ANDERSEN City Clerk WEA:lr City Hall • 3300 Newport Boulevard, Newport Beach, California 92663 5 -81 _. 0 AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR IRVINE AVENUE IMPROVEMENTS BETWEEN BRISTOL STREET AND MESA DRIVE THIS AGREEMENT is made and entered into this Z 6 744 day of e ru d v y 1982, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY," and the firm of WILLIAMSON AND SCHMID, CONSULTING ENGINEERS, hereinafter referred to as ENGINEER." W I T N E S S E T H WHEREAS, the CITY intends to prepare engineering plans and specifica- tions for the construction of street and bikeway improvements on Irvine Avenue between Bristol Street and Mesa Drive, hereinafter referred to as "PROJECT "; and WHEREAS, ENGINEER has submitted a proposal to CITY (dated February 4, 1982) to perform engineering services in connection with the preparation of engineering plans; and WHEREAS, CITY desires to accept said proposal; NOW, THEREFORE, in consideration of the foregoing, the parties agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be performed by ENGINEER ENGINEER hereby agrees to perform the following services: A. Obtain uncontrolled aerial photographs at an approximate scale of 1" = 40' to be used as base sheets for improvement plans in areas where full topo survey is not necessary. B. Obtain vertical and horizontal field survey information for street widening portion and supplement aerial photographs with field survey as required. C. Refine project scope by identifying solutions for construc- tion of bikeways in critical areas (i.e. narrow roadway sections, obstructions, transitions, etc.) 1 of 4 X2//8 D. Prepare improvement plans consisting of title sheet, plan and profile sheet for combined street /storm drain improve- ments and plan sheets for bikeway improvements, including details and provisions for driveway adjustments. E. Provide hydrology and hydraulic calculations for storm drain design. F. Prepare quantity and cost estimates G. Prepare contract bid package consisting of bid proposal form and special provisions. H. Process plans through approval with the County of Orange. I. Attend meetings as required by the project and provide for coordination with utilities. III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following informa- tion and materials: A. Copies of previous alignment studies, hydrology studies, and reports of the PROJECT area. B. Copies of existing improvement plans, and utility informa- tion for water, lighting and sewer systems in the PROJECT area. IV. Time of Completion The final plans and other documents shall be submitted to the Public Works Director of the CITY for final review by April 15, 1982. V. Ownership of PROJECT Documents Original drawings, reports, notes, maps, and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. VI. Right of Termination CITY reserves the right to terminate this Agreement at any time by giving ENGINEER seven (7) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to the ENGINEER's business office at 17782 Sky Park Boulevard, Irvine, California 92714. In the event of termination due to errors, omissions, or negligence of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER for that portion of the work affected by such errors, 2of4 omissions, or negligence of the ENGINEER. If this Agreement is terminated for any other reason, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VII. Fee Schedule and Payment In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Ten Thousand Four Hundred Dollars ($10,400) except as otherwise provided herein. A. Hourly rates for office and field personnel shall be as follows: CLASSIFICATION PER HOUR Principal Engineer $ 65.00 Project Engineer $ 55.00 Assistant Engineer $ 46.00 Design Draftsperson $ 39.00 Draftsperson $ 33.00 Junior Draftsperson $ 25.00 Secretary /Delivery $ 18.00 3 -Man Survey Crew $128.00 2 -Man Survey Crew $ 99.00 B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. 2. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents, materials' costs related to survey work, and other related costs authorized in advance by the Public Works Director and advanced by ENGINEER. VIII. Additional Work Should ENGINEER complete any additional work not outlined in this Agreement, but authorized by CITY, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section VII (Fee Schedule and Payment).above. IX. Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, 3of4 0 • omissions, or negligence in the ENGINEER's performance of the engineering work and services required by this Agreement. IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date first above written.
