SUBJECT: Agreement For Fire and Rescue Services From Z1 /k
Orange County
Recommendation:
It is recommended that the City Council approve and authorize
the Mayor to sign an agreement that will continue the fire
and rescue services from the Orange County Fire Department.
Discussion:
The City of Newport Beach has contracted with Orange County
for fire and rescue services since 1980. The area served by
Orange County Fire Department is normally adjacent to the
John Wayne Airport but could be anywhere a need would occur.
This agreement is for a five year period and can be
terminated on June 30 of any year with a six month prior
notification.
The agreement requires the City to pay 50% of the cost of
operating the County Fire Station #27 at the John Wayne
Airport. The cost includes direct salaries, retirement,
worker's compensation, holiday pay, health insurance, service
supplies and department overhead. Payments are made
quarterly, the City cost for 1989 -90 fiscal year will be
approximately $390,000.
The Fire Department's 1989 -90 budget includes the funds for
this contract.

THIS AGREEMENT, made and entered into this / day of . 1989,
which date is enumerated for purposes of reference only, between the COUNTY OF
ORANGE, a political subdivision of the State of California, hereinafter referred to as
"COUNTY," and the CITY OF NEWPORT BEACH, a Charter Law City situated in
the County of Orange, hereinafter referred to as "CITY';
WHEREAS, CITY desires that COUNTY provide fire and rescue service to
certain portions of CITY; and
WHEREAS, COUNTY has the ability to provide the above desired fire and
rescue services;
NOW, THEREFORE, for and in consideration of the covenants contained
herein the parties agree as follows:
1. COUNTY SHALL PROVIDE:
a) Fire and rescue service, consisting of one engine company, if available,
from COUNTY Fire Station No. 27 to fire and rescue emergencies in
the area defined as "central net." Except as may be required by
extraordinary conditions, the fire services provided by COUNTY shall
include a response of an engine with a minimum of three (3) persons.

b) From Station 27, COUNTY will provide to CITY non - emergency
services similar to those provided by existing CITY engine companies,
such as, prefire planning, fire hydrant inspections and company fire
prevention inspections;
c) Depending on County-wide fire and rescue conditions, COUNTY will
make every attempt possible to keep Station 27 covered when Engine
27 has been dispatched to a call outside its roll area.
2. For purposes of liaison and the administration of this agreement, the
County Director of Fire Services and the City Director of Fire Protection are
designated as the representatives of the respective parties to this agreement, and
they shall be jointly responsible for administration of this agreement.
3. The specific details of services to be provided under this Agreement
and general operational procedures shall be covered in a letter of understanding
between the respective fire chiefs.
4. CITY shall be responsible for any charges relating to fire hydrant repair
or usage.
5. This agreement shall become effective on July 1, 1989 and shall
supersede the preceding fire services agreement between COUNTY and CITY. The
agreement shall remain operational and effective until June 30, 1994 or until
participation is terminated by either party.

6. In consideration of the services provided in fiscal year 1989/90, CITY
agrees to pay COUNTY the sum of $398,940. All payments due COUNTY shall be
paid quarterly in arrears commencing on or before October 1, 1989.
7. CITY'S payment to COUNTY in subsequent fiscal years will be 50% of
the costs of operating Station 27 subject to this Agreement. The cost included shall
be based on (1) direct salaries, (2) retirement, (3) worker's compensation, (4) holiday
pay, (5) health insurance, (6) services /supplies and (7) department overhead. The
amounts for the above items shall be based on the current year's actual experience
and estimated changes that will occur in the subsequent budget period with the
exception that the total of services/ supplies plus department overhead costs shall
not exceed 12 1/2% of the salary and employee benefit costs as described in items 1 -5
above.
On or before March 31 of each year, commencing on March 31, 1990, the
County Director of Fire Services shall notify City Fire Chief in writing of the
estimated costs for the following fiscal year. On or before May 1 of each year,
commencing May 1, 1990, the County Director of Fire Services shall notify City Fire
Chief in writing of final charges to CITY for said services during the following fiscal
year. In the event CITY's Fire Chief fails to notify COUNTY as to CITY's agreement
to the charges prior to the following June 1, this Agreement shall expire effective
June 30 of the same year.

8. Each party shall indemnify and save harmless the other party, and its
officers, agents and employees from any and all losses, liability, damages, claims,
suits, actions and administrative proceedings, and demands relating to acts or
omissions of the indemnitor, its officers, agents or employees arising out of or
incidental to the performance of any of the provisions of this Agreement or any
other acts or omissions of the indemnitor, its officers, agents or employees. Neither
party assumes liability for the acts or omissions of persons other than each party's
respective officers, agents or employees. In the event judgment is entered against
both parties because of joint or concurrent negligence of both parties, or their
officers, agents or employees, an apportionment of liability to pay such judgment
shall be made by a court of competent jurisdiction and neither party shall be entitled
to a jury apportionment.
9. CITY shall not be liable for the direct payment of any wages or other
compensation to any officer, employee, or agent of COUNTY performing any
services under this Agreement. CITY shall not be liable to any officer, employee, or
agent of COUNTY for any sickness or injury incurred by such person in the course of
performing services under this Agreement. COUNTY shall be solely responsible for
personnel actions relating to COUNTY employees utilized in the performance of
this Agreement.

10. This Agreement may be terminated by the CITY on June 30 of any year
by giving written notice of termination to the COUNTY at least six (6) months prior
to said termination date. This Agreement may be terminated by the COUNTY on
June 30 of any year by giving written notice of termination to the CITY at least
twelve (12) months prior to said termination date.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement
on the day and year first above written.

SUBJECT: Automatic Aid Agreement With Orange County AGENDA ITEM NO. F2A
On September 18, 1981, the City of Newport Beach and the County of Orange
renewed an automatic aid agreement for the following fire protection and
rescue services. The County Fire Station #27 responds first -due into the
city area north of Santa Isabel Avenue and is second -due into areas south
of Santa Isabel Avenue. The City provides first -due fire protection and
rescue services to various county areas adjacent to the City boundaries.
This agreement expires June 30, 1984. It should be revised and renewed in
order to continue the current level of protection provided to that area of
the community.
The services provided and the working relationship between the two
departments have been satisfactory.
The proposed revised agreement includes two changes.
First, the method of apportioning the operating costs of Station #27 will
be based on a simple 50/50 split of those operating costs rather than the
present method of deriving the split from a comparison of the assessed
valuations of the city and county areas served by Station #27. In each of
the past three years the City has paid about 51% of the cost based on the
existing method. Is is anticipated that this would continue for the near
future.
Second, the agreement period has been changed to extend for five years
rather than the present three year period.
The fire department staff recommends that the City renew the agreement at
a cost for 1984 -85 of $285,812. (The 1983 -84 cost was $270,588.) This
is an increase of $15,224 (5.63 %). The charge to the City is based on
one -half of the estimated operating costs of Station #27 under this
agreement.

AGREEMENT
THIS AGREEMENT, made this !,t" day of 1984 by and
between the COUNTY OF ORANGE, a political subdivision of the State of
California, hereinafter referred to as "COUNTY ", and the CITY OF NEWPORT
BEACH, a Charter Law City situated in the County of Orange, hereinafter
referred to as "CITY ";
WHEREAS, COUNTY desires that CITY provide fire, paramedic, and
rescue service to certain portions of the unincorporated territory of
COUNTY and CITY OF IRVINE; and
WHEREAS, CITY desires that COUNTY provide fire, paramedic, and
rescue service to certain portions of CITY; and
WHEREAS, each party has the ability to provide the above desired
fire, paramedic, and rescue services;
that
NOW, THEREFORE, IT IS AGREED by and between the parties hereto
1. CITY SHALL PROVIDE:
a) Fire protection, up to full first alarm fire assignment, if
available, to that unincorporated territory of COUNTY which is
indicated in Exhibit 1 Area "A" and Exhibit 2 Area "B"
attached hereto;

b) Paramedic and rescue protection to that unincorporated
territory of COUNTY which is indicated in Exhibit 1 Area
"A" and Exhibit 2 Area "B" attached hereto;
c) One (1) engine, paramedics, and truck company service to
that unincorporated territory of COUNTY which is indicated in
Exhibit 2 Area "C" attached hereto;
d) Full first alarm fire assignment, if available, and paramedic,
and rescue protection to that territory of COUNTY protection
jurisdiction (a part of the City of Irvine) which is indicated
in Exhibit 2 Area "D" attached hereto.
2. COUNTY SHALL PROVIDE:
a) Fire protection, one first due engine company, if available,
from COUNTY Fire Station No. 27 to fire and rescue emergencies
in that area of the CITY indicated in Exhibit 2 Area "E ", or
one second due engine company, if available, from COUNTY Fire
Station No. 27 to fire and rescue emergencies in that area of
the CITY indicated in Exhibit 2 Area "F" attached hereto;
b) Rescue and back up paramedic protection to that area of the
CITY indicated in Exhibit 2 Area "E" attached hereto;
C) COUNTY will provide non - emergency services similar to those
provided by existing CITY engine companies, such as, prefire
planning, fire hydrant inspections and company fire prevention
inspections;

d) Depending on County -wide fire and rescue conditions, COUNTY
will make every attempt possible to keep Station 27 covered
when Engine 27 has been dispatched to a call outside its roll
area.
3. Except as may be required by extraordinary conditions, the
fire services provided by CITY and COUNTY shall include a response of an
engine with a minimum of three (3) persons and the paramedic unit shall
include a minimum of two (2) mobile intensive care paramedics, each
qualified as an Emergency Medical Technician - Paramedic (EMT -P)
pursuant to Health and Safety Code Section 1797.172.
4. The specific details of the service to be provided under this
Agreement and general operational policies including, but not limited to,
Station 27 coverage policy, communications, types of equipment,
procedures, personnel, traffic control, written reports, and predetermined
grid systems, shall be covered in a letter of understanding between the
respective fire chiefs.
5. CITY agrees to make periodic tests of fire hydrants in that
portion of this Agreement indicated by Exhibit 1 Area "A" and Exhibit
2 Area "B ", using the normal procedures used with CITY and as mutually
agreed between the COUNTY Director of Fire Services and the Fire Chief of
CITY, provided that charges for water usage, if any, will be the
responsibility of COUNTY.

6. CITY shall not be held liable for fire hydrant repair or
rental charges.
7. COUNTY agrees to make periodic tests of fire hydrants in that
area indicated by Exhibit 2 Area "E" of this Agreement, using the normal
procedures used within the COUNTY and as mutually agreed between the
COUNTY Director of Fire Services and the Fire Chief of CITY, provided that
charges for water usage, if any, will be the responsibility of CITY.
8. COUNTY shall not be held liable for fire hydrant repair or
rental charges.
9. Each agency agrees to furnish necessary reports to the other
party on fire, paramedic, and rescue service and other activities in
connection with this Agreement.
10. This Agreement shall become effective on July 1, 1984 and
remain in force until June 30, 1989.
11. In consideration of the services provided in fiscal year
1984 -85, CITY agrees to pay COUNTY the sum of $285,812. This amount and
the total amounts for the following fiscal years are to be paid in four

14. Both CITY and COUNTY agree to indemnify and hold the other
harmless from any loss, liability, claim, suit, or judgement resulting
from work or acts done or omitted by the other in carrying out this
Agreement. These provisions are included in accordance with Government
Code Section 895.4 and are applied to all parties herein.

b) COUNTY will provide non - emergency services similar to those
provided by existing CITY engine companies, such as, prefire
planning, fire hydrant inspections and company fire prevention
inspections;
c) Depending on County -wide fire and rescue conditions, COUNTY
will make every attempt possible to keep Station 27 covered
when Engine 27 has been dispatched to a call outside its roll
area.
3. Except as may be required by extraordinary conditions, the fire
services provided by CITY and COUNTY shall include a response of an engine with
a minimum of three (3) persons and the paramedic unit shall include a minimum
of two (2) mobile intensive care paramedics certified pursuant to the Wedworth-
Townsend Paramedic Act (Health and Safety Code, Section 1480 to 1485).
4. The specific details of the service to be provided under this
Agreement and general operational policies including, but not limited to,
Station No. 27 coverage policy, communications, types of equipment, procedures,
personnel, traffic control, written reports, and predetermined grid systems,
shall be covered in a letter of understanding between the respective fire chiefs.
S. CITY agrees to make periodic tests of fire hydrants in that
portion of this Agreement indicated by Exhibits "A" and "B ", using the normal
procedures used with CITY and as mutually agreed between the COUNTY Fire
Warden and the Fire Chief of CITY, provided that charges for water usage, if
any, will be the responsibility of COUNTY.

6. CITY shall not be held liable for fire hydrant repair or
rental charges.
7. COUNTY agrees to make periodic tests of fire hydrants in
that area indicated by Exhibit "E" of this Agreement, using the normal pro-
cedures used within the COUNTY and as mutually agreed between the COUNTY Fire
Warden and the Fire Chief of CITY, provided that charges for water usage, if
any, will be the responsibility of CITY.
8. COUNTY shall not be held liable for fire hydrant repair or
rental charges.
9. Each agency agrees to furnish necessary reports to the other
party on fire,,paramedic, and rescue service and other activities in connection
with this Agreement.
10. This Agreement shall become effective on July 1, 1981 and remain
in force until June 30, 1984.
11. In consideration of the services provided in fiscal year 1981 -82,
CITY agrees to pay COUNTY the sum of $153,343. This amount and the total amounts
for the following fiscal years are to be paid in four quarterly installments,
the first to be due on September 30, 1981.
12. On or before February 1 of each year, commencing February 1982,
the COUNTY Fire Warden shall notify CITY's Fire Chief in writing of contract
cost for the following fiscal year.
CITY's payment to COUNTY for services provided in 1982 -83 shall be
determined using the following two step formula.
A. The 1981 -82 assessed valuation for both secured and unsecured
rolls shall be gathered for those areas of CITY, COUNTY and Irvine served on a
first due basis by Fire Station No. 27. The area to be served on a first due basis
shall at all times be determined by the County Fire Warden. The assessed valuation

for the three jurisdictions shall be added to obtain a total amount of assessed
valuation. The assessed valuation for CITY shall be divided by the total amount
of assessed valuation to determine the percentage of assessed valuation for CITY.
COUNTY Fire Warden shall determine the annual operating cost of Station No. 27
for fiscal year 1982 -83. The percentage of assessed valuation for CITY shall be
multiplied by the operating cost of Station No. 27 to obtain the 1982 -83 esti-
mated total cost of services to CITY.
B. The final 1982 -83 cost to CITY shall be determined by adding
one -half the difference between the 1982 -83 estimated total cost and the 1981 -82
contract cost ($153,343) to the 1981 -82 contract cost ($153,343).

CITY's payment to COUNTY for services provided in 1983 -84 shall
be the estimated total cost of services to CITY for that fiscal year to be de-
termined by using assessed.valuation formula stated in Step A.
13. In the event that CITY desires to terminate the Agreement, such
written notice must be given within two weeks after receiving notification of the
contract cost for the following fiscal year.
If at that time, CITY chooses to terminate Agreement, said services
shall be discontinued at the beginning of the following fiscal year.
14. If CITY chooses to terminate Agreement, within the period allowed
in Clause 13, CITY shall pay COUNTY the difference between the estimated total

cost of services and the • 1 contract cost, which was n• charged to CITY, for
each previous fiscal year.
15. COUNTY shall be solely responsible for all personnel actions re-
lating to COUNTY employees utilized in the performance of this Agreement.
16. Both CITY and COUNTY agree to indemnify and hold the other harmless
from any loss, liability, claim, suit, or judgement resulting from work or acts
done or omitted by the other in carrying out this Agreement. These provisions
are included in accordance with Government Code Section 895.4 and are applied to
all parties herein.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to

SUBJECT: Fire Protection Service For North Newport Beach
The Automatic Aid Agreement for fire protection between Orange County and
Newport Beach expired on June 30, 1981. A decision by the City Council
whether to renew this agreement or to approve an alternative method of
providing fire protection service is needed.
The proposed agreement for 1981 -82 (copy attached) contains a cost increase
from $127,786 in 1980 -81 to $188,616 in 1981 -82. The reason for this increase
is due to the following:
1. Increases in cost of salaries, benefits and supplies.
2. The annexation of County territory which formerly offset a
portion of Newports' charges.
3. Errors in assessment roll value computations used in last year's
allocation which understated Newport Beach's share of the costs,
While the cost of the agreement has increased substantially, it is still a cost
effective method of providing fire protection service to North Newport Beach.
Also, the County has submitted a second proposal (copy attached) that includes
the following:
1. A multi -year (three year contract).
2. A contract price of $153,343 for 1981 -82 which represents a
20 percent increase over the 1980 -81 price.
3. A phase in arrangement over the next two years to pick up one -
half of the difference between $153,343 and the 1982 -83 price
as calculated by formula. Fiscal year 1983 -84 would be at full
formula price.
The services provided and the working relationship between the two departments
has been satisfactory. The number of incidents occurring in this area from
January 1, 1980, to December 30, 1980, was 309 (121 fires, 160 medical aids,
28 service calls). Many letters of appreciation and thank you notes have been
received for the fast, courteous and efficient service. Very few complaints
have been registered.
If a decision is made to renew the agreement, the staff would support that
decision and expect the services provided and the working relationship to continue
to be satisfactory.

However, before a decision is made, the Council should consider four alternative
methods of providing fire protection service. Those four alternatives are:
1. Discontinue the County agreement and service the area from
the Newport Center and Mariners fire stations.
2. Approve a one year agreement and renew each year.
3. Approve a three year agreement and review again in 1984.
4. Approve a three year agreement and during those three years,
prepare to open a Newport Beach fire station in this area.
ALTERNATIVE 1: Discontinue the County Agreement and serve the area from the
Newport Center and Mariners Fire Stations.
This alternative was discussed by the City Council about fourteen
months ago. The decision reached at that time was the response
time and travel distance was excessive. This decision is still
valid and it is assumed the Council's position has not changed.
ALTERNATIVE 2: Approve a one year agreement and renew each year.
This alternative is a workable program for the fire department
and meets the immediate needs of the area. However, the cost
of the 1981 -82 agreement has increased $60,830 (47.6 %) and
while the costs should not increase as dramatically in future
years, the increases in salaries and annexation of County
territories will impact Newport's future cost. The one year
proposal has Newport Beach paying 51.59% of the operating cost
of Station 27. This percentage will increase in future years.
In the long term, this arrangement will not be in Newport's
best financial interest.
ALTERNATIVE 3: Approve a three year agreement and review again in 1984.
This alternative is also a workable program and meets the
immediate needs of the area. Again, for the reason stated in
Alternative 2, it does not resolve the issue for the long term.
ALTERNATIVE 4: Approve a three year agreement and during those three years,
prepare to open a Newport Beach Fire Station in this area.
This alternative would require an approval of the three year
agreement with Orange County. During those three years, staff
would prepare and submit to Council for approval a plan to open
a Newport Beach Fire Station in this area. This alternative,

in the long term, is the most cost effective and efficient.
The success of this plan is contingent upon the City of Costa
Mesa and Newport Beach developing an automatic aid agreement
for the exchange of fire protection service.
The Fire Department staffs of both communities have been meeting
and have agreed, subject to Council approval, that an exchange
of service is desirable. If an agreement is approved, Newport
Beach will provide engine company and paramedic services into
selected areas of Costa Mesa. In exchange, Costa Mesa will
provide truck company service to the western half of Newport
Beach. This plan will allow the truck company personnel
(three men per shift) to be reassigned to man an engine company
in the new fire station. This reassignment of existing personnel
allows for the opening of the station with minimum annual expense.

As you know, we have been working with Chief Reed of your city for
the past two months trying to reach an agreement for the 1981 -82 fiscal
year, The purpose of these negotiations has been to reach an equitable
distribution of costs relating to the services shared by the County,
the City of Irvine and the City of Newport Beach.
It has come to our attention that your budget committee will be recom-
mending a rejection of the proposed contract to your city council on
August 24, 1981. Also, that the primary reason for this rejection is
an increase of $60,830 over the 1980 -81 contract price. The increase
of $60,830 is due to the following reasons:
(1) Increases in costs of salaries, benefits and supplies
(2) The annexation of County territory which formerly offset a
portion of your charges,
(3) Errors in assessment roll value computations used in last
year's allocation which understated Newport Beach's share
of the costs..
Our Department feels that the proposed agreement was equitable and fair
to all parties,
It is of increasing concern to me that we are operating without benefit
of a contract for this year. Our department needs to make an immediate
decision as to the continued operation of Station #27. The present

WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement for fire
protection services in the northern part of the City between the
County of Orange and the City of Newport Beach; and
WHEREAS, the City Council has reviewed the terms and
provisions contained in said agreement with the County of Orange
and finds that it would be in the best interests of the City to
execute said agreement for fire protection services in the
northern part of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the agreement between the County

AGREEMENT
THIS THIS AGREEMENT, made this day of 19 SCE
by and between the COUNTY OF ORANGE, a political subdivision of the
State of California, hereinafter referred to as "COUNTY ", and the
CITY OF NEWPORT BEACH, a Charter Law City situated in the County of
Orange, hereinafter referred to as "CITY ", pursuant to Government
Code Section 55632.
WHEREAS, COUNTY desires that CITY provide fire, paramedic,
and rescue service to certain portions of the unincorporated territory
of COUNTY and CITY OF IRVINE; and
WHEREAS, CITY desires that COUNTY provide fire, paramedic,
and rescue service to certain portions of the unincorporated territory
of CITY; and
WHEREAS, each party has the ability to provide the above
desired fire, paramedic, and rescue services;
that
NOW, THEREFORE, IT IS AGREED by and between the parties hereto

a) Full first alarm fire, if available, paramedic, and rescue
protection to that unincorporated territory of County which
is indicated in Exhibits "A" and "B ";
b) One (1) engine, paramedics, and truck company service to

to that territory of COUNTY protection jurisdiction (a

Attached Exhibit "F" is a statement of budgeted operating

to the services to be rendered hereunder. Said amount includes
$95,445 which represents 39.47% of the budgeted costs for salaries
and fringe benefits. Said amount of $95.445 shall be adjusted at the

end of the term of this Agreement to reflect any increase or decrease
in the budgeted costs for the various salary and benefit cost
categories enumerated in Exhibit "F ", including changes resulting
from adjustments to duty week hours. Said adjustment shall be
reflected in the final quarterly payment in accordance with a billing
to be furnished to CITY Fire Chief by COUNTY Fire Chief.
11. This Agreement shall become effective on July 1, 1980
and remain in force until June 30, 1981.
12. The CITY of Newport Beach agrees to indemnify and hold
the COUNTY of Orange harmless from any loss, liability, claim, suit,
or judgment resulting from work or acts done or omitted by the CITY
of Newport Beach in carrying out this Agreement. The COUNTY of
Orange agrees to indemnify and hold the CITY of Newport Beach harmless
from any loss, liability, claim, suit, or judgment resulting from
work or acts done or omitted by the COUNTY of Orange in carrying
out this Agreement. These provisions are included in accordance

SUBJECT: FIRE PROTECTION CONTRACT IN THE NORTHERN SECTION OF NEWPORT BEACH
For several years the Orange County Fire Department has provided,
through a Mutual Aid Pact, "first -in" fire protection and medical aid ser-
vices, excluding paramedics, for the Koll Center and the Emkay properties.
In return, the City has provided fire services for the County Triangle, the
Banning property, the horse ranch east of Cameo Shores, and some County
islands adjacent to Irvine Avenue. The County has provided their services
from Fire Station No. 27, located on the airport property. In 1979, as a
result of Proposition 13, and the County assuming financial responsibility
for some state firefighters, the Orange County Board of Supervisors com-
missioned a fire feasibility study. This study analyzed the Orange County
firefighting capability and made certain recommendations with respect to
modifying the County's firefighting facilities. One specific recommendation
made was that the County close Fire Station No. 27 which would impact the
Koll Center and the Emkay properties. During the first part of 1980 the
County approached the City to determine interest of joint funding of County
Fire Station No. 27. They proposed that with some City financial support,
the County would keep the subject station open. For the past five months
Newport Beach representatives have met with Orange County representatives
to explore this possibility.

The Fire Chief has submitted a memo to me, dated August 18, 1980,
(copy attached) in which he recommends that the City sign a proposed agree-
ment with the County of Orange providing City financial support for Station
No. 27. His report further lists alternatives available to the City. There
is another alternative, however, available to the City not discussed in this -
memo. The other alternative is to service the northern section of Newport
Beach (Koll /Emkay) by the Newport Center Fire Station and the Mariners Fire
Station and not enter into any agreement with the County.
This alternative could, in time, result in an increase in fire
insurance rates for improvements in the Koll Center and in the Emkay develop-
ment. The rate increase would probably come in 1985, even though there is
a possibility that the insurance companies may "spot rate" the subject area
prior to 1985. The last City rating by the Insurance Services Office (I.S.O.)
was given Newport Beach in 1975. Normally, the I.S.O. will rate a city
every ten years, thus the next rating would come in 1985 unless, as indicated
above, a "spot rate" is implemented. The Fire Chief estimates that the
subject area could possibly go from a 3 rating to a 5 rating (1, being the
best on a scale of 1 to 10) if a fire station is not provided in the area.
An estimate of the amount of fire insurance increase in the subject
area due to a raise from a 3 rating to a 5 rating is even more difficult to
estimate than the time in which the rating will become effective. In 1975,
when the Insurance Services Office rated Newport Beach, the area by the air-
port was reduced from a Class 6 to a Class 3. The balance of the City was
reduced from a Class 4 to a Class 3. We were advised at that time that a
typical commercial zoned property in Class 4 will receive about a 9% reduc=
tion on a building fire insurance premium and about a 4% premium reduction

on contents by going to a Class 3

6 will receive about a 21% reduction on building fire insurance premiums
and about an 11% premium reduction on the contents by going to a Class 3.
Rates on properties protected by automatic sprinkler systems, (and 66 of
197 buildings in the subject area have automatic sprinkler systems) will
be reduced approximately 5% by going from a 6 rated fire zone to a 3 rated
fire zone. In other words, the City was notified in 1975 that for a build-
ing protected with automatic sprinkler systems a rate reduction of approxi-
mately 1.7% per fire rate zone could be expected. In a commercial build-
ing not protected by a sprinkler system a rate reduction of approximately
9% per fire rate zone would be achieved. This would mean that fire insur-
ance premiums could increase on buildings protected by automatic sprinkler
systems approximately 3.4% and for buildings not protected by automatic
sprinkler systems the fire insurance premiums could increase by approximately
18% if the Koll /Emkay areas go from a fire rating of 3 to a 5.
If the City signs the contract with the County it is assumed that
the subject area would stay in Class 3 and fire insurance premiums would
remain constant, but the City's annual Fire Department budget would increase
a minimum of $127,786/yr. If the City does not sign the agreement, fire
insurance rates could increase to the owner or tenant of the building, but
the City's budget would not increase. It is not known what the aggregate
fire insurance premiums are in the subject area and, therefore, it is un-
known whether the increases would be less or greater than $127,786.00/yr.
Staff, therefore, cannot advise the Council with certainty whether the
total fire insurance premium in the subject area would surpass the cost

to the City of the County contract. The subject matter, therefore, cannot
be decided on economics alone. The question, therefore, may be asked --
Is the City morally obligated to provide a fire station in the subject area,
or sign the County agreement? There are two points that should be made. --
1. Initially, when the Emkay parcel was in the planning stages,
the representative of the developer made a conscious effort
to delete fire station uses on the property. He was advised
by me, personally, that without a fire station the fire in-
surance rates may increase. He responded that as a developer
he would prefer the increase over the unsightly appearance of
a fire station in the planned community. He may not speak for
the current tenants, but he did speak for the developer initially.
Primarily, because of this attitude, the City did not reserve
property in the subject area for a fire station. Koll representa-
tives and Collins Radio group, who owned the property prior to
Mr. Koll, to my knowledge have not reviewed the fire station /fire
insurance rate increase alternative.
2. There are some fire chiefs in the state who believe that solid
data is not available to pinpoint whether a five, ten, or fifteen
minute response time will substantially increase the risk for loss
of life, or a specific dollar value of property damage. Traditional-
ly, response time, as suggested by the Insurance Services Office,
is approximately three minutes, using one and one -half miles as a
distance. It must be remembered that I.S.O. suggestions or criteria
are idealistic. I.S.O. does not consider the local economics in
establishing response time criteria. I.S.O. further suggests, for

instance, that four men should be used on fire apparatus equip-
ment. We currently are using three men because it is more cost-
effective. Koll /Emkay areas are approximately 3.3 miles from
the Newport Center Fire Station. Assuming the fire truck can
average 33 miles per hour, the response time to the subject area
from the Newport Center Fire Station would be approximately six
minutes. There are some times of the day that the fire truck could
average less than 33 miles per hour, and there are other times of
the day in which the fire truck could average more than 33 miles
per hour. Assuming the fire truck can average 40 miles per hour,
the response time would be approximately 4.8 minutes. Medical aid
response, like fire, may or may not be critical at the three minute
goal suggested by I.S.O. If the Fire Department arrives within
three minutes, how is it known whether two minutes was the critical
time element needed to save life or reduce property damage? As
a summary, suffice it to say that many experts disagree on the
value of a three, five or ten minute response time to decrease
risk of life or property.
There are a number of general comments and background information that
may be of interest to the City Council. A number of cities were surveyed to
determine response times, number of fire stations, etc. This survey is at-
tached as "Exhibit I." The first three columns in Exhibit I are self- explana-
tory. The fourth refers to the maximum response time deemed ultimately ac-
ceptable by the subject department. The fifth column refers to actual maxi-
mum response time in areas in the respective cities similar in terms of type

of development to that in northern Newport Beach area. Columns 6 and 7
refer to actual maximum response time to any area of the subject City, ir-
respective of type of development. To place this data in proper reference,
the subject property (Koll /Emkay) is approximately 3.3 miles from the
Newport Center Fire Station. Assuming, again, the fire truck can average
33 miles per hour, the response time to the subject area from the Newport
Center Fire Station would be six minutes.
Attached, as "Exhibit II ", you will find a list of all the fire zone
classes in each of the twenty -six cities within Orange County. Keep in
mind that the current fire class rating in the subject area is a 3 and
could go to a fire zone class 5 if a fire station isn't provided in the im-
mediate vicinity.
SUMMARY AND CONCLUSIONS
It appears that there are two basic alternatives available to the City
Council. One alternative is to enter into an agreement with the County for
fire protection services for the Koll /Emkay properties. The other basic
alternative is to service the northern section of Newport Beach by the
Newport Center Fire Station and the Mariners Fire Station and not enter into
an agreement with the County. The alternative listed in the Fire Chief's
memo for Newport Beach to construct, equip and man a new facility is not
cost - effective and, in my judgment, should be eliminated at this time. The
other alternative listed in the Fire Chief's memo to form a committee to
study this issue is also deemed unacceptable. In my opinion, the City is
qualified to study this issue and reach an acceptable conclusion.
If the City Council is of the opinion, after reading this report, that
the best interests of the City would be served by providing firefighting

capability within the subject area, the proposed County contract should be
approved. The County contract is much less expensive than constructing and
manning a City fire station. On the other hand, if the City Council believes
that adequate protection can be provided from the Newport Center Fire Station,
the County agreement should not be approved. Technically, the Fire Chief
will state that firefighting capabilities are needed in the subject area.
On the other hand, however, there is reason to question the cost- effective-
ness of maintaining firefighting capabilities in the area. Fire insurance
rates may increase, but there is insufficient proof that risk to life and
property would be increased if Fire Station No. 27 is closed.

SUBJECT: Fire and Emergency Medical Services for the Northern Section of
Newport Beach.
For several years the Orange County Fire Department from the Airport Fire Station
#27, at the corner of Campus Drive and Dove Street, has provided first due fire
suppression and emergency medical services in the northern section of Newport
Beach. Station #27 provides a first due engine company response within the
minimum required travel distance to allow the area to receive the same insurance
rates as the remainder of the city. More important, the response is short enough
to keep fires small enough to be manageable and to be able to initiate medical
life support measures according to their urgency.
We have been notified that this fire station is scheduled to be closed in the
immediate future. If this happens, the first due engine company from Newport
Beach to respond into this area will be well beyond the recommended travel distance
to provide the desired, as well as an equivalent level of service available to
the other areas of this community.
On June 25, 1980, a meeting was held with representatives of Orange County and
the City of Newport Beach to explore the possibility of these two agencies
developing an agreement that would provide for joint use and funding of the
personnel and equipment at Station #27. The County Board of Supervisors at their
July 21 regular meeting agreed to a continuation of the operations of Station #27
while contract negotiations are being conducted.
This report contains a description of the area and three alternatives, including
a joint agreement with Orange County, that need to be considered before a
decision is made on this issue.
DESCRIPTION OF THE AREA
The area being considered consists primarily of commercial office space with a
mix of hotel, restaurant and light industrial businesses distributed throughout.
Fourteen of the buildings are three and four stories high, and ten more are from
five stories to ten stories. A moderate percentage of the buildings have built -in
fire protection. The population is highest during business hours and minimal
between midnight and 6:00 a.m. Traffic flow becomes congested at times related
to the work day. The majority of need for service is the result of growth of
the area in the last several years.

In the early 1970's, a decision was made to rely on such service for this area
as was available from the Orange County Fire Department Station #27 at the
John Wayne Airport. At present, 303 responses or 6.6% of the City's calls
annually are in the industrial and commercial section of this area. Comparable
areas, such as the industrial and commercial sections of Newport Center and Lido
generate respectively 7.7% and 9% of the annual calls. The level of demand
for each of these areas is more than twice that of other districts of the City.
Fire stations are presently located near the center of both the Lido and Newport
Center areas.
Other fire protection available to this area is provided by Newport Beach fire
stations at Newport Center and at Dover and Irvine. These stations are two and
one half times farther away than the standard accepted response distance for
this type of area (standard accepted response distance is 12 miles). They
are over five times farther away than the fire company responses to other
comparable areas within the City. Prior to Station #27 providing first due
engine company service, this area's fire rating was two classifications higher
than areas within the City.
ALTERNATIVES:
There are three alternatives that need to be considered before a decision is
made regarding this issue. The three alternatives are:
The City of Newport Beach to construct, equip and man a
new facility in this area.
Approve an agreement with Orange County for automatic aid
to serve this area.
Form a committee to study this issue and report back to City
Council with other alternatives.
ALTERNATIVE 1 (The City of Newport Beach to construct, equip and man a new
facility in this area).
This alternative would require a substantial capital outlay expenditure to
purchase land, construct a facility and provide the necessary fire equipment.
It would also require the hiring of nine additional personnel to man the facility.
This station would then become an integral part of the Newport Beach Fire
Department. Their training, supervision, management objectives and daily
activities would be coordinated and controlled to insure a consistent level
of service is provided.

Some of the advantages of this alternative are:
a. Will provide a consistent level of service between all areas
of the City.
b. Will increase the overall fire defense strength within the
community.
c. Will maintain the insurance rating classification of Class 3.
d. Will provide a first due engine company within the recommended
travel distance.
e. Will provide a totally integrated Newport Beach engine company.
f. Will provide a crew to perform support services in their first
due district (inspections, pre - plans, hydrant detail, etc.)
Some of the disadvantages of this alternative are:
a. Will require a capital outlay expenditure to construct and
equip a facility of approximately $1,000,000.
b. Will require an annual increase in the department's budget of
approximately $350,000 to hire nine additional employees.
ALTERNATIVE 2 (Approve an agreement with Orange County for automatic aid
to serve this area).
This alternative would require Newport Beach to sign an agreement with Orange
County. The agreement would provide first due engine company service for
this area at a cost of $127,786 for the first year. The agreement would also
provide for service to various County territories from the Newport Beach Fire
Department. The agreement would be reviewed annually by both parties and is
subject to termination by either Newport Beach or Orange County.
Some of the advantages of this alternative are:
a. Will provide a first due engine company within the recommended
travel distance.
b. Will maintain the insurance rating classification of Class 3.
c. Does not require a capital outlay expenditure by Newport Beach.

Some of the disadvantages of this alternative are:
a. Requires an annual expendirure of $127,786 to contract for
County service (this cost is subject to an adjustment based
on the result of pending salary negotiations).
b. Difficulties of dispatch and radio communication between
agencies.
c. The County engine companies would not be totally integrated into
our system and become intimately familiar with our operational
procedures.
ALTERNATIVE 3 (Form a committee to study this issue and report back to City
Council with other alternatives).
This alternative would require a committee to be formed for the purpose of
reviewing other alternatives that would require a reorganization of the fire
department. Some of these options would impact the current level of service
and cause a reaction by various special interest groups.
An advantage of the alternative is:
a. Will provide an opportunity for input as to the level of
fire department service.
Some of the disadvantages of this alternative are:
a. Will probably delay any decision and actions.
b. A delay in reaching a decision may jeopardize an agreement
between Newport Beach and the County.
SUMMARY:
An urgent decision is needed regarding the fire and emergency medical services
provided to the northern Newport Beach area. The Orange County Fire Station #27
is scheduled for closure. If this happens, the travel time and distance to
provide fire and emergency medical services will be beyond recommended standards.
The level of service to this area will be inconsistent with the remainder of
the City and delays will occur in responding to incidents. The insurance rating
classification will increase from a Class 3 resulting in increased fire insurance
premiums for commercial and industrial properties.
RECOMMENDATION:
I recommend that the City of Newport Beach sign the proposed agreement with the
County of Orange and that the staff report back to City Council with recommendations

for the next fiscal year.

City of Newport Beach and the County of Orange in connection
with fire protection services in the northern part of the
City; and
WHEREAS, the City Council has reviewed the terms and
conditions of said agreement and finds them to be satisfactory
and that it would be in the best interest of the City to execute
said agreement,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
