H -2(d) Adopt a resolution awarding Contract 2090 to Cecil Mays in the total amount of $18,050.00 (for the base bid plus the additive bid item); and authorizing the Mayor and City Clerk to execute the contract. DISCUSSION: Construction: Base Bid $16,790 Additive Bid Item 1,260 $18,050 Designer's Fee 850 Miscellaneous & Contingencies 1,100 $20,000 The project consists of the addition of a staff restroom plus a staff room with built -in kitchen unit. The additive bid item is for replacing cold water supply lines to two existing restrooms and a janitor closet. The project is financed by a $20,000 appropriation from the Building Excise Tax Fund. The work is shown on the attached sketch. The low bid is 5% under the estimate of $19,000. The designer of the addition is Howard Martin of Balboa Island. The estimated date of completion is October 19, 1979. If contingencies arise, the staff will request a budget amendment to the 1979 - -80 budget. The low bidder is a properly licensed general building contractor who has mainly worked on buildings owned by himself. The project is relatively simple. The bonds and contract protect the City's interests. The other two bids exceed the available funds. It is therefore recommended that the contract be awarded o the low bidder even though he has no record of working for local public agencies or large private organizations. Benjamin B. DISCUSSION: The 1978 -79 budget contains an appropriation of $20,000 from the Building Excise Tax Fund to construct two staff restrooms at Mariners Library. The scope of the project has been changed to provide one restroom plus a staff room with built -in kitchen unit. A copy of the floor plan is attached. A full set of plans is on display in the Council Conference Room. The plans were prepared by Howard C. Martin, Building Designer, of Balboa Island. Work was sub- stantially completed by November 9, 1979. Recommendation is made that there be no assessment of liquidated damages because the contractor prosecuted the job vigorously; and the City requested him to do additional work on the building which was not a part of this contract. The City was not damaged by the delay. (cont.) .. t^a'. i Page la The City has adopted the Standard Specifications for Public Works Construction (1976 Edition) as prepared by the Southern California Chapters of the Merican__FubTTc Works Association and the Associated General Contractors of America. Copies may be obtained from Building News, Inc., 3055 Overland Avenue, Los Angeles, California 90034, (213) 870 -9871. The City has adopted Standard Special Provisions and Standard Drawings. Copies of these are available at the Public Works Department at a cost of $5 per set. A standard "City of Newport Beach Special Endorsement" form has been adopted by the City of Newport Beach. This form is the only endorsement acceptable to the City for liability insurance purposes. The successful low bidder will be required to complete the form upon award of contract. (A sample form is attached for reference.) For any required bonds, the company issuing bid bonds, labor and material bonds, and faithful performance bonds must be an insurance company or surety company licensed by the State of California. In accordance with the provisions of Article 2, Chapter 1, Part 7 of the California Labor Code (Sections 1770 et seq.), the Director of Industrial Relations has ascer- tained the general prevailing rate of per diem wages in the locality in which the work is to be performed for each craft, classification, or type of workman or mechanic needed to execute the contract. A copy of said determination is available in the office of the City Clerk. All parties to the contract shall be governed by all provisions of the California Labor Code relating to prevailing wage rates (Sections 1770 -7981 in- clusive). The contractor shall be responsible for compliance with Section 1777.5 of the California Labor Code for all apprenticeable occupations. The contractor shall post a copy of the prevailing wage rates at the job site. Copies may be obtained from the Public Works Department. The City reserves the right to reject any or all bids and to waive any informality in such bids. In case of a discrepancy between words and figures, the words shall prevail. In case of an error in the extension of a unit price, the corrected extension shall be calculated and the bids will be computed as indicated above and compared on the basis of the corrected totals. The estimated quantities of work indicated in this Proposal are approximate only, being given solely as a basis for comparison of bids. BIDDING . . . . . . . . . . . . . . . . . . . . . . . . . 3 • 0 SPIof2 CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT SPECIAL PROVISIONS FOR CONSTRUCTION OF ADDITION TO MARINERS LIBRARY CONTRACT NO. 2090 SCOPE OF WORK The work to be done under the base bid for this contract consists of relocating a french drain, removing and disposing of existing concrete sidewalk and turf; constructing a building addition to the existing Mariners Library building. The building addition will be 22 feet long and 13 feet wide. The work to be done under additive bid item No. 2 consists of furnishing and installing new cold water supply lines to two existing restrooms and a janitort closet in the existing library building. The contract does not call for any planting or replacement of sprinklers. The contract requires the Contractor to furnish all labor, equipment, material, transportation, and services necessary to complete all the work as shown on the Drawing No. B- 5069 -S (Sheets 1 -4 incl.) and in accordance with these Special Provisions, the City Standard Special Provisions and Drawings, the City's Standard Specifications, and the 1976 Uniform Building Code. The City's Standard Specifications are the Standard Specifications for Public Works Construction, 1976 Edition. SPECIAL CONDITIONS The Special Conditions contain additions to the Standard Specifications. In the event of conflict between the Special Conditions and the Standard Specifi- cations, the Special Conditions shall prevail. III. GUARANTEES Besides guarantees required elsewhere, the contractor shall guarantee all work for a period of one (1) year after the date of acceptance of the work by the City; and shall repair and replace any such work, together with any other work which may be displaced in so doing, that may prove defective in workmanship and /or materials within the one (1) year period from date of acceptance, with- out any expense to the City, ordinary wear and tear and unusual abuse or neglect excepted. WATER AND ELECTRICITY The Contractor may use at no cost to him water and electricity that is available at the existing building. VIII. RESTROOM FACILITIES There are public restrooms available adjacent to the existing multi - purpose room which may be used by the contractor. IX. SITE PREPARATION Debris, vegetation, other deleterious materials, and non - organic debris or concrete, etc., located at the site of the proposed building addition shall be removed from the site and disposed of in a legal manner. The existing french drain to be relocated consists of a 21- inch - diameter pipe 5 feet deep filled with rock. It shall be relocated to clear the building addition, and connected to the existing roof drain with a 6 -inch PVC pipe. X. SUBGRADE PREPARATION The excavated soils shall be replaced with a minimum of 4 inches of clean sand, brought to approximate optimum moisture content and compacted to a mini- mum relative compaction of 95 percent of the laboratory standard. The labora- tory standard is ASTM D- 1557 -70, the 5 -layer method. XI. ALLOWANCES The contractor shall include in his Base Bid the following allowances: Flooring: $525 to include furnishing and installing vinyl flooring in the toilet room and lavatory room; and carpet and pad in the staff room and corridor. Finish Hardware: $400 to include handicapped grab rail, toilet tissue holder, an owel dispenser, and door hardware. SP 3 of 3 The amount of each allowance includes the cost to the Contractor less any trade discounts, delivery, labor allowed under the allowance and taxes. The base bid for the contract includes the Contractor's costs for handling the items at the building site; labor for installation and finishing except where labor is a part of the allowance; other expenses required to complete the installation; and overhead and profit. The Contractor must assist the owner in determining qualified suppliers or installers, and obtain proposals from them when requested by the owner. Upon notification of selection by the owner, the Contractor must purchase products and make arrangements for delivery and installation. Should the net cost be more or less than the specified amount of the allowance the Contract Sum will be adjusted accordingly by Change Order. The amount of the Change Order will recognize any changes in handling costs at the site, labor, installation costs, overhead, profit, and other expenses caused by the selection under the allowance. XII. NEW WATER SUPPLY LINES TO EXISTING RESTROOMS The work to be done under additive bid Item No. 2 consists of replacing the existing cold water supply lines to two existing restrooms and a janitor's closet with 3/4 inch type "L" copper lines. The work includes all associated costs including cutting, patching, and painting patches in the existing walls. XIII. PERMIT FEES The City will waive all permit fees normally charged by the City, except that all contractors and subcontractors will be required to have valid City of Newport Beach business licenses in effect. XIV. BIDDING Each bidder must submit a bid for the base bid and for the additive bid item. The City reserves the right not to award the additive bid item. The low bidder will be determined by the amount bid for the base bid only.
