(v MEMORANDUM OF AGREEMENT
BETWEEN
UNITED STATES COAST GUARD (CG CUTTER NARWHAL)
AND
CITY OF NEWPORT BEACH
This Memorandum of Agreement ("MOA"), entered into this 1st day of October, 2022 between the
United States Coast Guard Cutter Narwhal ("CG CUTTER") and the CITY OF NEWPORT BEACH,
a California municipal corporation and charter city ("CITY") is to set forth the terms by which CG
CUTTER and CITY conduct joint operations, and to specifically address how fire protection,
emergency medical services and confined space rescue services, will be provided by CITY to CG
CUTTER. CITY and CG CUTTER agree that:
1. On request by CG CUTTER to CITY via telephone number 911, firefighting, emergency medical
services or confined space rescue services, equipment and personnel of CITY shall be dispatched to
CG CUTTER as directed by CITY.
2. Any dispatch of equipment and personnel pursuant to the MOA is subject to the following
conditions:
a. All requests for fire or emergency medical equipment and personnel shall be made by
telephone, unless that number is inoperative or unavailable for any reason.
b. Upon requesting services, CG CUTTER will provide a description of the type and nature of
the fire or other emergency, and will specify the location to which resources and personnel
should be dispatched. Based on the nature of the request, CITY will determine which
equipment and personnel will be provided to respond.
3. CITY equipment and personnel will report to the quarterdeck / brow of CG CUTTER. CG
CUTTER shall provide a representative to meet the equipment and personnel at the quarterdeck /
brow and brief CITY on the nature of the incident. CITY will be responsible for directing and
controlling their personnel and equipment at all times during the response.
4. Reimbursement to CITY for direct expenses and losses incurred as result of firefighting on CG
CUTTER is governed by 15 U.S.C. §2210, and the implementing regulations set forth in 44 C.F.R.
part 151.
5. Reporting requirements: Following all emergency responses under this MOA, CITY shall
forward a copy of the incident report in its customary format to the CG CUTTER point of contact
named below. Provisions must be made to protect the privacy and medical information of individuals
who may be named in the incident report.
6. Communications between CITY and CG CUTTER shall be between the points of contact for the
respective agencies named below.
7. As an aid to implementing this agreement, members of CITY may, with prior arrangement with
the Commanding Officer or his designated point of contact listed below, have access to CG
CUTTER and any of its structures for the purpose of preparing pre -fire plans. Access to the Cutter
will be granted at least biannually, within thirty (30) days of a Commanding Officer change of
command, or following a greater than fifty percent (50%) cutter crew personnel turnover for the
purpose of reviewing and updating pre -fire plans and conducting in port fire response training. CG
CUTTER must notify CITY of Commanding Officer change of command, or upon a greater than
(50%) cutter crew personnel turnover to initiate review of pre -fire plans and conducting training.

9. This MOA shall become effective upon the date subscribed by both original signatories, and their
successions in office.
10. This MOA may be modified by a written agreement signed by both original signatories, and their
successors in office.
11. This MOA shall terminate upon 30 days written notice by either party.
The authority for CG CUTTER to enter into this agreement is found in 14 U.S.C. § 141 (1999) and
the Safety and Environmental Health Manual, COMDTINST M5100.47.
