CONTRACT FOR LEGAL NOTICES
THIS AGREEMENT is made and entered into this day
of , 1980, by and between the CITY OF
NEWPORT BEACH, hereinafter referred to as "City," and the
NEWPORT ENSIGN, hereinafter referred to as "Newspaper," with
reference to the following facts:
A. Section 419 of the City Charter requires the City
Council of the City of Newport Beach prior to the beginning
of each fiscal year to publish a notice inviting bids and to
contract for the publication of all legal notices or other
matter required to be published in a newspaper of general circu-
lation in the City during the ensuing fiscal year; and
B. Said notice was published and bids were received in
accordance therewith; and
C. The City Council, upon analysis of the bids received,
has made an award for the publication as aforesaid in the fiscal
year beginning July 1, 1980; and
D. newspaper was the successful bidder for said publication.
NOW, THEREFORE, in consideration of the foregoing, the
parties hereto agree as follows:
1. Newspaper agrees to publish all legal notices of City
and other matter required to be published for the fiscal year
beginning July 1, 1980. The rate for said publication is as
follows, which is not in excess of the customary rate charged
by Newspaper for the publication of legal notices of a private
character:
$3.50 per column inch for the first
insertion and $3.00 per column inch
for subsequent insertions.

2. Newspaper agrees to utilize 6 -point type for all legal
notices and other matter printed and published pursuant to this
agreement.
3. City agrees to submit to Newspaper all legal notices and
other matter required to be published during said fiscal year.
4. City agrees to pay Newspaper for said publication in
accordance with the schedule hereinabove set forth.
5. In the event that Newspaper for any reason is unable
to make timely publication of any legal notice or other matter
required to be published during the term of this contract, City
may submit such matter to any other newspaper or newspapers
qualified to publish such matter for the City during the term
hereof. Such determination shall be at the discretion of the City.
6. Fifteen (15) copies of each issue of the official
newspaper must be furnished to City on the date of publication.
7. Affidavits of Publication for every item published will
be furnished to City at no additional charge.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement as of the day and year first above written.

SUBJECT: CONTRACT FOR LEGAL NOTICES
The City Council on June 9, 1980 awarded the contract
for City legal advertising,during the 1980 -81 fiscal
year, to the Newport Ensign.
The cost of the service shall be as follows:
$3.50 per column inch for the
first insertion and $3.00 per
column inch for subsequent
insertions.
Attached is the contract for the printing and publica-
tion of legal notices during the past fiscal year.
It would be appreciated if your office would prepare
a new contract incorporating the approved rates.
Following preparation, the document should be forwarded
to the City Clerk's office.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AWARDING A CONTRACT FOR THE
PUBLICATION OF LEGAL NOTICES AND OTHER MAT-
TERS AND DESIGNATING AN OFFICIAL NEWSPAPER
FOR PUBLICATION OF NOTICES, AND RESCINDING
RESOLUTION NO. 9577
WHEREAS, Section 419 of the Newport Beach City
Charter provides that the City Council shall publish a notice
inviting bids and contract for the publication of legal notices
and other matters required to be published in a newspaper of
general circulation in the City during the ensuing fiscal year;
and
WHEREAS, the City Council has published such notices
and bids have been received in accordance therewith; and
WHEREAS, the City Council has analyzed said bids and
determined to make the award as hereinafter provided,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the bid of Newport
Ensign be accepted and that the Mayor and City Clerk
be and hereby are authorized and directed to execute a contract
in accordance with this award for the fiscal year beginning
July 1, 1980; and
BE IT FURTHER RESOLVED that Newport Ensign
is hereby designated the official newspaper for the publication
of legal notices and other matters required to be published for
the fiscal year beginning July 1, 1980; and
BE IT FURTHER RESOLVED that Daily Pi
is hereby designated as the alternate official newspaper for the

publication of legal notices and other matters required to be
published for the fiscal year beginning July 1, 1980, to be
used only if Newport Ensign is unable to timely
publish legal notices and other matters required to be published
due to publication dates, failure of equipment, or similar
causes; and
BE IT FURTHER RESOLVED that Resolution No. 9577 is
hereby rescinded.

NOTICE IS HEREBY GIVEN that the City Council of the City of
Newport Beach will hold a public hearing regarding:
NOTICE INVITING BIDS to be received at or before the hour of
7:00 p.m. on June 11, 1979 for a contract covering the pub-
lishing and printing of all legal notices or other material
required to be published in a newspaper of general circulation
published and circulated in the City of Newport Beach, for
the fiscal year ending June 30, 1980, Contract No. 209q.
NOTICE IS HEREBY FURTHER GIVEN that the said public hearing will
be held on the 11th
day of June

at the hour of 7:00 P.M. in the Council Chambers of the City Hall of the City
of Newport Beach, California, at which time and place any and all persons
interested may appear and be heard thereon.
