NOTIFICATION OF NONCOMPLIANCE If, in the course of fulfilling their responsibilities, the civil engineer, surveyor, the soils engineer, the engineering geologist or the testing agent finds that the work is not being done in conformance with the approved grading plans, the discrepancies shall be reported immediately in writing to the person in charge of the grading work and to the Building Division. Recommendations for corrective measures, if necessary, shall be submitted to the Building Division for approval. 5. When import or export of materials is required, haul routes to and from the site shall be approved by the City Traffic Engineer and hauling procedures shall be in accordance with Chapter 15 of the Newport Beach Municipal Code (NBMC). Contractor shall use Best Management Practices (BMP's) to insure that all water quality issues are addressed. 6. Between October 1 and April 30, erosion control BMP measures shall be in place. During the remainder of the year dry season wind erosion BMP's (dust control) shall be implemented. Sediment control BMP's shall be installed and maintained at all operational storm drain inlets internal to the project. BMP's to control off -site sediment tracking shall be implemented and maintained. Appropriate BMP's to prevent contamination of stormwater from construction activities shall be implemented. A "weather triggered" action plan and the ability to deploy BMP's to protect all exposed portions of the site within 48-hours when the National Weather Service forecasts a 50% or greater chance of rain. 7. All fills shall be compacted throughout to a minimum of 90 percent compaction as determined by ASTM test method 1557 and approved by the soils engineer. Compaction tests shall be performed according to the preliminary soils report. 8. All trench (including interior and exterior utility trenches) and retaining wall backfill shall be compacted throughout to a minimum of 90 percent relative compaction and approved by the soils engineer. 9. Whenever work on which required inspection/testing is covered by additional work without first being inspected/tested, the Chief Building Official shall require by written notice that the work be exposed for examination. The work of exposing and recovering shall not entail or be subject to expense to the City of Newport Beach and will be the sole expense of the Permittee. 10. Landscaping of all slopes and pads shall be in accordance with 15.10.130 of the NBMC. 11. Approved drainage provisions shall be used to protect adjoining properties during the grading operation. 12. The permittee or his agent shall notify the Building Division when the grading operation is ready for eaan of the following inspections: , a. This test report supersedes our previous Compaction Test Report dated November23, 2016. The project was placed on winter suspension and resumed grading activities after the 2016 heavy storm season, which caused damaged to the previous grading operation and required the contractor to re -grade and re -compact the foundation subgrade. The test area consisted of the foundation level of the footings at randomly designated locations. The test fieldwork took place from 04/22/2017 to 04/23/2017. We observed the grading operation before and after that date to ensure conformity with the approved soils report.. Our compaction tests were conducted in accordance with ASTM 1557, and ASTM 1556. The laboratory compaction results are presented in the Appendix section. Proposed foundation design: The site foundation trenches are in conformance with the Site soils report prepared by Coast Geotechnical, Inc. dated 03/14/2014, "Foundation" section. Site native soils have been used locally. With compaction and over -excavation recommendations per the referenced soils report. Study Area Improvements: Our scope of work included testing the relative compaction at the new building foundation area, at the locations referenced in the Introduction section. The approximate locations of our tests are presented in the attached Compaction Test Summary. Laboratory Testing: The Lab Test method ASTM 1557 was used to determine the maximum Dry Density of the soil material within the subject area. Summary of results: The minimum acceptable relative compaction is 90% in accordance with the project Soils Report. The delay in field operation was due to foundation plans updates, winter suspension, Owner idle time, and multiple repairs to the trenches slopes and over excavation conditions to prepare it for City inspection. 4- The Compaction report attached is wet signed and stamped by the Geotechnical engineer. 5- The term "relative density" has been revised in the report to ne " relative compaction'. 6- All five points on the compaction cure are shown on the Maximum Dry Density Exhibit in the Appendix section. 7- A legible exhibit showing the testing locations is attached in the Appendix section 8- The main purpose of the over excavation is to support the structure foundation, grade beam and concrete slabs. Secondary purpose is to serve as competent subgrade for proposed site hardscape features. 9- The entire building footprint was dug to the over excavation limit (24" below foundation level). Moisture control was kept during the grading operation. The project was placed on winter suspension and resumed grading activities after the 2016 heavy storm season, which caused damaged to the previous grading operation and required the contractor to re -grade and re -compact the foundation subgrade. The test area consisted of the foundation level of the footings at randomly designated locations. The test fieldwork took place from 04/22/2017 to 04/23/2017. We observed the grading operation before and after that date to ensure conformity with the approved soils report. Our compaction tests were conducted in accordance with ASTM 1557, and ASTM 1556. The laboratory compaction results are presented in the Appendix section. Proposed foundation design: The site foundation trenches are in conformance with the Site soils report prepared by Coast Geotechnical, Inc. dated 03/14/2014, "Foundation" section. Site native soils have been used locally. With compaction and over -excavation recommendations per the referenced soils report. Study Area Improvements: Our scope of work included testing the relative compaction at the new building foundation area, at the locations referenced in the Introduction section. The approximate locations of our tests are presented in the attached Compaction Test Summary. I have made two site visits with copies of the originally approved grading and drainage plan to compare with actual work done on the site in regards to drainage and have determined that the proposed work has been completed with the exception of the 12" x 12" catch basin in the front northwest comer. The contractor, I have been told is waiting for the city approval for the drain lines the run under the sidewalk and out to and through the face of curb. I understand this is a very uncommon practice for obtaining approval, but my client is desperate to obtain a final and complete this project. The have been delayed beyond belief due the incompetence of their original contractor and hope the city will be sympathetic to their situation.
