Approve the award of a contract for building /janitorial maintenance service
for the City Hail Complex to the Reliable Maintenance Co.; cost to be
$3,685 monthly.
BACKGROUND:
On December 14, 1981, the City Council passed Resolution No. 11101, giving
approval to Contract No. 2311 with the Commercial Maintenance Systems, Santa
Ana, CA. This contract provided for contract janitorial maintenance service
for the City Hall Complex, including Council Chambers, Planning and Build-
ing Departments, and the City Yard Complex. It became effective on 1/4/82,
and the current cost to the City is $3,611 /monthly.
In response to an increasing level of complaints concerning various aspects
of service provided by CMS, earlier this summer I was directed by the City
Manager to solicit new bids for a new building maintenance service contract
for the"City Hall Complex only. CMS would continue to service the City Yard
Complex.
After contacting many commercial businesses and other agencies regarding their
contractors, I eventually received three bids for the new City Hall Complex
contract. All of the bids are based on providing janitorial service to the
buildings currently in use. They do not include coverage for the new Pro-
fessional- Technical Building, as yet. It is understood that once the new
building is completed and occupied, the rented space would be vacated and
deleted from the contract. Any adjustment in the contract made necessary
by the move would then be negotiated.

All of the proposed bids were based on the same service criteria and specifi-
cations. Benco Building Services is the apparent low bidder, but after con-
tacting their references, the response was not very positive. Their service
was rated as only fair. Service Master, Inc. was the highest bidder of the
three because of additional charges for carpet shampooing and for servicing
the Council Chamber after every meeting. Reliable Maintenance was the next
to lowest bidder. Their references revealed that they had been servicing
some of The Irvine Co. buildings for the last five to six years. Their serv-
ice was rated from very good to excellent.
After considering all the factors involved, and digesting the comments re-
ceived from their references, I could not recommend awarding the contract to
Benco Building Services. I believe it would only be a repetition of our ex-
periences with other contractors. Also, the bid from Service Master, Inc.
was quite high, and contained too many additional charges.
On the other hand, the bid from Reliable Maintenance appears to be reasonable,
and their service was rated highly by their references.
Therefore, I recommend awarding to Reliable Maintenance, Inc. the contract for
building maintenance services for the City Hall Complex. Commercial Mainten-
ance Systems would retain the contract for the City Yard Complex.

JANITORIAL SERVICES AGREEMENT

This Agreement, made this Al day of �� x/1985, by
and between THE CITY OF NEWPORT BEACH, (hereinafter "City ") a
Municipal Corporation and Charter City duly organized and
operating under the laws of State of California, and HY
ROSEWERG'S RELIABLE MAINTENANCE INCORPORATED, (hereinafter
"Reliable ") is made under the following terms and conditions.
A. Reliable, owns and operates a janitorial service
business at 3184 Airway St., #B, Costa Mesa, California providing
janitorial and cleaning maintenance services.
B. City has a need for janitorial and window cleaning
services for its public buildings within the City Hall complex.
NOW, TI- EREFCRE, the parties hereto agree as follows:
I. Duties of Reliable
A. Reliable shall perform all building janitorial
maintenance services and indoor /outdoor window washing for
buildings within the City Hall complex, which include the City
Council Chambers, the City Attorney's office, the Fire
Department, the Parks, Beaches & Recreation building and the
Professional & Technical building. Janitorial services are to be
performed five days per week between 5 :15 p.m. and 7:00 a.m., as
follows:

B. The services to be performed by Reliable shall be
part of a well- managed and supervised cleaning program with the
highest standards of quality and productivity including, but not
necessarily limited to, weekly inspections and program evaluation
reviews with City's representative, and same -day correction
system by trained and qualified crews to handle day -to -day
operations:
(I) Daily
(a) Check City Clerk's calendar to determine which
rooms in the Council Chamber Building or in
the City Hall building are to be opened to the
public for meetings at times specified that
evening; open doors to those rooms ten
minutes before the specified times, making
sure doors to surrounding rooms are locked;
(b) Turn out lights not on time clocks and not
specified by City as required for decorative,
security or safety lighting;
(c) Assume responsibility while working in the
building for reasonable protection of City
property in portions of City Hall and Council
Chambers;

(d) Lock doors, shut off lights and disconnect
appliances when meetings adjourn;
(e) Keep waste baskets clean, inside and outside,
and install new plastic trash bag liners;
(f) Sweep all uncarpeted floors, including under
furniture, using treated dust cloths or dust
mops;
(g) Clean spots from uncarpeted floors giving
special attention to employees' lunch room and
restrooms;
(h) Vacuum all carpets with commercial vacuum
cleaner, including under furniture; dust
tables, desks and counter tops;
0) Remove carbon, ditto blue and other stains
from desks, counters and table surfaces by
washing with appropriate chemicals;
(j) Clean and sanitize drinking fountains, remove
spots and polish metal;
(k) Empty all ashtrays and sand urns and wipe
ashtrays clean;
(1) Pick up litter and sweep porches at building
entrances;

Sweep and wash restroom floors with pine
oil
disinfectant or equivalent; wipe walls and
floor tiles clean;
(n)
Clean restroom wash basins, toilet bowls
and
seats and urinals with pine oil disinfectant
detergent or equivalent; eliminate urine
odor
from restrooms;
(o)
Clean and refill restroom towel, toilet
tissue, paper toilet seat covers and soap
dispensers with supplies; replace urinal
deodorant cakes as used;
(p)
Clean slAash screens in men's urinals;
(q)
Polish mirrors and chrome portions of
fixtures, piping and toilet seat hinges;
(r)
Clean spots and marks from restroom walls
and
toilet partitions;
(s)
Clean chalkboards;
(t)
Pick up litter and sweep outside all door
entrances.

(a) Vacuum fabric furniture and remove spots;
(b) Wash and sanitize restroom tile walls and
toilet partitions;
(c) Clean fingermarks and smudges from cabinets,
walls, doors, partitions around door handles
and light switches and other frequently
touched areas;

(d) Remove shoemarks from baseboards, walls and
furniture legs.
(3) Monthly
(a) Damp mop and machine scrub uncarpeted floors,
wax and buff; wipe all baseboards and
furniture legs clean after each floor
refinishing;
(b) Vacuum drapes and cornices;
(c) Dust all picture frames and other objects on
walls;
(d) Wash inside and outside windows and sills;
(e) Dust mini blinds;
(f) Clean all wall and ceiling vent and fan
covers;
(g) Clean aluminum and wood door sills, checks,
kick plates, etc.;

(4) Every Three Months
(a) Clean and wax floors in vaults in Finance
Department, Public Works Department and City
Clerk's office during working hours;
(b) Strip wax from uncorpeted floors, wax and buff
floors during non - working hours.
(5) Every Six Months
(a) Shampoo or steam clean carpets during weekend
hours.
2. Term. This Agreement shall continue in effect
until earlier terminated as provided in paragraph 7.
3. Compensation. As compensation for janitorial
services performed hereunder, City shall pay Reliable the total
sum of $4,125.00 per month, payable as follows:
Janitorial Service $3,075.00 per month
Window Cleaning 1,050.00 per month
4. Independent Contractor. The parties intend that
Reliable, in performing services herein specified, shall act as
an independent contractor and shall have control of his work and
the manner in which it is performed. Reliable is not to be
considered an agent or employer of City and is not entitled to
participate in any pension plans, bonus, stock or similar
benefits that City provides for its employees.

5. Indemnification. Reliable shall defend, indemnify
and hold City harmless against all liablility or loss and against
all claims or actions based upon or arising out of injury to, or
death of persons, or damage to or loss of property caused by, or
in any way related to, the acts or omissions of Reliable or its
employees, or agents in connection with the performance of this
Agreement.
6. Termination. City reserves the right to terminate
this Agreement upon 30 days' notice. Notices shall be in writing
and mailed to the parties, as follows:

If notice is so given, this Agreement shall terminate
after expiration of 30 days from date of mailing. The liability
of the parties for further performance of the terms of this
Agreement shall thereupon cease.
7. Assignment. This Agreement shall not be assigned
without written consent of City, which consent shall not be
unreasonably withheld.

8. Entire Agreement. This Agreement shall be governed
by the laws of the State of California and constitutes the entire
agreement between the parties and may be modified only in writing
by the parties hereto.
Executed at Newport Beach, California on the day and
year first above written.
