NOW, THEREFORE, the parties hereto agree as follows: A. EXISTING AGREEMENTS: Nothing contained in this Agreement Shall be construed as repealing or modifying any existing agreements, including] mutual aid agreements, except this Agreement repeals the existing I UNIFIED ORANGE COUNTY - CITIES DISASTER AGREEMENT dated December 5, 1972. B. LOCAL AUTHORITY: In the event of an actual or threatened emergency, COUNTY and each CITY shall retain the authority provided for by law respecting its jurisdiction. C. Upon request by CITY, assist in the preparation, development and support of all aspects of an emergency management pro- gram for that CITY. 2. A\ the COUNTY, and will take into account and be coordinated with the needs of CITIES in the event of an emergency. 3. Provide assistance during emergency incidents: a. When confined to one CITY, COUNTY will, if requested, offer assistance within the limits of its capabilities and will, if requested, coordinate assistance furnished by other CITIES. b. When affecting an area greater than one CITY, COUNTY will, if requested, offer assistance within the limits of its capabilities and will, if requested, direct and coordinate the assistance furnished by other CITIES. c. Notwithstanding any of the above, fire and law enforce- ment assistance shall be provided by COUNTY pursuant to applicable mutual aid agreements. 4. Maintain a current resource listing of the facilities, equipment and supplies available in the County for use in the event of an emergency. 5. Provide technical assistance in obtaining any federal or State funds which may become available to CITIES for emergency purposes. 6. Provide technical assistance in the acquisition by CITIES of surplus and excess government property. D. THE CITIES SHALL: 1. Accept primary responsibility for the development within each CITY of an emergency management program which shall be compatible with, and complementary to, the Countywide emergency management program. 2. Promote cooperation among CITIES and the COUNTY in order to 2. I 3. • 1 improve the overall Countywide emergency management program. 2 3. Assure training within their respective CITIES. . 3 E. COORDINATION: It shall be the responsibility of the Orange 4 County Emergency Management Division to coordinate the efforts of the 5 parties to this Agreement for the accomplishment of its purposes. 6 F. ORGANIZATION: There is hereby established the Orange County- 7 Cities Emergency Management Organization, hereafter referred to as 8 "Organization." 9 1. Membership in the Organization shall consist of COUNTY and 10 all CITIES within the County which are signatories to this 11 Agreement. 12 2. The Manager, Emergency Management Division shall be the 13 COUNTY representative member, and shall provide clerical 14 support for the Organization. J� 15 3. A representative from each CITY shall be appointed, in o° ;� 16 writing, by the City Manager /Administrator of that CITY. .Z quo 17 4. Ex officio representatives from other public and private 18 agencies may actively participate as non- voting members 19 at the Organization's meetings and events. 20 5. Official action of the Organization requires a majority 21 vote of the membership. Each member shall have one vote. 22 6. Officers of the Organization and line of succession shall be 23 President, First Vice President, and Second Vice President. 24 7. Officers of the Organization shall be elected at the first 25 meeting to be conducted after the effective date of this n 26 Agreement, and annually thereafter. N N 27 8. The purposes of the Organization include the following: LL ® 28 a. Provide a forum for discussion and exchange of ideas 3. • 1 that are of mutual concern to some or all jurisdictions. 2 b. Identify and examine areas of common concern -and 3 coordinate the development of appropriate plans and 41 programs. 5 c. Assist in the coordination of an annual training exer- 6 cise which will be aimed at strengthening a specific 7 aspect of the CITY - COUNTY disaster response relationship 8 d. Encourage plans and programs leading toward an integrate 9 Countywide preparedness for emergencies. 10 e. Promote public education and individual emergency 11 preparedness within the COUNTY and CITIES. 12 f. Review legislation impacting emergency plans and pro - 13 grams and propose concepts for new legislation. 14 g. Provide technical advice to any requesting member Z; 15 jurisdiction. o.0 ;- >_ 16 h. Review proposals of emergency mutual aid plans and z, U0 17 agreements and recommend further review and approval 18 of such proposals to member jurisdictions. 191 9. During calendar year 1981, the Organization shall meet 201 monthly. Thereafter, regular meetings shall be held 21 quarterly. In addition, special meetings may be called by 22 the President. 23 10. The Organization has no authority to bind the COUNTY or any 24 CITY to any financial arrangement. 25 G. EFFECTIVE DATE: This Agreement shall take effect when executed n_ ° N 26 by COUNTY and a majority of the Cities in Orange County. WITHDRAWAL: Any party may withdraw from this Agreement by written notice to the Board of Supervisors and the President Qf the Organization. F -2(u) 1; a-4 1981 UNIFIED EMERGENCY MANAGEMENT AGREEMENT In September, 1980 a series of recommendations relative to emergency preparedness were issued by the County's Blue Ribbon Committee on Emergency Preparedness and Civil Defense. One of the basic themes of these recommendations was that greater cooperation and coordination in county -wide emergency planning should be imple- mented. As a direct result of the above - referenced recommendations, the Orange County - Cities Emergency Management Organization (EMO) was established on an informal basis. This group, which consists of emergency management representatives from all 26 cities and representatives from the County Office of Emergency Management has met regularly on a monthly basis for some time. One of the key tasks of the EMO has been to develop an acceptable County emergency management agreement. After several months of meetings and lengthy discussions, a proposed agreement has been formulated. Proposed Agreement Attached is a letter from Supervisor Clark transmitting to the City copies of the proposed agreement and the Board resolution approving the document. The proposed agreement repeals the former agreement which had been approved in 1972. This latter agreement had established fees for City participation. The proposed agreement eliminates such fees and generally provides greater clarification of respective City and County roles in emergency planning. County responsibilities are delineated beginning on Page 1 of the agreement while City responsi- bilities are contained on Pages 2 and 3. Additionally, the agree- ment formalizes the structure and functions of the EMO. Conclusion City staff both as representatives to the EMO and through independent analysis has concluded that the proposed agreement is acceptable and represents a potential benefit to the City. In order to encourage timely ratification of this agreement by the cities, we are sending you two (2) copies of the Agreement and a copy of Board of Supervisors Resolution No. 81 -1104. Please execute both copies and return them to the Emergency Management Division. One copy will be returned to your city, so that you'll have an original executed version for the record. The Orange County- Cities Emergency Management Organization was formed to improve county -city coordination in disaster planning, and in answer to the recommendations of the Blue Ribbon Committee on Emergency Preparedness and Civil Defense, which was the subject of my letter to you on September 3, 1980. A subcommittee of the Organiza- ticn reviewed the old Unified Agreement and recommended major revisions including the elimination of annual fees. This revised agreement was approved by the County Emergency Management Council and submitted to each City Manager for review and approval. A majority of the cities have responded favorably either directly or through their representatives in the Emergency Management Organization. Consequently, the Organization voted to approve the new agreement, and recommended that it be forwarded to the Board of Supervisors On July 14, 1981, the Board unanimously approved the revised agreement by Resolution No. 81 -1104. The Board also rescinded the original Agreement dated December 5, 1972. County officials are very encouraged by the response to this effort at improving Countywide emergency planning and believe that it will prove advantageous to all of our citizens. Action to ratify and return the enclosed copies of the agreement at your earliest convenience will be appreciated.
