Authorize the Mayor and the City Clerk to execute an amendment to a
consultant agreement with Norris -Repke Inc., for the preparation of
plans, specifications and cost estimates for the over -all street
improvements for Cannery Village.
DISCUSSION:
The City Council approved a consultant agreement with Norris -Repke
Inc. on October 9, 1984 for the completion of improvement plans for Cannery
Village.
As a part of the original agreement, the consultant was to utilize
• existing City topographic surveys for the design of the Cannery area improve-
ments, performing minor additional topographic surveys as needed with his own
survey crew.
However, during the design process it became apparent that substan-
tially more survey was required than originally thought, as most of the City
surveys were done prior to 1977. Since that time approximately 35% of the
street improvements have been modified, requiring additional survey by the con-
sultant's survey party.
The consultant has requested partial compensation for the additional
scope of survey work, as well as for additional design of offsite improvements,
all in the amount of $5,000. The consultant has expended $32,600 for the design
of the Cannery Village improvements as of April 1986 and is requesting only par-
tial compensation.
The agreement for the Cannery Village Master Plan street improvements
is funded from Account No. 02- 2797 -279.
It is felt that the request is justified and it is recommended that an
• additional $5,000 be authorized for completion of the Cannery Village improve-
ment plans.

This Modification of the Agreement
entered into thi sday of April, 1987 by

Inc. on October 12, 1984 for Professional Services to complete
the street design for Cannery Village; and
B. In the original Agreement, the Consultant was to
utilize existing city topographic surveys for the design of the
Cannery area improvements, performing minor additional
topographic surveys as needed with Engineers survey crew; and
C. Approximately thirty -five percent (35 %) of the
City's topographic survey was unusable due to changes in field
conditions; and
D. Engineer has requested partial compensation for the
additional scope of survey work and design of offsite
improvements in the amount of five - thousand dollars ($5,000).

NOW, THEREFORE, it is mutually agreed by and between
the undersigned parties as follows:
1. Paragraph IV of the Agreement is modified to read
as follows:
IV. Time of Completion
Final design, including all plans and other documents
for the PROJECT shall be submitted to the Public Works Director
of the CITY for final review by July 1, 1987.
2. Paragraph VIII of the Agreement is modified to read
as follows:
VIII. Fee Schedule and Payment
In consideration of the performance of the above-
' described engineering services, CITY hereby agrees to pay
Engineer an amount based upon the hourly rate schedule set forth
below. In no event shall said amount be greater than Twenty -Five
Thousand Dollars ($25,000) except as otherwise provided herein.

The above fees will be escalated six percent (6%) on
each August 1, beginning August 1, 1985, for any work uncompleted

at the time through no fault of Engineer. Outside agency fees,
reproductions, photographs, and long distance phone charges are
not included in above fees and will be billed at cost plus ten
percent (10 %). Periodic progress billings will be made for work
completed.
B. The contract amount shall be paid to Engineer as
follows:
1. Monthly partial payments shall be based on the
amount earned each month, as determined by the fee schedule. The
sum of the monthly partial payments shall not exceed ninety -five
percent (95%) of the maximum fee;
2. Balance of the total amount earned to be paid
upon completion of work specified in Section II (Services to be
performed by Engineer).

3. Except as expressly modified herein, all other
terms and covenants set forth in the Agreement shall remain the
same and shall be in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this

AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
FOR
DESIGN OF CANNERY VILLAGE AREA STREET IMPROVEMENTS
THIS AGREEMENT is made and entered into this xQd& day of
1984, by and between the CITY OF NEWPORT BEACH, a municipal
corporation, hereinafter referred to as "CITY ", and the firm of NORRIS-
REPK.c", Tl0., hereinafter referred to as "ENGINEER"
WITNESSETH:
WHEREAS, CITY intends to have complete street improvements plans prepared
for the Cannery area: The project area will include 30th Street from Newport
Boulevard to LaFayette Avenue, 29th Street from Newport Boulevard to LaFayette
Avenue, Villa Way from 29th Street to LaFayette Avenue, west side of LaFayette
Avenue from Villa Way north 150 feet to the first alley, the four alleys
bounded by Newport Boulevard, 28th Street, LaFayette Avenue and 30th Street,
and the alley between 30th and 31st Streets from Villa Way to LaFayette Avenue.
WHEREAS, ENGINEER has submitted a proposal to CITY (dated August 3,
1984) to perform engineering services in connection with the design of PROJECT;
and -
WHEREAS, CITY desires to accept said proposal;
NOW,THEREFORE, in consideration of the foregoing, the parties hereto
agree as follows:
I. General
A. CITY engages ENGINEER to perform the services hereinafter
described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon the terms
hereinafter set forth.
II. Services to be performed by ENGINEER
ENGINEER hereby agrees to perform the following services:
A. Prepare complete, detailed plans, specifications and engi-
neer's estimate (PS & E) for construction of ultimate im-
provements. The components of the process to produce the
PS & E include, but may not be limited to, the following
activities:

1. Conduct a thorough inspection of the PROJECT, photograph
it, reinspect portions as necessary.
2. Review all available improvement plans, atlases, record
maps, and any other similar maps.
3. Determine the most -used elevation datum for use in the
surveys, and provide equations for conversion of eleva-
tions on existing plans.
4. Compile horizontal control.
5. Draft plan views at 1 inch equals 20 feet on improvement
plan sheets incorporating the topographic information
shown on CITY's field notes.
6. Determine additional surveying necessary.
7. Perform survey for horizontal control and supplemental
topography.
8. Begin design.
9. Confer with CITY staff for input on preferences where
alternatives may be chosen.
10. Perform survey to obtain still further topographic in-
formation identified as needed during design and to
verify datums between existing improvement plans as
needed.
11. Complete the PS & E.
B. It is assumed that CITY's topographic surveys were complete,
accurate and correct when performed, and the purpose of the
supplemental survey is to update them and add detail along
join lines as necessary.
C. In addition to the contract documents (PS & E), ENGINEER
will provide CITY with copies of ENGINEER's field notes, co-
ordinate control and horizontal control plan.
Duties of CITY
CITY hereby agrees to supply ENGINEER with the following in-
formation and materials:

A. Available records pertaining to existing street improvements
and CITY -owned utilities.
B. CITY crews to pothole underground facilities that might inter-
fere with the construction.
C. Any other additional available information which the parties
hereto agree may be beneficial to the design of the PROJECT.
IV. Time of Completion
Final design, including all plans and other documents for the
PROJECT shall be submitted to the Public Works Director of the
CITY for final review by April 1, 1985.
V. Ownership of PROJECT Documents
Original drawings, reports, notes, maps, and other documents
shall become the property of CITY and may be reproduced and
utilized as deemed necessary by the Public Works Director.
VI. Engineer in Charge
Jack P. Norris, RCE No. 15446, shall be the Engineer in Charge
of PROJECT design.
VII. Right of Termination
CITY reserves the right to terminate this Agreement at any time
by giving ENGINEER seven (7) days' prior written notice; notice
shall be deemed served upon deposit in the United States Mail,
postage prepaid, addressed to the ENGINEER's business office at
17662 Irvine Boulevard, Suite 7, Tustin, California 92680. In
the event of termination due to errors, omissions, or negligence
of ENGINEER, CITY shall be relieved of any obligation to com-
pensate ENGINEER for that portion of the work affected by such
errors, omissions, or negligence of the ENGINEER. If this
Agreement is terminated for any other reason, CITY agrees to
compensate ENGINEER for the actual services performed up to the
effective date of the notice of termination, on the basis of the
fee schedule contained herein.
VIII. Fee Schedule and Payment
In consideration of the performance of the above - described

engineering services, CITY hereby agrees to pay ENGINEER an

Dollars ($20,000) except as otherwise provided herein.

IX. Additional Work
Should ENGINEER complete any additional work not outlined in
this Agreement, but authorized by CITY, the extra work shall
be performed on an hourly basis in accordance with the hourly
rate standard fee schedule set forth in Section VIII (Fee
Schedule and Payment) above.

X. PROJECT Scope Revisions
The scope of the PROJECT may be changed and the maximum fee re-
vised upon prior written approval of the Public Works Director
if the increase in the maximum fee does not exceed Two Thousand
Dollars ($2,000). If the revisions to the scope of the PROJECT
would result in an increase in the maximum fee exceeding Two
Thousand Dollars ($2,000), an amendment providing for such re-
visions shall be processed and executed by the parties hereto.
XI. Insurance
A. Professional Liability Insurance
ENGINEER shall provide Professional Liability (errors and
omissions) insurance in the minimum amount of $250,000.
B. General Liability Insurance
ENGINEER shall maintain in full force and effect during the
term of this Agreement the following insurance in the mini-
mum amounts specified below:
Bodily Injury or Death. . . . . $ 300,000 each person
$1,000,000 each occurrence
Property and Product Damage $ 500,000 each occurrence
$1,000,000 aggregate -
The policy or policies shall contain the following endorse-
ment:
"The City of Newport Beach and the State of California,
their officers, employees and agents are hereby declared
to be additional insureds under the terms of this policy,
as to activities of both the City and the State in re-
spect to PROJECT, and this policy shall not be cancelled
without Thirty (30) days' prior written notice to the
City and the State."
IN WITNESS WHEREOF, the parties hereto have executed this Agreement

The Public Works Department has reviewed the Agreements and has
found them to be in order and sufficient.

improvements for Cannery Village.
2. Authorize the Mayor and the City Clerk to execute a consultant
agreement with Norris - Repke, Inc. for the preparation of plans
specifications and cost estimate for 31st Street between Newport
Boulevard and Villa Way.
DISCUSSION:
Cannery Village,which is bounded by Newport Boulevard, 32nd Street,
the Rhine Channel and 28th Street has been a source of continual complaints re-
garding the general condition of the public right -of -way and the need for
public improvements in the area to resolve drainage problems and reduce poten-
tial liability.
In order to improve the Cannery Village area, a master.plan for the
area must be formulated that can be used for completing the public improve-
ments.
The Public Works Department has received two proposals from Norris -
Repke, Inc. The first proposal is for the preparation of detailed plans, speci-
fications and engineering estimates for the construction of the ultimate street
improvements for the Cannery Village area. The lump sum fee for the engineer-
ing work is $20,000.
The major parts of the scope of the service provided in the agreement
are as listed below:
1. Review of all available improvement plans, atlases, record maps
and any other similar maps.
2. Determine the most used elevation datum for use in surveys and
provide equations for conversion of elevations on existing plans.
3. Compile horizontal control.
4. Provide additional surveying as needed for horizontal control
and supplemental topography.
5. Provide complete plans, specifications and cost estimate for
construction of ultimate improvements on 30th Street from
Newport Boulevard to Lafayette Avenue, 29th Street from

Newport Boulevard to Lafayette Avenue, Villa Way from 29th
Street to Lafayette Avenue, west side of Lafayette Avenue from
Villa Way northerly 150 feet to the first alley, the four
alleys bounded by Newport Boulevard, 28th, Lafayette Avenue and
30th Street, and the alley between 30th and 31st Streets from
Villa Way to Lafayette Avenue.
The second proposal is for the preparation of detailed plans, speci-
fications and cost estimate for 31st Street between Villa Way and Newport
Boulevard, as well as providing services for the processing of the Chapter 27
procedure of the Improvement Act of 1911 for construction of the property owner
share of the public improvements. The lump sum fee for the engineering work is
$10,000.
The major parts of the scope of the service provided in the agreement
are as listed below:
1. Perform a partial topographic survey to supplement the City's
1976 survey as necessary to prepare accurate plans and speci-
fications.
2. Prepare plans, specifications and engineer's estimate for con-
struction to complete the roadway improvements (curb, gutter,
sidewalk, new pavement, street lights and drainage devices),
fitting existing public improvements as practical and fitting
private improvements definitely.
3. Provide appropriate services necessary for the processing as a
Chapter 27 1911 Act project.
A local agency /consultant agreement has been executed by the civil
engineering firm, Norris - Repke, Inc. for each proposal to provide the engi-
neering services described above.
The agreement for the Cannery Village master plan street improvements
will be funded from Account No. 02- 2797 -279.
The agreement for the 31st,Street improvements will be funded from
Account No. 02- 3397 -310.
The consultant is prepared to commence work immediately upon the City's
written notification to proceed.
Attached is a sketch showing the streets included in the two contracts.
