Steve Bucknam Jr. Senior Civil Engineer- Design Section SB:do Att. 1 f, 1 0 0 AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES JASMINE CREEK STORM DRAIN DESIGN REPORT THIS AGREEMENT is made and entered into this -5.11 day of _.2 1979, by and between: The CITY OF NEWPORT BEACH, a municipal corporation, hereinafter designated as "CITY "; and ALDERMAN, SWIFT AND LEWIS, CONSULTING ENGINEERS, consulting civil engineers, hereinafter designated as "ENGINEER." WITNESSETH: WHEREAS, CITY intends to have a design report, hereinafter referred to as "REPORT," prepared to develop hydrologic, hydraulic and preliminary system design data for the Jasmine Creek storm drain system, here- inafter referred to as "SYSTEM "; and WHEREAS, ENGINEER has submitted a proposal to CITY to perform engineering ser- vices in connection with the REPORT preparation; and WHEREAS, CITY desires to accept said proposal; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. GENERAL A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. SERVICES TO BE PERFORMED BY ENGINEER A. Provide topographic mapping for the study area. The mapping will be provided at a scale of 1" = 200' with 5 -foot contour intervals. B. Prepare a detailed project drainage map which will reflect present as well as ultimate land use. The drainage area boundary and flow patterns will be verified in the field. C. Establish levels of protection against flood risk for various reaches of the SYSTEM. Risk will be established in relation to damage potential. D. Prepare a hydrological analysis based on County of Orange EMA criteria including unit hydrograph for Harbor View Dam E. Verify the physical characteristics of the existing storm drain system. F. Compute the capacity of the existing system from Newport Bay to Harbor View Dam, including verification of actual outflow characteristics from Harbor View Dam. G. Investigate and recommend solutions to the silting problem at the outlet of the Bayside Drive storm drain to Newport Bay. H_ Assess system deficiencies by comparing actual with desired capacity. I. Investigate alternate solutions for correcting deficiencies both structural and hydraulic, taking into consideration the service life of existing facilities. J. Review alternates with CITY staff. K. For the selected alternate prepare a preliminary plan and profile including plotting of the hydraulic grade line and construction cost estimate. L. Summarize findings in a final design report. III. DUTIES OF CITY CITY hereby agrees to supply ENGINEER with the following in- formation and materials: A. As -built drawings of existing storm drain system, zoning maps, inspection reports, design reports and other in- formation relative to the existing system. B. Assistance in the detailed field verification phase for. the existing storm drain system. This would include TV inspection, maintenance.personnel and survey crew for a one or two -day period. IV. COMPLETION OF REPORT, Two (2) copies of the draft REPORT shall be submitted to CITY for review and comment by June 15, 1979. Ten (10) copies of the final REPORT shall be submitted to the Public Works Director of CITY within 30 days of ENGINEER's receipt of draft REPORT com- ments from CITY. 2 - V. OWNERSHIP OF REPORT DOCUMENTS 0 Original drawings, notes, maps and other documents shall become the property of the CITY, and may be reproduced and utilized as deemed necessary by the Public Works Director. VI. ENGINEER IN CHARGE Mr. William D. Lewis, RCE No. 11543, shall be Engineer in charge of REPORT preparation. VII. FEE SCHEDULE AND PAYMENT In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Twenty -two Thousand Dollars ($22,000.00) except as otherwise provided herein. A. Hourly Salary Costs: Hourly Personnel Salary Cost Principal in Charge of Project $50.00 Designer $27.00 Designer /Draftsperson $25.00 Draftsperson $23.75 Secretary /Typist $15.00 Technician $12.00 B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not ex- ceed ninety percent (90%) of the maximum fee; 2. Balance of the total amount earned to be paid upon com- pletion of work specified in Section II (Services to be Performed by ENGINEER); 3. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents, as well as computer costs, filing fees, checking fees, materials costs related to survey work plus fifteen percent (15%) and other related costs authorized in advance by the Public Works Director and advanced by ENGINEER. - 3 - VIII. ADDITIONAL WORK Should ENGINEER complete any additional work not outlined in this Agreement, but authorized in writing by the Public Works Director of CITY, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section VII (Fee Schedule and Payment) above. IX. REPORT SCOPE REVISIONS The scope of the REPORT may be changed and the maximum fee re- vised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed Two Thousand Dollars ($2,000.00). If the revisions to the scope of the REPORT would result in an increase in the maximum fee exceed- ing Two Thousand Dollars ($2,000.00), an amendment providing for such revisions shall be processed and executed by the par- ties hereto. X. RIGHT OF TERMINATION CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER's business office at 2921 South Main Street, Santa Ana, California 92707. In the event of termination due to errors, omissions, or negli- gence of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER for that portion of the work affected by such errors, omissions, or negligence of the ENGINEER. If this Agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. - 4 - XI. HOLD HARMLESS ENGINEER shall indemnify and hold harmless CITY and its officers and employees, from any damage or liability arising from any errors, omissions, or negligence in ENGINEER's performance of this Agreement, or in the engineering work and services herein provided. " E A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES BETWEEN THE CITY OF NEWPORT BEACH AND ALDERMAN, SWIFT AND LEWIS IN CONNECTION WITH THE DESIGN REPORT FOR JASMINE CREEK STORM DRAIN WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain Agreement for Professional Engineering Services between the City of Newport Beach and Alderman, Swift and Lewis in connection with the design report for the Jasmine Creek storm drain; and WHEREAS, the City Council has reviewed the terms and conditions of said Agreement and finds them to be satisfactory and that it would be in the best interest of the City to authorize the Mayor and City Clerk to execute said Agreement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said Agreement for Professional Engineering Services above described is approved, and the Mayor and City Clerk are authorized and directed to execute the same on behalf of the City of Newport Beach.
