HomeMy WebLinkAboutC-2119(A) - Engineering services for Superior Avenue realignment at Pacific Coast Highwaya a AMENDED AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR THE WIDENING AND REALIGNMENT OF SUPERIOR AVENUE, COAST HIGHWAY TO 1200'± NORTH OF COAST HIGHWAY THIS AGREEMENT is made and entered into this �k_�{ 1 ) day of 1982, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY" and the firm of WILLIAMSON AND SCHMID, here- inafter referred to as "ENGINEER." W I T N E S S E T H WHEREAS, CITY's Circulation Element - Master Plan of Streets and Highways has designated Superior Avenue between Coast Highway and 1200'± north of Coast Highway, a Primary Road (four lanes divided); and WHEREAS, the roadway improvements for Superior Avenue between Coast Highway and 1200'± north of Coast Highway have not been completed to a Primary Road cross section and CITY desires to complete these improvements and to re- align the roadway, as shown on Exhibit "A" attached hereto and by this ref- erence made a part hereof, under a project to be cooperatively financed with the County of Orange Arterial Highway Financing Program (AHFP), hereinafter referred to as "PROJECT "; and WHEREAS, ENGINEER has substantially completed engineering services for design of the PROJECT under terms of an agreement with the City dated September 29, 1980; and WHEREAS, CITY desires to modify design of the PROJECT to include an additional right -turn lane from southbound Superior Avenue to westbound Coast Highway, a merging lane on westbound Coast Highway and a separate right -turn lane from westbound Coast Highway to northbound Superior Avenue; and WHEREAS, ENGINEER has submitted a proposal to CITY (dated May 20, 1982) to perform engineering services in connection with design modification of the PROJECT; and WHEREAS, CITY desires to accept said proposal; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. 1 of 6 a B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by ENGINEER ENGINEER hereby agrees to perform the following services necessary to revise PROJECT improvement plans, specifica- tions, right -of -way drawings and legal descriptions: A. Perform field survey as necessary to verify and tie out points of control and other physical monumentation. B. Perform topographic field survey for precise locations of flow lines, edge of pavement, utility structures, etc. C. Prepare a "right -of -way acquisition map" to be used as the basis for preparing specific legal descriptions of street easements, slope easement, right -of -way vacations, etc. Prepare legal descriptions and accompanying sketches for specific parcels necessary for conveyance of the property. D. Prepare a mass grading plan for inclusion in the project drawings. The plan will be drawn at a scale of 1" = 40' and will show the cut for the new roadway as well as the removal of the existing roadway pavement. Construction of terrace drains, downdrains, and subdrains will be in- cluded on these plans. Regrading of adjacent undeveloped properties are not comtemplated as being within the scope of the plan. E. Prepare erosion control and desiltation plans. Two sets of plans are contemplated - -one for implementation with each of the two anticipated construction phases. F. Prepare a horizontal control plan for inclusion in the project drawings. The plan will benefit both the design and construction staking phases of the project. G. Prepare detailed street improvement plans including a title sheet, detail sheets, plan and profile sheets, street lighting sheet, retaining wall profile and detaila, and median barrier investigation and design. 2of6 • r H. Retain a traffic engineering consultant to prepare traffic signal modification plans and specifications, a striping and signing plan for the new realigned street, and detour plans showing striping and signing for use during con- struction of the new street improvements. It is antici- pated that the detour plans will show three arrangements, each one corresponding to a different stage of the construction. I. Prepare detailed plan and profile storm drain improvement plans. Prepare a hydrology map and supporting hydrology and hydraulic calculations. J. Prepare a plan for the landscaping of the cut and fill slopes created as part of this PROJECT. Prepare an accompanying plan for the temporary irrigation of the slope planting. Installation of the water service to supply the irrigation system will be part of the street improvement plans. K. Prepare quantity and cost estimates for the project. Prepare a bid proposal and PROJECT special provisions for inclusion in the contract documents. III. Duties of City CITY hereby agrees to supply ENGINEER with the following in- formation and materials: A. Title, plan, and profile sheets as needed for PROJECT. B. Materials investigations and required pavement section. C. Available records pertaining to existing street improve- ment and City -owned utilities. IV. Time of Completion Final design, including all plans and other documents for the PROJECT shall be submitted to the Public Works Director of the CITY for final review by October 1, 1982. V. Ownership of Project Documents Original drawings, reports, notes, maps and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. 3of6 • r VI. Right of Termination CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER's business business office at 17782 Sky Park Boulevard, Irvine, California 92714. In the event of termination due to errors, omissions, or negligence of the ENGINEER, CITY shall be re- lieved of any obligation to compensate ENGINEER for that portion of the work affected by such errors, omissions, or negligence of the ENGINEER. If this Agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee sched- ule contained herein. VII. Fee Achedule and Payment In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Seventeen Thousand Five Hundred Dollars ($17,500.00), except as other- wise provided herein. A. Hourly rates for office and field personnel shall be as follows: Principal Engineer $65.00 /hr. Project Engineer $56.00/hr. Assistant Engineer $46.00 /hr. Design Draftsperson $39.00 /hr. Draftsperson $33.00 /hr. Secretary /Delivery $18.00 /hr. 3 -man survey crew $128.00 /hr. 2 -man survey crew $99.00 /hr Computer processing time $25.00 /hr. Plotter time $10.00 /min. "Total Station" survey equipment $1.0.00 /hr. 4of6 • 0 B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the Fee Schedule. The sum of the monthly partial payments shall not exceed Ninety -five Percent (95 %) of the maximum fee; 2. Balance of the total amount earned to be paid upon completion of work specified in Section II (services to be performed by ENGINEER), or by July 1, 1983, whichever occurs first; 3. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents and any other related costs authorized in advance by the CITY and advanced by ENGINEER. VIII. Additional Work Should ENGINEER complete any additional work not outlined in this Agreement, but authorized by CITY, the extra work shall be performed on a hourly basis in accordance with the hourly rate standard Fee Schedule set forth in Section VII (Fee Schedule and Payment) above. IX. Project Scope Revisions The scope of the PROJECT may be changed and the maximum fee revised upon prior written approval of the Public Works Director, if the increase in the maximum fee does not exceed One Thousand Seven Hundred Fifty Dollars ($1,750.00). If the revisions to the scope of the PROJECT would result in an increase in the maximum fee exceeding One Thousand Seven Hundred Fifty Dollars ($1,750.00), an amendment providing for such revisions shall be processed and executed by the parties hereto. 5of6 a n U X 0 Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, omissions, or negligence in the ENGINEER's performance of the engineering work and ser- vices required by this Agreement. DISCUSSION: On September 22, 1980, the City Council adopted a resolution authorizing the Mayor and the City Clerk to execute an agreement with Williamson and Schmid for the design of the subject project. Since that time, plans have been completed which provide for the widening of Superior Avenue on a new alignment creating a more nearly right angle intersection at Coast Highway. The realigned roadway was designed for two travel lanes in each direction, a raised median, a separate left -turn lane from southbound Superior Avenue to eastbound Coast Highway, a separate right -turn from southbound Superior Avenue to westbound Coast Highway, sidewalk -bike trail, safety light- ing, drainage systems and modified traffic signal. The realignment also provides for the widening of Coast Highway on the northerly side to its ultimate width at a later date. See the attached sketch for the location and limits of the work. Since that time, traffic phasing plan studies in conjunction with proposed new developments in the area have indicated that additional turning lanes would be required at the intersection of Superior Avenue and Coast Avenue., The additional lanes are a second right -turn lane from southbound Superior Avenue to westbound Coast Highway, with a necessary merging lane on Coast High- way, and a separate right -turn lane from westbound Coast Highway to northbound Superior Avenue, it is desirable to combine the additional work with the currently scheduled project. A proposal has been requested and received from the engineering firm of Williamson and Schmid for providing the engineering services necessary to modify the existing improvement plans, right -of -way drawings, right -of -way descriptions and specifications to include the additional turning and merging lanes. Compensation will be based on standard hourly rates with maximum fee not to exceed $17,500 (rate schedule attached). Funds for the agreement will come from the currently budgeted gas tax project. The gas tax account will later be reimbursed by funds received from the developers that are obligated to do the additional improvements. Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, omissions, or negligence in the ENGINEER'S performance of the engineering work and services required by this Agreement. DISCUSSION: On December 10, 1979, the Council adopted a resolution requesting that the project be included in the 1980 -81 Orange County Arterial Highway Financing Program (AHFP). The Environmental Impact Report- Negative Declaration was ac- cepted by the Council after a public hearing on January 7, 1980. The proposed project provides for safer and more efficient traffic flow by widening Superior Avenue and creating a more nearly right angle intersection at Coast Highway. The realigned roadway will provide two travel lanes in each direction, a raised median, a separate left -turn lane from southbound Superior Avenue to eastbound Coast Highway, a separate right turn -lane from southbound Superior Avenue to westbound Coast Highway, sidewalk -bike trail, safety lighting, drainage system and modified traffic signal. See the attached sketch for the location and limits of the work. The realignment is also necessary to enable the widening of Coast Highway on the northerly side to its ultimate configuration at a later date. The new alignment will require that approximately 3.75 acres of the vacant CalTrans property west of existing Superior Avenue be dedicated. Approxi- mately 2.5 acres of the existing right -of -way which will not be needed after the realignment would be vacated. At this time, it is anticipated that CalTrans will dedicate the required right -of -way, but no commitment from CalTrans has been received. The estimate construction cost for the project is $1,042,000. It is proposed to finance the improvements with Gas Tax Funds and County AHFP Funds over a two -year period. Phase "I" work, which includes all engineering and rough grading for the new roadway, has been approved by the County and is provided for in the current budget. Phase "II ", which will include the remaining fine grading and construction of the new improvements will be submitted to the County in December 1980, for inclusion in the 1981 -82 AHFP. A proposal has been requested and received from the engineering firm of Williamson and Schmid for providing the engineering services necessary for design and preparation of plans and specifications to realign and widen Superior Avenue. Compensation will be based on standard hourly rates with maximum fee not to exceed $60,000 (rate schedule attached). Funds for the agreement will September 22, 1980 Subject: Superior Avenue Improvements of Coast Highway Page 2 from Coast Highway to 1200 Feet North will come 50% from County AHFP and 50% from the currently budgeted gas tax proj- ect. It is anticipated that a project for Phase I can be advertised for bids in April 1981. Depending on right -of -way acquisition and funding for Phase II work, it may become a practical alternate to combine the work into one contract which could be advertised for bids in January 1982. CITY COUNCIL CITY Do ?g#MT uwka RESOLUTION NO. 9864 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN ENGINEERING AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND WILLIAMSON AND SCHMID IN CONNECTION WITH SUPERIOR AVENUE IMPROVEMENTS FROM COAST HIGHWAY TO 1200 FEET NORTH OF COAST HIGHWAY (C -2119) WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain Engineering Agreement between the City of Newport Beach and Williamson and Schmid in connection with Superior Avenue Improvements from Coast Highway to 1200 feet north of Coast Highway; and WHEREAS, the City Council has reviewed the terms and conditions of said Agreement and finds them to be satisfactory and that it would be in the best interest of the City to execute said Agreement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
