A G R E E M E N T
On this day of ,k X41_ ✓ , 1979, the
City of Newport Beach, a municipal corporation, hereinafter
referred to as "City," and the NEWPORT BALBOA ROTARY CLUB,
hereinafter referred to as "Club," mutually agree as follows:
W I T N E S S E T H:
WHEREAS, the City of Newport Beach, Department of Parks,
Beaches and Recreation, desires to provide an annual boys' and
girls' track meet; and
WHEREAS, the Parks, Beaches and Recreation Department is
dedicated to a philosophy that encourages community involvement
in recreation activities; and
WHEREAS, the Parks, Beaches and Recreation Department has
the staff and expertise to administer and train volunteers to
provide manpower for the boys' and girls' track meets; and
WHEREAS, Club desires to be a co- sponsor of the annual
boys' and girls' track meets; and
WHEREAS, Club desires to provide approximately $1,000 a
year for awards and supplies for the annual boys' and girls'
track meets; and
WHEREAS, Club desires to provide persons to assist in con-
ducting the boys' and girls' track meets; and
WHEREAS, City desires to enter into an agreement with Club
to provide funding for awards and supplies for the boys' and
girls' track meets and to accept the offer of volunteers to
assist in conducting the boys' and girls' track meets,
NOW, THEREFORE, for and in consideration of the promises
hereinafter contained, the parties hereto agree as follows:
1. Club and City hereby agree to cooperatively provide a
joint sponsorship of the annual boys' and girls' track meets;
2. During the term hereof, Club will provide approximately
$1,000 each year for awards and supplies for the boys' and
girls' track meets;
3. Club will provide volunteers for the annual boys'
and girls' track meets to assist in conducting the events;
4. City's Department of Parks, Beaches and Recreation
will be responsible for securing facilities and materials
necessary to conduct the annual boys' and girls' track meets.
City further will determine the dates for the.events, and agrees
to consult with Club and will cooperatively utilize the resources
of the Club for publicity, promotion and related manpower respon-
sibilities to provide a total program for conducting the annual
boys' and girls' track meet;
5. City agrees to hold Club harmless from liability which
may result from its participation in the event;
6. This agreement shall be renewed annually unless
terminated by either party in writing.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement as of the day and year first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE
CITY OF NEWPORT BEACH AND THE NEWPORT BALBOA
ROTARY CLUB IN CONNECTION WITH AN ANNUAL BOYS'
AND GIRLS' TRACK MEET
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the Newport Balboa Rotary Club in
connection with an annual boys' and girls' track meet; and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to
execute said agreement,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.

SUBJECT: CO- SPONSORSHIP OF BOYS AND GIRLS
TRACK & FIELD PROGRAM
RECOMMENDATION:
Authorize the Mayor to sign an agreement
which establishes a co- sponsorship with
the Newport Balboa Rotary Club of the
City's boys and girls track and field
program and; accept the initial donation
of $1,000 to provide awards and supplies
for the program.
DISCUSSION:
For some time we have been working with the Newport Balboa
Rotary Club on a concept of co- sponsorship of the boys and
girls track and field program. The accompanying agreement
outlines specific responsibilities and commitments.
From our standpoint, in this tax - reform era, this agreement
allows a program to be continued and undoubtedly improved
by the fiscal and manpower resources made available by the
Rotary Club.
The Parks, Beaches and Recreation Commission at its meeting
of October 2, 1979 unanimously approved of the concept and
is recommending that the Council approve the agreement.
