1) Approve the awarding of an emergency public works contract by the Acting
Utilities Director to S. E. Eaton Co. in the amount of $15,459.60 for emergency
repairs to the control valve for the 30" water main damaged during the storm
on March 1, 1983, and determine that the contract was of urgent necessity
for the preservation of health and property.
2) Adopt a resolution containing a declaration of the facts constituting the
emergency.
DISCUSSION:
Due to the heavy rains that occurred an March 1, 1983, the 30 "water main
which services the City north of Coast Highway broke underneath the Bay Bridge. This
break disrupted water service and fire protective service for the northern portion
of the City. This presented an immediate danger to both health and property.
Before City crews could bring water to the service area from other sources,
it was necessary to shut down the water flowing through the 30" line. The valve needed
to accomplish this broke during the shut down operation. In order to restore water
service to the affected area it was determined that even though it would further damage
the valve, it was essential that the valve be forced shut. This was done, thereby
enabling City crews to restore water and fire service on a temporary basis.
It was determined on March 2, 1983 that even though the line had been shut
down, the water supply was not completely shut off and large amounts of water were
flowing into the bay. As City crews were also involved with the break in Corona del
Mar and with checking services throughout the City, the Acting Utilities Director
determined that it was necessary to hire an outside contractor to expose the valve
and to repair the problem. Bids were requested from three contractors on a time and
materials basis. The lowest bid was received from S. E. Eaton Company. It was thought
that the cost would be under $12,000. However, difficulties in locating the damage
and in preparing a vault for the repaired valve brought the cost to $15,459.60.
It is requested that the City Council determine that the contract was of
urgent necessity for the preservation of health and property and approve the payment
of $ 15,459.60 to S. E. Eaton Company for their work in exposing and repairing
the broken valve.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AWARDING AN EMERGENCY CONTRACT
BETWEEN THE CITY OF NEWPORT BEACH AND S. E.
EATON CO. IN THE AMOUNT OF $15,459.60, FOR
EMERGENCY REPAIRS TO CITY'S CONTROL VALVE FOR
WATER MAIN DAMAGED AS A RESULT OF STORM
DAMAGES AND DETERMINING THE URGENT NECESSITY
THEREFOR
WHEREAS, on March 1, 1983, the City of Newport Beach
suffered storm damage from heavy rains and windstorms; and
WHEREAS, as a result of this storm, a 30" inch water
main serving the northern portion of the City was broken, thereby
depriving the affected area of water and fire protective
services; and
WHEREAS, as a result of this storm, a control valve,
essential for the operation of a portion of the water system, was
damaged; and
WHEREAS, it was essential to repair this valve to
prevent a loss of water and pressure;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach finds and determines that, as a result
of the foregoing, it was an urgent necessity to award, without
competitive bidding, a contract to S. E. Eaton Co., in the amount
of $15,459.60;
BE IT FURTHER RESOLVED that the Mayor and City Clerk be
and hereby are authorized to execute same on behalf of the City
of Newport Beach.
