W I T N E S S E T H WHEREAS, the CITY's Positive Traffic Solutions Program recommends development of a program for the widening of Newport Boulevard between 30th Street and Coast Highway to six lanes, as provided for in the CITY's Circula- tion Element- Master Plan of Streets and Highways; and WHEREAS, the CITY desires to prepare a project report and prelimin- ary plans for the widening of Newport Boulevard between 30th Street and Coast Highway, said widening improvements hereinafter referred to as "PROJECT "; and WHEREAS, ENGINEER has submitted a proposal to CITY (dated September 24, 1980) to perform engineering services in connection with the preparation of a project report and preliminary plans; and WHEREAS, CITY desires to accept said proposal; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by ENGINEER A. Surveying 1. Prepare a 40 -scale aerial topography map of the project area extending from 30th Street to West Coast Highway. The aerial topography map will show all existing topo- graphic features with contour elevations shown at one - foot intervals and will be used in preliminary design and alignment studies for Newport Boulevard. • r�L 2. Provide field surveying as necessary to establish controls for the aerial surveys and to complete a boundary control survey for use in connection with the roadway alignment calculations and right -of -way map- ping. B. Right -of -Way Engineering and Mapping 1. Review all right -of -way documents and record date assem- bled by the CITY staff and assist the City in determining the properties where litigation guarantees should be obtained by the CITY. 2. Verify all existing State and CITY right -of -way. 3. Based on the precise alignment developed for the ulti- mate widening of Newport Boulevard, determine the additional right -of -way needed to accomplish the ulti- mate widening. 4. Prepare 40 -scale right -of -way maps showing the precise alignment for Newport Boulevard and showing all existing and required right -of -way including all bearings, dimen- sions, and other pertinent data. 5. Prepare preliminary cost estimates for right -of -way acquisition. C. Traffic Studies 1. Review and analyze the following data supplied by the CITY: a. Daily and peak hour traffic volumes. b. Intersection turning volumes. c. Bicycle counts and movements. d. Accident reports and diagrams. 2. Based on the above data, evaluate and make recommenda- tions for the initial widening project, the ultimate project, and for phasing of construction with respect to the following items: a. Intersection geometrics, including left- and right - turn storage lanes. b. Traffic signal modifications. c. Bicycle facilities. - 2 - 0 9 • d. Lane and transition striping for phased construction. e. On- street parking requirements. f. Mitigation of high accident causes. 3. Evaluate and comment on lane widening and reducing transi- tions at each end of the project, initially as well as ultimately. This will include analysis of Coast Highway ramp usage. D. Preliminary Engineering and Cost Estimates 1. Assemble and review all available information pertaining to the PROJECT including existing as -built improvement plans, utility atlases, previous alignment studies, soil information, and other data. 2. Analyze and evaluate alternate schemes for widening Newport Boulevard between 30th Street and West Coast Highway with respect to such factors as right -of -way requirements, existing structures and utilities, access, parking, traffic requirements, etc. Precise alignment calculations will be prepared for the alignment that is determined to best accomplish the roadway widening with respect to the above factors. 3. Conduct a structural analysis of the existing West Newport Channel bridge to determine the feasibility of widening the bridge to accommodate one additional travel lane and a bike facility. Evaluate various structural alternatives for accomplishing the bridge widening, and provide recommendations based on economics, aes- thetics, compatibility with the existing structure, and ease of construction. Also, prepare a geometric design for the bridge widening, including a plan, elevation, and typical cross section based on the recommended method of construction. The geometric design will in- clude provisions for maintaining the existing bike trail beneath the bridge at the north side of the channel. 4. Prepare a preliminary design for the ultimate widening of Newport Boulevard from 30th Street to West Coast Highway, including a study plan showing curbs, sidewalks, - 3 - 0 0 driveways, median islands, transitions, striping, signals, utility relocations, intersection modifications, etc. Also, prepare a preliminary design for the initial widening project along the easterly side of Newport Boulevard from 32nd Street to the West Newport Channel Bridge. Preliminary plans will be prepared on City of Newport Beach mylar sheets. 5. Evaluate the proposed widening with respect to construc- tion phasing and provide recommendations for a phased construction sequence that will provide for continuous traffic movement on Newport Boulevard during the con- struction period. 6. Evaluate the impact of the Newport Boulevard widening on the City Hall parking lot and prepare alternative preliminary designs for the parking lot modifications. 7. Conduct coordination meetings with CITY and Caltrans staff at various stages of the project to review the progress and to obtain additional input and direction. 8. Prepare preliminary cost and quantity estimates for the widening project. 9. Prepare an engineering report summarizing all the above studies and design recommendations for submittal to Caltrans with the preliminary plans. Ten (10) copies of the engineering report will be provided. III. Duties of CITY A. Assemble parcel maps, records of survey, and other record data from the CITY and County files. B. Obtain litigation guarantees on all properties where right- of -way acquisition will be made. C. Conduct utility research and compile an inventory of all existing and proposed utilities within the roadway right -of- way. Also, coordinate with each utility owner in develop- ing recommendations for all utility relocations required by the project. == D. Prepare an updated hydrology study for the project area, analyze existing drainage improvements, identify existing drainage deficiencies, and develop recommendations for ultimate drainage facilities. E. Provide mylar plan and profile and standard sheets for preparation of right -of -way and preliminary improvement plans. IV. Time of Completion The final PROJECT report, including all plans and other docu- ments for the report shall be submitted to the Public Works Director of the CITY for final review by March 15, 1980. V. Ownership of PROJECT Documents Original drawings, reports, notes, maps, and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. VI. Right of Termination CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER's business office at 1020 South Anaheim Boulevard, Suite 300, Anaheim, California 92805. In the event of termination due to errors, omissions, or negligence of ENGINEER, CITY shall be relieved of any obliga- tion to compensate ENGINEER for that portion of the work affected by such errors, omissions, or negligence of the ENGINEER. If this Agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VII. Fee Schedule and Payment In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Thirty Thousand Dollars ($30,000.00) except as otherwise provided herein. - 5 - 0 A. The rates will be adjusted after that date to compensate for annual labor union negotia- ted adjustments and other increases in labor costs. B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. 2. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents, and other related costs authorized in advance by the Public Works Director and advanced by ENGINEER. IX. Additional Work Should ENGINEER complete any additional work not outlined in this Agreement, but authorized by CITY, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section VII (Fee Schedule and Payment) above. X. PROJECT Scope Revisions The scope of the PROJECT may be changed and the maximum fee re- vised upon prior written approval of the Public Works Director - 6 - 0 0 if the increase in the maximum fee does not exceed Three Thousand Dollars ($3,000.00). If the increase in the maximum fee should exceed $3,000, an amendment providing for such revisions shall be processed and executed by the parties hereto. XI. Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, omissions, or negligence in the ENGINEER's'performance of the engineering work and services required by this Agreement. DISCUSSION: The Positive Traffic Solutions Program recommended development of a program for the widening of Newport Boulevard between 30th Street and Coast Highway to six lanes, as provided in the City's Circulation Element. The sub- ject report will provide engineering and traffic data, right -of -way drawings, preliminary improvement plans and cost estimates for the proposed widening. The report is a necessary first step in pursuing a cooperative project with CalTrans for construction of the improvements. Competition for funding State highway projects is intensifying and a detailed engineering report will be advantageous in establishing project priorities. A proposal has been requested and received from Willdan Associates for providing the engineering services necessary to prepare the subject project re- port and preliminary plans. (See attachment for services to be provided.) Com- pensation will be based on standard hourly rates, with the maximum fee not to exceed $30,000 (rate schedule attached). Funds are available in the currently budgeted gas tax account to pre- pare EIR's and preliminary engineering for street projects. Benjamin B. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR PRO- FESSIONAL ENGINEERING SERVICES BETWEEN THE CITY OF NEWPORT BEACH AND WILLDAN ASSOCIATES IN CONNECTION WITH THE WIDENING OF NEWPORT BOULEVARD BETWEEN 30TH STREET AND COAST HIGHWAY WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain Agreement for Professional Engineering Services between the City of Newport Beach and WILLDAN ASSOCIATES in connection with the widening of Newport Boulevard between 30th Street and Coast Highway and; WHEREAS, the City Council has reviewed the terms and conditions of said Agreement and finds them to be satisfactory and that it would be in the best interest of the City to execute said Agreement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
