SUBJECT: ACCEPTANCE OF 31ST STREET AND NEWPORT HEIGHTS ALLEY IMPROVEMENTS
CONTRACT NO. 2470
RECOMMENDATIONS:
1. Accept the work.
2. Authorize the City Clerk to file a Notice of Completion.
3. Authorize the City Clerk to release the bonds 35 days after the
Notice of Completion has been recorded in accordance with appli-
cable portions of the Civil Code.
DISCUSSION:
The contract for the construction of the subject project has been
• completed to the satisfaction of the Public Works Department. Included was the
construction of alleys in Block 2, Tract 27 in Newport Heights and street improve-
ments in 31st Street between Newport Boulevard and Villa Way.
The bid price was $126,769.77
Amount of unit price items constructed 135,748.81
Amount of change orders 725.00
Total contract cost $136,473.81
Funds were budgeted in the General Fund, Account No. 02- 3397 -310.
The increase in the amount of the unit price items constructed was due
primarily to additional quantities of aggregate base and asphaltic concrete
pavement required.
One change order in the amount of $725.00 was issued which provided
for installation of parking meter posts on 31st Street.
The contractor is Jerry Cross Paving, Inc. of Costa Mesa, California.
• The contract date of completion was February 29, 1988. The work was
substantially completed by that date. Construction of the final alley approach
was delayed until a power and telephone pole was relocated. All work was
completed on March 21, 1988.

INSTRUCTIONS TO BIDDERS
The following contract documents shall be completed, executed and received
by the City Clerk in accordance with NOTICE INVITING BIDS:
1. PROPOSAL
2. INSTRUCTIONS TO BIDDERS
3. DESIGNATION OF SUBCONTRACTOR(S)
4. BIDDER'S BOND (sum not less than 10% of total bid price)
5. NON- COLLUSION AFFIDAVIT
6. TECHNICAL ABILITY AND EXPERIENCE REFERENCES
except that cash, certified check or cashier's check (sum not less than 10% of
the total bid price) may be received in lieu of the Bidder's Bond. The title of
the project and the words SEALED BID shall be clearly marked on the outside of
the envelope containing the bid.
The City of Newport Beach will not permit a substitute format for the
contract documents listed above. Bidders are advised to review their content
with bonding and legal agents prior to submission of bid.
Bids shall not be received from bidders who are not licensed in accordance
with the provisions of Chapter 9, Division III of the Business and Professions'
Code. The low bidder shall also be required to possess a City of Newport Beach
business license prior to execution of contract.
The estimated quantities indicated in the PROPOSAL are approximate, and are
given solely to allow the comparison of bid totals.
Bids are to be computed upon the estimated quantities indicated in the
PROPOSAL multiplied by unit price submitted by the bidder. In the event of
discrepancy between wording and figures, bid wording shall prevail over bid
figures. In the event of error in the multiplication of estimated quantity by
unit price, the correct multiplication will be computed and the bids will be
compared with correctly multiplied totals. The City shall not be held respon-
sible for bidder errors and omissions in the PROPOSAL.
Contract documents shall bear signatures and titles of persons authorized
to sign on behalf of the bidder. For corporations, the signatures shall be of a
corporate officer or an individual authorized by the corporation. For part-
nerships, the signatures shall be of a general partner. For sole ownership, the
signature shall be of the owner.
In accordance with the California Labor Code (Sections 1770 et seq.), the
Director of Industrial Relations has ascertained the general prevailing rate of
per diem wages in the locality in which the work is to be performed for each
craft, classification, or type of workman or mechanic needed to execute the
contract. A copy of said determination is available in the office of the City
Clerk. All parties to the contract shall be governed by all provisions of the
California Labor Code relating to prevailing wage rates (Sections 1770 -7981
inclusive). The Contractor shall be responsible for compliance with Section
1777.5 of the California Labor Code for all apprenticeable occupations.

The City of Newport Beach will not permit a substitute format for
these contract documents. Bidders are advised to review their content

BONDING COMPANIES shall be acceptable as sureties in accordance
with the latest revision of Federal Register Circular 570.
INSURANCE COMPANIES shall be (1) licensed to conduct business in
California, and (2) assigned Policyholders' Rating A (or higher) and
Financial Size Category Class VIII (or larger) in accordance with the
latest edition of Best's Key Rating Guide: Property- Casualty.
Coverages shall be provided or all TYPES 0 INSURANCE checked on the
CERTIFICATE OF INSURANCE.
All costs associated with the specifications of these contract
documents shall be absorbed in the bid. Such specifications shall
include those contained in (1) each contract document and (2) the
Standard S ecifications for Public Works Construction (latest edition
adopte or use in the City of Newport Beach), except as supplemented
or modified by the Special Provisions for this project.

31ST STREET AND NEWPORT HEIGHTS ALLEY IMPROVEMENTS
CONTRACT NO. 2470
I. SCOPE OF WORK
The work to be done under this contract consists of removing and
replacing existing street improvements and constructing new street
and alley improvements, street light conduit and incidental work on
private property abutting the street. All work necessary for the
completion of the improvements shall be done in accordance with (1)
these Special Provisions, (2) the Plans (Drawing Nos. R- 5543 -5 and
A- 5098 -5), (3) the City's Standard Special Provisions and Standard
Drawings for Public Works Construction (1985 edition), and (4) the
Standard Speciticatio�or Public Works Construction (1985 edition),
including supplements to date. Copies of the City's Standard Special
Provisions and Standard Drawings may be purchased at the Public Works
Department for five dollars .00). Copies of the Standard
Specifications may be purchased at Building News, Inc., 305_5_ Overland
Avenue, Los Angeles, California 90034.
Bidders shall satisfy themselves by personal examination of the loca-
tion of the proposed work and by such other means as they may prefer
as to the actual conditions and requirements of the work, and shall
not at any time after submission of the bid dispute, complain, or
assert that there was any misunderstanding in regard to the nature or
amount of work to be done.
II. AWARD AND EXECUTION OF THE CONTRACT
The bidder's attention is directed to the provisions of Section 2 -1
of the Standard Special Provisions and Standard Drawings for Public
Works Construction for requirements and conditions concerning award
and execution of the contract.
III. TIME OF COMPLETION AND SCHEDULE OF WORK
A. All work under this contract shall be completed by February 29,
1988.
B. The Contractor shall complete all work on each alley or street
within thirty (30) consecutive calendar days after beginning work
on that alley or street. The term "work" as used herein shall

include all removals, adjustments, and replacements; construction
of storm drain improvements; construction of alley pavement, alley
approaches, street pavement, curbs, gutters, driveways, street light
conduit, sidewalk, adjacent PCC or AC garage approaches and AC
joins. Also included within the specified period is curing time for
the new PCC improvements.
In summary, this means that each alley or street and every garage
approach with access from that alley must be returned to normal
vehicular use within thirty (30) consecutive calendar days from the
day it is first closed to such use. The Contractor must employ suf-
ficient men and equipment to meet this schedule. If it becomes
apparent during the course of the work that the Contractor will not
be able to meet this schedule, he will be prohibited from starting
work in additional alley or street until he has exerted extra effort
to meet his original schedule and he has demonstrated that he will be
able to maintain his approved schedule in the future. Such stoppages
of work shall in no way relieve the contractor from his overall time
of completion requirement, nor shall it be construed as the basis for
payment of extra work because additional men and equipment were
required on the job.
The Contractor will be assessed $100 per day (including Saturdays,
Sundays, and holidays) liquidated damages for each day in excess of
the thirty (30) consecutive calendar days allowed for 100% completion
of the construction work in each alley or street and the alley's or
street's return to normal vehicular use. Additional liquidated dama-
ges, as covered in Section 6 -9 of the Standard Specifications, shall
be assessed for failure to complete the project within the specified
time.
The intent of this section of the Special Provisions is to emphasize
to the Contractor the importance o prosecuting the work in an
orderly, pre - planned, continuous sequence so as to minimize the time
an alley or street is closed to vehicular traffic.
No work shall begin until a schedule of work has been approved by the
Engineer. The Contractor, in preparing his schedule of work, should
consider phasing construction to minimize traffic congestion during
the weekends, and between December 19, 1987 and January 3, 1988.
No work shall begin on 31st Street prior to January 4, 1988.
IY. PAYMENT
The unit or lump sum price bid for each item of work shown on the propo-
sal shall be considered as full compensation for all labor, equipment,
materials and all other things necessary to complete the work in place,
and no additional allowance will be made therefor.
Payment for incidental items of work not separately provided for in the
proposal shall be included in the unit price bid for each item of work.
Partial payments for mobilization shall be made in accordance with
Section 10264 of the California Public Contract Code.

V. STREET CLOSURE. ACCESS & TRAFFIC CONTROL
Construction will require partial closure of 31st Street and alleys to
vehicular traffic.
31st Street shall be signed for one -way traffic eastbound during
construction. 31st Street shall be kept open to vehicular traffic during
construction of parkway improvements (curb, gutter, sidewalk and street
light conduit) except for short closures as approved by the Public Works
Engineer..
31st Street may be closed for a maximum of five (5) working days,
closing on a Monday and re- opening on Friday, during reconstruction of
the pavement section.
The Contractor shall provide for street closure, traffic control and
access in accordance with Section 7 -10 of the Standard Special Provisions
and Standard Drawings for Public Works Construction and with the stan-
dards contained in the Work Area Traffic Control Handbook (WATCH),
published by Building News, Inc.
A. Traffic Control Plan
The Contractor shall submit written traffic control plans to the
Engineer for his approval a minimum of seven (7) calendar days prior
to commencing any work.
The plans shall incorporate the following:
1. The location and wording of all signs, barricades, delineators,
lights, warning devices, temporary parking restrictions, and any
other details required to assure that all traffic will be handled
in a safe and efficient manner with a minimum of inconvenience to
the motorists.
2. A complete and separate plan for each stage of construction pro-
posed by the Contractor showing all items listed under (1) above.
3. Reopening of all traffic lanes upon completion of each day's
work.
All streets not part of this contract shall remain open to travel and
parking at all times.
B. "NO PARKING. TOW- AWAY" Si
The Contractor shall furnish, install, and maintain in place "NO
PARKING" signs (even if streets have posted "NO PARKING" signs) which
he shall post at least 40 hours in advance of the need for enfor-
cement. In addition, it shall be the Contractor's responsibility to
notify the City's Police Department, Traffic Division, at (714)
644 -3742, for verification of posting at least 40 hours in advance of
the need for enforcement.

The signs shall (1) be made of white card stock; (2) have minimum
dimensions of 12 inches wide and 18 inches high; and (3) be similar
in design and color to sign number R -38 on the CalTrans Uniform Sign
Chart.
The Contractor shall print the hours, day and date of closure in
2 -inch high letters and numbers. A sample of the completed sign
shall be approved by the Engineer prior to posting.
C. Street Sweeping Signs
The Contractor shall bag or cover street sweeping signs on those
streets adjacent to the construction site in a manner approved by the
Engineer, after posting "NO PARKING -TOW AWAY" signs. All street
sweeping signs shall be uncovered immediately after completion of
work and upon removal of the "NO PARKING -TOW AWAY" signs.
VI. NOTICE TO RESIDENTS AND BUSINESSES
Between 48 and 55 hours before closing a section of street or restricting
vehicular access to driveways or parking spaces, the Contractor shall
distribute to each affected address a written notice stating when
construction operations will start and approximately when vehicular
access will be restored. Twenty -four (24) hours shutting off water ser-
vice to any business or residence, the Contractor shall distribute a
separate written notice stating the date and time the water will be shut
off and approximate time the water will be turned back on. The written
notices will be prepared by the Engineer. The Contractor shall insert
the applicable dates at the time he distributes the notice. Errors in
distribution, false starts, acts of God, strikes or other alterations of
the schedule will require Contractor renotification using an explanatory
letter furnished by the Engineer.
VII. CONSTRUCTION SURVEY STAKING
Field surveying for control of construction shall be the responsibility
of the Contractor. All such surveys, including construction staking,
shall be under the supervision of a California registered civil engineer
or licensed surveyor. Staking shall be performed on all items ordinarily
requiring grade and alignment at intervals normally accepted by the agen-
cies and trades involved. Payment for construction survey staking shall
be considered as included in the various items of work and no additional
allowance will be made therefor.
VIII. WATER
If the Contractor elects to use City's water, he shall arrange for a
meter and tender a $500 meter deposit with the City. Upon return of
the meter in good condition to the City the deposit will be returned
to Contractor, less a quantity charge for water usage.

IX. STEEL PLATES
The City can provide, free of charge, a limited quantity of 1" thick,
5' x 10' steel plates. These plates may be obtained from and shall
be returned to the City's Utilities Yard at 949 West 16th Street. To
determine the number of plates available and to reserve the plates, the
Contractor must call the City's Utilities Superintendent, Mr. Gil Gomez,
at (714) 644 -3011.
X. STREET AND ALLEY CONSTRUCTION
A. Removals and Excavation
The work shall be done in accordance with Section 300- 1.3.2. of the
Standard Specifications except as modified and supplemented herein.
Final removal at the sawcut lines may be accomplished by the use of
jackhammers or sledgehammers. Pavement breakers or stompers will not
be permitted on the job. Final removal accomplished by other means
must be approved by the Engineer.
B Existing Utilities
The Contractor shall adjust to finished grade all sewer manholes,
sewer cleanouts, water meter boxes, water valve covers, and monuments
prior to the placement of concrete pavement.
The Contractor shall be responsible for any damages to existing uti-
lities resulting from his operations.
C. PCC Curb and Sidewalk
The cost of constructing curb and sidewalk adjacent to new alley
approaches to join existing improvements shall be included in the
cost of constructing PCC alley approaches.
D. Patch Back
The Contractor shall patch back PCC within private property at loca-
tions shown on the plans in a manner that matches the adjoining pri-
vate property improvements in structural section, texture and color.
E. Water Meter Boxes
The City shall furnish to the Contractor, at no cost, meter boxes to
replace those boxes which were identified by the city to be substan-
dard or broken prior to construction. Boxes broken during the course
of construction shall be replaced by the Contractor at his expense.
No separate payment will be made for the placement by the Contractor
of meter boxes provided by the City.

F. Asphaltic Concrete Pavement
1. Base Course - -The base course shall be 3- inch -thick Type III -B2
with 5.2 to 9.8 percent AR 8000 paving asphalt.
2. Finish Course - -The finish course shall be a 1- inch -thick Type
III -C3 with 5.6 to 6.0 percent AR 4000 paving asphalt.
Prior to placing the finish course, a tack coat of Type SS -lh
asphaltic emulsion at a rate not to exceed one -tenth (1/10) of a
gallon per square yard shall be uniformly applied to the AC base
course, and the Portland cement concrete edges against which
asphalt concrete is to be placed. The surface shall be free of
all loose material or dust when the tack coat is applied.
G. Pavement Removal and Replacement on 31st Street
All the concrete pavement shall be completely removed and replaced
with 4" AC /4" AB pavement. Based on limited information available,
it appears that the existing concrete pavement is approximately 8" to
9" thick.
H. Portland Cement Concrete
All Portland Cement Concrete shall be Class 560 -C -3250. All exposed
concrete surfaces shall conform in grade, color and finish to all
adjacent curbs and walks.
I. Pavement Strioi
Final pavement striping will be completed by the City.
J. Utilities
The existence and location of underground utility pipes, lines or
structures shown on the plan were obtained by a search of available
records. To the best of the Engineer's knowledge, there are no
existing utilities except as shown on these plans. The Contractor is
required to take due precautionary measures to protect the utilities
shown and any other lines or structures not shown on these plans.
The Contractor shall be responsible for verifying the actual location
and elevation in the field prior to beginning construction of the new
facilities.
K. Inspection
Contractor shall request inspection from Public Works 48 hours in
advance of performing any work (644 - 3311).

DISCUSSION:
On September 28, 1987, in response to petitions submitted by the
owners in Block 2 of Tract No. 27 in Newport Heights, the City Council directed
staff to use the procedure of Chapter 27 of the Improvement Act of 1911 to
improve the alleys located in Block 2 of Tract 27. Attached is a sketch showing
• the alleys and the property owned by the petitioners and a copy of the petition.
A set of plans will be on display in the Council Chambers.

• Each owner of record has been mailed a copy of the "Notice to
Construct" along with a copy of the September 28, 1987 City Council staff
report. A copy of the "Notice to Construct" was posted in front of each
property; a notice was published in the Daily Pilot twice; and a copy of the
notice was posted on the City Clerk's bulletin board.
The recommended public hearing is step No. 3 in the procedure
outlined below:

5. Upon completion of the work, a second public hearing is held to
hear any protests about the construction or the method used to
spread the assessment.
6. After the second public hearing, the costs of construction is
assessed against each parcel. The assessments may be paid in
cash, or the City may allow the assessments to be paid over a
period of years. The payments are collected by the City
separately from other taxes. The maximum rate of interest
permitted is 12% per annum. Interest is charged on the unpaid
• balance. The maximum rate of interest and length of repayment
period are established by the City Council. Staff recommends
that 8% per annum be charged and that the assessement district
have pay back periof of 10 years.
Reconstruction of alley approaches to garages on private property
will be assessed to the individual properties. The garage approaches will be
constructed by the contractor who constructs the alleys.

Contract No. 2470 as proposed will include the construction of the
alleys in Block 2, Tract 27 in Newport Heights; and will also include the
construction of street improvements on 31st Street between Villa Way and
Newport Boulevard. The public hearing for 31st Street was held on September 28,
1987, with staff being directed to continue the Chapter 27 procedure (see
attached City Council memo).
Negative declarations of environmental impact have been prepared by
staff and approved by the Environmental Affairs Committee. Notices of deter-
mination will be filed with the Clerk of the Board of Supervisors and published
in the local newspaper upon City Council affirmation.
Inasmuch as the work includes rehabilitative work and paving of
existing alleys, the project is exempt from the permit requirements of the
Coastal Act.
The Engineer's estimate for Contract No. 2470 is $163,750. Funds for
award will be proposed from the following accounts:

RECOMMENDATIONS:
1. Direct the staff to notify the owners of property in Block 2 of
Tract No. 27 to construct portland cement concrete alleys
adjacent to their property using the procedures of Chapter 27
of the Improvement Act of 1911.
2. Schedule a public hearing for 7:30 p.m. on October 26, 1987 to
hear any protests on the matter.
DISCUSSION:
• The City has received petitions from owners of proper y in Block 2,
Tract No. 27, requesting that the City pave their alleys using the procedures
of Chapter 27 of the Improvement Act of 1911.
City policies require that initial construction of public
improvements be at the expense of the benefited property. After the improvements
have been constructed to City standards, the City assumes the responsibility
for maintenance.
A brief description of the procedure that is being used is:
1. The owners of 60% of the front footage facing any part of an
unimproved portion of an alley file a petition with the City
Clerk requesting the improvement of that part of the unimproved
portion of the alley. The Council may, on its own motion,

SUBJECT: 31ST STREET IMPROVEMENT BETWEEN NEWPORT BOULEVARD AND VILLA WAY,
CANNERY VILLAGE AREA
RECOMMENDATIONS:
1. Hold public hearing to hear protests from anyone who does not desire
to have the 31st Street improvements completed using the procedure
of Chapter 27 of the Improvement Act of 1911.
2. After closing the public hearing, direct the staff to:
a. Continue with the procedure to improve 31st Street per the
plans; or
DISCUSSION:
b. Modify the plans and continue with the procedure to improve 31st
Street per the amended plans; or
c. Abandon the proceedings.
On August 10, 1987, in response to petitions submitted by the owners
on 31st Street between Newport Boulevard and Villa Way, the City Council
directed the staff to use the procedure of Chapter 27 of the Improvement Act of
:. 1911 to improve 31st Street. Attached is a sketch showing 31st Street and prop-
erty owned by the petitioners. A set of plans will be on display in the Council
chambers.
Each owner of record has been mailed a copy of the "Notice to
Construct." A copy of the "Notice to Construct" was posted in front of each
property; a notice was advertised in the Daily Pilot twice; and a copy of the
notice was posted on the City Clerk's bulletin board.
•The recommended public hearing is step No. 3 in the procedure
outlined below:
1. The owners of 60% of the front footage facing any part of an
unimproved portion of a street file a petition with the City
Clerk requesting the improvement of that part of the unimproved
portion of the street. The Council may, on its own motion,
direct the improvement, should less than 60% of the petitions

• 2. Upon the filing of the petition, and after receipt of a notice
from the City, Lhe owners of all the front footage facing that
part of the unimproved portion of the street have a duty to
construct the improvements.
3. A public hearing is field at which time the City Council hears
protests from anyone who does not desire the improvements.
4. If the construction is not commenced by the property owners
within 60 days after receipt of a notice from the City, the City
performs the work and makes the cost a lien on the properties.
The work is financed by an advance from the City's Street and
Alley Maintenance Fund or other available funds.
5. Upon completion of the work, a second public hearing is held to
hear any protests about the construction or the method used to
spread the assessment.
6. After the second public hearing, the costs of construction is
assessed against each parcel. The assessments may be paid in
cash, or the City may allow the assessments to be paid over a
• period of years. The payments are collected by the City sepa-
rately from other taxes. The maximum rate of interest permitted
is 12% per annum. Interest is charged on the unpaid balance.
The maximum rate of interest and length of repayment period are
established by the City Council.
The property owners of Lots 8, 15, 19, and 20 of Block 431 and Lots
17, 27, and 30 of Block 331 of Lancaster's Addition have previously constructed
curb, gutter,and sidewalk improvements across their frontages, satisfying their
obligation.
The City will bear the cost of reconstructing any existing curb,
gutter, or sidewalk along the frontages of the above - mentioned lots and the cost
of reconstructing the 31st Street section.
The owners of Lots 9, 10, 11, 12, 14, 16, 17, and 18 of Block 431
and Lots 16, 18, 19, 20, 21, 22, 23, 28, and 29 of Block 331 of Lancaster's
Addition will be required to pay for all new curb, gutter, and sidewalk improve-
ments constructed along their frontages.
The owner's of Lot 13, Block 431 of Lancaster's Addition will pay
• for gutter improvements along 23 linear feet of frontage and curb, gutter, and
sidewalk improvements along 7 linear feet of frontage. Curb and sidewalk im-
provements have previously been completed along the rest of the frontage.

• The owners of Lots 24, 25, and 26 of Block 331 of Lancaster's
Addition will pay for gutter improvements only. The curb and sidewalk improve-
ments have previously been Completed.

The owner of lot 15, Block 431 of Lancaster's Addition will not be
assessed for curb, gutter, and sidewalk improvements as the improvements have
already been paid for as a requirement of Conditional Use Permit No. 3017.
The improvement plans include installation of street light conduit
along 31st Street for future street light installation. The installation cost
for this conduit will be borne by the City at this time; however, at such time
as a street light assessment district is formed and the street lights installed,
the City will recover the conduit installation costs. The estimated cost of the
project is:

• The assessments were spread in proportion to the width of the lots
(not including Lot 13 of Block 431 or Lots 24, 25, & 26 of Block 331,
Lancaster's Addition). The estimated assessment for 525 feet of total width
would be 57.10 per foot of width or $1,713 for a 30- foot -wide lot; $2,570 for a
45- foot -wide lot.
The petition represents 60.3% of the property frontage along 31st
Street. Section 5876 of the Streets and Highway Code provides that the property
owners shall have the duty to construct improvements upon notice by the City
when:
a. Improvements have been constructed or guaranteed in front of 50%
of the front footage; or
b. The owners of 60% of the front footage of any part of an
unimproved section have petitioned requesting the improvements;
c. The City Council on its own motion has ordered the improvements.
