SUBJECT: LIFEGUARD SERVICES AGREEMENT /COUNTY OF ORANGE HARBOR, BEACHES,
AND PARKS DISTRICT
Recommendation:
If desired, adopt a Resolution authorizing the Mayor and City Clerk to execute
the attached agreement between Orange County Harbor, Beaches, and Parks District
and the City of Newport Beach for the City to provide lifeguard services at the
County owned Santa Ana River Jetty Beach.
Diccuccion-
The agreement under consideration is between the City and the County of Orange
for lifeguard personnel provided by the City in the unincorporated area of the
Santa Ana River mouth.
The City has been providing lifeguards for the County at the Santa Ana River
since the early 1950's under an annual agreement /contract. The level of service
proposed by the County of Orange for the 1980 calendar year is consistent with
prior years and is generally at the same level that is provided to the adjoining
City beach.
The major difference with the proposed agreement is that the contract period is
for five calendar years, from 1980 through 1984.
The County, in consideration for lifeguards provided by the City, agrees to
pay the City as follows:
1980 - $22,621
1981 - $24,149
1982 - $24,149 - Adjusted by the 1981 annual average Consumer Price Index
for the Long Beach /Los Angeles area (CPI)
1983 - $24,149 - Adjusted by the combined 1981 -82 annual average CPI
1984 - $24,149 - Adjusted by the combined 1981 -82 -83 annual average CPI
The contracted dollar amounts are hard dollars (actual City costs) for three
lifeguards and supervisory personnel for the Santa Ana River Jetty during the
summer months, Easter week, and certain spring and fall weekends.

Mayor and City Council -2- March 24, 1980
On January 21, 1980 the City Council, with an Additional Business Item (J -2),
gave approval for the Marine Department to submit a bid to the County of Orange
for the City lifeguard services over a five year period at the Santa Ana River
mouth.
The attached agreement, if executed by the Mayor and City Clerk will be forwarded
to the Board of Supervisors for their execution during the first part of April.

WHEREAS, there has been presented to the City
Council of the City of Newport Beach a certain agreement
between the City of Newport Beach and the Orange County
Harbors, Beaches and Parks District for lifeguard services
within the Santa Ana River Jetty unincorporated area for
the 1980 through 1984 calendar years; and
WHEREAS, the City Council has reviewed the terms
and conditions of said agreement and finds them to be
satisfactory and that it would be in the best interest of
the City to authorize the Mayor and City Clerk to execute
said agreement,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above
described is approved, and the Mayor and City Clerk are here-
by authorized and directed to execute the same on behalf of
the City of Newport Beach.

following Resolution was adopted:
BE IT RESOLVED that this Board hereby approves the Lifeguard
Services Agreements dated May 13, 1980 with the Cities of Newport Beach
and Huntington Beach to guard north County beaches for calendar years
1980 - 1984 and the Clerk of the Board is authorized to execute said
Agreements on behalf of the Board of Supervisors.

A C R E E M E N T
THIS AGREEMENT is made and entered into on / T, 1980, by
and between the ORANGE COUNTY HARBORS, BEACHES AND PARKS DISTRICT, hereinafter referred
to as "DISTRICT ", and the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter
referred to as "CONTRACTOR ". The implementing agent for the DISTRICT shall. be the Orange
County Environmental Management Agency (EMA).
R E C I T A L S

WHEREAS, DISTRICT is desirous of obtaining lifeguard services at county owned-
operated beaches and bays and
WHEREAS, CONTRACTOR is desirous of providing said lifeguard services at
DISTRICT owned - operated facilities.
NOW, THEREFORE, it is agreed between the CONTRACTOR and DISTRICT as follows:
1. The CONTRACTOR shall provide lifeguard services during the 1980 -84 calendar
years in the following described unincorporated area commonly known as the mouth of the
Santa Ana River and in .particular described as follows:
The coastal waters and tidelands areas of the Pacific Ocean,
within Orange County bounded by the following lines:
The southeast boundary Line of Bolsa Chica State Beach; the Pacific Coast Highway and the
northeast boundary line of the City of Newport Beach.
2. CONTRACTOR shall employ only properly trained and qualified lifeguards
and supervisory personnel in the discharge of its obligations under this agreement. For

the purpose of this agreement, training and qualifications of lifeguard personnel shall
comply with United States Surf Lifesaving Association standards, as shown in Appendix A.
Upon request of Director, EMA or his designee, CONTRACTOR shall provide documentation of
lifeguard certification.
3. CONTRACTOR shall provide adequate supervisory personnel at all times, it
being the intent of the parties that lifeguard service of high quality and standards
shall be available at all times.

4. CONTRACTOR shall respond to all lifeguard emergency calls with qualified
ppersonnel.
5. Proposed hourly schedule of lifeguard service on contracted days and the
CONTRACTOR's Emergency Back -Up Procedure shall be subbitted to Recrenti.on Manager, Countvi
of Orange, EMA, 10852 Douglass Road, Anaheim, CA 92806. Schedule of service for 1980
shall be submitted within ten (10) days after execution of agreement. DISTRICT shall
approve or reject schedule of service within ten (10) days of receipt. Such proposal
upon approval of DISTRICT shall constitute level of service under this agreement. Subse -!
quest annual schedules to be submitted by February 1 of each year. CONTRACTOR shall sub-
mit all amendments to the Emergency Back -Up Procedure at least ten (10) days prior to
implementation.
6. Each month the CONTRACTOR shall file with the Recreation Mannger, EXA, a
complete written report of its activities and services rendered pursuant to and under
this agreement.
7. CONTRACTOR shall maintain payroll records of all employees by name and /or
employee number to verify that contracted man hours were in fact worked. CONTRACTOR
shall make these documents available to DISTRICT upon request of Director, CIA, or his
designee.

8. DISTRICT, in consideration for performance by CONTRACTOR as provided in

this agreement, does hereby agree to pay CONTRACTOR as follows:
1980 $22,621

1981 $24,149
1982 $24,149 adjusted by 1981 Annual Average Consumer Price I.uden for
the Long Beach /Los Angeles area (CPI).
1983 $24,149 adjusted by combined 1981 -82 Annual Average CPI.
1984 $24,149 adjusted by.combined 1981 -82 -83 Annual Average GPI.
Payment subject to additions and deductions at the unit prices set forth in
CONTRACTOR's service proposal which is incorporated herein by reference and made a part

herein as though fully set forth.

Payments will be made on the dates and in the amounts as follows:
July 1, 20% annual cost

9. It is expressly understood and agreed that the lifeguard service to be

furnished by CONTRACTOR shall be under the sole and exclusive direction and employment
of CONTRACTOR; subject to the right of DISTRICT to approve the standards of service, as
in this agreement provided.

10. CONTRACTOR shall provide and maintain all lifeguard towers; to be located
at the discretion of CONTRACTOR's Chief Lifeguard (Chief Lifeguard) and subject to right
of DISTRICT to request the placing of lifeguard towers or personnel at any point in the +
unincorporated area of Orange County deemed necessary by DISTRICT.

11. It is further agreed that CONTRACTOR will respond with qualified personnel
anywhere within the County of Orange to the extent there are qualified personnel avail-
able which the Chief Lifeguard or his subordinate then on duty, determines are not
immediately needed within the CONTRACTOR's jurisdiction when, in the opinion of the
DISTRICT or the Orange County Sheriff- Coroner Department, Harbor Patrol Bureau Commander, .

an emergency exists which warrants additional assistance beyond the ability of any one
jurisdiction to provide.
12. It shall be the duty of the Chief Lifeguard to immediately notify the
DISTRICT and the Orange County Sheriff- Coroner Department, Harbor Patrol Bureau Commander)
in the event of sea rescue or aircraft emergencies so that other City, District, County
or State rescue units may be alerted and coordinated for standby or assistance.
13. All lifeguards and other rescue personnel of CONTRACTOR, who shall be
called on duty at any such emergency, shall be under the control. and supervision of the
individual in charge where such emergency occurs; the above individual. being expressly
understood as the Chief Lifeguard, public official, City employee, District or County

employee who has jurisdiction and responsibility over the immediate area where the
emergency exists.
14. All personnel of the CONTRACTOR while on emergency duty hereunder, and
(while going to and returning from the scene of such emergency, shall be deemed to remain i
the employee of the CONTRACTOR.
15. If, within the CONTRACTOR's personnel, there are lifeguards equipped with
and trained to use Self- Contained Underwater Breathing Apparatus (SCUBA), such personnel
(shall be made available to serve, to the extent reasonably permitted by their capabil-
ities, training, experience and equipment as determined by the Chief Lifeguard, in an
'Orange County underwater rescue team coordinated and called into duty by the Orange
County Sheriff- Coroner Department, Harbor Patrol Bureau Commander. CONTRACTOR shall
annually provide a list of such qualified personnel to Orange County Sheriff-Groner
Department, Harbor Patrol Bureau Commander.
16. It is further agreed that CONTRACTOR shall guard beaches during the summer
months from June 1 through September 15 daily. The coverage shall include land units

and all lifeguard towers manned as weather and crowd conditions warrant. CONTRACTOR
further agrees to provide weekend coverage during April, May, September and October. j
CONTRACTOR shall also provide lifeguard service and land unit coverage during the week ofl
Easter vacation, and at other times as required by DISTRICT in Appendix B.
17. If, in the event of inclement weather, Chief. Lifeguard determines sche.duled'I
level of service is not warranted, then Chief Lifeguard may appropriately alter scheduled
service. CONTRACTOR shall . notify, as indicated in Appendix C, DISTRICT and Orange Count;
Sheriff - Coroner Department, Harbor Patrol Bureau Commander of altered level of scheduled
service.
18. Surplus mandays resulting from alteration in scheduled service clue to

inclement weather may, at the discretion of Chief Lifeguard, be rescheduled as weather,
surf and crowd conditions warrant. CONTRACTOR shall notify DISTRICT and Orange County
Sheriff- Coroner Department, Harbor Patrol Bureau Commander of rescheduled service.

of Orange or DISTRICT shall apply in excess of and not
contribute with, insurance provided by this policy."
All insurance policies required by this paragraph shall contain the following clause
"This insurance shall. not be cancelled, limited or non-
renewed until after thirty (30) days written notice has
been given to the County of Orange, Environmental Manage-
ment Agency, 10852 Douglass Road, Anaheim, CA 92806 and
Risk Management Division, 625 North Ross, Santa Ana, CA
92701."
Certificates of insurance or self insurance evidencing the coverages required by this
paragraph and the required clauses set forth above shall be filed with the County of

Orange, Environmental Management Agency, 10852 Douglass Road, Anaheim, CA 92806, prior
to the effective date of this agreement.
23. CONTRACTOR shall obtain all licenses necessary to conduct their business
and shall be required to furnish all necessary insurance certificates and licenses as
required by County of Orange, EMA.
24. CONTRACTOR is aware of the provisions of Section 3700 of the State of
California Labor Code, which require every employer to be insured against liability for
Workmen's Compensation or undertake self- insurance in accordance with the provisions of j
that code and will comply with provisions before commencing the performance of the work
of this agreement.
25. CONTRACTOR agrees that it will not engage in discrimination in employment
of persons because of the race, color, gender, religion, national. origin or ancestry of
such persons. Violation of this provision may result in the imposition of penalties
referred to in Section 1735 of the State of California Labor Code.
26. CONTRACTOR further agrees that it will not discriminate against any
employee or applicant for employment because of physical or mental handicap in regard to
any position for which the employee or applicant for employment is qualified. The

CONTRACTOR agrees to take Affirmative Action to employ, advance in employment and other-
wise treat qualified handicapped individuals without discrimination based upon their
physical or mental handicaps in all employment practices such as the following: employ-
ment, upgrading, demotion, layoff or termination, rate of pay or other forms of compen-
sation, and selection for training, including apprenticeships.
27. CONTRACTOR shall not assign or otherwise dispose of this agreement or its
right, title, or interest therein, nor any part thereof, to any persons without the prior'

written consent of DISTRICT.
28. CONTRACTOR shall maintain a communication system providing direct voice
communication between .lifeguard towers and a system of communication with back up land
units through central dispatch or direct radio contact. Description of communication
system shall be submitted for approval. to Recreation Manager, PIMA, ten (10) days after
execution of agreement. Any changes thereafter shall be submitted to Recreation Manager,)
BMA, ten (10) days prior to proposed implementation.

29. Changes in schedule of service, standards of service, or areas to be ser-
viced may be made as DISTRICT acquires new beach facilities and /or visitation rates
change at present locations. All such changes shall be made upon written notification

from Recreation Manager, EMA. Compensation for such changes shall be based on unit
prices submitted in service proposal. DISTRICT reserves the right to negotiate a sepa-
rate agreement for services on any or all new beach facilities.
30. CONTRACTOR shall furnish all uniforms, badges, or other identification
necessary.
31. CONTRACTOR and DISTRICT reserve the right to terminate this agreement,

without penalty and without cause effective June 30 of any year by giving thirty (30)
I
days prior written notice of intention to terminate. In the event of such termination,
the total consideration owing from DISTRICT to CONTRACTOR for all. services performed

hereunder shall be the total of the installment payments specified in Clause 8 for the
completed fiscal year, less any adjustment for services not yet rendered as determined
under conditions of Clause 7.

CERTIFICATION REQUIREMENTS
A. EMPLOYMENT STANDARDS
Excellent health.
Possession of valid Standard First Aid card and CPR issued by American Red
Cross or Emergency Medical Technician - 1 rating.
Successful completion of training program (minimum of 56 hours) and physical
exam.
Valid drivers license.
Knowledge of
