HOLD HARMLESS AGREEMENT
We, TRUMAN B. STIVERS, and JAMES N. STIVERS, hereinafter referred
to as OWNERS, in consideration of a GRANT OF APPROVAL by the CITY
OF NEWPORT BEACH to construct a deck over a common area to the south
of the southerly property line of Lot 22, Bay Island, hereby agree
to hold the CITY OF NEWPORT BEACH and its officers and employees
harmless against any claim, loss, damage or liability that may arise
from,.or in anyway relate to, the construction, use, maintenance or
repair of the deck and all appurtenances as described in plans on
file with the BUILDING DEPARTMENT of the CITY OF NEWPORT BEACH.
This agreement to hold the CITY OF NEWPORT BEACH and its officers
and employees harmless includes the obligation to defend, or provide
a defense for, the CITY and its officers and employees, with respect
to any arbitration or litigation arising out of or related to the
deck and its construction, repair, use and maintenance, and further,
to indeminify the CITY and /or its officers or employees against any
judgement or award that may result therefrom.
This agreement shall be binding on the successors in interest to
as well as the heirs or beneficiaries of the OWNERS.
