Effective Date: Renolution, No. Attuchmont cc: Finance DoparVmont City 11;111 Bonkyrd, Mivlwri Beach, ("aliGnAA 92W3 AGREEMENT FOR ENGINEERING SERVICES FOR THE CONSTRUCTION OF MARINERS MILE PARKING LOT, ACCESS ROAD, AND DRAINAGE FACILITIES THIS AGREEMENT is made and entered into this 8th day of June 1981, by and between the CITY OF NEWPORT BEACH, a municipal corporation and charter city, hereinafter referred to as "CITY," and the firm of ROBERT BEIN, WILLIAM FROST & ASSOCIATES, hereinafter referred to as "ENGINEER." THIS AGREEMENT is made and entered into with reference to the following: A. CITY proposes to construct improvements at its proposed Mariners Mile municipal parking lot and the proposed access road leading to the parking lot from Tustin Avenue; and to reconstruct drainage facilities on adjacent private property located between the proposed parking lot and the Coast Highway. B. CITY has determined that ENGINEER is well qualified to perform engineering services to design said improvements. C. CITY has invited ENGINEER to submit a proposal to perform said engineering services. D. ENGINEER has submitted a proposal to perform said engineering services. E. CITY desires to accept said proposal. NOW, THEREFORE, in consideration of the foregoing, CITY and ENGINEER hereto agree as follows: I. SERVICES TO BE PERFORMED BY ENGINEER ENGINEER hereby agrees to perform the 1. Prepare a boundary and topographi parking lot and access road. 2. Analyze the merits of varying the wall versus the merits of grading retaining wall adjacent to Ensign - 1 - following services: survey for the height of the retaining the bluff above the View Park. 3. Prepare detailed plans, quantity and cost estimates, and technical specifications for the improvement project. 4. Prepare underground utilities information required to construct the project. II. SERVICES TO BE PROVIDED BY CITY CITY hereby agrees to provide the following services: 1. Provide all soils data, pavement design values, and pavement sections. 2. Provide up -to -date title reports on parcels of land where construction will take place. 3. Provide general geometric requirements for the parking facilities. 4. Determine location of the access road intersection with Tustin Avenue. 5. Secure permits from all public agencies having jurisdic- tion of the project. 6. Prepare and process any required environmental documents. 7. Provide all rights -of -way, easements, and rights of entry required to construct the improvements. 8. Provide all available records of existing improvements, hydrology and runoff calculations, and existing under- ' ground utilities in the project area which would affect the design of the improvements. 9. Provide standard mylar plan sheets at no cost to ENGINEER. 10. Reproduce bidding sets of plans and specifications; ad- minister the construction contract, provide construction staking and construction inspection. III. SCOPE OF WORK AND PROJECT DESIGN CRITERIA A. Scope of Work PHASE I. This phase shall include preparation of a field survey boundary and topographic map of the site at a scale of 1" = 20'. Map shall show all easements of record, property and right -of -way lines, and existing utility lines and facilities on the site. - 2 - { r t M so I PHASE II. This phase shall include preparation of a con- ceptual layout for the parking facilities, including parking along the access road from Tustin Avenue. Said layout shall be submitted to the CITY staff for review. PHASE III. This phase shall include preparation of an analysis comparing various retaining wall heights versus the degree of slope grading required in the areas adjacent to the bluffs southwest of Ensign View Park. Said analysis shall be submitted to the CITY staff for review. PHASE IV. This phase shall include a hydrology study of the tributary areas and a hydraulic analysis of modifica- tions required to existing drainage structures, including drainage structures adjacent to Coast Highway within the Art Center parking lot located between the proposed parking lot and the Coast Highway. PHASE V. This shall include the preparation of land- scaping and irrigation plans and lighting plans for the proposed parking lot. PHASE VI. This phase shall include the design and prepa- ration of construction plans, special provisions, bid pro- posal forms, and cost estimates for the various construction items including: a. Approximately 60,000 square feet of asphalt concrete pavement included in the new parking lot; new access road from Tustin Avenue; rebuilding portions of existing Art Center parking lot; and other appurtenant items of work. b. Approximately 450 linear feet of retaining wall as described in Phase III above. c. Any additional field survey work required to verify exis- ting elevations at join points with proposed facilities. B. Project Design Criteria 1. Construction plans for all improvements shall be pre- , pared in accordance with the standard requirements of the City of Newport Beach. Plan view scale shall be 1" = 20'. Where profiles are required, they shall be drawn at a scale of 1" = 2' vertical. _3_ i M 2. Any work relating to soils engineering, foundation engineering, geological surveys or reports, soil in- vestigations, construction inspection, soil testings, compaction certification, or parking metering will be provided by CITY and is specifically excluded from the engineering and surveying services to be provided by ENGINEER. ENGINEER will work closely with the soil engineering firm retained by CITY to assure coordina- tion of this phase of the project. 3. ENGINEER makes no representation concerning the cost estimates made in connection with the plans, specifica- tions or drawings other than that all cost figures are estimates only and ENGINEER cannot be responsible for fluctuations in cost. IV. FEE SCHEDULE AND PAYMENT A. In consideration of the performance of the above - described engineering services, CITY agrees to pay to ENGINEER an amount based on two and six - tenths the direct hourly wages of the staff member employed on the work, with the maximum fee for the phases of work and approximate completion dates as outlined below; plus any blueprinting costs, filing fees, checking fees, or other related costs author- ized in advance by CITY. PHASE I - Preparation of Field Survey, Boundary and Topographic May (Estimated Completion Date - -3 weeks) $ 6,500 PHASE II - Preparation of Conceptual Layout for Parking Facilities (Estimated Completion Date - -5 weeks) 1,100 PHASE III - Preparation of Retaining Wall - Slope Grading Analysis (Estimated Completion Date - -6 weeks) 1,200 PHASE IV - Preparation of Hydrology Study and Hydraulic Analysis (Estimated Completion Date - -7 weeks) 1,200 PHASE V - Preparation of Landscape, Irrigation and Lighting Plans (Estimated Completion Date - -9 weeks) 2,400 N PHASE VI - Preparation of Construction Plans, Special Provisions and Cost Esti- mates for New Parking Facility and Retaining Wall (Estimated Completion Date - -12 weeks) 9,500 TOTAL $21,900 Estimated completion dates are shown in weeks following CITY's authorization to commence work on the project. CITY review time must be added to the times shown above. Any additional work authorized by CITY such as legal de- scriptions, sketches, plan revisions due to project concept changes or additions, design of offsite facilities not listed above, construction staking, or redesign of conflict- ing portions of any utility system shall be paid for on a per diem basis in accordance with the following hourly rate schedule: Professional Consultation $ 60.00 per hour Registered Engineer $ 45.00 per hour Engineering, Design Calculations and Supervision $ 35.00 per hour Drafting $ 25.00 per hour Technician $ 15.00 per hour Field Survey Crew (3 -man) $110.00 per hour Consultation in Connection with Litigation and Appearance Before Courts and /or Commissions $125.00 per hour These hourly rates will be subject to a 10% increase each ensuing January 1, beginning January 1, 1982, until com- pletion of the project. Should CITY authorize work at overtime rates, the rates set forth above will be increased to one and one -half times the amount shown. B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month as determined by the fee schedules set forth above; 2. The sum of the monthly partial payments shall not ex- ceed 90 percent of the maximum fee; 3. Balance of the total amount earned is to be paid upon completion of the engineering services. - 5 - V. PROJECT SCOPE REVISIONS The scope of the project may be changed, and the maximum fee revised, upon prior written approval of CITY, if the increase in the maximum fee does not exceed ten percent of that fee. If revisions to the scope of the project would result in an increase in the maximum fee in excess of ten percent of the fee as presently constituted, an amendment providing for such re- visions shall be processed and executed by the parties in the same manner as this Agreement. VI. OWNERSHIP OF PROJECT DOCUMENTS Ownership of project documents, original drawings, reports, notes, maps, and other documents shall become the property of the CITY and may be reproduced and utilized when deemed appro- priate by CITY. VII. RIGHT OF TERMINATION CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' prior written notice. Notice shall be deemed to have been given when deposited in the U. S. Mail, postage prepaid and addressed to ENGINEER's business office at 1401 Quail Street, Newport Beach, California 92663. In the event of termination by CITY due to errors, omissions or negligence of ENGINEER, CITY shall be relieved of any ob- ligation to compensate ENGINEER for that portion of the work affected by such errors, omissions, or negligence. If this Agreement is terminated for reasons unrelated to the errors, omissions, or negligence of ENGINEER, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, and on the basis of the fee schedules contained herein. VIII. INDEMNITY CITY will require that any contractor or subcontractors per- forming work in connection with the drawings and specifications produced pursuant to this Agreement to hold harmless, idemnify and to defend CITY and ENGINEER, their consultants, and their officers, agents and /or employees from any and all liability, 11rdE i � M N claims, losses, damages, judgments, or awards, arising out of or alleged to arise out of the contractors' or subcontractors' negligence in performance of the work described in the construc- tion contract documents, that such duty to indemnify and defend does not extend to liability that may be the result of the sole negligence of CITY, ENGINEER, or their consultants, officers, agents or employees. IX. ENGINEER TO INDEMNIFY ENGINEER shall hold harmless, indemnify, and defend CITY, and its officers, agents, consultants or employees from any damage or liability arising from, or alleged to arise from, any error, omission, or negligence in ENGINEER's performance of the work and services required by this Agreement. Geometric layout of the parking spaces in the parking lot. 2. Provision of soils engineering information. (This work will be retained separately.) 3. Obtain all permits needed. 4. Prepare and process environmental documentation. 5. Obtain all right -of -way needed. 6. Administer construction contract. 7. Provide construction inspection and surveys. Construction of the project will be scheduled in the 1981 -82 fiscal year, thus the budget appropriation will be carried over. Because of right - of -way and retaining wall costs, an increase in the current appropriation will be needed. SUBJECT: ENGINEERING SERVICES AGREEMENT FOR PROPOSED MARINERS MILE PARKING LOT AND ACCESS ROAD RECOMMENDATION: Adopt a resolution approving an engineering services agreement with Robert Bein, William Frost & Associates; and authorizing the the Mayor and the City Clerk to execute the agreement. DISCUSSION: Included in the 1980 -81 budget is an appropriation of $230,000 from the General Fund to construct the Mariners Mile Parking Lot and access road. The parking lot will contain approximately 115 spaces; and is located at the foot of the bluff below Ensign View Park. An access road will run easterly from Tustin Avenue to the parking lot. The location of the project is shown on the attached sketch. A proposal has been received from the consulting engineering firm of Robert Bein, William Frost & Associates for design of the project and prep- aration of the plans and specifications. The following services are included in the Consultant's work: 1. Preparation of a boundary and topographic survey for the site. 2. Preparation of a comparison analysis of varying retaining wall heights versus varying degrees of slope grading for the bluff area adjacent to Ensign View Park. 3. Preparation of hydrology study and hydraulic (drainage) analysis. 4. Design of lighting, irrigation, and landscaping. 5. Preparation of construction plans, specifications, and final cost estimate for the parking lot and for the access road and retaining wall. Compensation for the work will be based on the Consultant's stan- dard hourly rates, with a specified maximum fee of $21,900. Comparison of the fee with the scope of work to be performed and the currently estimated construction cost of $235,000 indicates that the fee is reasonable. Listed below for information are the applicable standard hourly rates: 0 RESOLUTION NO. fi ()4,4 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND ROBERT BEIN, WILLIAM FROST & ASSOCIATES IN CONNECTION WITH THE MARINERS MILE PARKING LOT AND ACCESS ROAD WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain Engineering Services Agreement between the City of Newport Beach and Robert Bein, William Frost & Associates in connection with the Mariners Mile Parking Lot And Access road; and WHEREAS, the City Council has reviewed the terms and conditions of said Agreement and finds them to be satisfactory and that it would be in the best interest of the City to execute said Agreement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Agreement above described is approved and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
