MAR 2 2 1982 By the CITY COUNCIL FROM: Public Works DepartmO fl( OF NEWPORT 05ACH SUBJECT: AMENDED PROFESSIONAL SERVICES AGREEMENT FOR ENVIRONMENTAL DOCUMENTA- TION FOR JAMBOREE ROAD WIDENING AND NOISE WALL CONSTRUCTION ADJACENT TO EASTBLUFF RECOMMENDATION: Approve an amended professional services agreement with Phillips Brandt Reddick for environmental documentation for Jamboree Road widening and noise wall construction adjacent to Eastbluff, and authorize the Mayor and the City Clerk to execute the agreement. DISCUSSION: On September 28, 1981, City Council approved a professional services agreement with Phillips Brandt Reddick (PBR) to prepare environmental docu- mentation and noise wall study for Jamboree Road improvements adjacent to Eastbluff. On January 11, 1982, City Council held a public hearing and accepted the initial study and negative declaration for the project. This amended agreement is required to finalize the noise wall report and reimburse Phillips Brandt Reddick for necessary additional service performed during completion of the environmental documentation. Traffic Counts 1,800 2,300 500 $21,600 $29,900 $ 8,300 The additional funding is necessary to provide for the increase in PBR and noise consultant staff time required for the public workshops. The original scope of work called for two public meetings and three workshops. The workshops were intended to be held with a small selected citizens' advisory March 22, 1982 • ' Subject: Amended Professional Services Agreement for Environmental Documenta- tion for Jamboree Road Widening and Noise Wall Construction Adjacent to Eastbluff Page 2 committee. The adjacent homeowners were more concerned with the proposed im- provements than was anticipated, and a large majority of them have attended the workshops. The noise consultant was required to attend all the workshops to date, and PBR staff was required to prepare exhibits and presentations suitable for a large public gathering rather than the handout exhibits antici- pated for a small advisory committee. In addition to the exhibits and presenta- tions, the final initial study and noise wall analysis were mailed to each homeowner adjacent to the project prior to the last workshop and City Council public hearing. Yet to be completed is the final noise wall report and workshop with the residents to determine preferred noise wall types, locations and heights. Upon completion, the consultant will make a presentation of noise wall recom- mendations to the City Council at a regularly scheduled study session in May. A final report from the City staff would then be presented to the City Council for approval at a public meeting in June. Benjamin B. WITNESSETH: WHEREAS, the CITY has determined that it requires an environmental documentation and supporting design and coordination services for the Jamboree Road Widening and Noise Wall, in the City of Newport Beach, County of Orange, State of California; and study; and WHEREAS, CONSULTANT has submitted to CITY a proposal to prepare said WHEREAS, CITY entered into an agreement dated September 29, 1981, to provide services necessary to prepare study; and WHEREAS, CONSULTANT has been required to prepare additional material and attend more workshops than anticipated with the homeowners adjacent to the proposed Jamboree Road improvements; and WHEREAS, compensation for the above - mentioned services now totals Twenty -one Thousand Six Hundred Dollars ($21,600) and is estimated to require an additional Eight Thousand Three Hundred Dollars ($8,300) to complete the study; and WHEREAS, CITY desires to enter into a new agreement with CONSULTANT to extend services as necessary to complete the study; NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: 1. GENERAL CONSULTANT agrees to prepare the subject study in accordance with the requirements set forth in Paragraph 2 of this Agreement. CITY agrees to remit to CONSULTANT the amounts set forth in paragraph 3 of this Agreement in accordance with the terms and conditions set forth in this document. 1 of 2 2. SCOPE OF WORK Perform additional services as necessary to complete the subject study in accordance with the CONSULTANT's proposal dated August 17, 1981, and letter dated August 26, 1981, which are attached to this Agreement, marked as Exhibit "A" and Exhibit "B" respectively, and by reference incorporated herein at this point as if fully set forth. 3. BILLING AND PAYMENT CONSULTANT shall be paid under this Agreement on a time and mater- ial basis and shall not exceed Eight Thousand Three Hundred Dollars ($8,300). The City Planning Director may authorize an additional Eight Hundred Thirty Dollars ($830) for services related to this,contract for services rendered not presently anticipated. Partial payments shall be made by CITY to CONSULTANT upon CONSULTANT's presentation of statements verifying the time and material costs incurred by it in connection with this Agreement. 5. TERMINATION This Agreement is subject to termination by the CITY at any time upon serving written notice to CONSULTANT. The CITY shall be thereafter liable to CONSULTANT only for fees and costs incurred as of the date CONSULTANT re- ceives such notice of termination. FAITHFUL PERFORMANCE CONSULTANT shall use diligent efforts to complete this contract within ninety (90) days after execution of this Agreement. The subject study must meet the approval of the Environmental Affairs Committee of the City. In the event additional work shall be subject to a separate contract. 5. TERMINATION This Agreement is subject to termination by the CITY at any time upon serving written notice to CONSULTANT. The CITY shall be thereafter liable to CONSULTANT only for fees and costs incurred as of the date CONSULTANT receives such notice of termination. DISCUSSION: In 1976, a draft environmental impact report (EIR) was prepared for the widening of Jamboree Road between Ford Road and MacArthur Boulevard. Due to concerns about noise in the Eastbluff community, the final EIR was.certi- fied only for the widening of Jamboree Road northerly of Eastbluff Drive (North). In 1979, the City began requiring developments that add traffic to Jamboree Road in the Eastbluff area to contribute to a Noise Wall Fund. This fund is to be used to construct a noise wall on the westerly side of Jamboree Road adjacent to Eastbluff. fund: The following developments have been required to contribute to the Amount Contributed Required to Date 1. Big Canyon Area 10 5,350 $223,038 $57,530 Funds have been included in this year's budget to prepare plans and to update the environmental document for the street improvements and sound wall along the westerly side of Jamboree Road between Ford Road and Eastbluff Drive (North). September 28, 1981 0. Subject: Professional Services Agreement (Phillips Brandt Reddick) Page 2 Proposals were received from two firms specializing in the preparation of environmental documents. They- were.Phil.lips Brandt Reddick (PBR) and Larry Seeman Associates. The staff recommendst. that PBR be retained. The work proposed to be performed by PBR will place heavy emphasis on noise sampling and analyses to determine the type of noise attenuation required. The process will include a public participation program, field noise sampling, field surveys, technical analysis, and developing concepts for noise attenuation. The public participation program will initially provide residents the opportunity to discuss their perceived problems. After collecting tech- nical data and preparing alternate designs, the participation program will provide an opportunity for public input. To assist the layman in understand- ing noise levels, PBR has proposed a unique concept of tape recording actual noise conditions and simulating future conditions with and without attenuation. In addition to the noise study, the proposed work includes an update to the original EIR for completing the improvements on the westerly side of Jamboree Road between Ford Road and Eastbluff Drive (North). PBR proposed to perform the study and environmental update to the EIR in 3k months for a fee of $21,600. It is recommended that a professional services agreement be entered into with PBR to perform the work as proposed. Funding for the project will come 50% from the Jamboree Road Noise Wall Fund and 50% from the Circulation and Transportation Fund. am�, �_ 40. )a Benjamin B. Nolan Public Works Director DW:jd RESOLUTION NO I.l U 5'5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES WITH PHILLIPS BRANDT REDDICK FOR ENVIRONMENTAL DOCUMENTATION FOR THE JAMBOREE ROAD WIDENING AND NOISE WALL CONSTRUCTION ADJACENT TO EASTBLUFF WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain Agreement for professional engineering services between the CITY OF NEWPORT BEACH and PHILLIPS BRANDT REDDICK, in connection with environmental documentation for the Jamboree Road widening and noise wall construction adjacent to Eastbluff; and WHEREAS, the City Council has reviewed the terms and conditions of said Agreement for professional engineering services and finds them to be satisfactory, and that it would be in the best interests of the City to execute said Agreement for professional engineering services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Agreement for professional engineering services above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
