SUBJECT: ACCEPTANCE QE MISCELLANEOUS CONCRETE CON CTIow c- 2327) RECOMMENDATIONS: 1. Accept the work. 2. Authorize the City Clerk to file a Notice of Completion. 3. Authorize the City Clerk to release the bonds 35 days after Notice of Completion has been filed. DISCUSSION: The contract for Miscellaneous Concrete Construction has been com- pleted to the satisfaction of the Public Works Department. The bid price was $40,929.00 Amount of unit price items constructed 45,067.00 Amount of change orders 1,734.63 Total contract cost $46,801.63 Funds were budgeted in the General Fund. On July 26, 1982, the Council authorized additional curb and gutter construction in the area of 15th Street and Orange Avenue in Newport Heights. Payment for the work resulted in the increase in the cost of the unit price items. One change order was issued to provide for reimbursement for the CalTrans permit fee and for relocation of two CalTrans traffic signal pull boxes. The design engineering was performed by the Public Works Department. The contractor is Stevens & Stevens of Downey, California. The contract date of completion was August 31, 1982. Due to the additional curb and gutter construction and delays in obtaining the CalTrans p it rider, the work was not completed until October 15, 1982. Benjamin B. Bids shall not be received from bidders who are not licensed in accordance with the provisions of Chapter 9, Division III of the Business and Professions' Code. The low bidder shall also be required to possess a City of Newport Beach business license prior to execution of contract. Bids shall be submitted on the attached PROPOSAL form. The additional copy of the PROPOSAL form may be retained by the bidder for his records. The estimated quantities indicated in the PROPOSAL are approximate, and are given solely to allow the comparison of bid totals. Bids are to be computed upon the estimated quantities indicated in the PROPOSAL multiplied by unit price submitted by the Bidder. In the event of discrepancy between wording and figures, bid wording shall prevail over bid figures. In the event of error in the multiplication of estimated quantity by unit price, the correct multiplication will be computed and the bids will be compared with correctly multiplied totals. The City shall not be held responsible for Bidder errors or omissions in the PROPOSAL. Contract documents shall bear signatures and titles of persons authorized to sign on behalf of the bidder. For corporations, the signatures shall be of the President or Vice President. For partnerships, the signatures shall be of a general partner. For sole ownership, the signature shall be of the owner. In accordance with the California Labor Code (Sections 1770 et seq.), the Director of Industrial Relations has ascertained the general prevailing rate of per diem wages in the locality in which the work is to be performed for each craft, classification, or type of workman or mechanic needed to execute the contract. A copy of said deter- mination is available in the office of the City Clerk. All parties to the contract shall be governed by all provisions of the California Labor Code relating to prevail- ing wage rates (Sections 1770 -7981 inclusive). The Contractor shall be responsible for compliance with Section 1777.5 of the California Labor Code for all apprenticeable occupations. SP 1 of CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT SPECIAL PROVISIONS FOR MISCELLANEOUS CONCRETE CONSTRUCTION CONTRACT NO. 2327 SCOPE OF WORK The work to be done under this contract consists of constructing alley improvements and P.C.C. wheelchair ramps and appurtenant work as shown on the plans. Additional work which maybe done under this Contract consists of constructing alley improvements shown as "Additional Bid Items" on Plan A- 5097 -S and the proposal. The Contract requires the completion of all the work in accordance with these Special Provisions, the Plans (Drawing No. M- 5219 -S, A- 5099 -S, and A- 5097 -S), the City's Standard Special Provisions and Standard Draw - in s for Public Works Construction, 1980 Edition, and the Standard Speci- fications for Pub is Works Construction, 1979 Edition, including supplements to date. Copies of the Standard Specifications may be purchased from Building News, Inc., 3055 Overland Avenue, Los Angeles, California 90034, telephone (213) 870 -9871. A copy of the Standard Special Provisions and Standard Drawings may be purchased at the Engineer's office for $5. II. COMPLETION, SCHEDULE, AND PROSECUTION OF WORK The Contractor's construction schedule must be approved by the Engineer prior to start of any work and shall incorporate the following requirements: A. All work under this contract shall be completed by August 31, 1982 or within forty -eight consecutive calendar days after the start of work, whichever comes first. B. The Contractor shall complete all work on each alley within (16) con- secutive calendar days after beginning work on that alley. The term "work" as used herein shall include all removals, adjustments, and replacements; construction of alley pavement, alley approaches, adjacent street pavement,. curb , driveways, sidewalk, adjacent P.C.C. or A.C. garage approaches and A. C. joins. Also included within the specified period is curing time for the new P.C.C. improvements. In summary, this means that each alley and every garage approach with access from that alley must be returned to normal vehicular use within sixteen (16) consecutive calendar days from the day it is first closed to such use. The Cont r actor must employ sufficient men and equipment to meet this schedule. If it becomes apparent during the course of the work that the Contractor will not be able to meet this schedule, he will be prohibited from starting work in additional alleys or work until he . • SP2of5 has exerted extra effort to meet his original schedule and he has demon- strated that he will be able to maintain his approved schedule in the future. Such stoppages of work shall in no way relieve the Contractor from his overall time of completion requirement, nor shall it be con- strued as the basis for payment of extra work because additional men and equipment were required on the job. The Contractor will be assessed $100 per day (including Saturdays, Sundays, and holidays) liquidated damages for each day in excess of the sixteen (16) consecutive calendar days allowed for 100% completion of the construction work in each alley and the alley's return to normal vehicular use. Additional liquidated damages, as covered in Section 6 -9 of the Standard Specifications, shall be assessed for failure to com- plete the project within the specified time. The intent of this section of the Special Provisions is to emphasize to the Contractor the importance of prosecuting the alley construction in an orderly, pre - planned, continuous fashion, so as to minimize the time an alley is closed to vehicular traffic. C. The Contractor shall complete all work on each wheelchair ramp or ramps within five (5) consecutive work days after beginning work. The term "work" includes all removals, adjustments, construction, and curing time. III. PAYMENT The unit or lump sum price bid for each item of work shown on the Proposal shall be considered as full compensation for all labor, equipment, materials, and all other things necessary to complete the work in place, and no addi- tional allowance will be made therefor. Payment for incidental items of work not separately provided for in the proposal shall be included in the unit price bid for each item of work. IV, TRAFFIC CONTROL AND ACCESS The Contractor shall provide traffic control and access in compliance with Section 7 -10 of the Standard Secif�ications and with the standards contained in the Work Area Traffic�ontrol Handbook WATCH), also published by Building News, Inc. In addition, the Contractor shall conform with the following traffic require- ments: Work along Pacific Coast Highway and Newport Boulevard 1. The Contractor shall provide traffic control and access in accordance with California Department of Transportation (CalTrans) Standard Specifications, and the "Manual of Traffic Controls - Warning iS gns, Lights, and Devices for Use in Performance of Work Upon Highways" published by CalTrans. 2. The Contractor shall furnish and install "Flashing Arrow" signs per CalTrans' Standard Specifications, Section 12 -3.03, should the Contractor choose to close a traffic lane. 0 0 SP3of5 Work Along Streets Other than Pacific Coast Highway and Newport Boulevard The Contractor may close a traffic lane only between the hours of 9 A.M. and 3 P.M. A. Notice to Residents Between 48 and 55 hours before closing a section of street or alley or restricting vehicular access to garages or parking spaces, the Contractor shall distribute to each affected address a written notice stating when construction operations will start and approximately when vehicular accessibility will be restored. The written notices will be prepared by the Engineer. The Contractor shall insert the applicable dates at the time he distributes the notice. Errors in distribution, false starts, acts of God, strikes or other alterations of the schedule will require Contractor renotification using an explanatory letter furnished by the Engineer. "NO PARKING" Signs Where any restrictions herein mentioned necessitate temporary prohibition of parking during construction, the Contractor shall furnish, install, and maintain in place "NO PARKING" signs (even if streets or alleys have posted "NO PARKING" signs) which he shall post at least 40 hours in advance of the need for enforcement. In addition, it shall be the Contractor's responsibility to notify the City's Police Department, Traffic Division, at (714) 644 -3742, for verification of posting at least 40 hours in advance of the need for enforcement. The signs shall (1) be made of white card stock; (2) have minimum dimen- sions of 12 inches wide and 18 inches high; and (3) be similar in design and color to sign number R -38 on the Caltrans Uniform Sign Chart. The Contractor shall print the hours, day and date of closure in 2- inch -high letters and numbers. A sample of the completed sign shall be approved by the Engineer prior to posting. PERMITS The Contractor shall obtain the following permits prior to any construction: Permit to perform excavation or trench work from the Division of Industrial Safety, State of California. Permit to dispose of demolition at any sanitary landfill site in Orange County, from the City Public Works Department at no charge. 3. Rider for California Department of Transportation Encroachment Permit. Contractor shall remit permit and inspection fees with the Department of Transportation and will be reimbursed by City for actual costs of permit and inspection fees upon completion and acceptance of Project. The City has obtained a California Department of Transportation Encroachment Permit (attached hereto). • . SP4of5 VI. CONSTRUCTION SURVEY STAKING Field staking for control of construction will be provided by the Engineer. VII. WATER The Contractor shall make provisions for obtaining and applying water necessary to perform his work. If the Contractor elects to use City water free of charge it shall be his responsibility to make arrangements by contacting the City's Utilities Superintendent, Mr. Gil Gomez at (714) 640 -2221. VIII. SURFACE WATER Surface runoff water containing mud, silt or other deleterious material due to the construction of this project shall be treated by filtration or reten- tion in settling basin (s) sufficiient to prevent such material from migrating into the bay. IX. CONSTRUCTION DETAILS A. Removals, Excavation, and Subgrade Preparation Existing portland cement concrete or asphalt concrete improvements to be removed shall be sawcut a minimum of 2 inches deep along property lines, joint lines, at the locations beyond property lines as shown on the Plans, or as directed by the Engineer. Final removal at the sawcut lines may be accomplished by the use of jackhammers or sledgehammers. It is emphasized that edges created by other means or final removal accomplished by other means will not be acceptable, and hard blow pavement breakers, such as stompers, will not be permitted on the job. B. Portland Cement Concrete Overhead screeds will be required at the flow line. A 12- inch -wide smooth trowel surface shall be constructed along the flow line (centerline) of each alley. The remainder of the alley surface shall be medium broom finished. All sidewalk or drive approaches that extend beyond the street or alley right -of -way shall have a cold joint or if placed monolithic, a minimum 2" deep saw cut within 24 hours at the right -of -way line. • SP5of5 C. Permittee shall notiiy the Permit Inspector between 0700 and 0900 two (2) working days prior to starting any work authorized by this permit. See the face of the permit for Inspector's telephone number. 2. Permittee shall arrange for a pre - construction meeting at the job site with the Permit Inspect- or and all other interested persona two (2) working days prior to starting work, to discuss the permit requirements. 3. In the event that all or a portion of this work is within the working area of a State highway construction project, no work shall be started until all arrangements have been made with the State Contractor and Resident Engineer to avoid any and all conflict or delay to the State Contractor. 4. Unless otherwise authorized by the Permit Inspector, all work within State right of way shall be in accordance with the current Caltrans standards Specifications and standard plans. The Uniform Building Code, may be used as the minimum specifications unless a more stringent specification is required by the local agency, permit or Permit Inspector. Improvements shall be constructed at the location shown on the Permittee's approved plane if they do not conflict with State requirements. 5. Should there be any discrepancy between the terms of this permit and the plans attached hereto, the terms of the permit will prevail. 6. All inspection costs incurred incidental to this work shall be borne by the Permittee. 7. All work shall be performed during the working hours regularly assigned to Department of Transportation employees unless otherwise authorized in writing. 8. All COOLS incurred for work within State right of way pursuant to this encroachment permit shall be borne by the Permittee, and Permittee hereby waives all claims for indemnification or contribution from the State for such work. 9. Upon completion of work, Permittee shall clean the highway and the work area shall be left in a neat and presentable condition and to the satisfaction of the Permit Inspector. L0. A minimum walkway and /or bike path width of 30 inches must be maintained at all times for safe passage through the work area. 11. Any work authorized by this permit which requires traffic diversion and /or traffic interruption, including sidewalks and bike paths, shall be approved by the Permit Inspector. See the face of the permit for inspector's telephone number. 12. Unless otherwise authorized by the Permit Inspector, the normal traffic control shall be limited to the hours of 0900 - 1500 and open for use by public traffic on Saturdays, Sunday$, designated legal holidays and after 3:00 P.M. on Fridays and the day preceding designated legal holidays, and when construction operations are not actively in progress on working days. 13. Designated legal holidays are: January let, and third Monday in February, the last Monday in May, July 4th, the first Monday in September, November 11th, Thanksgiving Day, and December 25th. When a designated legal holiday falls on a Sunday, the following Monday shall be a designated legal holiday. When November lltb falls on a Saturday, the preceding Friday shall be a designated legal holiday. 14. The Permittee shall provide adequate protection of traffic in accordance with the current traffic control requirements of the Department of Transportation (Caltrans), the Standard Specifications Section 7 -1.08 (Public Convenience), Section 7 -1.09 (Public Safety) and Section 12, (Construction Area Traffic Control Devices), and special provisions of the permit. The condition and location of other traffic control devices shall be approved by the Permit Inspector and installed and maintained by the Permittee in accordance with the permit. All cones shall be 28 inch minimum height. Portable delineators used in lieu of cones shall be placed at one half the spacing for cones. All advance warning signs shall be equipped with flags for daytise, closures. ALL advance warning signs shall be 48 inch x 48 inch minimum for approach speeds of 45 MPH or more on two lane highways with reversible control and for approach speeds over 50 MPH on'I multiple lane directional half roadway and lane closures. At all other speeds all warning signs shall be 36 inch by 36 inch minimum except that "Road Work Ahead" (23) shall be 30 inch by 30 inch minimum. .Department of Transportatio ,"ltrans) • SPECIAL PROVISION "A" (Attach to all Permits - 2 -82) Page 2 14. continued During the hours of darkness all necessary cones used for lane delineation shall be illuminated or reflectorized for approach speeds through 50 MPH. All flagpersons shall be trained and their sole duty will be to control traffic. They shall wear white hard hats, orange veeta or jackets, and have an approved slow /atop paddle. They shall be intervisible or be in communication vie 2 -way radio. During the hours of darkness the vest or jacket shall be reflettorized, flagman stations shall be illuminated such that the flagman will be clearly visible to approaching traffic and all necessary cones used for lane delineation shall be illuminated or reflectorized for approach speeds through 50 MPH. 15. The signs used for traffic control shall either be covered, removed from the right of way, or turned to face away from traffic when not actually in use. 16. All lane closures on multilane highways shall be made using an approved flashing arrow sign, if available. After January 1, 1982 the State inspector shall close down any project found to have such a lane closure without the required flashing arrow signs. 17. The Permittee shall notify the Division of Highways Signal Laboratory at 213- 620 -2030, at least 72 hours in advance of any excavation within 5001 of the signalized intersection or in the vicinity of State lighting facilities. The Permittee and /or his contractor asavme the responsibility for the payment of all costs incurred by the State in repairing facilities damaged during construction. Requests for relocation of facilities for the contractor's convenience must be made in writing with the contractor assuming coats. 18. Existing utilities shall be protected from damage by the Permittee. 19. Existing highway facilities damaged by reason of the Permf.ttee's operations shall be repaired by the Permittee at his expense. 20. Permittee shall be responsible for notifying his contractor and all sub - contractors of the provisions of this permit. No work will be started until a copy of this permit in given to the contractor and each of his sub- contractors. 21. The Permittee and /or the contractor shall submit a copy of all required CalOsha permits to the Permit Inspector prior to starting work. 22. This permit. shall be kept at the site of the work and must be shown to any representative of the grantor or law enforcement officer on demand. Failure to comply may require stoppage of all work within State right of way for a minimum of the remainder of the working day. 23. All lane and pavement markings shall be removed by sandblasting or air blasting. 24. Placement of pavement and lane markings shall be done by the Permittec under the direct supervision of the State representative in the field. 25. A survey "at no coat to the State" of the Permittee'e property may be required to verify compliance to approved plans. 26.. Should work take place between October 15 and April 15, Permittee shall obtain a long - range clear weather forecast before breaking into a main line scam drain. Construction of facilities connecting to the main line will be permitted only during a clear weather forcast that Is acceptable to the Caltrans representative. Once operations under this permit are initiated, the work shall be conducted in a continuous manner until completed. 27. Abandoned connector pipes shall be sealed at both ends with 8 -inch brick and mortar or six inches of concrete. When facilities are allowed to be abandoned in place, backfilliag with sand, or other measures, may be required to protect the highway. This is mandatory for metal Pipes 12" In diameter or larger and all other pipes 24" in diameter or larger. 28. All inlet openings shall be provided with protection bare spaced to provide an opening that does not exceed six inches. 29. Permittee shall not use Caltrane property for the temporary or permanent storage of excavated materials, rock, sand, cement or other material or any equipment, except as specifically noted. l.i Depkrtment of Transpo tion (Caltrans) STANDARD SPECIAL PROV�ONS "B" - (STREET IMPROVANTS) 1/82 I This Special Provision sheet "B" and its attachments as minimum specifications for construction of sidewalk, roof drains, and wheel chair ramps at the location shown approved plan. II Sidewalk are to be used curb and gutter, on Permittee's 1. Sidewalk shall be constructed with Class "A" (6 sack) Portland Cement Concrete four (4) inches in depth except at commercial drive- ways where six (6) inch depths respectively, will be required. 2. The subbase under the sidewalk shall be 4" of pea gravel or sand subbase. The 4" of subbase may be waived provided the native soil has a sand equivalent value of 20% as determined by California Test Method 217F or as determined by the Permit Inspector. 3. A Caltrans approved soil sterilant shall be applied as directed by the State representative in the field. The sterilant shall be a borate chlorate sterilant containing not less than 25 percent sodium chlorate. The sterilant shall be applied at a rate such that not less than 2.5 pounds of sodium chlorate is applied per 100 square feet of area to be sterilized. Sterilant shall not be applied closer than 12 inches to plants and shall be applied by a device approved by the Engineer. 4. The finished grade of sidewalk shall have a crossfall of 1/4" per foot toward the curb. The surface of sidewalks shall be marked into rectangles of not less than 12 square feet nor more than 20 square feet with a scoring tool which will leave the edges rounded or scored to matching adjoining sidewalk. 5. Back edge of sidewalk shall be placed on the right of way line. Sidewalk width shall be a minimum of 5 feet. 6. Section of existing concrete sidewalks to be removed shall be sawcut on the nearest score marks beyond the limits of removal unless it is within 5' of an expansion joint. This concrete shall be re- moved to the sawcut line or the expansion joint to full depth and disposed of outside the State right of way. III Curb and Gutter 1. Unless otherwise authorized by the Permit curb and gutter shall be Caltrans standard A2 -8. Curb and gutter shall be constructed with class 'A' (6 sack) Portland Cement Concrete over a minimum of 6" class II aggregate base. 2. Concrete curbs and gutters shall be constructed to plan grade or in conformance with alignment and grade of existing curb and gutter. 3. Prior to the removal of existing curbs or construction of new curbs, the Permittee shall relocate surface obstructions (such as utility poles, trees etc.) to locations back of the y p proposed curb. Hold public hearing to hear protests from property owners who do not desire this project utilizing procedures from Chapter 27 of the Improvement Act of 1911. 2. Direct staff to either: a. Construct the project per the plan if the property owners do not commence construction within the 60 -day period of public notice; or b. Modify the plans and construct the project if the property owners do not commence construction within the 60 -day period of public notice; or c. Abandon the project. DISCUSSION: On December 31, 1981, the City Clerk received petitions signed by owners of 10 of the 12 lots in Block 3, Tract 27, requesting that the City im- prove their alley. The petitioners own 85% of the area of Block 3 and 81 %z% of the front footage along Alley 102D (see attached sketch). On April 12, 1982, the Council directed the staff to notify the prop- erty owners to construct the improvements, and to set a public hearing for April 26, 1982, to hear any protests. The hearing is the third step in a procedure to improve alleys which was approved by the City Council on April 24, 1972. The procedure is as follows: 1. The owners of 60% of the front footage facing the alley file a petition with the City Clerk requesting the improvement. 2. Upon the filing of the petition and after a notice from the City, the owners have a duty to construct improvements. 3. A public hearing is held at which time the City Council may hear protests from anyone who does not desire the improvement.
