SUBJECT: Computerization Study Contract
Purpose
To hire a consultant (Inland Marketing Group, Inc.) who will conduct a compre-
hensive study of the Building Department's permit issuance and inspection
processes and record keeping procedures to determine what extent these processes
and procedures can be computerized.
Background
The City of Newport Beach 1982 -1983 Budget on Page 190 allocates $15,000 under
Object 2916 to conduct a comprehensive study to computerize building permit
and record keeping process in the Building Department.
After City Council approval of this expenditure, the Buildinq Department sent
out requests for proposals in August of 1982, which outlined the scope and range
of services. Two firms responded: namely, Connerly and Associates of Sacramento
who did a similar study for the City of Irvine, and Inland Marketing Group, Inc.
of Redlands who implemented the computer processing for the County of Riverside.
After comparing the operations of Irvine with Riverside County, the Building
Department chose Inland Marketing Group, Inc. as the consultant.
Discussion
The attached contract is based on time and material (not to exceed $15,000) and
shall be completed within 60 days. It shall contain a written report analyzing
current processes, procedures, and deficiencies in these practices and their
adaptability to a computerized data processing system, plus specific information
findings and recommendation with regard to design of a software system.

Recommendation
It is recommended that City Council approve the contract with Inland Marketing
Group, Inc. to perform a computer study; and authorize the Mayor and City Clerk
to execute the agreement.

Computer Study Agreement
nu AND MARKETING GROUP, INC.
This agreement, made thiso(6W) day of i 1983, by
and between the City of Newport Beach, a Municipal Corporation and
Charter City, hereinafter "CITY", and Inland Marketing Group, Inc., a
California Corporation, hereinafter "CORPORATION" is made with
reference to the following facts the materiality and existence of
which is stipulated and agreed by between the parties:
(A) CORPORATION has represented to CITY that it is highly
skilled in evaluating the processes and procedures utilized
by municipal building departments in the performance of
their regular functions; and
(B) CORPORATION has represented to CITY if selected to perform
the study of the processes and procedures utilized by the

Building Department of the City of Newport Beach, that the
study will be performed by highly qualified personnel with
significant experience in all disciplines involved in the
study; and
(C) CORPORATION has represented to CITY that it is capable of
preparing a study of the procedures of the Building
Department. NOW, TUEREFORE, the parties hereto agree as
follows:

1. CORPORATION agrees as follows:
(A) CORPORATION will conduct a study into the practices,
procedures and processes utilized by the Building
Department of the City of Newport Beach and, in
preparing the study, CORPORATION shall do the
following:
(1) Contact all relevant personnel within the
Building Department to obtain information with
regard to the current processes, practices and
procedures utilized by that Department, both

internally and as that Department may interact
with other CITY Departments;
(2) Contact and interview all relevant personnel
in Departments which interface with the
Building Department, including, but not limited
to, the Planning Department, Public Works
Department and Fire Department;
(3) Review all relevant policies, practices,
procedures and rules of the Building
Departments and related Department, insofar as
they relate to the performance of functions
delegated to the Building Department;

(4) Utilizing the information gathered in the
activities described in Sub-Paragraph 1 through
3 above, prepare a report, the contents of
1 which shall be as setforth in Sub- Paragraph (b)
below.
(B) The study to be prepared by CORPORATION shall
contain, at a minimum, the following information:
(1) A statement as to the current processes,
practices and procedures utilized by the
Building Department with emphasis on the points
at which those procedures impact on other
Departments;
(2) An analysis of the deficiencies of the current
process, practices and procedures. Possible
reasons for those deficiencies, and
recommendations that could be taken by the City
to remedy the deficiencies;
(3) Specific information, findings and
recanmendations with regard to the design of a
software system which could be implemented into
a computer /data processing system.

2. The study to be prepared by CORPORATION shall be delivered
to CITY within sixty (60) working days from the date on
which this Agreement is executed by CITY. If city
personnel are not available when required, the delivery of
the study to city will be delayed without penalty to
CORPORATION.
3. CITY, in consideration of the services to be performed by
CORPORATION pursuant to this Agreement, shall compensate
CORPORATION as follows:
(A) CORPORATION shall bill CITY for all work performed at
the rate of fifty -seven dollars and fifty cents
($57.50) per hour, plus any actual incurred expense
to the CORPORATION in performing services pursuant to
this Agreement including, but not limited to, costs
related to travel, telephone and any other out of
pocket expense.
(B) Billing to occur on a weekly basis and payment to be
made by CITY to CORPORATION within ten (10) days from
the date on which billings are received.
(C) The parties hereto expressly agree that the sum of
fifteen thousand dollars ($15,000.00) is the total,
agregated amount to be paid by CITY pursuant to this
Agreement as outlined in paragraph 3A except for any
applicable sales tax.

(D) The parties hereto specifically agree that
CORPORATION will perform all of the services and work
called for by this Agreement notwithstanding the fact
that CORPORATION may, during the term of this
Agreement extend time which, when multiplied by the
hourly rate called for in this Agreement would result
in billing in excess of fifteen thousand dollars
($15,000.00)
4. Upon delivery of the study called for by the Agreement CITY
shall beccme the sole owner thereof and CORPORATION shall
retain no ownership interest or rights therein except for
proprietary information and /or products owned by
CORPORATION.
CITY reserves the right to terminate this Agreement for any
reason whatsoever, upon seven (7) days written notice. In
the event of an early termination of this Agreement, CITY
shall be obligated to pay for only those services rendered
prior to the effective date of the notice, but in no event
shall that amount exceed the sum of fifteen thousand
dollars ($15,000.00).
5. The Agreement may not be assigned by other party without
the prior written consent of the other.
6. Any notice required to be given pursuant to this Agreement
shall be deemed given when deposited in the United States
