efficiencies, the
company was now in a position to offer their services at a reduced
rate. A specific proposal of $1.42 per citation processed was
presented to the Council.
In response to the substantial cost reduction proposed, and in
recognition of the fact that staff was preparing an in -house proces-
sing plan for review during October, the Council opted to maintain
relations with SAI. Staff was directed to prepare for Council
consideration on September 22, 1980, a contract amendment incorporating
the revised rate of $1.42. Additionally, certain members of the
Council expressed an interest in the type of functions performed by
SAI.
Proposed Amendment
In response to the Council's directive, staff has prepared an
amendment revising the SAI contract to provide for a City cost
of $1.42 rather than $1.74 per citation processed. The amendment,
if approved, would become effective on September 23, 1980.
Services Provided by SAI
Attachment 2 is a letter from SAI confirming the $1.42 contract
cost revision and transmitting informational items relative to
the firm's parking citation services. The list appended to the
letter presents those services and functions performed by SAI.
Transmitted also with the letter was an annual report for the SAI
parent company. This document, which addresses the entire spectrum

of SAI research and development activities is available in this
office for review by any member of the Council.
Finally, the letter from SAI requests that the contract termina-
tion provisions (60 days' written notice) be made applicable to
both the City and the company to insure uniformity and consistency.
This request has been incorporated into the proposed amendment
along with the revised cost figure.
Suggested Action
If desired, adopt Resolution No. , authorizing the Mayor
and City Clerk to execute an amen men�t to —the SAI contract as

CONTRACT
PARKING CITATION MANAGEMENT
THIS CONTRACT, made and entered into as of this
day of ,!,. , 1980, by and between The City of Newport
Beach, pV puolzc body organized and existing under and by virtue
of the laws of the State of California, hereinafter referred to
as the "Buyer" and Science Applications, Inc., a corporation
organized and existing under the laws of the State of California,
with its principal place of business at 1200 Prospect Street,
La Jolla, California, 92038; hereinafter referred to as the
`Seller ".
WHEREAS, the Buyer desires that the Seller provide
technical services to conduct a Parking Citation Management
Program (PCAP).
NOW, THEREFORE, the Buyer and the Seller do mutually
agree as follows:
A. STATEMENT OF WORK. Work will be conducted as follows:
1. Data Entry
The citation data entry function of PCMP is concerned
with the entry of data on all parking citations; the
establishment and maintenance of a data base; the
k- identification of citations within the system from a
query; and provisions for data elements which will be
utilized for future statistical and detail reporting
and systems verification.
2. Entry of Data `
Data shall be entered from four (4) sources as follows:
a. original Entry of Parking Citation Into System at

After all parking citations have been issued, they
will be sent for processing to the municipal court
having jurisdiction. When the citations arrive at
the court, a Seller's data processing clerk will
code the citations to capture the required data for
automated processing. The original parking citations
will be filed into a numerical file by citation
number at the court. The citations will be removed
from that numerical file only upon disposition by
the municipal court or the Department of Motor,
Vehicles. The coded information will then be entered
into the computer system. _
b. Entry of Disposition by the Court
The municipal court will have the only authority,
other than the Department of Motor Vehicles, to
establish a disposition for parking citations. A
designatee of the clerk of the municipal court will
fill out a disposition sheet daily to give a
disposition for the following reasons:
(1) Paid on initial parking citation

The disposition sheet will be given to the Buyer's
data processing clerk assigned to that court for
entry into the system.

All current parking citations in the system which
have reached a failure to appear status will have
the required information sent to the Department of
Motor Vehicles for registered owner information.
The systems program will be interfaced with the
Department of Motor Vehicles' DMV /EDP Vehicle
The Department of Motor vehicles, in return, inputs
the vehicle registered owner information in a
compatible format for future use.
d. Entry of the Department of Motor Vehicles Disposition
The Department of Motor Vehicles, Division of
Registration, will enter the disposition of parking
citations that have been sent to them via a Notice
of Non - Compliance. The.dispositions.will be one of
the following:
(1) Cleared with collection of bail
(2) Cleared without collection of bail
The Division of Registration will clear a Non-
compliance Notice without collection of bail for
only one (1) of four (4) reasons:
(1) Transfer of registration
(2) Non - renewal for two (2) years
(3) ,Court receipt presented by applicant
(4) Deletion notice sent by court
3. Data Base
This function provides a base for future processing and
data base analysis. The following data are captured for
processing statistical and legal purposes:
a. City identifier
b. Citation number

d. Reporting district
e. Vehicle identifiers
f. Location of violation
g. Violation(s)

a. During original data entry, critical data elements
will be "double entered ".
b. The data will be scanned again to verify that all
elements are within predetermined parameters.
C. The registered owner information will be reverified
against the vehicle license number, make, and model,
prior to a notice being issued.
d. A scan mode will be used by the operator at any
time to scan for errors.
7. Subsystem- Notice of Intent Generation
The Notice of Intent generation function is concerned
with the parking citations that are in a failure to
appear status. This function consists of several sub -
functions for notice generation. These subfunctions
are:
a. Automated request for registered owner
b. Registered owner is matched with a parking citation
c. Notice of Intent is generated

When the parking citation proceeds further into the
system, a combination of the following data will be
added;
a. Date cleared
b. How cleared
c. Registered owner
d. Date notice sent

Identification of Parking Citation Within the System
This function is responsible for locating a parking
citation within the system, and giving the status of
that citation in the system. This is a valuable asset
for violators who have lost their citations, eliminating
the long mechanical delay of hand searching for a
parking citation.
The court shall have two (2) alternatives for an
inquiry. One is to look at an updated status report
that is sorted by numerical sequence or secondly, make
'
a direct inquiry into the system via a "hotline ". This
"hotline" has direct access to a systems operator.
5.
Statistical Data Collection
Data collected from entries into the system will be
available for future development and detail management
.
reports (refer to Paragraph 12).
6.
Data Verification
Data that is entered will be verified through both
human and programmatric methods. The data processing
clerk will insure that all illegible items are verified
by the originator before entry. Within the system
itself, there are four (4) verification processes;
a. During original data entry, critical data elements
will be "double entered ".
b. The data will be scanned again to verify that all
elements are within predetermined parameters.
C. The registered owner information will be reverified
against the vehicle license number, make, and model,
prior to a notice being issued.
d. A scan mode will be used by the operator at any
time to scan for errors.
7. Subsystem- Notice of Intent Generation
The Notice of Intent generation function is concerned
with the parking citations that are in a failure to
appear status. This function consists of several sub -
functions for notice generation. These subfunctions

the day after the appearance date, the system generates
an interfaced magnetic tape to the DMV /EDP Vehicle

9. Registered Owner is Matched With a Parking Citation
This subfunction is responsible as a further edit and
verification procedure. A cross -check of all data will
be verified to insure the registered owner data matches
the data provided on the vehicle issued a citation.
Prior to the Notice of Intent being generated, the parking
citation status will again be verified to insure the
status is still "failure to appear ".
10. Notice of Intent Is Generated
The Notice of Intent will be generated and sent to the
registered owner as the records of the Department of
Motor Vehicles indicates. This Notice of Intent provides
the registered owner with the following:
a. Municipal court having jurisdiction
b. Vehicle identifier
V. Date and time of violation
d. Violation
e. Location of violation
f. Legal obligations
g. Consequences for failure to comply with the legal
obligations
h. Instructions for change of ownership or lessee
information
i. Instructions on how to comply with the notice
The Notice of Intent will be prepaid first class postage,
excluding return postage.
11. Subsystem- Notice of Non - Compliance
This subsystem is responsible for identifying those
parking citations with which there was noncompliance to
the Notice of Intent. An automated Notice of Non -
Compliance will be sent to the Department of Motor Vehicles
and attached to the vehicle registration.
There is a critical time factor involving this subsystem.
The State of California has stated by law that, "Whenever
any person has for a period of 15 or more days failed to
comply with the provisions (Notice of Intent), notice shall
be given to the Department of Motor Vehicles not more than
thirty (30) days after such failure to appear. The system
will have programmatic time table to insure all requirements
of the law are met ".
12. Subsystem- Reporting
his function is responsible for statistical and detail
management reports. These reports will provide a data
base for management analysis and citation accountability.
The reporting subsystem consists of three (3) functions:

Status Reporting
This reporting procedure is a printout of all the
citations current in the system. The report will be
in ascending citation number sequence and provides the
following information for court reference.
a. City of issuance
b. Citation number '
c. Vehicle license number
d. Reporting district
e. Date issued

g. Fine

h. Officer serial number
is Date DMV Notice of Non - Compliance sent (if applicable)
j. Date Notice of Intent sent (if applicable)

Statistical Reporting
'
This function provides a multitude of different variables
limited only by the data base. The reports will also
provide an audit factor of parking citations going through
the system.
15.
Management Reporting
This function provides a reporting base on which management
analyses may be conducted. These will include, but will
not be limited to, the following:
a. Citations per reporting district
b. Total citations per violation

Time Factors for Citation Processing
The following time factors will be utilized during the
sequential occurrence of events within the PCMP:

17. Forms Requirements
The Parking Citation Mangement program will utilize
the basic guidelines for document formatting. These
guidelines are to insure ease and uniformity of the
data entry system. Refer to Figure 1 for the parking
citation format. The Buyer will consult with the
Parking Citation Management Program Manager of Seller
prior to any revision to the parking citation format.
Figures 2 and 3 are the formats for the Notice of Intent,
that will be furnished by the program. As previously
mentioned above, the Buyer will consult with the PCMP
Manager of Seller prior to any revision to the Notice
of Intent formats.
18. The Seller shall provide a programmatic audit trail for
citation(s).issued by the Buyer up to a total of fifty
(50), on an annual and /or semiannual basis upon request.
19. Period of Performance and Termination Provisions
The services of the Seller will commence as of the
date indicated on the face of this contract and
shall continue for a period of twelve (12) months
thereafter.
The performance of work under this contract may be
terminated, in whole or from time to time in part,
with or without cause, by the Buyer provided that
at least sixty (60) days notification be given
Seller in writing. After receipt of the Notice of
Termination the Seller shall cancel his outstanding
committments hereunder covering the procurement of
materials, supplies, equipment and miscellaneous items.
The Seller shall submit his termination claim,
including outstanding liabilities at the time of
termination to the Buyer promptly after receipt of
a Notice of Termination, but in no event later than
one (1) year from the effective date thereof.
20. Compensation
a. $1.74 per citation processed from the date of
execution to the expiration of the contract
term, subject to the condition that contract
cost increases, based upon materials, postage
or other overhead items, may be items for nego-
tiation during the term of the contract.
b. $1.74 per citation processed retroactive from
the date of execution to May 1, 1980.

I 21. DaR Base Transference
Should the City eventually.implement an in -house system,
Seller shall cooperate in transferring necessary data
base information to the City. Compensation to Seller
for any transition services shall be based upon prevail-
ing industry rates.
22. Program Rights
The Seller in providing the services set forth herein,
will utilize as Seller's proprietary, the computer program
developed at Seller expense and entitled Parking Citation
Management Program (POMP).
The Buyer hereby agrees that all rights and titles to the
aforementioned program shall remain exclusively with the
Seller. Further, the Buyer agrees that such program shall
not be provided to the Buyer as part of the Contract; neither
will the Buyer have direct or indirect access to such program
without express written approval of the Seller.
23. Program Security
The PCMP has restricted access and the Seller's project
manager will monitor the program to insure the security
of the system. Only persons authorized by a joint agreement
ment between Seller and Buyer will have a security code
to have access to the system.
24. Applicable Law .
This contract shall be construed and interpreted in
accordance with the laws of the State of California.
25. Amendments and Notices
Sole authority to make changes in or amendments to this
contract and to effect deviations (by way of addition or
deletion) from the work herein specified is hereby vested
in the authorized representative of the Buyer's Contracts
Department, and no directions from such representative
shall be valid unless in writing.
26. Waiver
The failure of Buyer to enforce at any time any provision
of this contract or to exercise any option herein shall
not in any way be construed to be a waiver of the right
of Buyer to demand compliance with each and every other
provision contained in this contract or the right of
Buyer thereafter to enforce each and every provision
thereof.
27. Damages
Buyer agrees to fully indemnify and hold Seller harmless
from any liability, loss, damage and expense resulting
by reason of anything done or omitted to be done by Seller
under or in connection with any work performed by Seller
under the terms and conditions of this contract.
28. Independent Contractor
The Seller's relationship to Buyer in the performance of
this contract is that of an independent contractor. The
personnel performing services under this Agreement shall
at all times be under Seller's exclusive direction and
control and shall be employees of Seller and not employees
of Buyer. Seller shall pay all wages, salaries and other
amounts due its employees in connection with this contract

10 and sh* be responsible for all'reports and obligations
respecting them relating to social security, income tax
. withholding, unemployment compensation, workmen's compen-
sation and similar matters.
Seller shall cover or insure all of its employees perform-
ing services under this contract in compliance with the
applicable laws relating to workmen's compensation and
employer's liability insurance.
Z9. Entire Agreement
This contract is intended by the parties as a final
expression of their agreement and also is a complete and
exclusive statement of the terms thereof, any prior oral
or written agreements regarding the same subject matter
notwithstanding. This contract may not be modified or
terminated orally, and no modification nor any claimed
waiver of any of the provisions hereof shall be binding
unless in writing and signed by the party against whom
such modification or waiver is sought to be enforced.

Per our telephone conversation, this letter confirms SATs offer to
reduce the cost of the Parking Citation Management Program currently
being provided to the City of Newport Beach. SAI proposes that the
contract price be reduced to $1.42 per citation processed, effective
October, 1980. Since this represents a modification in our current
contract, written council approval is required prior to the effective
date.
SAI is pleased to offer the above savings at no change in the services
being provided under the contract. The savings arise from recent up-
grades to our computer software programs which have improved our
operating costs.
As consideration for this change, and in the interests of consistency
with other SAI contracts for similar services, SAI requires that
Paragraph 19, "Period of Performance and Termination Provisions," be
modified to extend to Seller the same termination rights presently
existing for Buyer.
As you are aware, SAI's Parking Citation Management Program (PCW) is
an automated system operated out of the company's Irvine facility. All
personnel directly involved in the POMP Program are highly qualified
people who are computer oriented and/or experienced former police and
municipal employees. They are equipped with the knowledge and expertise
to generate a system of equipment, software, and procedures designed
to perform all the functions of citation/clearance /disposition pro-
cessing.
Attachment A is a summary list of the services which POMP provides. We
believe this is the most complete full- service program available in
California today. POT is fully operational today with 16 separate
California cities and courts. Our current annual volume is over
600,000 citations.

This is a complete parking citation management program where our personnel and /or
company shall be responsible for:
(1) a thoroughly tested and operational "on -line" software program.
(2) bonded courier service for pickup and delivery.
(3) the entry of parking citations into the computer at our facility with
verification and validation procedures.
(4) the filing and storage of the original parking citations at our
facility.
(5) all terminal and data storage hardware at our facility.
(6) D.M.V. interface capability for obtaining registered -owner information.
(7) all telephone calls and correspondence (excluding bail) regarding

PARKING CITATION MANAGEMENT
,THIS CONTRACT, made and entered into as of this...! -
day of 1980, by and between The City of Newport
Beach, a publip body organized and existing under and by virtue
of the laws of the State of California, hereinafter referred to
as the "Buyer" and Science Applications, Inc., a corporation
organized and existing under the laws of the State of California,
with its principal place of business at 1200 Prospect Street,
La Jolla, California, 92038, hereinafter referred to as the
"Seller ".
WHEREAS, the Buyer desires that the Seller provide
technical services to conduct a Parking Citation Management
Program (PCMP).
NOW, THEREFORE, the Buyer and the Seller do mutually
agree as follows:
A. STATEMENT OF WORK. Work will be conducted as follows:
1. Data Entry
The citation data entry function of PCMP is concerned
with the entry of data on all parking citations; the
establishment and maintenance of a data base; the
identification of citations within the system from a
query; and provisions for data elements which will be
utilized for future statistical and detail reporting
and systems verification.
2. Entry of Data
Data shall be entered from four (4) sources as follows:
a. Original Entry of Parking Citation Into System at
After all parking citations have been issued, they
will be sent for processing to the municipal court
having jurisdiction. When the citations arrive at
the court, a Seller's data processing clerk will
code the citations to capture the required data for
automated processing. The original parking citations
will be filed into a numerical file by citation
number at the court. The citations will be removed
from that numerical file only upon disposition by
the municipal court or the Department of Motor
Vehicles. The coded information will then be entered
into the computer system.
b. Entry of Disposition by the Court
The municipal court will have the only authority,
other than the Department of Motor Vehicles, to
establish a disposition for parking citations. A
designatee of the clerk of the municipal court will
fill out a disposition sheet daily to give a
disposition for the following reasons:
(1) Paid on initial parking citation

(2) Paid on notice before Notice of Non - Compliance
to Department of Motor Vehicles
(3) Paid on notice after Notice of Non - Compliance
to Department of Motor Vehicles
(4) Dismissed by court
(5) Fine suspended
The disposition sheet will be given to the Buyer's
data processing clerk assigned to that court for
entry into the system.
c. Entry of the Registered Owner
All current parking citations in the system which
have reached a failure to appear status will have
the required information sent to the Department of
Motor Vehicles for registered owner information.
The systems program will be interfaced with the
Department of Motor Vehicles' DMV /EDP Vehicle
Registration Non - Urgent Inquiry System via magnetic
tape.
The Department of Motor Vehicles, in return, inputs
the vehicle registered owner information in a
compatible format for future use.
d. Entry of the Department of Motor Vehicles Disposition
The Department of Motor Vehicles, Division of
Registration, will enter the disposition of parking
citations that have been sent to them via a Notice
of Non - Compliance. The dispositions -will be one of
the following:
(1) Cleared with collection of bail
(2) Cleared without collection of bail
The Division of Registration will clear a Non -
Compliance Notice without collection of bail for
only one (1) of four (4) reasons:
(1) Transfer of registration
(2) Non - renewal for two (2) years
(3) Court receipt presented by applicant
(4) Deletion notice sent by court
3. Data Base
This function provides a base for future processing and
data base analysis. The following data are captured for
processing statistical and legal purposes:
a. City identifier
b. Citation number

d. Reporting district
e. Vehicle identifiers
f. Location of violation
g. Violation(s)

h. Officer's serial number
When the parking citation proceeds further into the
system, a combination of the following data will be
added:
a. Date cleared
b. How cleared
c. Registered owner
d. Date notice sent
4. Identification of Parking Citation Within the System
This function is responsible for locating a parking
citation within the system, and giving the status of
that citation in the system. This is a valuable asset
for violators who have lost their citations, eliminating
the long mechanical delay of hand searching for a
parking citation.
The court shall have two (2) alternatives for an
inquiry. One is to look at an updated status report
that is sorted by numerical sequence or secondly, make
a direct inquiry into the system via a "hotline ". This
"hotline" has direct access to a systems operator.
5. Statistical Data Collection
Data collected from entries into the system will be
available for future development and detail management
reports (refer to Paragraph 12).
6. Data Verification
Data that is entered will be verified through both
human and programmatric methods. The data processing
clerk will insure that all illegible items are verified
by the originator before entry. Within the system
itself, there are four (4) verification processes:
a. During original data entry, critical data elements
will be "double entered ".
b. The data will be scanned again to verify that all
elements are within predetermined parameters.
C. The registered owner information will be reverified
against the vehicle license number, make, and model,
prior to a notice being issued.
d. A scan mode will be used by the operator at any
time to scan for errors.
7. Subsystem- Notice of Intent Generation
The Notice of Intent generation function is concerned
with the parking citations that are in a failure to
appear status. This function consists of several sub -
functions for notice generation. These subfunctions
are:
a. Automated request for registered owner
b. Registered owner is matched with a parking citation

8. Automated Request for Registered Owner
This subfunction will be interfaced with the Department
of Motor Vehicles when a parking citation has reached
the day after the appearance date, the system generates
an interfaced magnetic tape to the DMV /EDP Vehicle
Registration Non- Urgent Inqu�ir_y System. The tape will
be sent to DMV an�c will— einto a 24 -hour turnaround
agreement.
9. Registered Owner is Matched With a Parking Citation
This subfunction is responsible as a further edit and
verification procedure. A cross -check of all data will
be verified to insure the registered owner data matches
the data provided on the vehicle issued a citation.
Prior to the Notice of Intent being generated, the parking
citation status will again be verified to insure the
status is still "failure to appear ".
10. Notice of Intent Is Generated
The Notice of Intent will be generated and sent to the
registered owner as the records of the Department of
Motor Vehicles indicates. This Notice of Intent provides
the registered owner with the following:
a. Municipal court having jurisdiction
b. Vehicle identifier
c. Date and time of violation
d. Violation
e. Location of violation
f. Legal obligations
g. Consequences for failure to comply with the legal
obligations
h. Instructions for change of ownership or lessee
information
i. Instructions on how to comply with the notice
The Notice of Intent will be prepaid first class postage,
excluding return postage.
11. Subsystem- Notice of Non - Compliance
This subsystem is responsible for identifying those
parking citations with which there was noncompliance to
the Notice of Intent. An automated Notice of Non -
Compliance will be sent to the Department of Motor Vehicles
and attached to the vehicle registration.
There is a critical time factor involving this subsystem.
The State of California has stated by law that, "Whenever
any person has for a period of 15 or more days failed to
comply with the provisions (Notice of Intent), notice shall
be given to the Department of Motor Vehicles not more than
thirty (30) days after such failure to appear. The system
will have programmatic time table to insure all requirements
of the law are met ".
12. Subsystem- Reporting
Shis function is responsible for statistical and detail
management reports. These reports will provide a data
base for management analysis and citation accountability.
The reporting subsystem consists of three (3) functions:

13. Status Reporting
This reporting procedure is a printout of all the
citations current in the system. The report will be
in ascending citation number sequence and provides the
following information for court reference.
a. City of issuance
b. Citation number
c. Vehicle license number
d. Reporting district
e. Date issued
f. Violation
g. Fine
h. Officer serial number
i. Date DMV Notice of Non - Compliance sent (if applicable)
j. Date Notice of Intent sent (if applicable)
k. Citation status in system
14. Statistical Reporting
This function provides a multitude of different variables
limited only by the data base. The reports will also
provide an audit factor of parking citations going through
the system.
15. Management Reporting
This function provides a reporting base on which management
analyses may be conducted. These will include, but will
not be limited to, the following:
a. Citations per reporting district
b. Total citations per violation

17. Forms Requirements
The Parking Citation Mangement program will utilize
the basic guidelines for document formatting. These
guidelines are to insure ease and uniformity of the
data entry system. Refer to Figure 1 for the parking
citation format. The Buyer will consult with the
Parking Citation Management Program Manager of Seller
prior to any revision to the parking citation format.
Figures 2 and 3 are the formats for the Notice of Intent,
that will be furnished by the program. As previously
mentioned above, the Buyer will consult with the PCMP
Manager of Seller prior to any revision to the Notice
of Intent formats.
18. The Seller shall provide a programmatic audit trail for
citation(s).issued by the Buyer up to a total of fifty
(50), on an annual and /or semiannual basis upon request.
19. Period of Performance and Termination Provisions
The services of the Seller will commence as of the
date indicated on the face of this contract and
shall continue for a period of twelve (12) months
thereafter.
The performance of work under this contract may be
terminated, in whole or from time to time in part,
with or without cause, by the Buyer provided that
at least sixty (60) days notification be given
Seller in writing. After receipt of the Notice of
Termination the Seller shall cancel his outstanding
committments hereunder covering the procurement of
materials, supplies, equipment and miscellaneous items.
The Seller shall submit his termination claim,
including outstanding liabilities at the time of
termination to the Buyer promptly after receipt of
a Notice of Termination, but in no event later than
one (1) year from the effective date thereof.

withholding, unemployment compensation, workmen's compen-
sation and similar matters.
Seller shall cover or insure all of its employees perform-
ing services under this contract in compliance with the
applicable laws relating to workmen's compensation and
employer's liability insurance.
29. Entire Agreement
This contract is intended by the parties as a final
expression of their agreement and also is a complete and
exclusive statement of the terms thereof, any prior oral
or written agreements regarding the same subject matter
notwithstanding. This contract may not be modified or
terminated orally, and no modification nor any claimed
waiver of any of the provisions hereof shall be binding
unless in writing and signed by the party against whom
such modification or waiver is sought to be enforced.

OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND SCIENCE APPLI-

WHEREAS, there has been presented to the City
Council of the City of Newport Beach a certain agreement

and conditions of said agreement and finds them to be
satisfactory and that it would be in the best interest of
the City to execute said agreement,

PARKING CITATION MANAGEMENT CONTRACT
The City of Newport Beach annually issues a significantly large
volume of parking violation citations. Currently these citations
number in excess of 150,000 per year.
Prior to February 1979, the City's citations had been processed
by the Harbor Municipal Court. It had been learned, however,
that due to a combination of large volumes and inadequate staffing
levels, the Court was far behind in processing the City's citations.
This was true even given the fact that the City had employed two
clerical personnel specifically to work at the Court in the pro-
cessing function.
In response to these developments, and given the fact that the
City was losing citation revenues due to the backlog, the City
Council, on February 12, 1979, authorized the execution of a
contract with Science Applications, Inc. (SAI) to conduct a Parking
Citation Management (PCM) program.
Performance Analysis
Attachment 1 is a chart illustrating the comparison between citations
issued and revenues generated through processing for 1978, 1979
and part of 1980. The significant aspect of this chart relates
to the noticeable increases in revenues which have occurred since
the City began contracting out its parking citation management
operations. Several points need to be made about this data. These
figures represent "gross" revenues. That is, they do not take
account of the monies paid to SAI for contracting services, or the
15% retained by the Court, or of the funds "on hold" at the D.M.V.
According to the February 1979 contract, the City was to pay SAI
pursuant to the following sliding scale:

The majority of the City citations have been processed at a
rate of $1.80. Between January 1979 and April 30, 198o,a total
of 177,827 citations were processed. Subtracting contractor
costs and the 15% of gross revenues still retained by the Court
according to law, the following net revenue figures result:
$1,132,063 (Gross Revenues)
- $282,867 (SAI Payments)
- $169,809 (Court Costs)
$679,387 NET CITY
The increased total number of citations actually processed since
contracting with SAI has, of course, increased the cumulative net
revenues to the City.
Attachment 2 is a list of the types of operations performed by
SAI pursuant to the contract.
The SAI contract expired on April 30, 1980.
Proposed Contract Renewal
Attachment 3 is a copy of the proposed one -year renewal contract
with SAI. This contract is essentially the same as the former
contract with the following exceptions:
1. Rate will be at a flat $1.74 per citation issued rather than
according to a sliding scale.
2. City will be billed at $1.74 per citation issued retroactive
from the execution date of the new contract to the expiration
date of the former contract.
3. SAI agrees to provide the City with a procedure to allow for
"spot checking" of the processing operation by instituting
a programmatic audit trail.
4. SAI agrees to cooperate in transferring necessary data base
information to the City in the event an in -house system is
implemented.

5. 60 -day rather than a 30 -day termination clause inserted at
the request of SAI.
Discussion
It is staff's position that the proposed contract represents a
fair and equitable agreement for the following reasons:
1. The $1.74 per citation processed is less than the rate
charged by SAI to other cities. It is lower in recognition
of the City's large volumes.
2. Without a contract, SAI would have billed the City at a rate
of $1.80 rather than $1.74 per citation retroactive to
May 1, 1980.
3. SAI has a "track record" in the citation processing business
and has provided the City with a quality service.
4. SAI has developed an effective working relationship with the
Court and D.M.V. which is essential to a reliable system.
It should be noted at this juncture that the City did receive
proposals and hold meetings with other firms interested in per-
forming this service. The City's need to receive continuous and
reliable processing was deemed to be of paramount concern given the
inability of staff to absorb this function at the present time.
Since SAI is the only citation management company which has
clearly established and demonstrated its capabilities, it was
felt that a sudden change would be unwise without assurances that
the same type of system stability could be maintained. As of this
writing it is the position of this office, and one which is shared
by the Police Chief, that such assurances have not been demonstrated
by any other firm. It should be stressed, however, that staff
fully intends to actively monitor developments in the field as well
as to pursue the possibility of implementing in -house processing.
Should a change be deemed appropriate at some point during the
course of the contract term, the 60 -day termination clause will
allow for the exercise of the City's options.
Recommendation
It is recommended that the City Council authorize the execution
o the subject contract with Science Applications, Inc.

The City of Newport Beach, a public body organized and existing under
and by virtue of the laws of the State of California, hereinafter referred
to as the "Buyer" and Science Applications, Inc., a corporation organized
and existing under the laws of the State of California, with its principal
place of business at 1200 Prospect Street, La Jolla, California, 92038,
hereinafter referred to as the "Seller ".
WHEREAS, the Buyer desires that the Seller provide technical services to
conduct a Parking Citation Management Program (POMP).
NOW, THEREFORE, the Buyer and the Seller do mutually agree as follows:
1. STATEMENT OF WORK. Work will be conducted as follows:
1.1 Data Entry
The citation data entry function of PCMP is concerned with the
entry of data on all parking citations; the establishment and
maintenance of a data base; the identification of citations
within the system from a query; and provisions for data elements
which will be utilized for future statistical and detail report-
ing and systems verification.
1.1.1 Entry of Data
Data shall be entered from four (4) sources.
(1) Original entry of parking citation into system at the
court by Seller's personnel.
(2) Entry of disposition by the court.
(3) Entry of registered owner (R /0) information from the
Department of Motor Vehicles.
(4) Entry of the Department of Motor Vehicles disposition.
a. Original Entry of Parking Citation Into System at the Court
After all parking citations have been issued, they will be
sent for processing to the municipal court having jurisdiction.
When the citations arrive at the court, a Seller's data process-
ing clerk will code the citations to capture the required data
for automated processing. The original parking citations will
be filed into a nmerical file by citation number at the court.
The citations will be removed from that numerical file only
upon disposition by the municipal court or the Department of
Motor Vehicles. The coded information will then be entered in-
to the computer system.
b. Entry of Disposition by the Court
The municipal court will have the only authority, other than
the Department of Motor Vehicles, to establish a disposition
for parking citations. A designatee of the clerk of the
municipal court will fill out a disposition sheet daily to
give a disposition for the following reasons:
(1) Paid on initial parking citation
(2) Paid on notice before Notice of Non-Ccmpliance to Depart-
ment of Motor Vehicles
(3) Paid on notice after Notice of Noncompliance to Depart-
ment of Motor Vehicles
(4) Dismissed by court
(5) Fine suspended
The disposition sheet will be given to the Buyer's data process-
ing clerk assigned to that court for entry into the system.
c. Entry of the Registered Owner (R /0) Information by the Depart-
ment of Motor Vehicles
All current parking citations in the system which have reached
a failure to appear status will have the required information
sent to the Department of Motor Vehicles for registered owner
information. The systems program will be interfaced with the
Department of Motor Vehicles' DMV/EDP Vehicle Registration Non -
Urgent Inquiry System via magnetic tape.
The Department of Motor Vehicles, in return, inputs the vehicle
registered owner information in a compatible format for future
use.
d. Entry of the Department of Motor Vehicles Disposition
The Department of Motor Vehicles, Division of Registration, will
enter the disposition of parking citations that have been sent
to them via a Notice of Non-Compliance. The dispositions will be
one of the following:
(1) Cleared with collection of bail
(2) Cleared without collection of bail
The Division of Registration will clear a Non- Coupliance Notice
without collection of bail for only one (1) of four (4) reasons:
(1) Transfer of registration
(2) Non - renewal for two (2) years
(3) Court receipt presented by applicant
(4) Deletion notice sent by court
1.1.2 Data Base

This function provides a base for future processing and data
base analysis. The following data are captured for processing
statistical and legal purposes:
(1) City identifier
(2) Citation number
(3) Date and time of issue
(4) Reporting district
(5) Vehicle identifiers
(6) Location of violation
(7) Violation(s)

1.1.3 Identification of Parking Citation Within the System
This function is responsible for locating a parking citation
within the system, and giving the status of that citation in
the system. This is a valuable asset for violators who have
lost their citations, eliminating the long mechanical delay
of hand searching for a parking citation.
The court shall have two (2) alternatives for an inquiry. One
is to look at an updated status report that is sorted by numerical
sequence or secondly make a direct inquiry into the system via a
"hotline ". This "hotline" has direct access to a systems operator.
1.1.4 Statistical Data Collection
Data collected from entries into the system will be available for
future development and detail management reports (refer to Para-
graph 1.4).
1.1.5 Data Verification
Data that is entered will be verified through both human and pro-
gramnatric methods. The data processing clerk will insure that all
illegible items are verified by the originator before entry. Within
the system itself, there are four (4) verification processes:

(1) During original data entry, critical data elements will
be "double entered ".
(2) The data will be scanned again to verify that all elements
are within predetermined parameters.
(3) The registered owner information will be reverified against
the vehicle license number, make, and model, prior to a
notice being issued.
(4) A scan mode will be used by the operator at any time to scan
for errors.
1.2 Subsystem -Notice of Intent Generation
The Notice of Intent generation function is concerned with the
parking citations that are in a failure to appear status. This
function consists of several subfunctions for notice generation.
These subfunctions are:
(1) Automated request for registered owner
(2) Registered owner is matched with a parking citation
(3) Notice of Intent is generated
1.2.1 Automated Request for Registered Owner
Ibis subfunction will be interfaced with the Department of Motor
Vehicles when a parking citation has reached the day after the
appearance date, the system generates an interfaced magnetic tape
to the DMV /EDP Vehicle Registration Non Urgent Inquiry System.
The tape will be sent to DMV and will be put into a 24 -hour turn-
around agreement.
1.2.2 Registered Owner is Matched With a Parking Citation
This subfunction is responsible as a further edit and verification
procedure. A cross -check of all data will be verified to insure the
registered owner data matches the data provided on the vehicle issued
a citation. Prior to the Notice of Intent being generated the park-
ing citation status will again be verified to insure the status is
still "failure to appear ".
1.2.3 Notice of Intent Is Generated
The Notice of Intent will be generated and sent to the registered
owner as the records of the Department of Motor Vehicles indicates.
This Notice of Intent provides the registered owner with the following:
(1) Municipal court having jurisdiction
(2) Vehicle identifier
(3) Date and time of violation
(4) Violation
(5) Location of violation

(7) Consequences for failure to comply with the legal obligations
(8) Instructions for change of ownership or lessee information
(9) Instructions on how to comply with the notice
The Notice of Intent will be prepaid first class postage, ex-
cluding return postage.
1.3 Subsystem -Notice of Non - Compliance
This subsystem is responsible for identifying those parking
citations with which there was noncompliance to the Notice of
Intent. An automated Notice of Non - Compliance will be sent to
the Department of Motor Vehicles and attached to the vehicle
registration.
There is a critical time factor involving this subsystem. The
State of California has stated by law that, "Whenever any person
has for a period of 15 or more days failed to comply with the
provisions (Notice of Intent), notice shall be given to the De-
partment of Motor Vehicles not more than thirty (30) days after
such failure to appear. The system will have programmatic time
table to insure all requirements of the law are met ".
1.4 Subsystem - Reporting
This function is responsible for statistical and detail manage-
ment reports. These reports will provide a data base for nrmage-
ment analysis and citation accountability. The reporting subsystem
consists of three (3) functions:
(1) Status reporting
(2) Statistical reporting
(3) Management reporting
1.4.1 Status Reporting
This reporting procedure is a printout of all the citations current
in the system. The report will be in ascending citation number se-
quence and provides the following information for court reference.

1.4.2 Statistical Reporting
This function provides a multitude of different variables limited
only by the data base. The reports will also provide an audit
factor of parking citations going through the system.
1.4.3 Management Reporting
This function provides a reporting base on which management analyses
may be conducted. These will include, but will not be limited to,
the following:
(1) Citations per reporting district
(2) Total citations per violation
1.4.5 Time Factors for Citation Processing
The following time factors will be utilized during the sequential
occurrence of events within the PCMP:

1.4.6 Forms Requirements
The Parking Citation Management program will utilize the basic
guidelines for document formatting. These guidelines are to
insure ease and uniformity of the data entry system. Refer to
Figure 1 -1 for the parking citation format. The Buyer will con-
sult with the Parking Citation Management Program Manager of
Seller prior to any revision to the parking citation format.
Figures 1 -2 and 1 -3 are the formats for the Notice of Intent,
that will be furnished by the program. As previously mentioned
above, the Buyer will consult with the PCMP Manager of Seller
prior to any revision to the Notice of Intent formats.
2. PERIOD OF PERFORMANCE. The services of the Seller will cam ence as
of the date indicated on the face of this contract and shall continue
for a period of twelve (12) months thereafter. Contingent upon acceptance
of a Memorandm of Understanding between the courts having jurisdiction
and the City of Newport Beach, actual PCMP implementation will commence
within thirty (30) days after date of this contract.
3. COMPENSATION. For performance of services required under this contract,
the Buyer agrees to pay the Seller in the following manner, in every
case subject to receipt of a monthly requisition for payment from the
Seller:

Buyer also agrees that in the event the anticipated volmune of 100,000

ARTICLE I -- PROGRAM RIGRTS
The Seller in providing the services set forth herein, will utilize as
Seller's proprietary, the computer program developed at Seller expense
and entitled Parking Citation Management Program (POMP).
The Buyer hereby agrees that all rights and titles to the aforementioned
program shall remain exclusively with the Seller. Further, the Buyer
agrees that such program shall not be provided to the Buyer as part of
the Contract; neither will the Buyer have direct or indirect access to
such program without express written approval of the Seller.

The PCMP has restricted access and the Seller's project manager will
monitor the program to insure the security of the system. Only persons
authorized by ajoint agreement between Seller and Buyer will have a -
security code to have access to the system.
ARTICLE III — APPLICABLE LAW
This contract shall be construed and interpreted in accordance with the
laws of the State of California.
ARTICLE IV -- CHANGES AND SUSPENSION
If any change or suspension of work, by the Buyer, causes a material in-
crease or decrease in the cost of, or the time required for the performance
of any part of the work under this contract, an equitable adjustment shall
be made in the contract price or delivery schedule, or both, provided Seller
shall have notified Buyer in writing of any claim for such adjustment within
thirty (30) calendar days from the date of such notice from Buyer or from the
date of any act of Buyer which Seller considers constitutes such a change.
No such adjustment or any other modification of the terns of this contract
will be allowed unless authorized by Buyer by means of a contract supple-
mental agreement. Seller shall proceed with the work as changed without
interruption and without awaiting settlement of any such claim.
ARTICLE V -- AMENDMENTS AND NOTICES
Sole authority to make changes in or amendments to this contract and to
effect deviations (by way of addition or deletion) from the work herein
specified is hereby vested in the authorized representative of the Buyer's
Contracts Department, and no directions from such representative shall be
valid unless in writing.
ARTICLE VI -- WAIVER
The failure of Buyer to enforce at any time any provision of this contract
or to exercise any option herein shall not in any way be construed to be a
waiver of the right of Buyer to demand compliance with each and every other
provison contained in this contract or the right of Buyer thereafter to enforce
each and every provision thereof.

ARTICLE VIII -- INDEPENDENT CCNTRACIOR
The Seller's relationship to Buyer in the performance of this contract
is that of an independent contractor. The personnel performing services
under this Agreement shall at all times be under Seller's exclusive direction
and control and shall be employees of Seller and not employees of Buyer.
Seller shall pay all wages, salaries and other amounts due its employees in
connection with this contract and shall be responsible for all reports and
obligations respecting them relating to social security, income tax with-
holding, unemployment compensation, workmen's compensation and similar
matters.
Seller shall cover or insure all of its employees performing services under
this contract in compliance with the applicable laws relating to workmen's
compensation and employer's liability insurance.
ARTICLE IX -- ENTIRE AGREEIM
This contract is intended by the parties as a final expression of their
agreement and also is a complete and exclusive statement of the terms
thereof, any prior oral or written agreements regarding the same subject
matter notwithstanding. This contract may not be modified or terminated
orally, and no modification nor any claimed waiver of any of the provisions
hereof shall be binding unless in writing and signed by the party against
whom such modification or waiver is sought to be enforced.

outstanding commitments hereunder covering the procurement of materials,
supplies, equipment and miscellaneous items.
The Seller shall submit his termination claim, including outstanding

year from the effective date thereof.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND SCIENCE
APPLICATIONS, INC., IN CONNECTION WITH THE
PARKING CITATION MANAGEMENT PROGRAM
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Science Applications, Inc., in
connection with the Parking Citation Management Program; and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to
authorize the Mayor and City Clerk to execute said agreement,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of Newport
Beach.
