Amount of Contract see contract City Clerk AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES (INITIAL ENVIRONMENTAL STUDY) FOR THE WIDENING AND REALIGNMENT OF SUPERIOR AVENUE, COAST HIGHWAY TO 1200'± NORTH OF COAST HIGHWAY THIS AGREEMENT is made and entered into this !1�fday of 1979, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY" and the firm of LARRY SEEMAN ASSOCIATES, INC., hereinafter referred to as "CONSULTANT" W I T N E S S E T H WHEREAS, CITY's Circulation Element - Master Plan of Streets and Highways has designated Superior Avenue between Coast Highway and 1200'± North of Coast Highway, a Primary Road (four lanes divided), and WHEREAS, the roadway improvements for Superior Avenue between Coast Highway and 1200'± North of Coast Highway have not been completed to a Primary Road cross section and CITY desires to complete these improvements and to realign the roadway, hereinafter referred to as "PROJECT ", and WHEREAS, the California Environmental Quality Act of 1970 requires that an initial Environmental Study be prepared for all projects; and that for projects determined to be Major actions the initial Environmental Study is to be an analysis to determine if the environmental document should be a Negative Declaration or an Environmental Report, and WHEREAS, CONSULTANT has submitted a proposal to CITY to perform consulting services in connection with the preparation of an initial Environmental Study for PROJECT; and WHEREAS, CITY desires to accept said proposal, NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages CONSULTANT to perform the services hereinafter described for the compensation herein stated. B. CONSULTANT agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by CONSULTANT CONSULTANT hereby agrees to perform the following services: A. Prepare an expanded initial study for PROJECT following the "Guidelines for Implementation of the California Environmental Quality Act of 1970" issued by State of California Resources - 1 - III IV Agency and complying with CITY procedures for the preparation of Environmental Documents. The initial study shall include but not be limited to erosion control, siltation control data, and environmental assessments which are more specifically described in CONSULTANT'S proposal dated July 24, 1979, and by this reference made a part hereof. A sufficient number of copies of the initial study shall be provided for circulation to reviewing agencies. B. Attend public hearings or meetings if required. Duties of Citv CITY hereby agrees to supply CONSULTANT with the following informa- tion and materials: A. Existing plans and mapping of the PROJECT and adjacent areas. B. Current traffic studies and traffic counts. C. Other such data pertinent to the PROJECT. D. Assistance in coordinating and obtaining the grading and drainage information from the Project Engineer, (Williamson & Schmid). Time of Completion The initial study shall be completed by September 28, 1979. The CONSULTANT, however, will be allowed at least three (3) weeks to complete the study after receiving the required information from the Project Engineer. V. Ownership of Project Documents VI VII Original drawings, reports, notes; maps and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. Consultant in Charge William R. Foley shall be the Consultant in charge of preparing the initial study. Right of Termination CITY reserves the right to terminate this agreement at any time by giving CONSULTANT three (3) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to any of CONSULTANT'S business offices. In the event of termination due to fault of CONSULTANT, CITY shall be relieved of any obligation to compensate CONSULTANT. If this agree- ment is terminated for any reason other than fault of CONSULTANT, - 2 - CITY agrees to compensate CONSULTANT for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VIII. Fee Schedule and Payment A. In consideration of the performance of the above- described consulting services, CITY hereby agrees to pay CONSULTANT on a time and material basis. In no event shall said amount be greater than Eight Thousand One Hundred and twenty dollars ($8120.00), except as otherwise provided herein. B. The contract amount shall be paid to CONSULTANT as follows: Partial payments shall be made by CITY to CONSULTANT upon CONSULTANT'S presentation of statements verifying the time and material costs incurred by it in connection with this agreement. IX. Additional Work Should CONSULTANT complete any additional work not outlined in this agreement, but authorized by CITY, the extra work shall be performed on a time and material basis with payment as set forth in Section VIII B above. X. PROJECT Scope Revisions The scope of the PROJECT may be changed and the maximum fee revised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed One Thousand Dollars ($1,000.00). If revisions to the scope of the PROJECT would result in an increase in the maximum fee exceeding One Thousand Dollars ($1,000.00), an amendment providing for such revisions shall be processed and executed by the parties hereto. ' 3300 Newport Boulevard Newport Beach, California 92660 t SUBJECT: INITIAL ENVIRONMENTAL STUDY FOR SUPERIOR AVENUE WIDENING AND REALIGNMENT Dear Don: LSA is pleased to submit this proposal to prepare an expanded Initial Study for the proposed realignment and widening of Superior Avenue. The primary purpose of this study is to identify potential adverse impacts on the environment and to suggest necessary mitigation measures. If the study concludes that the proposed project including any recommended mitigation measures will not have a significant effect on the environment, then a negative declaration may be issued. SCOPE OF SERVICES LSA will address the following potential environmental issues:. 1. Soils /Geology. Existing studies on adjacent sites will be reviewed, and potential impacts identified. Potential mitigation measures will include recommendations for detailed on -site studies which may be required during project engineering phases. 2. Grading. The proposed project will include a significant amount of grading. The amount of cut and fill (if any) will be quantified. Potential disposal sites and haul routes for surplus cut will be discussed. This will include possible disposal on adjacent sites including the parcel containing the existing roadway. The aesthetic impacts of the proposed grading will be analysed. Alternative grading plans will be discussed and landscape plans will be reviewed. Our analysis will be based on grading concepts and grading plans to be prepared by the project engineer. 3. Land Use. Existing and proposed land uses on adjacent sites will be identified, and potential impacts on those land uses will be analysed. 4. Traffic. A complete traffic analysis will be prepared by Basmaciyan- Don Webb July 24, 1979 Page 2 Darrell, Inc. Data on existing conditions including traffic volumes, roadway capacities, accident rates, and roadway con- ditions will be collected. The data will be analysed and major constraints and deficiencies identified. The proposed project will be reviewed with regard to adopted circulation plans and future roadway projects in the vicinity. Project related im- pacts including access to adjacent parcels, impacts on adjacent streets, and construction impacts will be reviewed, and mitiga- tion measures proposed. Finally, graphics will be prepared show- ing the existing intersection, the interim intersection which, will exist following the widening of Coast Highway. In addition to preparing the traffic analysis, the consultant will review and discuss the project with Caltrans as necessary. 5. Air Quality. An air quality analysis will be prepared in a format acceptable to Caltrans and the AQMD. This analysis will include a review of potential carbon monoxide concentration based on the CALINE II dispersion model and the EMFAC 5 emis- sion factor generation mode. 6. Noise. A noise analysis will be prepared in a format acceptable to Caltrans and the State clearinghouse. The analysis will model existing and projected noise levels and identify areas which may be significantly impacted. 7. Archaeology and Paleontology. Archaeological and paleontological surveys will be conducted in a manner acceptable to the State Of- fice of Historical Preservation. These surveys will include a records search and a field survey. Mitigation measures will be recommended for any resources which are discovered within the pro- ject area. B. Drainage: Drainage and runoff from the new roadway will be reviewed. Particular attention will be paid to the adequacy of drainage fac- ilities on the northerly side of Coast Highway, and to water quality impacts on Newport Bay. This analysis will be based on information to be supplied by the project engineer. SCHEDULE LSA can complete this study within six (6) weeks of authorization to pro- ceed provided that all of the information requested from the project engineer is received at least three (3) weeks prior to the due date. This schedule will al- low the city to complete the environmental requirements for this project by December, 1979.
