SUBJECT: 19TH STREET RESTROOM PROJECT
The proposed 19th Street Restroom Project involves the demolition and
reconstruction of an existing restroom and boat storage facility
located at the bayside end of 19th Street. The existing facility is
used to store sabots used in the City's instructional sailing program.
The proposed new construction will make the restrooms accessable to
the handicapped as well as include boat storage and a small area for
sailing instruction. The proposed reconstruction will not further
encroach on the beach area. The existing structure is bordered by an
asphalt walkway and landscape area which will be eliminated with the
reconstruction.
The location of the restroom facility is ideal for the swimming beach
located between 18th and 19th Streets. In the recently enacted small
boat launching plan, March 24, 1980, Agenda Item #H -3(b), small boat
launching is permitted at the 18th Street end. The area is heavily used
to hand launch a variety of boats including catamarans and lasers. The
19th Street restroom facility will not be used for public launching of
small boats. Parks, Beaches and Recreation Department sailing classes
will use an existing dock for an instructional sabot sailing program.
The instructional program has been using the existing 19th Street rest-
room building and dock for the past 15 years without problems.
Staff feels that the 19th Street Restroom Project will eliminate an
unattractive restroom facility existing at the site and replace it with
an attractive well designed structure which will provide public rest -
rooms for a heavily used beach area. The proposed restroom facility will
not impact existing uses of the 18th to 19th Street swimming beach and
will not increase sailing activity in the area. The project is consistent
with the City's Local Coastal Plan, City Council policies, and municipal
codes and has been approved by the Coastal Commission. Staff recommends
City Council approval of this project which will improve public restroom
facilities at the 19th Street end.

The low bid is 33.8% under the Engineer's estimate of $87,500.
The 1981 -82 budget contains an appropriation of $100,000 from the
Building Excise Tax Fund to refurbish the 19th Street public rest rooms and
construct a classroom /storage area for use of the City's recreational sailing
program. Subsequently it was determined that the existing building should be
demolished and a new structure built.
The proposed building is of masonry construction, one story in
height, with approximately 960 square feet of enclosed floor space. Rooms
include two rest rooms, a small classroom, an office, and a boat storage room;
plus minimum site development. The location is shown on the attached sketch.
At the council meeting of April 12, 1982, rejection of the bids had
been considered because the Coastal Zone permit had not yet been approved.
However, the Contractor agreed by letter dated April 9 to maintain the bid offer
in force pending permit approval. The permit is scheduled for Coastal Commission
action on April 23, 1982. It is set as a consent calendar item, with a staff
recommendation for approval. Should the permit not be approved, a verbal report
will be made to the Council, with a revised recommendation
The Contractor has indicated that he feels the work can be completed
by June 1 if the contract is awarded on April 26. This schedule is probably
unrealistic; however, it should be possible to substantially complete the work
by mid -June, before most of the schools are out. Some inconvenience will be
entailed in constructing the project at this time of year. Arrangements will
be made to have an adequate number of high - quality portable toilets available
during the construction period for public use, and a high standard of maintenance
will be observed.

Gentlemen:
This letter is written to demonstrate the conflict between the intended use for the
beach at 19th Street and West Bay Avenue and the plan under consideration for
construction of a boating facility (classroom and restrooms) on that beach.
(1) The Municipal Codes clearly define this beach for swimming use. And the Code
which relates to boat launching exclude this beach in appropriateness. (City of
Newport Beach Municipal Codes: 11.12.090 Swimming Area No. 8 and 17.16.020
Boat Launching and Hauling, copies attached for reference.)
(2) At the present time swimming beaches are few on the Penihsula in the New-
port /Balboa
area:
One
at M Street in
Balboa
(small)
One
at 10th Street
on Bay
Ave. (one block)
One
at 19th Street
on Bay
Ave. (one block)
At the ends of some streets, beach areas of approximately 25 -35' contain 2 -3
off -shore boat mooring, thus rendering these areas limited in their appropriateness
for for swimming.
Dedication of the subject property for a boating facility would seriously reduce
the potential of its use for swimming.
(3) Beach property which blends the purpose intended with the Municipal Codes can
be found one block away from the subject property at lath Street and West
Bay Street.
(4) Has the question been addressed by the City Council as to the necessity of
providing a student boating facility at the expense of swimming facilities which
are highly limited already?
Attached are a number of letters which protest the subject construction along with
copies of the referenced Municipal Codes which emphasize the conflict between Code
and proposed use.
It is herewith requested that the City Council reconsider the plan to construct the
facility known as the 19th Street restroom and classroom, Contract No. 2312.

I am writing, in opposition to the proposed enlarging of the
restroom - boating facility at 19th and hest Bay Avenue.
I am a resident, and have been for ten years, directly in
front of the "out- house /boat- house" eye -sore! It obliterates
• valued and valuable view of the bay and scenic beauty of
• preci =.us area. It is poorly located, - -on one end of a 400
yard bay beach, and inaccessible to almost everyone,due to
limited parking spaces (metered). It is unsanitary, and
often precipitates flooding and stopping up of overloaded
plumbing and sewage disposal!
i..ore strongly, it is illegal! The beach is, according to
existing code, designated as a swimming area only. Over
the last few months, it has been invaded by boaters, hawaiian
catamaran -ers, Ilobie- cat - addicts, wind- surfers and wind-
surfing classes and promoters ... ad infinitum: Typicaby,
'.;oaters bring their boats to the water on trailers, early in
the morning, and take up the limited number of parking spaces
with their car and their trailer (2 spaces) -- making it impossible
fcr residents returning home from work to find a parking space
(for which they have paid the city money for a decal) and /or
for visitors /swimmers to find a parking space for beach use.
In actuality, the beach is used for a few minutes to launch
boats, catamarans, out - riggers, canoes, and assorted craft- -
which all leave for hours -- leaving the beach inaccessible
and unused by those who want to swim, sun- bathe, etc.
I am not against a restroom for swimmers, visitors, etc,- -
but I do think that a facility should be better placed,
close to city -owned property at 17th or 18th street, preserving
the beauty of this natural ecology, and protecting the vale of
the property.
I urge you, as a student of environmental psychology and as a
resident, to refuse to permit this proposed remodeling.

I am writing to express my concern for the proposed
construction of a large restroom /classroom /boat storage facility
at Bay and 19th Streets in Newport Beach. We currently have a
smaller restroom in the location which poses many problems and
which we would like to see eliminated.
The area is in a beach designated by the city to be a
bathing beach only. (Newport Beach code 11.12.090)
The public area is only one block long and commonly
referred to as "mother's beach" because it is about the only
beach where mothers can bring small children due to lack of a
large surf and the accompanying dangers. Boats already cause
hazards in the swimming area which is roped off during the summer
months. They do not abide by the yellow buoys and ropes but
at their whim, cut across them and run up onto the beach. The
hazards with the windsurfers, dories, sabots, Hobie cats and indeed
the catamarand clubs make it extremely hazardous to try to use
the area for swimming. With increased boatng facilities on a
"swimming only" beach, we fear for the safety of the children
both in and out of the water. (The restrooms are often the scene
of police arrests or investigation due to transients, suspected
drug pushing and alcohol abuse).
In addition, live - aboards are increasing in this area
where they are suposedly prohibited. They will be further encour-
aged by improved facilities.
Currently, the city has a trailer park fronting on 2/3
of the area and a sbwer is included there. Pore logically, if
restrooms are necessary, they should be located in the center of
the stretch of beach, in front of city property rather than in
front of private homes. In question is the need for such a facility
n this small area, anyway, when we consider that between the
wedge and the Santa Ana River (6 miles of high use ocean front)
there are only restrooms at the two piers and at 15th street.
It seems that if additional restrooms are needed, it is in those
areas, not in a one block bay beach where the tide often comes
up to street level and retaining walls will have to be built to
keep it from flooding.
There are many other reasons why a restroom /boating
facility should be denied this area, but I will leave you with
these and hope your logical reasoning will agree with mine.

hazard for the bay itself and a more evident one
for the beach area -- they bring their trash ashore
and dump it regularly in the beach trash bins.
Improved restroom facilities will invite more of
these people to pollute our bay.
3) the restrooms are hiding places for people who are
pursued by the police from time to time for various
reasons. And they serve as meeting places for drug
traders and other undesireables. This poses an
increasing danger for those of us who live on the
street and for those who use the beach.
It is my firm conviction that if facilities are provided at
all, they should be small and sparse (i.e. two port -a- cans).
Therefore, I oppose the current plan.

According to the Municipal Code (Chapter 11.12, Sections
11.12.090 Swimming Area #8), this is a swimming beach, not a
boating area.

Only these few public beaches remain on the bay side of
the Peninsula:
One at M Street in Balboa (small)
One at 10th Street on Bay Ave. (1 block)
One at 19th to 18th on Bay Ave. (1 block)
These few areas must serve not only Newport residents,
but people from all over Orange and Los Angeles counties who
come to enjoy the calm water and quiet beaches of our bay.
Z am opposed to any construction that will encourage
boating activity on this beach as such activity clearly
violates the existing code.

I object to the proposed construction of a sailing center
on the beach at 19th and Bay.
This has traditionally been a popular beach for mothers
with small children because it is safe and uncongested. Since
teenagers and tourists generally prefer the ocean beaches, this
is an ideal play beach for babies and younger children.
The sailing classes add unnecessary hazards to this area.
Neophyte sailors assembling boats on the beach for class use
while curious young children are wandering about is not safe.
If this facility is. necessary, the ideal location would
seem to be at the end of 18th Street near the mobile home park
which the City owns. This is already a designated boating area.
This also would be a better area for the adjoining restrooms
as it is at the center of phe beach and convenient to more people.

19th Street Restroom & Classroom be abandoned, as it is
in conflict with the intended use of the beach at i9th
and West Bay Avenue.
We who use this beach for swimming object to it being
used for boating facilities. There are few swimming areas
left on the bay beaches where the swimming is safest for
small children.
Therefore we request that this contract be abandoned
until further study can be made of the use of the beach,
according to the Newport Beach Municipal Code.

congestion caused now by the boaters and windsurfers at the
19th Street boat launching area. I feel strongly that building
larger facilities for sailing classes will mean more classes,

is "coaxed out” already.

are not firm and responsible on this issue,, I believe serious

come to enjoy the calm water and quiet beaches of our bay.
I am opposed to any construction that will encourage
boating activity on this beach as such activity clearly

I object to the proposed construction of a sailing center
on the beach at 19th and Bay.
This has traditionally been a popular beach for mothers
with small children because it is safe and uncongested. Since
teenagers and tourists generally prefer the ocean beaches, this
is an ideal play beach for babies and younger children.
The sailing classes add unnecessary hazards to this area.
Neophyte sailors assembling boats on the beach for class use
while curious young children are wandering about is not safe.
If this facility is necessary, the ideal location would
seem to be at the end of 18th Street near the mobile home park
which the City owns. This is already a designated boating area.
This also would be a better area for the adjoining restrooms
as it is at the center of the beach and convenient to more people.

I strongly protest the plans to construct a new classroom
and restrooms at the corn of Bay and 19th Streets.
The prospect of increased boating activity on the beach
between 18th and 19th is most unwelcome. We have limited
parking space available as it is. More classes mean more
congestion -- we have enough of that already with the wind-
surfing classes, the canoeing classes, the Hobie's and their
trailers.
In addition, the existing restroom and storage structure
is an eyesore. However, building a larger facility in its
place is moving in the wrong direction. Such a structure would
only further obstruct the view of the bay for several residences
along both streets involved.
I urge you to abandon this project.

I am writing to call your attention to some problems
you have neglected to consider in planning to upgrade and enlarge
the restroom facilities on the 19th and Bay beach.
First of all, is a restroom facility really necessary here
at all: Do the number of swimmers and sunbathers really justify
such a facility? How can you justify a restroom for a one -block
stretch of beach on the bay side, when there are only two facilities
in a six -block area of ocean beach which attracts many hundreds
more people?

As a resident of the area in question, I have observed the
following:
1) the restrooms on the bay beach attract derelicts and
transients who hang around this area year round.
2) the restrooms in such close proximity to the dock
on 19th street encourage live - aboards. Although it
is illegal to live aboard a boat on moorings in this
harbor, an alarming number of people are getting
by with it. This poses a potential environmental
hazard for the bay itself and a more evident one
for the beach area -- they bring their trash ashore
and dump it regularly in the beach trash bins.
Improved restroom facilities will invite more of
these people to pollute our bay.
3) the restrooms are hiding places for people who are
pursued by the police from time to time for various
reasons. And they serve as meeting places for drug
traders and other undesireables. This poses an
increasing danger for those of us who live on the
street and for those who use the beach.
It is my firm conviction that if
all, they should be small and sparse

According to the Municipal Code, Chapter 17.16.020 under "Vessel
Operation," I quote:
Boat Launching and Hauling. No person shall launch or
remove any vessel from the waters of Newport Harbor over
any public seal wall, sidewalk, street end or public property
except at locations where a regular business of launching
and hauling vessels is conducted or at launching sites
designated by resolution of the City Council.
To my knowledge, the City Council has never made the required
resolution to permit launching of sail boats at the 19th Street
dock. If it has, I I to see a printed, dated copy of this
resolution. If not, then all sailing classes at the 19th Street
dock are in violation of the code.
Accommodating such actions with City -owned facilities such
as the one presently in operation and the one proposed condones
such illegal action and should be condemned.
If you want sailing classes at the 19th Street dock, the
Code must be changed first, then facilities proposed, not
the other way around.
Since the Public Works Department seems to have the cart
before the horse with its proposal for the new builidng on
the 19th Street beach, I am very much opposed to its construction.

to extend the bid past 60 days from the date of the bid opening. This
is not the case. If the council desires to award the contract directly
after the April 21st coastal zone permit meeting, Hedrick is willing
to stand behind its commitment to construct the project. Many hours
of preparation have gone into the bid as well as preparation to start
the project. Many hours were wasted due to no communication from your
planning staff that there was a problem. I£ the project is started
by April 30th, it most likely can be occupied by the end of June.

Subject: 19th Street Rest Room and Classroom (C -2312)
The low bid is 33.8% under the Engineer's estimate of $87,500.
The 1981 -82 budget contains an appropriation of $100,000 from the
Building Excise Tax Fund to refurbish the 19th Street public rest rooms and
construct a classroom /storage area for use of the City's recreational sailing
program. Subsequently it was determined that the existing building should be
demolished and a new structure built.
The proposed building is of masonry construction, one story in
height, with approximately 960 square feet of enclosed floor space. Rooms in-
clude two rest rooms, a small classroom, an office, and a boat storage room;
plus minimum site development. The location is shown on the attached sketch.
There are two reasons to .reject such favorable bids, both arising
from the fact that the public hearing on the application for a Coastal Zone
Permit will not be held before April 21, 1982:
1. Construction would take place during the busy summer season at
the bayfront public beach.
2. The contract documents provide that contracts will be awarded
within 30 days after opening bids. The low bidder reluctantly
agreed to hold his bid price for an additional 30 days, but does
not wish to delay any further.
The staff plans to obtain the Coastal Zone Permit, and to have the
building constructed after the end of the beach season. The project will be
re- budgeted to the 1982 -83 fiscal year.

SUBJECT: 19TH STREET CLASSROOM AND RESTROOM BUILDING (CONTRACT NO. 2312)
RECOMMENDATIONS:
1. Approve the plans and specifications.
2. Authorize the City Clerk to advertise for bids to be opened
at 11:00 A.M. on February 24, 1982.
DISCUSSION:
The 1981 -82 budget contains an appropriation of $100,000 from the
Building Excise Tax Fund to refurbish the 19th Street restroom and construct
a classroom /storage area for the use of the City's recreational sailing
program. The location is on the bayfront public beach at 19th Street and is
shown on the attached sketch.
Local architect Dennis Wood was retained to develop a schematic plan
for refurbishing and adding to the existing building. Based upon his study,
the staff agrees with the architect's recommendation that the existing 400 -
square -foot building of indeterminate age should be demolished and a new
structure built. Accordingly, plans and specifications have been prepared for
a new classroom and restroom building. A complete set of plans is located in
the Council's conference room.
The proposed building is of masonry construction, one story in height,
with approximately 960 square feet of enclosed floor space. Rooms include two
restrooms, a small classroom, an office, and a boat storage room; plus minimum
site development.
The project budget is as follows:
Demolition $ 5,000
New building, 1,000 square feet p $75.00 /sq. ft. 75,000
Site work 7,500
Professional fees 9,500
Miscellaneous and Contingencies 3,000
Total $100,000
The estimated date of completion is July 15, 1982.
